E. 176TH ST, O TITtE INSURANCE COMPANY RENTON, WASH I NGTON 98055 226615 4M AVENUE, SEATTLE, WA 98121 E A S E M E N T THIS INDENTURE, made this /4;day^of 1978, by and between CASCADE SEIVER DISTRICT, a municipal corporation of King County, Washington, hereinafter ermed the "Grantee" and hereinafter termed the "Grantors WITNESSETH: That the said Grantors for a valuable consideration, receipt of which is hereby -acknowledged by the Grantee, does by these presents convey, grant and -warrant unto the Grantee a perpetual easement for sewer mains and appurtenances under, through, above, over and across the following described property situated in King County, Washington, together with all after acquired title of the Grantors therein; and more particularly described as follows: That portion of the South half of the South half of the Northeast quarter of the Northeast quarter of Section 31, Township 23 North, Range 5 East, W.M., King County, Washington lying Easterly of the Talbot Road and Northerly of Carr Road less portion described as follows: Beginning at the intersection of the South line.of the North half of the above described parcel with the Easterly margin.of Talbot Road; Thence Northerly along the margin 69 feet; Thence Easterly 128 feet; Thence Southerly parallel with said road 69 feet; Thence Westerly 128 feet to the Point of Beginning. - Said easement shall be that portion of the above described parcel lying 10 feet Easterly of and adjacent to Talbot Road (Springbrook Road). TOGETHER WITH a temporary"construction easement described as that portion of said parcel lying 20 feet Easterly of and adjacent to Talbot Road (Springbrook Road). Said temporary construction easement shall remain in force during construction and until the sewers and appurtenances are accepted for maintenance and operation by the Cascade Sewer District. The said Grantee shall have the right without prior_ institution of any �..' suit or proceeding at law, at such times as may be necessary, to enter upon the easement for the purpose of constructing, repairing, altering or recon- structing said sewer main, or making any connections therewith, without in- curring any legal obligation or liability therefor, provided that such con- structing, repairing, altering or reconstructing of said sewer main shall be accomplished in such a manner that the private improvements existing in this easement shall not be disturbed or destroyed, or in the event that they are disturbed or destroyed, they will be replaced in as good a condition as they were immediately before the property was entered upon by the said Grantee. The Grantor shall retain the right to use the surface of the easement if such use does not interfere with installation of the sewer main. However, the Grantor shall not erect buildings or structures on the easement during the existence of said easement. The easement, during its existence, shall be a covenant running with the land and shall be binding on the successors, heirs, and assigns of both of the parties hereto.
