The South 10 feet and the Westerly _-I e of Lot 1, Plat of Scott's
Terrace, according to the plat recorded in Volume 72 of Plats, pages
39 and 40, records of King County, idashington.
AND ALSO the North 5 feet of Lot 4 of said Plat. T
Together with a temporary construction easement described as the
South 20 feet of said Lot 1.
AND ALSO a temporary construction easement described as the North
20 feet of Lot 4 of said plat.
Said temporary construction easement shall remain in force during
construction and until the sewers and appurtenances are accepted for
maintenance and operation by the CASCADE SEVER DISTRICT.
The above descriptions show two distinctly separate easements, one
on Lot 1 and one on Lot 4. The temporary easements on each lot
shall continue as to that lot only until that part of the sewer
line has been constructed and accepted by the Cascade Sewer District.
The said Grantee shy 1 have the right without prior institution of any
Iit or proceeding at l� at such t;_mes as may be neces y, to enter upon
t:e easement for the purpose of constructing, repairing.etering or recon-
structing said sewer main, or making any connections therewith, without in-
curr_n; any legal obligation or liability therefor, provided that such con-
structing, repairing, altering or reconstructing of said sewer main shall be
accviliplished in such a manner that the private improvements existing in this
easam—'_nt shall not be disturbed or destroyed, or in the event that they are
c-istu__bed or destroyed, they will be replaced in as good a condition as they
were i_ainediately before the property was entered upon by the said Grantee.
The Grantor shall retain the right to use the surface of the easement
i ; cn use does not interfere with installation of the sewer main. However,
the Grantor shall not erect buildings or structures on the easement during

SPECIAL CONDITIONS to Easement No. 31-23-5-1 R David P. and Thea
P. Wellington
and
Robert D. and
Geraldine Bockoven

The following special terms and conditions are a
part of the easement granted by David P. Wellington and
Thea P. Wellington, his wife, and Robert D. Bockoven and
Geraldine Bockoven, his wife, (Grantors) to Cascade Sewer
District, (Grantee) a municipal corporation in King County,
Washington, said easement being dated the day of ,
1974 and granting an easement over the soutT—To feet an t e
westerly 10 feet of Lot 1 of the plat of Scott's Terrace, and
also over the north 5 feet of Lot 4 of said plat, together with
associated temporary construction easements:
1. The man -hole to be installed by the District
at the northwesterly corner of Lot 4 will be so designed and
installed as to accomodate a side sewer serving Lots 3, 4 and
16 of Scott's Terrace.
2. A side sewer serving said Lots may be connected
to said man -hole without the payment of any late-comer's charge
or assessments by the District, so long as an appropriate late-
comer's charge is paid to the City of Renton as reimbursement
for an appropriate portion of the cost of the construction of
the City's Talbot Road sewer line running along the westerly
side of Talbot Road.
3. The regular sewer service chargesAfor sewer ser
vice provided to said lots will be paid to the District or to ,2�4—
the City of Renton as may be agreed upon between them, but the
District will not make any such charges if the regular monthly
sewer service charge is paid to the City„
4. At their own expense, the Grantors have already
constructed a sewer line crossing Talbot Road and connecting
the City of Renton's Talbot Road line to Lot 1 of Scott's Ter-
race. The District shall be entitled to construct a man -hole
at the easterly end of said crossing into which it may connect
sewer mains to be constructed along the easement granted on Lot
1 of Scott's Terrace.
S. Since these mains will be using the crossing
constructed by the Grantors, the District will pay FIVE HUNDRED
DOLLARS to said Grantors as its share of the cost of construct-
ing said crossing,

and further, that its contractor furnish a guarantee against
defective compaction or defective paving for a period of one
year, and the District will repair or cause its contractor to
repair at no cost to the Grantors any damages to the restored
paving caused by settlement due to inadequate, improper or in-
sufficient compaction and paving restoration.
0 8. When requested by the Sewer District, the Grantors
will transfer the sewer line referred to in Paragraph 4 of these
Special Conditions to either the City of Renton or to the Cascade
Sewer District, as may be agreed between the City and the Dis-
trict.
