Blaylock, Zoning Administrator SUBJECT: Robert Wells Short Plat-107-84 The Public Works Department has made specific comments concerning proposed Condition No. 2 by the Building and Zoning Department. They believe that utility easements should also include a fifteen (15) foot wide storm water easement along the alignment of the existing year-round creek which runs along the southern and western property line of Lot #4. This easement will be utilized for storm water drainage maintenance. The creek is tied into the city's storm water drainage management system. The Public Works Department believes that the Building and Zoning Department did not clearly address the need for this easement along the creek bed. APPLICANT: - - ROBERT H. WELLS FILE NO. Short Plat 107-84 & V-106-84 LOCATION: 2702 Jones Avenue N.E. SUMMARY OF REQUEST: Approval of a short plat to subdivide approximately 2.05 acres of property into four single family residential lots, together with an application for a variance to allow a private street. SUMMARY OF ACTION: Building and Zoning Department Recommendation: Approval subject to conditions. Hearing Examiner Decision: Short Plat as proposed is denied. BUILDING & ZONING The Building & Zoning Department Report was DEPARTMENT REPORT: received by the Examiner on November 27, 1984. PUBLIC HEARING: After reviewing the Building and Zoning Department Report, examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: The hearing was opened on December 4, 1984, at 9:00 A.M. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. The following exhibits were entered into the record: Exhibit #1 - Yellow file containing application, proof of posting, and other documents pertinent to this request. Exhibit #2 - Site Plan Exhibit #3 - Assessors Map Exhibit #4 - Updated statement from Renton Fire Department concerning short plat (read into the record). The hearing opened with Roger Blaylock, Zoning Administrator, presenting the staff report for this proposal. The applicant wishes to subdivide approximately 2 acres into 4 lots, with a variance to allow a private street to service 3 of those lots. The site has frontage on 2 streets - Jones Avenue N.E. and N.E. 27th Street. Mr. Blaylock read a memo into the record from the Fire Department which expressed concern as to the turnaround required for fire equipment. The concern was directed in the area of the interior hammerhead location as well as the intersection of the private street requested and N.E. 27th Street. Lot #1 will access onto Jones Avenue N.E. and lots 2, 3, and 4 would be serviced off of a private street coming in from 27th N.E. An existing house and barn are located on lot #1, with the other three lots being vacant. The short .plat request complies with the intent of the Comprehensive Plan designation for the area, lots 1, 3, and 4 comply with the R-1 zoning of the property, but lot #2 needs to be provided with at least 75 ft. of frontage onto, a private or public street. Originally the applicant had just shown a dead-end street without a hammerhead, but staff recommended that the hammerhead be utilized to meet the criterion of providing the 75 ft. frontage on the hammerhead. Utilities will have to be extended through the private roadway. Public Works Department has commented that a 20 ft. wide easement should be provided along the existing stream bed on the western and southern edge of lot #4; as well as a 15 ft. easement along the eastern property line of lot #4. Mr. Blaylock stated it was necessary to have 2 easements - the eastern 15' easement would be for sanitary sewer extensions and the 20 ft. easement would be for storm water drainage into the creek. • ROBERT H. WELLS SHORT PLAT107-84 & V-106-84 December 13, 1984 Page 2 Reviewing the variance request to allow 3 of the single family lots to access onto a private street, Mr. Blaylock said there are special physical limitations effecting the subject property. The shape of the site is one of the large superblocks that was created around the turn of the century. 'There are residences along N.E. 27th street that are very close together, and N.E. 27th Street is a primary collector arterial for this area. If a street was to be put in off of a full city street, existing structures would be in the way which would create non-conforming lots with regard to setbacks. A brief discussion was held on the conformance/non-conformance of the proposed lots as pertains to the constructing of a connecting street and the circulation problems that could result in this area. Mr. Blaylock stated it is quite a circulation problem in the area as in the past access easements had been provided for lots that were only 15 to 20 ft. wide. Originally the applicant had previously had only 15 feet to service the property, but through a series of lot line adjustments they now have 42 ft. That 42 feet is not of sufficient width for a city street. City Streets usually require a 50 ft. width, with a 60 ft. right-of-way being preferred. In order to place all public utilities, make allowances for curbs, gutters and sidewalks, and 26 ft. of paving, the 50 ft. right-of-way would be completely utilized. Further discussion ensued regarding the circulation problem and the large block, and it was felt that a through street would present too many problems and be more detrimental to the site and the surrounding properties than allowing the creation of a private street. It was recommended that the short plat and variance requests be approved subject to conditions set out in the staff report. The Hearing Examiner called for testimony from the applicant or his representative. Responding was: Robert Wells 912 - 168th Place N.E. Bellevue, Wa. 98008 Mr. Wells stated he concurred with the staff report as presented, and as the owner was in agreement with all conditions. Calling for further testimony in support of, or opposition to this application, wishing to comment was : John Cowan 1830 N.E. 24th Renton, Wa. 98056 Mr. Cowan. referred to the many easements east of the plat and said there is a private road in that area serving only one single family dwelling, a dirt road coming in off of Aberdeen Street which has been there for over 20 years. He questioned whether it would serve a good purpose to have two private roads to serve one piece of property. He said there are 4 private roads in the subject block and the interior property is being landlocked because of this. Mr. Cowan feels there should be a comprehensive plan for this area, and upgrading of the existing roads rather than creating more easements and another private road. Mr. Blaylock responded that the private road would be in excess of 500 ft. and therefore be in violation of the City ordinance. Mr. Cowan pointed out the private dirt road existing now is in excess of 500 ft., but Mr. Blaylock stated that the situation existed before the area was incorporated into the City. After incorporation, the City had to accept the property as it existed (referred to as grandfathering), and said owners have vested rights under previous subdivision approvals. Mr. Cowan was advised that the street he referred to for improvement does not intersect by approximately 30 ft. with the subject site. Responding to Mr. Cowan's comments addressing the maze of easements in the area, Mr. Blaylock stated the City does not have control over existing pre-established lots unless they desire to subdivide and develop more than a single family residence. Mr. Blaylock stated there are 6 other large blocks in the subject area that have similar problems. We have no control over those blocks also. Mr. Cowan advised the Examiner that he owns Tract 274 which contains 4 lots, and the strip adjacent to his tract is landlocked, no access to it at all. He stated if the City would improve the existing private road it would open up the adjacent land currently landlocked. Calling for further testimony or comments from staff, Mr. Blaylock acknowledged the subject property is a difficult parcel that has been worked on for over 2-1/2 years because of the access problems to the area. There being no one else wishing to speak, the hearing was closed at 9:40 A.M. • • ROBERT H. WELLS SHORT PLAT107-84 & V-1ub-84 December 13, 1984 Page 3 FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: 1. The applicant, Robert H. Wells, filed a request for approval of a four lot short plat of approximately 2.05 acres, together with a variance to allow access via a private street. 2. The application file containing the application, the State Environmental Policy Act (SEPA) documentation, the Building and Zoning Department Report, and other pertinent documents was entered into the record as Exhibit #1. 3. Pursuant to the City of Renton's Environmental Ordinance and SEPA (RCW 43.21C, 1971, as amended), the subject proposal has been determined to be exempt from the threshold determination by the Environmental Review Committee (ERC). 4. Plans for the proposal have been reviewed by all city departments affected by the impact of this development. 5. The subject site is located at 2702 Jones Avenue N.E., generally southwest of N.E. 27th Street. The site has 42 foot wide pipestem frontage on N.E. 27th. 6. The subject site was annexed into the City in March of 1960 by Ordinance 1818, at which time it was automatically classified G-7200 (General; Single Family Residential; Minimum lot size - 7,200 Sq ft). Ordinance 1827 amended the annexation, in May, 1960. A consolidation of single family districts in June, 1982 redesignated the subject site R-1. 7. The map element of the Comprehensive Plan designates the area in which the subject site is located as suitable for the development of single family uses but does not mandate such development without consideration of other policies of the . plan. 8. The subject site is in the northwest corner of a larger superblock, one of many in this general area of Kennydale. 9. The superblock status means that large parcels ring the block, with private drives, easements and cul-de-sacs providing access to interior parcels. Development in these blocks occurred' in the main along the roads fronting the block, leaving irregular access and irregularly shaped parcels in the interior of the block. 10. Public utilities are located adjacent to the site and adequate capacity to serve the subject site appears to exist. 11. The site is served by schools in the Renton School District. 12. The applicant proposes dividing the subject site into four lots, with an existing house to be located on the westernmost lot, proposed Lot 1. Lot 1 would be just under 40,000 sq ft while the remaining lots would each be greater than 10,000 sq ft. Lot 1 could be further divided since the zone only requires a lot area of 7200 sq. ft. and Lot 1 is approximately 40,000 sq. ft. 13. The applicant proposes access to the 3 easterly lots via a private street approximately 200 feet in length and with approximately 42.4 feet of frontage along N.E. 27th. Private roads- are permitted by variance under Section 9-1108(23(A)(9). 14. The proposed street would ,enter N.E. 27th at a blind curve with limited sight clearance. 27th is a popular arterial leading to an I-405 interchange serving the Kennydale area of the City. 15. The Fire Department requires that the street terminate in a hammerhead turnaround for emergency access. In addition, a creek flowing through the site will have to be culverted or bridged, with such structure meeting structural design standards for load limits of emergency vehicles. 16. The Department of Public Works indicates that easements are required along both the western and eastern boundary lines of proposed Lot 4. The western easement would follow the creek and allow a natural storm drainage course. The eastern easement would be for utility lines. ROBERT H. Some parcels south of the subject site, parcels 282 and 274, either have access via established easements or might be able to accommodate future cul-de-sacs. Similar development has occurred on Parcel 261. Existing structures along existing street frontages may complicate development of parcels 275, 276 and 277 but some combination of private road and cul-de-sacs would be necessary. There are at least 6 similar superblocks in this general vicinity, with similar access problems. 18. Neighboring property owners expressed concern regarding the hodge-podge or mish-mash of streets, easements and cul-de-sacs serving the area. CONCLUSIONS 1. While staff has recommended the division of the subject site into four lots, and the applicant has apparently acquired additional property to provide a wider access " point onto N.E. 27th Street, the access method in this location may be inappropriate. 2. The approval of one more haphazardly drawn private road will not further the aims of the City to create a uniform, clear and consistent street pattern, and may only intensify an already poor road system in this area of Kennydale. The approval of this road could preclude other more reasonable alignments and will do nothing to systematize access in this area. 3. A comprehensive approach should be evaluated in order to solve these and other problems of utility access and criss-crossing water and sewer lines. Rather than approve the proposed short plat, the entire matter of access in this area should be presented to the City Council with input especially from the Fire Department, which has expressed concerns regarding these matters in prior hearings, and the Traffic Engineering and Utilities divisions. 4. A further example of this situation could be the potential division of the 40,000 sq. ft. proposed Lot 1. An additional private street would be necessary. Similar narrow private streets may also be necessasry to parcels 282, 274, 275, 276 and 277, as well as up to six other superblocks in this area. 5. Currently, the continued approval of short plats in this area is only preserving the trend of inconsistent public and private roads, inconsistent widths, grades, curves, paved versus dirt, and inconsistent improvements inherited from King County. While this piecemeal approach may be acceptable, it may also be time for the City Council to review and explicitly approve this approach. 6. The division of the subject site, the access problem aside, appears reasonable. Services are available to the site and would probably not be taxed by the site's development. 7. The absence of any negative comments regarding traffic would lead to the presumption that the additional traffic would not adversely affect area roads. 8. Ultimate development of the site would allow infilling of an area already served by the appropriate utilities without forcing development to unserviced areas. And improvement of the subject site would increase the tax base of the city and provide additional living opportunities in the City. 9. Therefore, based upon the above analysis, the short plat as proposed should not be approved until the access situation is reviewed by the City Council. The process, up until this point, has been hit or miss and it may be time for a studied approach. DECISION The short plat as proposed is denied due to questions pertaining to access requirements. Warren, City Attorney Renton Record-Chronicle Pursuant to Title.IV, Section 3015 of the City's Code, request for reconsideration must be filed in writing on or before December 27, 1984. Any aggrieved person feeling that the decision of the Examiner is based on erroneous procedure, errors of law or fact, error in judgment, or the discovery of,new evidence which could not be reasonably available at the prior hearing may make a written request for review by the Examiner within fourteen (14) days from the date of the Examiner's decision. This request shall set forth the specific errors relied upon by such appellant, and the Examiner may, after review of the record, take further action as he deems proper. An appeal to the,City Council is governed by Title IV, Section 3016, which requires that such appeal be filed with the City Clerk, accompanying a filing fee of $75.00 and meeting other specified requirements. Copies of this ordinance are available for inspection or purchase in the Finance Department, first floor of City Hall. The Appearance of Fairness Doctrine provides that no ex parte (private one-on-one) communications may occur concerning land use decisions. This means that parties to a land use decision may not communicate in private with any decision-maker concerning the proposal. Decision-makers in the land use process include both the Hearing Examiner and members of the City Council. All communications concerning the proposal must be made in public. This permits all interested parties to know the contents of the communication and would allow them to openly rebut the evidence. Any violation, of this doctrine would result in the invalidation of the request by the Court. DEPARTMENT ANALYSIS: The following analysis focuses on the land use issues relevant to the short plat application and the specific variance request for a private street to access three of the proposed lots. SHORT PLAT 1. The proposed short plat complies with the intent of the Comprehensive Plan designation of Single Family Residential and the R-1, Single Family Residential zoning for the subject site. 2. Lots No. L 3 and 4 comply with the dimensional requirements of the R-1 zone and subdivision code. However, Lot No. 2 needs to be provided with at least 75 feet of frontage onto a private or public street. This can be accomplished and solve another problem of fire access turnaround to Lot No. 2 by creating hammerhead turnaround jointly shared between Lots No. 2 and No. 3. Increasing the size of the private street to include the hammerhead turnaround will not reduce either Lots No. 2 or 3 below minimum square footage requirement. 3. The utilities will have to be extended through the private roadway and across the eastern fifteen feet of proposed Lot #4 for the extension of sewer service into the plat. In addition, a twenty (20) foot wide easement should be provided along the existing stream bed which is located on the southern and western boundaries of Lot #4 for maintenance of storm water utility. VARIANCE 4. The applicant has requested a variance from Section 9-1108(23)(A)(9) to allow access to three single family lots by a private street. The proposed variance request by the applicant appears to be justified based upon the applicant's justification and the following analysis. The staff believes that the following criteria enumerated under Section 9-1109 of the Subdivision Code are met by the applicant and the variance is appropriate. a. That there are special physical circumstances or conditions affecting said property such as the strict applications of provisions of this ordinance would deprive the applicant of reasonable use or development of his land. PRELIMINARY REPORT,,, THE HEARING EXAMINER ROBERT H. WELLS: SHORT PLAT-107-84, V-106-84 DECEMBER 4, 1984 PAGE 3 The physical limitation is the shape of the subject property and the available access from NE 27th Street to the subject site. The applicant has accomplished lot line adjustments in the past to acquire more access onto NE 27th Street. Originally there were only fifteen (15) feet available and presently the applicant now has a total of forty-two (42) feet of frontage on to NE 27th Street. The property is only 150 feet wide from north to south and construction of a sixty (60) foot right-of-way for a public street with lots to the south would require the removal of the existing residence and barn if the street was placed along the northern property line. The street cannot be placed along the southern property line because of topography differences. The subject property increases in slope from north to south and the roadway would the top of the ridge looking down on the property. In addition, it would serve no purpose since the property to the south has been recently improved upon with a single family residential addition. b. That the variance is necessary to assure such property the rights and privileges enjoyed by other properties in the vicinity and under similar circumstances. The property in the general area has been developed through a series of pipestems, cul-de-sac streets and easements. The easements were utilized prior to annexation into the City. It does not appear that a through street could be developed because of the configuration of the lots in this large block and, thererfore, deprive any applicant of the use of a private street would deprive all development potential on the subject site. c. The granting of the variance will not be materially detrimental to the public welfare or injurious to other property in the vicinity. It does not appear that granting of the variance will either land-lock or impose any greater hardship upon adjacent property. It would be more logical to develop the remaining parcels in the•block by utilization of either cul-de-sacs or pipestems. In this case, the private road provides a measure of relief because surrounding development has generally precluded reasonable access to the subject site. 5. in addition, private streets have to meet certain criteria enumerated under Section 9-1108(23)(A)(9) to include the fact that they cannot service more than four (4) single family residences, that there is not a reasonable anticipation to extend a street for future traffic or pedestrian circulation through the subdivision to serve adjacent properties, and that the private street shall not be greater than 500 feet in length. In this case, the private street will be approximately 200 feet in length with a modified hammerhead cul-de-sac and will serve three lots. ISSUE: 6. Does the,private,street,preclude a reasonable..traffic_circulation oppgrtuni for,future,development in the area?, The subject property is unique in shape and size with limited access onto NE 27th Street. Lots to the north of the subject site already have access onto established public streets. Lots to the south can be accessed by either established easement or future cul-de-sac streets specifically on Parcels 282 and 274. 1 his would be of similar style that was developed on Parcel 261. Parcels 277, 276, and 275 could be developed jointly but are limited because of existing structures. Parcel 295 has already been developed through a series of short plats and previous subdivisions. The Building Division suggested that possibly a street be extended along the eastern property line where Lot No. 4 is proposed. This is impractical based upon the location of present structures immediately to the east of the property line. In addition, the access is limited to forty-two (42) feet which would not be sufficient for a through public street. Combining these problems with the fact that the street would bd entering near a curve and restricted sight distance on NE 27th Street, it would not be prudent to locate a street in this location. Therefore, a through street would be more detrimental than allowing the creation of a private street, at this point. PRELIMINARY REPORT ,o THE HEARING EXAMINER • ROBERT H. WELLS: SHORT PLAT-107-84, V-106-84 DECEMBER 4, 1984 PAGE 4 ISSUE: 7 Are. the Fire.Code standards the governing_ standards for bridges on private streets? The Subdivision Code does not establish any specific standards for private streets. It does not establish standards for asphalt, depth, subgrades, or structures spanning water courses or storm drainage swales. It would appear that since the pavement will receive more traffic than a standards single family residential driveway that it should be constructed to minimum City standards for roadway surfaces and include the necessary subgrades and paving. In the case of bridges, the bridge should be structurally sound to meet the minimum standards of the F ire Code for emergency vehicle access. This should be sufficient to meet all of the needs of a single family residential area. The alternative would be to bridge the course by using a culvert and then paving it to City standards. SUMMARY: The applicant is requesting a short plat of four (4) lot including access to three (3) by a private road. The private road appears justified under the criteria of both the subdivision variance and the specific criteria for private streets. Minor modifications for utility easements do need to be placed on the face of the short plat. Specific design criteria need to be elaborated, at this time, as to the status of bridge structures on the private road and the pavement surface for the private road. The proposal complies with the intent of the Comprehensive Plan Land Use Designation and the specific limitation of the Zoning Code with minor adjustments in the private street to accommodate a hammerhead turnaround for fire access. H.
