Hearing Examiner Decision: Denied BUILDING & ZONING The Building & Zoning Department Report was DEPARTMENT REPORT: received by the Examiner on May 21, 1985. PUBLIC HEARING: After reviewing the Building and Zoning Department Report, examining available information on file with ' the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: The hearing was opened on May 28, 1985, at 9:20 A.M. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. The following exhibits were entered into the record: YY Exhibit #1 - Yellow file containing application, proof of posting and other documents pertinent to this request. Exhibit #2 - Short Plat Map. Roger Blaylock, Zoning Administrator was asked to present th'e staff report for this proposal. Upon entering the above exhibits, Mr. Blaylock continued stating the subject property is approximately one-half acre in size, 21,650 sq. ft., with two commercial businesses located on the property. The intent of this request is' to divide the property and sell to the individual businesses that are now operating. There are residential and commercial uses surrounding the site, with improved public services available. The streets are designated as arterials. This short plat will have no effect on fire protection, transit, schools or recreation in the area as the uses are already established. Mr. Blaylock continued stating it is the applicant's intention to divide the property into 2 separate lots. The applicant requested the short plat to meet real estate contract financing requirements. It was pointed out that buildings exist on both of the proposed lots and do comply with setbacks from public streets, but do not comply with setbacks under the Fire Code which requires them to be 20 ft. from a property line. It was recommended that the property line on Lot #1 be moved 5-1/2 ft. to the east. The building on Lot #2 is more difficult, and three suggestions for conformance were presented. There was a brief discussion on the setback requirements, and Jim Hanson, Building and Zoning Department, explained that the Fire and Building Codes permit building right up to the property line, but when that is done the applicant is required to have varying fire walls depending on the use and size of the building. These two buildings are considered to be a low to moderate hazard, and of such a size that only a one hour fire resistant wall would be required. Mr. Hanson stated both buildings were constructed without fire walls but could be modified as one hour fire walls are easily obtained. The Hearing Examiner clarified that there is actually no setback requirement, only certain building standards as one would move closer to the property line. Mr. Hanson agreed with that statement. JACK STEWART , SP-035-85 June 5, 1985 Page 2 At this point it was noted for the record that written comments had not been received from the Public Works Department. Mr. Blaylock stated staff was aware there were problems with access to the site because both streets are major arterials. Based upon the information available, staff recommended approval of this request subject to two conditions set out in the staff report. The Hearing Examiner called for testimony in support of the application by the applicant or his representative. Wishing to speak was: John Baima, Surveyor 499 Rainier Blvd. North Issaquah, Wa. 98027 Mr. Baima stated the buildings have been on the property for a long period of time and it is possible by subdividing the lot along the line shown on the short plat map between lots 1 and 2, they could be adding to an undesirable condition already existing on the property. He said the building shown on Lot #2 is not creating any more of a hazard than already exists. Lot #2 is anticipated to be sold to the nursery to the north and Lot #1 will be sold to a separate party. Rather than move the lot line on Lot #1, he stated his client wishes _ to construct the one hour fire wall and retain the current lot line. Mr. Baima stated the applicant can not do anything with an easement on the property to the north because they would be 'obligating someone else's property which they have no control over. He suggested Lot #2 could be left as it is now because it is not worsening any conditions that are already present; the building is not of great value; and requested that the Examiner allow Lot #2 to remain as it is. He stated they could put a fire wall in the building but it would be counter-productive to place a fire wall in a building that actually has no value. At this point in the hearing, Gary Norris from the Traffic Engineering Department arrived and presented statements regarding the concerns of that department. Mr. Norris stated it is the feeling of the Traffic Engineering Department that this Short Plat request not be approved due to access conditions as they now exist. Existing access driveways nearest the intersections of Sunset Blvd. and Duvall do not meet driveway standards as they are too close to a signalized intersection. He stated as traffic volumes increase, it will become more desirable to close off the driveways nearest the intersection corner. As it stands now, Lot #2 does not have appropriate access, and it is felt Lot #1 may have a problem in the future. Mr. Baima, Surveyor for the applicant, spoke again reiterating the fact that at the present time Lot #2 is going to be purchased by the owner of a nursery to the north. He urged that this request be approved as they are not increasing or making an existing condition more difficult. He stated if the sale of the property goes through it may be possible for them to improve the access problem on Lot #2 at the time the building permit is issued. Mr. Baima stated the building now on Lot #2 is of no value. Lot #1 houses an appliance store which is to be purchased by the current tenant. The hearing continued, with a brief discussion on the possibility of joining Lot #2 with the northern property, with some type of restriction stating if the two lots were ever joined into one ownership that the access to Lot #2 would be precluded and moved to the north. Mr. Norris said that would be possible but cautioned any intense use proposed as the Traffic Engineering Department would want to maintain limited access conditions to any properties on those two corners due to their distance from the intersection. The Hearing Examiner called for further testimony in support of, or in opposition to this proposal. There was no one else wishing to testify, and no further comments from staff. The hearing was closed at 9:40 A.M. FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS 1. The applicant, Jack Stewart, has requested approval of a two lot short plat on approximately .497 acres of property. 2. The application file containing the application, the State Environmental Policy Act (SEPA) documentation, the Building and Zoning Department Report, and other pertinent documents was entered in the record as Exhibit #1. JACK STEWART 0 SP-035-85 June 5, 1985 Page 3 3. Pursuant to the City of Renton's Environmental Ordinance and SEPA (RCW 43.21C, 1971, as amended), the subject proposal has been determined exempt from environmental review by the Environmental Review Committee (ERC), the responsible official. 4. Plans for the proposal have been reviewed by all City departments affected by the impact of this proposal. 5. The subject site is located at 4608 N.E. Sunset Boulevard. The site is the northwest corner lot at the intersection of Duvall Avenue N.E. and Sunset Blvd. 6. The lot is oddly shaped due to its location along the sweeping curve between Duvall and Sunset, which makes up its southerly property line. At it narrowest dimension, the site is approximately 37.52 feet in depth, while at its widest dimension, it is approximately 133.22 feet in depth. The lot is also approximately 218.08 feet in width, although again, because of the location of the lot, that dimension also varies downward. 7. The map element of the Comprehensive Plan designates the area in which the subject site is located as suitable for the development of commercial uses, but does not mandate such development without consideration of other policies of the plan. 8. The subject site is zoned B-1 (Business/Commercial). The site was annexed into the City in November, 1974 by the adoption of Ordinance 2894, at which time it was automatically zoned G (General; Single Family Residential; Minimum lot size - 35,000 sq ft). The site was reclassified to B-1, its current zoning, in June, 1978 by the adoption of Ordinance 3225. 9. Separate businesses are located on each of the proposed lots. The applicant did not provide the ultimate area of each lot. Due to the pre-existing, location of the buildings, some non-conformities already exist. One building is located as close as approximately 2.5 feet from a property line. The other building would be located within 14 feet of a proposed property line. The Fire Code requires either a greater setback or fire wall construction techniques. The applicant prefers the fire wall technique rather than a potential modification of the proposed lot lines. 10. Traffic engineering opposes the proposed subdivision citing the small lots which only complicate access problems at the intersection of two heavily traveled arterial streets, Duvall and Sunset. The existing conditions do not meet todays standards of driveway access vis-a-vis proximity to an intersection. Traffic Engineering has indicated that the existing configuration is already unsafe, and approval would lessen the chance of correcting the problems. CONCLUSIONS 1. The applicant has the burden of demonstrating that the proposed subdivision is in the public interest and will provide for, among other things, safe and adequate. public rights-of-way. The proposed subdivision does not serve the public use and interest, and should be denied. 2. The proposed subdivision will only cast in concrete an already unsafe conflict between private driveways and the Duvall/Sunset intersection. While the subdivision will recognize an existing condition, two separate businesses sharing a single lot, it will perpetuate an unsafe condition and make it more unlikely that it would be corrected by changed land use patterns. It would be easier for the City to force closure of one or more unsafe driveways if the lots were maintained in one ownership. It would be more difficult, if not impossible, if the lots were in separate ownerships. Separate lots would be required to have separate access and each could force the City to recognize such separate rights. As one lot, the City remains in a better position to modify an unsafe traffic condition. 3. Alone, the resulting traffic conditions merit denial. Coupled with the complexities of non-conforming building locations and the fact that the applicant could also not ( provide square footage, the applicant has not met the burden of demonstrating that the proposed subdivision is in the public interest. Any aggrieved person feeling that the decision of the Examiner is based on erroneous procedure, errors of law or fact, error in judgment, or the discovery of new evidence which could not be reasonably available at the prior hearing may make a written request for review by the Examiner within fourteen (14) days from the date of the Examiner's decision. This request shall set forth the specific errors relied upon by such appellant, and the Examiner may, after review of the record, take further action as he deems proper. An appeal to the City Council is governed by Title IV, Section 3016, which requires that such appeal be filed with the City Clerk, accompanying a filing fee.of $75.00 and meeting other specified requirements. Copies of this ordinance are available for inspection or purchase in the Finance Department, first floor of City Hall. The Appearance of Fairness Doctrine provides that no ex parte (private one-on-one) communications may occur concerning land use decisions. This means that parties to a land use decision may not communicate in private with any decision-maker concerning the proposal. Decision-makers in the land use process include both the Hearing Examiner and members of the City Council. All communications concerning the proposal must be made in public. This permits all interested parties to know the contents of the communication and would allow them to openly rebut the evidence. Any violation of this doctrine would result in the invalidation of the request by the Court. Northeast Renton Area Plan, City of Renton Comprehensive Plan Compendium, January, 1985, p.55-60. 3. Section 9-1105 Plat Requirements for Short Subdivisions. G. DEPARTMENT ANALYSIS: 1. The applicant, Jack Stewart, is requesting a short plat of 21,650 square feet (approximately 1/2 acre) into two commercial lots. 2. The property was originally rezoned in 1978 (Ordinance 3225) after being annexed in 1974. Presently, two businesses occupy the subject site. 3. Short plats are exempt from the State Environmental Policy Act of 1971. The Environmental Review Committee has not considered the consequences of subdivision. 4. Buildings presently exist on both proposed lots. The building on Lot 1 located approximately 38 feet from the northern property line, 21 feet from the western property line, and 14-1/2 feet from the proposed eastern property line. On proposed Lot 2, the building is located approximately 2-1/2 feet from the northern property line and approximately 47 feet from the southern property line. Both• lots comply with the required setbacks from public streets; however, both buildings do not comply with the minimum setbacks under the Fire Code of 20 feet from a property line. Therefore, to resolve the problem with Lot 1, the property line would have to be moved approximately 5-1/2 feet to the east to allow adequate clearance, while the building on Lot 2 would have to be (1) removed, (2) combined with the lot to the: north, or (3) a building easement obtained on the property to the north so that no structure could be located within 17-1/2 feet of the existing building. The applicant has stated that' proposed Lot 2 will be sold to the adjacent property owner to the north, but separate lots are needed to allow for the financing under a real estate contract. 5. Various City departments have commented. All of them agree that the short plat is appropriate with the exceptions of the Building and Fire departments which suggests that necessary mitigation has to occur to meet the -fire • standards as discussed above. 6. The site is within the sewer moratorium area. Construction should be completed by this fall (1985) on the new pump station and sewer line. H. DEPARTMENTAL RECOMMENDATION: Based upon the above analysis, it is recommended that the short plat request by Jack . Stewart, file Short Plat-035-85, be approved subject to the following conditions: 1. Moving of the property line, between proposed Lot 1 and Lot 2, 5-1/2 feet to the east. 2.
