SUMMARY OF REQUEST: Approval of a Short Plat to subdivide approximately 0.52 acres of property into two (2) single family residental lots and an application for a Waiver of required off-site improvements. SUMMARY OF ACTION: Building and Zoning Department Recommendation: Approval with conditions. Hearing Examiner Decision: Short Plat is approved and recommend Waiver request be granted., BUILDING & ZONING The Building & Zoning Department Report was DEPARTMENT REPORT: , .received by the Examiner on November 26, 1985. PUBLIC HEARING: After reviewing the Building and Zoning Department Report, examining available information on file with _ the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: The hearing was opened on December 3, 1985, at 9:45 A.M. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. The following exhibits were entered into the record: Exhibit Ill - Yellow file containing application, proof of posting and publication and other documents related to.this request. Exhibit #2 - Short Plat map showing proposed 2 lots. After placing the above exhibits into the record, Roger Blaylock, Zoning Administrator, reviewed the staff report for the Examiner containing the following information. The applicant is requesting a short plat to permit the construction of a second residence on the site. The main residence is located on lot #2. The site is 22,500 sq. ft., each of the lots contain more'than the 7200 sq. ft. required in the .R-1 zone, the proposal is supported by the Comprehensive Plan, and utilities are provided to the property. It was pointed out that Aberdeen Avenue N.E. right-of-way is 76 ft. wide which creates a setback on the lots of 42 ft., which more than complies with the minimum requirements. Mr. Blaylock continued stating the only issue to be discussed for this proposal is the request for a waiver of off-site improvements. The Policy Development Department feels a deferral would be more appropriate at this time, while the Public Works Department feels the improvements should be required at this time due to problems associated with enforcement when deferrals or restrictive covenants are utilized in securing off-site improvements for a later date. There is adequate fire flow and an 8 inch water main on N.E. 12th which meet minimum fire standards at this time, but may have to be up-graded in the future. Continuing, Mr. Blaylock stated the applicant is requesting a waiver of off-site improvements as there are no other improvements in the area, specifically•curbs, gutters and sidewalks.' Waivers have previously been granted for these improvements to the north of this site, and there is not enough development in the area to establish a pattern for the requested improvements. 'He stated staff recommends approval of the Short Plat and requested the Waiver for off-site- improvements be granted. ALBERT J. KOSHKO • • SP-089-85 & W-090-85 December 12, 1985 Page 2 The Hearing Examiner called for testimony in support of this proposal from the applicant or his representative. Responding was: Albert J. Koshko 1164 Aberdeen N.E. Renton, Wa. 98056 Mr. Koshko stated he has lived on this property for over twenty-five years. When he first bought the property and sewer lines were put in place, he requested a second outlet with the idea in mind that at some time in the future he would want to divide the property. With this in mind, he feels there should already be a second sewer outlet on Aberdeen Avenue. At one time the water meter was on N.E. 12th, but he moved it to his property; much of the property around him has been divided into smaller parcels over the years; and he feels the requirement of curbs, gutters and sidewalks on just his corner would not enhance the property at all. Mr. Koshko advised that he is retiring this year and contemplates selling this property. He said the sale of the property is dependent upon whether or not the property can be divided. He had no further comments. The Examiner called for further testimony in support of, in opposition to, or comments from staff. There was no one else in attendance wishing to speak. The hearing was declared closed at 9:55 A.M. FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: 1. The applicant, Albert J. Koshko, has requested approval of a 2 lot short plat together with a waiver for the installation of off-site improvements. 2. The application file containing the application, the State Environmental Policy Act (SEPA) documentation, the Building and Zoning Department Report, and other pertinent documents was entered in the record as Exhibit #1. 3. Pursuant to the City of Renton's Environmental Ordinance and SEPA (RCW 43.21C, 1971, as amended), the subject proposal has been determined exempt from environmental review by the Environmental Review Committee (ERC), the responsible official. 4. Plans for the proposal have been reviewed by all City departments affected by the impact of this proposal. 5. The subject site is located at 1164 Aberdeen Avenue N.E. The site is located on the southeast corner of Aberdeen and N.E. 12th Street. 6. The subject site was annexed into the City in October, 1959 at which time it was automatically zoned for single family uses. The site is currently zoned R-1 (Single Family Residential; Minimum lot size - 7,200 sq ft). 7. The map element of the Comprehensive Plan designates the area in which the subject site is located as suitable for the development of single family uses but does not mandate such development without consideration of other policies of the ' plan. 8. The subject site is approximately 150 feet square and is relatively level. 9. An existing single family home is located on the southern half of the subject site. The home is set back approximately 42 feet from Aberdeen, and 5 feet from the proposed new lot line on its north. An existing garage is located 4 feet from the south side yard and approximately 15 feet from the rear lot line. All required yards would be legal and conforming as proposed. 10. The existing home would be located on proposed Lot 2 which would be approximately 77 feet wide by approximately 150 feet deep. It would be the interior lot and contain approximately 11,550 square feet. Proposed Lot 2 is currently vacant, would be approximately 73 feet wide by approximately 150 feet deep, and would be a corner lot. Schools are located within 1-2/3 miles of the subject site. 12. There are no curbs, gutters or sidewalks within the immediate vicinity of the subject site, and a Waiver was granted in this general area in the Emmett Eaton Short Plat (File Short Plat 080-81). 13. The Fire Department has indicated that the water main could need upgrading although the site would have sufficient fire flow. CONCLUSIONS 1. The proposed Short Plat appears to serve the public use and interest. The division will permit the development of an additional single family home in an area in which public services are already provided, avoiding costly extensions 2. The eventual construction of a new residence will result in in-filling of an urbanized area rather than forcing growth to an area in which services are deficient. 3. The lots proposed meet, and in most cases exceed, the minimum standards of the R-1 district. Lot sizes will exceed the 7,200 sq ft requirement, 'and required setbacks are observed on the lot where the existing home is located. 4. The creation of one additional home in this area will not tax the utility infrastructure nor will traffic impacts tax the road system. 5. The absence of off-site improvements in the area surrounding the subject site, coupled with the the approval of a similar waiver in the area, justifies the applicant's request. The Waiver should be granted. DECISION: • The Short Plat request is approved. The Waiver request for off-site improvements should be granted. ORDERED THIS 12th day of December, 1985. FRED J. Copies of this ordinance are available for inspection or purchase in the Finance Department, first floor of City Hall. The Appearance of Fairness Doctrine provides that no ex parte (private one-on-one) communications may occur concerning land use decisions. This means that parties to a land use decision may not communicate in private with any decision-maker concerning the proposal. Decision-makers in the land use process include both the Hearing Examiner and members of the City Council. All communications concerning the proposal must be made in public. This permits all interested parties to know the contents of the communication and would allow them to openly rebut the evidence. Any violation of this doctrine would result in the invalidation of the request by the Court. The applicant, Albert Koshko, is requesting short plat approval to divide 22,500 square feet into two lots for the construction of an additional single family residence. The property is located at 1164 Aberdeen Avenue N.E. with an existing house being located on proposed lot #2. 2. The proposal is exempt from the State Environmental Policy Act of 1971. 3. The proposal complies with the Comprehensive Plan designation of single family residential and the underlying zoning classification of R-1, Residential. 4. Lot #1 contains 10,950 square feet while proposed lot #2 contains 11,550 square feet. The residence located on proposed lot #2 is set back 42-1/2 feet from the front property line and a minimum of 5 feet from the side property lines. Thus, it complies with the setback requirements as delineated in the R-1 zone. The proposal complies with the specific lot width and depth requirements of the subdivision code and zoning ordinance. 5. The applicant's request for a waiver of off-site improvements has ,been opposed by various City departments. The Policy Development Department believes that a deferral would be more appropriate in this case. The Public Works Department believes that the improvements should be made because of the enforcement problems associated with deferrals or restrictive covenants. The Fire Department notes that the water main along Aberdeen Avenue N.E. is only a 4-inch diameter main and the main should be upgraded or the property owner should provide an agreement to participate in future improvement when necessary. Present fire flows appear adequate. The applicant argues that there are no off-site improvements in the general area, specifically including curbs, gutters and sidewalks. The Hearing Examiner has granted waivers of off-site improvements in this general area on previous short plat requests (Emmett Eaton, Short Plat-080-81). H. DEPARTMENTAL RECOMMENDATION: Based upon the above analysis, it is recommended that the short plat request, file number SH.PL.-089-85, by Albert J. Koshko be approved.
