SUMMARY OF REQUEST: Approval to subdivide 0.83 acre of property into three single family lots, and approval of a waiver of off-site improvements. SUMMARY OF ACTION: Building and Zoning Department Recommendation: Short Plat and Waiver approved with conditions set out in staff report. Hearing Examiner Decision: Short Plat is approved, with conditions. Waiver is denied. BUILDING & ZONING The Building & Zoning Department Report was DEPARTMENT REPORT: received by the Examiner on August 12, 1985. PUBLIC HEARING: After reviewing the Building and Zoning Department Report, examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: The hearing was opened on August 20, 1985, at 9:25 A.M. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. The following exhibits were entered into the record: Exhibit #1 - Yellow file containing application, proof of posting and publication, and various documentation pertaining to this request. Exhibit #2 - Short Plat Map The following information was reviewed from the staff report by Roger Blaylock, Zoning Administrator. The subject site is 0.83 acre of property which the applicant wishes to develop into 3 single family lots, with a waiver of off-site improvements on S.W. 19th Street. Existing zoning in the area is primarily G-1 and R-1. The Comprehensive Plan calls for the area to be single family, and access to the property is directly off of 19th Street. The property is surrounded by single family residences and vacant property. It was noted there has been previous short plat approval on the west side of the subject site; services have been extended into the area; the sewer system will have to be extended into the site; and each lot exceeds the 7200 sq. ft. minimum requirement. The subject site has dimensions of 225 ft. by 160 ft. The site had been a part of the Honey Creek moratorium area, but the moratorium has now been lifted by the City for construction purposes. Mr. Blaylock continued with a review of staff comments which included a requirement by the Fire Department that a water main be installed replacing the 2" domestic line along N.E. 19th Street and a hydrant to be placed at the intersection of N.E. 19th and Shelton. The Engineering Department has recommended that off-site improvements be installed and the request for a waiver of these improvements be denied. It is the feeling of the the Traffic Engineering Department that power lines running north and south between lots 2 and 3 be placed underground: an easement of 10 ft. be required on property fronting on 19th N.E.; and that off-site improvements be required at the time building takes place on the site. It was noted that the applicant is not actually requesting a waiver of improvements, but more appropriately a deferral. The applicant wishes to defer the improvements until street grades can be determined and an LID formed. With this in mind it was noted that this request should probably be presented to the Public Works Department for review. Mr. Blaylock stated if it is a matter dealing with a life/safety situation, staff would not recommend a deferral or waiver, but in this instance there is DON VAN PARYS • • SP-049-85 and W-060-85 August 30, 1985 Page 2 a distance of only 125 ft. from fire hydrants to the site, so that logic would not apply. In conclusion, Roger Blaylock recommended approval of the Short Plat subject to the conditions set out in the staff report, and recommended the deferral request for off-site improvements be referred to the Public Works Department. The Examiner called for testimony from the applicant or his representative. Speaking in his own behalf was: Don Van Parys 13837 S.E. 128th Renton, Wa. 98056 Mr. Van Parys had comments which included advising that the staff report stated his property was 1300 ft. from the sewer line when in actuality the line stops at the edge of the second lot, which places the farthest lot within 400 ft of the line. He advised he would prefer not to have to install a hydrant at this time as there is a hydrant on both sides of his property, within 120 ft. of lot #3 (one located at the intersection of 19th and Union, and one on the east side of. Shelton Avenue). He does not feel he should be required to provide storm drains as there currently are no others in the immediate area. Mr. Van Parys continued stating between lots 2 and 3 there are power lines that serves another resident. He does not wish to be burdened with the cost to place those lines underground on his property as it could be fed through that resident's access, not his. The lines are overhead, and as far as he knows there is not a legal easement across his property that would permit the lines to exist over his property. The Hearing Examiner inquired of the applicant if he would consider granting an easement between lots 2 and 3 for his neighbor to place the power lines underground. The applicant stated he would have no problem with that suggestion, but it was pointed out that the adjoining property does have access which would lead the applicant to suggest that the power lines should bypass his personal property and be fed directly onto the adjoining property. It was suggested by the Examiner that the applicant speak with his neighbor and try to determine how long the lines have been in place and the circumstances under which they were placed there. It was also suggested by staff that Mr. Van Parys contact the Power Company and further discuss this matter. The applicant had no further comments. There was no one in the audience wishing to speak in opposition, and no further comments offered by staff. The hearing was closed at 9:45 A.M. FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: 1. The applicant, Don Van Parys, has requested approval of a Short Plat on approximately .83 acres together with a Waiver of the required off-site improvements. 2. The application file containing the application, the State Environmental Policy Act (SEPA) documentation, the Building and Zoning Department Report, and other pertinent documents was entered in the record as Exhibit #1. 3. Pursuant to the City of Renton's Environmental Ordinance and SEPA (RCW 43:21 C, 1971, as amended), the subject proposal has been determined exempt from environmental review by the Environmental Review Committee (ERC), the responsible official. 4. Plans for the proposal have been reviewed by all City departments affected by the impact of this proposal. 5. There.was no opposition to the subject proposal from any member of the public. 6. The subject site is located on the south side of N.E. 19th Street, approximately 100 feet east of Shelton Avenue N.E. DON VAN PARYS SP-049-85 and W-060-85 August 30, 1985 Page 3 i 7. The subject site was annexed into the City in March, 1969 by the adoption of Ordinance 2472. The site was initially zoned G-1 (General; Single Family Residential; Minimum lot size - 35,000 sq ft) upon annexation. That was changed to R-1 (Single Family Residential; Minimum lot size - 7,200 sq ft) by a restructuring of single family zones in June, 1982. 8. The map element of the Comprehensive Plan designates the area in which the subject site is located as suitable for the development of single family uses, but does not mandate such'development without consideration of other policies of the , plan. 9. The lots will each front on N.E. 19th Street. Each of the lots will be 75 feet wide and approximately 160 feet deep. Lot 1 will be approximately 12,198 sq ft, Lots 2 and 3 will each be approximately 11,998 sq ft. 10. The applicant indicated that the nearest sewer line is approximately 400 feet from the site, while staff indicated that the sewer was approximately 1,300 feet away. A fire hydrant is located near the intersection of 19th and Union, approximately 125 feet east of the subject site. Another hydrant is located along Shelton approximately 400 feet south of the intersection with 19th. 11. There is no storm drainage system in the area, nor are there curbs and gutters. An overhead powerline crosses the middle of the subject site from 19th to a lot south of the subject site. 12. The water line serving the site is 2 inches and staff recommends that it be sized up to serve the 3 new lots. Fire recommended the installation of a new hydrant at the corner of 19th and Shelton. A utility easement of 10 feet parallel to 19th is required to serve the subject site. - CONCLUSIONS 1. The proposed 3 lot subdivsion appears to serve the public use and interest. The new lots will permit in-filling of an existing neighborhood in which many, if not all the' necessary infrastructure improvements exist. 2. The ultimate development will increase the tax base of the City and provide additional residential opportunities in the City. 3. The fact that the area does not have an extensive off-site improvement quotient would appear to justify the waiver requested, but at the same time improvements in the area should not be entirely foreclosed. Rather than issue an outright waiver, the applicant should request a deferral of the improvements, or at least some of them, from the Board of Public Works. 4. The installation of a fire hydrant seems excessive for an area in which the addition of the new lots is minor compared to the existing stock of.homes. Especially, when a hydrant is located in the opposite direction approximately the same distance, the burden should not be placed so extensively upon this sole applicant. 5. The applicant will have to upgrade the water lines serving the subject site, extend the sewer line to serve the subject site and provide the necessary undergrounding of utilities. The powerline crossing the subject site does not appear to be of use to the applicant and the responsibility for it is not the appicant's. DECISION The Short Plat is approved subject to providing the 10 foot easement along N.E. 19th Street. The Waiver is denied in favor of a deferral by the Board of Public Works, if one is warranted. Warren, City Attorney Renton Record-Chronicle Pursuant to Title IV, Section 3015 of the City's Code, request for reconsideration must be filed in writing on or before September 13, 1985. Any aggrieved person feeling that the decision of the Examiner is based on erroneous procedure, errors of law or fact, error in judgment, or the discovery of new evidence which could not be reasonably available at the prior hearing may make a written request for review by the Examiner within fourteen (14) days from the date of the Examiner's decision. This request shall set forth the specific errors relied upon by such appellant, and the Examiner may, after review of the record, take further action as he deems proper. An appeal to the City Council is governed by Title IV, Section 3016, which requires that such appeal be filed with the City Clerk, accompanying a filing fee of $75.00 and meeting other specified requirements. Copies of this ordinance are available for inspection or purchase in the Finance Department, first floor of City Hall. The Appearance of Fairness Doctrine provides that no ex parte (private one-on-one) communications may occur concerning land use decisions. This means that parties to a land use decision may not communicate in private with any decision-maker concerning the proposal. Decision-makers in the land use process include both the Hearing Examiner and members of the City Council. All communications concerning the proposal must be made in public. This permits all interested parties to know the contents of the communication and would allow them to openly rebut the evidence. Any violation of this doctrine would result in the invalidation of the request by the Court. The Doctrine applies not only to the initial public hearing but to all Requests for Reconsideration as well as Appeals to the City Council. Transit: Metro Transit Route #114 operates along Union Avenue N.E. approximately 200 feet east of the subject site. 4. Schools: a. Elementary Schools: Sierra Heights Elementary School is located approximately 1900 feet north of the subject site. b. Middle Schools: McKnight Middle School is slightly less than one mile west of the subject site. c. High Schools: Hazen High School is located approximately .6 of a mile southeat of the site. 5. Recreation: The Kiwanis Park located on Union Avenue N.E. is located approximately .8 of a mile south of the subject property. E. APPLICABLE SECTIONS OF THE ZONING CODE: 1. DEPARTMENT ANALYSIS: 1. The applicant, Don Van Parys, is requesting approval of a three (3) lot short plat (Short Plat 049-85) and a waiver of off-site improvements (W-060-85). 2. The proposed short plat is for future single family residences. This complies with the Comprehensive Plan designation of single family for the site and with a present zoning designation of R-1, Single Family Residential zoning. 3. Each of the proposed lots is in excess of the 7200 square foot lot size and meets the minimum dimensional requirements of single family residential lots. 4. Various City departments have reviewed the subject proposal. The Policy Development Department, Building and Zoning Department, Parks and Recreation Department, and the Police Department have approved the subject proposal. Fire Prevention, Engineering, and Traffic Engineering have approved the proposed short plat subject to certain conditions. The conditions of approval by the various departments are as follows: • Fire: Water main required to replace existing 2" domestic line along N.E. 19th. Hydrant required at intersection of N.E. 19th and Shelton. • Engineering: Recommend , off-site improvements be installed - curbs, gutter, sidewalk, storm drainage, sanitary sewers, water, and paving. • Traffic Engineering: a. Underground overhead power line extending north and south between proposed lots 2 and 3. PRELIMINARY REPORT TO THE HEARING EXAMINER • DON VAN PARYS, Short Plat 049-85, W-060-85 AUGUST 20, 1985 PAGE 3 b. Off-site improvements required when building is intiated. Curb, gutters, sidewalks, street light, undergrounding of overhead electrical and communications distribution system. c. Ten foot utility easement required on property frontage to N.E. 19th Street. 5. Utility Engineering did not approve the proposal since at the time of staff review the subject site was located in the sewer moratorium area within the Honey Creek and May Creek drainage basins. On August 5, 1985,. the City Council lifted the moratorium with the passage of Resolution No. 2611. 6. The applicant has applied for a waiver of off-site improvements as specified in Section 9-1105(6) of the Subdivision Ordinance. The applicant is not requesting a true waiver in which the applicant would never install the improvements. Rather, the applicant requests "...a waiver of off-site improvements be granted until such time that street grades can be established and an L.I.D. formed." An on-site visit to the site confirms the applicant's statement that the curbs, gutters, and sidewalks are lacking in the area. It should be noted that along Shelton Ave. N.E. there are curbs and an improved street. However, along N.E. 19th St. these improvements are lacking. H. DEPARTMENTAL RECOMMENDATION: Based upon the above analysis, it is recommended that the applications be approved as follows: Short Plat (File Short Plat-049-85) The short plat be approved subject to the following conditions: 1. Approval of required water and sewer plans by Utility Engineering. 2. Provide a ten (10) foot utility easement on property fronting N.E. 19th Street and show on the face of the plat. Waiver (File W-060-85) The waiver be approved subject to the following condition: 1. That restrictive covenants be filed stating that the applicant will install the off-site improvements including but not limited to curbs, gutters, sidewalks, sanitary sewer, water main and fire hydrant, storm water drainage, underground electrical and communications distribution system, lighting and street improvements, either prior to the construction of the first single family residence located in the short plat or participate in an L.I.D. at the time one is formed in the immediate area, whichever comes first.
