APPLICANT: • CITY OF RENTON, DEPARTMENT OF PUBLIC WORKS FILF NO. SP-115-84 LOCATION: Soythwest corner of Union Avenue N.E. and N.E. 3rd Place. SUMMARY OF REQUEST: Approval of a short plat to subdivide approximately 4.81 acres of property into two (2) lots for a future reservoir site and a future park site. SUMMARY OF ACTION: Building and Zoning Department Recommendation: Approval Hearing Examiner Decision: Approved. BUILDING & ZONING The Building & Zoning Department Report was DEPARTMENT REPORT: received by the Examiner on January 11, 1985. PUBLIC HEARING: After reviewing the Building and Zoning Department Report, examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: The hearing was opened on January 15, 1985, at 9:55 A.M. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. The following exhibits,were entered into the record: Exhibit #1 - Yellow file containing application, verification of posting, and other information pertinent to this request. Exhibit #2 - Site Plan Exhibit #3 - Vicinity Map The hearing was opened and Roger Blaylock, Zoning Administrator presented a review of the staff report stating the property involved is presently owned by the Department of Public Works, but will be sold to the Parks Department. The 4.8 acres is scheduled to eventually become a neighborhood park as well as a reservoir site. This is a subdivision in the G-1 zone with both lots meeting the criteria of 35,000 sq. ft. He continued stating part of the property is a right-of-way. There is presently 30 ft. of right-of-way for N.E. 3rd Place, and an additional 30 ft. will be required per City code. It was noted that there will be another public hearing required on the uses placed on the proposed sites. There is no sanitary sewer service extended to Lot #2, and it was recommended that said extension should take place immediately upon development of this site. Mr. Blaylock continued stating the only apparent issue at this time is whether Union Avenue should be dedicated at 60 ft. or 70 ft. The portion of Union Avenue in question is designated as a secondary arterial, to be utilized as a collector. At the present time Union Avenue N.E. ends in a cul-de-sac. It is anticipated there will be future plans to open up that portion of the street to provide a through access. The proposal complies with all intents of the Subdivision Code. The Zoning Administrator advised that staff recommended approval of this short plat request conditioned upon the widening of Union Avenue N.E. to 35 feet. The Hearing Examiner called for testimony from the applicant or their representative. There were only City employees in attendance, and no one wished to speak in oposition to the request. With no further comments from staff, the hearing was closed at 10:05 A.M. City of Renton, Departriof Public Works Short Plat 115-84 January 25, 1985 Page 2 • FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS 1. The applicant, The City of Renton, Department of Public Works, has requested approval of'a two lot short plat of an approximately 4.81 acre parcel. 2. The application file containing the application, the State Environmental Policy Act (SEPA) documentation, the Building and Zoning Department Report, and other pertinent documents was entered in the record as Exhibit #1. 3. Pursuant to the City of Renton's Environmental Ordinance and SEPA (RCW 43.21 C, 1971, as amended), a Declaration of Non-Significance has been issued for the subject proposal by the Environmental Review Committee (ERC), the responsible official. 4. Plans for the proposal have been reviewed by all City departments affected by the impact of this proposal. 5. There was no opposition to the subject proposal from any member of the public. 6. The subject site is located at the southwest corner of Union Avenue N.E. and N.E. 3rd Place. 7. The subject site is currently undeveloped. 8. The map element of the Comprehensive Plan designates the area in which the subject site is located as suitable for the development of public and quasi-public and medium density multiple family uses, but does not mandate such development without consideration of other policies of the plan. 9. The subject parcel, which is approximately 4.81 acres in area, will be divided into two lots of approximately 2.59 acres (Proposed Lot 1) and 1.78 acres (Proposed Lot 2). The difference in acreage is due to land given over to public rights-of-way. 10. The subject site was annexed into the city in June, 1966 by Ordinance 2249, at which time it was automatically zoned G-1 (General; Single Family Residential; Minimum lot size - 35,000 sq ft), its current classification. 11. The City proposes dividing the parcel to enable eventual development of a reservoir on Lot 1 and a City park on Lot 2. Those proposals are subject to separate review at the development stage. 12. The City is bound by the same off-site requirements as any other party and has not sought special treatment. The arterial status of Union Avenue N.E. was raised. While designated as a secondary arterial, its treatment in the past has resulted in a width of 60 feet whereas the Building and Zoning Department recommends at this stage a 70 foot width. The subject site would have to provide 35 feet of this width, or five more than formerly. 13. Union Avenue does not provide through access at this time. The street runs south and ends without an outlet. Ultimate construction of a through link in the vicinity is envisioned but plans remain unformulated. CONCLUSIONS 1. The proposed division of the subject site into two parcels appears to serve the public use and interest. Each of the lots exceeds the minimum 35,000 sq ft requirement of the G-1 zone. 2. The applicant will provide sidewalks and other off-site improvements as well as dedicating portions of the site for new and wider streets. 3. The street width would apparently be appropriately 70 feet and therefore, the applicant should provide for 35 feet for its half street dedication. . 'The proposed uses will not generate additional population, but traffic patterns would be altered by a park. Warren, City Attorney Renton Record-Chronicle Pursuant to Title IV, Section 3015 of the City's Code, request for reconsideration must be filed in writing on or before February 8, 1985. Any aggrieved person feeling that the decision of the Examiner is based on erroneous procedure, errors of law or fact, error in judgment, or the discovery of new evidence which could not be reasonably available at the prior hearing may make a written request for review by the Examiner within fourteen (14) days from the date of the Examiner's decision. This request shall set forth the specific errors relied upon by such appellant, and the Examiner may, after review of the record, take further action as he deems proper. An appeal to the City Council is governed by Title IV, Section 3016, which requires that such appeal be filed with the City Clerk, accompanying a filing fee of $75.00 and meeting other specified requirements. Copies of this ordinance are available for inspection or purchase in the Finance Department, first floor of City Hall. The Appearance of Fairness Doctrine provides that no ex parte (private one-on-one) communications may occur concerning land use decisions. This means that parties to a land use decision may not communicate in private with any decision-maker concerning the proposal. Decision-makers in the land use process include both the Hearing Examiner and members of the City Council. All communications concerning the proposal must be made in public. This permits all interested parties to know the contents of the communication and would allow them to openly rebut the evidence. Any violation of this doctrine would result in the invalidation of the request by the Court. HISTORY/BACKGROUND: The subject site was annexed into the City of Renton by Ordinance #2249 of June 22, 1966, at which time the current zoning designation was applied to the subject property. D. PUBLIC SERVICES: 1. Utilities: a. Water: A ten-inch water line is located along the north property line and near the west property line. Section 4-704, General Use. F. APPLICABLE SECTIONS OF THE COMPREHENSIVE PLAN OR OTHER OFFICIAL CITY DOCUMENT: 1. Northeast Renton Area Plan, City of Renton Comprehensive Plan Compendium, 1983, p. 40-45. 2. General Objective and Water Objective (Section VIII, A & B), Utilities Goal, Policies Element, City of Renton Comprehensive Plan Compendium, 1983, p. 22-23. 3. Parks Objective (Section IX, D), Community Facilities Goal, City of Renton Comprehensive Plan'Compendium, 1983, p. 25. • 4. Section 9-1105,'Short Subdivision, Subdivision Ordinance. G. DEPARTMENT ANALYSIS: 1. The applicant's request to create a two-lot short plat of 4.81 acres to allow future construction of a reservoir and park is in compliance with the intent of the Comprehensive Plans designated site as Public/Quasi-Public and the existing G-1, General Use zoning. Actual development of either public project would require a conditional use permit. Specific site plan review will be accomplished at that time through the public hearing process. 2. The applicant has not sought a variance from the requirements to install adjacent off-site improvements. Union Avenue N.E. is presently under reconstruction in this area. In addition, sidewalks will need to be installed on the south side of N.E. 3rd Place along with the extension of a sanitary sewer to provide service to proposed lot No. 2. ISSUE ' 3. . The only apparent issue in the short plat request is whether Union Avenue N.E. should be dedicated at 70 feet in width or 60 feet in width. This segment of Union Avenue N.E. is designated as a secondary arterial primarily to be used as a residential arterial and collector. Under the subdivision code, Section 9-1108(7)(H) Table 1, the minimum width for community arterials is 70 feet. However, in the past, the City has not imposed this specific requirement upon Fernwood North, another project to the south on Union Avenue N.E., nor Oakhurst Development Co.'s Sunnydale Mobile Home Park. Union Avenue N.E. presently is a deadend street to the south, but with intensions that it could be extended to the west and south in the future. Even though only 60 feet of right-of-way is provided, it would appear that Union Avenue N.E. can still be utilized as a major arterial. It will intertie with other arterials in the area. Although the Building and Zoning Department and the Public 'Works Department erred in advising the Hearing Examiner on the previous projects, the Examiner is bound by City code. Probably the real issue is whether arterial streets should be designated that don't provide through circulation and whether the Six-Year Arterial Street plan should be updated at this time. • 4.
