This Office considered the appearance of prejudice in this matter and simply concluded that an applicant who creates his own hardship is not entitled to a variance. You have modified the fact situation. The Decision and language were merely to notify the applicant that the size, shape and limitations of the lot were of the applicant's choosing, and as such, were binding upon the applicant and his successors-in-interest. Obviously, if the street was condemned for City purposes, or any other act outside the control of the applicant were to affect the subject site, the facts would be different and the determination would be predicated upon those particular facts at that particular time. Obviously, in light of the concerns of some property owners in the Valley over the M-P zone setbacks on smaller lots, a warning to an applicant that creating smaller lots which must comply with these restrictive setbacks is prudent. Explaining to an applicant that a hardship related to size, shape or topography which denies one reasonable use of a parcel of property may not be available because the restricted size of the lot was knowingly requested by the applicant, was reasonable. DODD/SHORT PLAT 094-85/RECONSIDERATION REQUEST Reviewing the Hearing Examiner's decision concerning the short plating and development of Consolidated Freightways under the Harvey R. Dodd application, the decision appears clear and concise except for one point. In the case of specifically limiting the Building and Zoning Department from accepting an application for a setback variance in the future on proposed Lot #1, it appears that the Examiner is prejudging the situation without considering all,of the facts at that point in time. The best example that I can suggest is based upon the following scenario: 1. The site has been developed to City standards after site plan approval by the Hearing Examiner. 2. The site plan allowed a building to be constructed 60 feet from both S.W. 27th Street and East Valley Road. 3. The City after the building is constructed determines that S.W. 27th Street needs to be widdened to 90 feet because it has become a primary access from SR 167. 4. The City condemns 15 feet of the property. • 5. The property owner requests an expansion of the building by adding a second floor, but he can not expand because he.has lost the right to apply for a variance for setbacks. One suggestion might to place the setback requirement directly on the face of the short plat in the form of an easement. This would address the problem of full discloser to any prospective purchaser. If property was ever acquired for roadway expansion, it would not modify the setback line disclosed on the short plat. The problem with this approach is that the zoning code might change and the short plat might then be incorrect. However, there is even a greater procedural concern. Should one appear to prejudge the possible merits of a possible setback variance application before they are submitted. An outright restriction of even applying for a variance suggests a violation of due process. Hearing Examiner Decision: Short Plat, Site Plan and Conditional Use Permit are approved, subject to conditions. r, BUILDING & ZONING The Building & Zoning Department Report was DEPARTMENT REPORT: received by the Examiner on December 10, 1985. PUBLIC HEARING: After reviewing the Building and Zoning Department Report, examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: The hearing was opened on December 17, 1985, at 9:45 A.M. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. The following exhibits were entered into the record: Exhibit #1 - Yellow file containing application, proof of posting and publication and other documents pertinent to this application. Exhibit #2 - Short Plat showing 2 lots. Exhibit #3 - Site and Landscape Plan. Exhibit #4 - Elevation Map The hearing opened with Roger Blaylock, Zoning Administrator, presenting a review of the staff report advising the applicant is proposing to subdivide 4.33 acres of property into two lots, and 'seeks, approval of a conditional use permit and site plan approval for property to be utilized by Consolidated Freightways for a truck terminal. The applicant proposes to construct a tilt-up building of 5350 sq. ft., with a loading dock and office space. The northern lot of this short plat will be 283 ft. wide and 286 ft. long with the southern lot being 375 ft. in length and 281 ft. wide. Both lots meet the minimum lot size as well as setback requirements. Mr. Blaylock stated the only possible concern that may arise would be future curb cuts on the site, but it is felt there should be sufficient sight distance and enough, room for turning lanes. There is a small building on lot #2 with proposed building on' lot #1 to encompass possibly an office structure or industrial uses. Sidewalks will be required on East Valley and 27th Street as part of the short plat. Burlington Northern Railroad tracks are located directly behind the property. It was noted, with railroad traffic decreasing in the industry at this time, the railroad company has decided to sell or lease their property so as not to have the property remain unproductive and unused. Mr. Blaylock stated staff feels the short plat meets the intent of the Comprehensive Plan. Harvey R. Dodd & Associ. (Consolidated Freightways) January 3, 1985 Page 2 Continuing with a discussion of the Conditional Use request, Mr. Blaylock stated the applicant has provided justification for this proposal. He reviewed the 11 criteria to be considered for any conditional use request stating the applicant is classified as a common cargo carrier and has the need for a loading dock, all of which must be placed in and meet the necessary requirements of the appropriate zone. Mr. Blaylock stated further justification could be the fact the area has been developing large office complexes, new manufacturing plants and even an expansion of Boeing facilities which will incease the demand for commodity transportation. The design of East Valley Road is sufficient to meet the needs of truck traffic and provides easy access to the freeway, with no impact from this proposal anticipated. It was pointed out the addition of a street light should prove to have no intrusion into the residential area. The timing of this proposal seems appropriate. The report continued with Mr. Blaylock reviewing the criteria to be considered for approval of a site plan, such as compatibality of adjacent structures; compliance with the Comprehensive Plan and Zoning Code; access; functionality of the parking lot; and traffic and pedestrian circulation. A brief discussion was held regarding the platting of.corner lots (lot #1) which are to be platted wider than interior lots (lot #2), considering the possible turning radius and access functions that will be necessary for development of lot #1. It was pointed out there is no definitive width for platting corner lots in the city code, and it was suggested that possibly something in the code could be changed to more clearly define this process. It was also suggested that the record on this matter be held open for three more days to enable the Public Works Department and the Building Department to submit to the Hearing Examiner their comments on this matter. Continuing, the Zoning Administrator stated the building, one story in height, will be compatible with the other manufacturing park uses in the area; a concrete fence for security will be constructed in front of the building to separate the public area and the public parking area from the security area, with a chain link fence continuing to the. rear of the property; the 9 ft. of landscaping is not to include the 6" curbing thereby making a 40 ft. driveway for access by the trucks, providing 122-153 ft. for maneuvering on-site; and there is public parking on-site which meets the requirements of the code. Continuing, it was pointed out sidewalks will be required along the front of the site, with a small area in the front being • provided for employees wanting to get away from the office. The light standard that is to be provided may have to be moved to the south to further widen the driveway and provide for better access and maneuverability by the trucks. With the. above information provided, the Zoning Administrator recommended approval of the above three requests. The Hearing Examiner called for testimony in support of this application from the applicant or their representative. Responding for the applicant was: Arnold Lorvick 2000 Fairview Avenue East . Seattle, Washington, 98102 Mr. Lorvick took no objection to the recommendations made by staff, but wanted to comment on the, short plat for lot #1. He stated he concurred with the information presented and stated the 300 ft. provided on lot #1 should be adequate to develop that lot without any concern regarding access. He advised Consolidated Freightways is purchasing lot #2 from Burlington Northern and lot #1 will remain with the railroad company. He had no further comments. Wishing to testify further in support of this proposal was: Lee Van Pevenage 200 S.W. 34th Renton, Wa. 98055 Mr. Van Pevenage is the Terminal Manager for Consolidated Freightways and briefly reviewed the functions of the company and plans for this facility. The aesthetics are very important to this company, and Mr. Van Pevenage re-emphasised that they are audited periodically for cleanliness of surroundings as well as their equipment. He stated they choose to be aesthetically compatible with the surrounding neighbors and wish to present a pleasing appearance to the general public. When asked if they would be agreeable to the movement of the street light standard further south to enable them to widen the driveway for trucks, Mr. Van Pevenage stated it would be no problem for the applicant to accomplish. This new facility will replace the present Consolidated Freightway facility on 34th in Renton. At this point the Hearing Examiner stated his continued concern as to the platting of lot #1, and stated he will hold the record open until December 20, 1985 at 5:00 P.M. for further information from the Building and Public Works Departments. • Harvey R. There were no further comments from the applicant's representative or staff. The hearing closed at 10:45 A.M. FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: 1. The applicant, Harvey R. Dodd & Associates, Inc., has requested approval of a 2 lot short plat, together with a conditional use permit and site approval for a truck terminal on one of the resultant lots. 2. The application file containing the application, the State Environmental Policy Act (SEPA) documentation, the Building and Zoning Department Report, and other pertinent documents was entered in the record as Exhibit #1. 3. Pursuant to the City of Renton's Environmental Ordinance and SEPA (RCW 43.2IC, 1971, as amended), a Declaration of Non-Significance has been issued for the subject proposal by the Environmental Review Committee (ERC), the responsible official. 4. Plans for the proposal have been reviewed by all City departments affected by the impact of this proposal. 5. There was no opposition to the subject proposal from any member of the public. 6. The subject site is located on the west side of the 2800 block of the East Valley Road. 7. The subject site is zoned M-P (Manufacturing Park) a classification it received by the adoption of Ordinance 2533 in December, 1964. V 8. The subject site was annexed into the City by the adoption of Ordinance 1745 in April, 1959, as amended by Ordinances 1764 and 1928 adopted in May, 1959 and December, 1961 respectively. The site was automatically zoned G-1 (General; Single Family Residential; Minimum lot size -.35,000 sq ft) upon.annexation. 9. Resolution 2254 adopted in March, 1979 created the plat of which the subject site was one lot. More than 5 years have passed and lots in the original division may be freely short platted subject to other requirements. 10. The subject site is approximately 4.33 acres in size, and is located on the corner of East Valley and S.W. 27th Street. The lot is approximately 671.51 feet long and approximately 281.25 feet deep. 11. The proposed short plat would create Lots A and B. Lot A would be approximately 2.42 acres on a 375 by 281 foot lot. Lot B would be approximately 1.91 acres on an approximately 287 by approximately 281 foot lot. Proposed Lot B, a corner lot, would be platted narrower than proposed Lot A. 12. The area contains a mix of uses including light: industrial uses, warehousing and manufacturing park uses. Undeveloped land also surrounds the subject site. 13. The map element of the Comprehensive Plan designates the area in which the subject site is located as suitable for the development of manufacturing park/multiple option uses, but does not mandate such development without consideration of other policies of the plan. 14. The applicant proposes constructing an approximately 5,350 sq ft office/warehouse building on the.center of proposed Lot A, the southerly lot. The 50 foot wide by approximately 103 foot long building will be a concrete tilt-up building with entry on the east and loading bay doors located along the north and south sides of the building. V 15. Extending off the front wall will be two concrete tilt-up fence-like structures which will have the architectural effect of extending the building's facade approximately 100 feet in each direction. All truck .loading and unloading will occur behind the facade. From the street (East 'Valley Road) none of the truck operations will be visible. Harvey R. Landscaping will be planted along the front wall, and across from the entry a widened lawn with landscaping will soften the facade. 17. The building will be approximately 28 feet in height. 18. A street light standard is located immediately adjacent to the proposed northern driveway. Public Works indicates that the standard should be relocated to a less vulnerable location away from entering truck manuevers. 19. Section 9-1108(24)(E)(1)(d) requires corner lots to be platted wider than interior lots, further subject to the determination of the Building Department. 20. Conditional Use Permits are required to establish truck terminal facilities in the M-P zone (Section 4-730.020(6). Site Plans are required of all uses in the M-P zone. CONCLUSIONS Short Plat 1. The proposed short plat generally appears to serve the public use and interest. Although the Building and Zoning Department determined that the size of the corner lot is sufficient to permit reasonable development, the provision which indicates that corner lots shall be platted larger than interior lots, subject to the determination of the Building Department, needs further exploration by the City Council. The provision seems at cross purposes with itself and merely leads to confusion. The applicant in the instant case should not be punished by the strict interpretation of the provision, but it should be clarified for future cases, as language containing the word 'shall' normally would limit further discretion. 2. The Building Department has indicated that the 'two lots will each provide useable acreage to permit development, and this is obviously the case for proposed Lot A for which specific development plans have been submitted. 3. The size of proposed Lot B, a two acre corner lot which requires extensive setbacks ' along two (2) frontages, was determined by both the applicant and the Building and Zoning Department to be sufficient to enable successful development. As the applicant has requested the division in this fashion, it will be up to the applicant to provide a user who can utilize the proposed lot. No variances from the setback requirement will be available as the limitations of the lot, if there are any, are the creations of the applicant. Conditional Use Permit 4. The applicant for a conditional use permit must demonstrate that the request is in the public interest, wi11 not impair the public health, safety and welfare and in addition, is in compliance with the criteria found in Section 4-748(C) which provides in part that: a. The proposal generally conforms with the Comprehensive Plan; b. There is a general community need for the proposed use at the proposed location; c. There will be no undue impacts on adjacent property; d. The proposed use is compatible in scale with the adjacent residential uses, if any; e. Parking will not occur in required side yards and that traffic movement and circulation will be safe; f. Noise, light and glare will not be adverse; g. Landscaping shall be sufficient to buffer the use; h. Adequate public services are available and will not be burdened by the proposal. The proposal generally conforms with the Comprehensive Plan which calls for manufacturing park and supporting facilities in the Green River Valley. The use will observe the required setbacks indicated in the Comprehensive Plan for this area. ' 6. There is a general need for the proposed use in this location. The :use will permit the breaking down of larger shipments into smaller constituent parts for distribution in and around the Valley. 7. The one story structure should not have any untoward affects on adjacent property, and it appears compatible in scale with the adjacent uses. 8. The recent LID road improvements along East Valley should reasonably accommodate the traffic the proposed use will generate. The relocation of the street light standard should assure that circulation into the site will be safe. While larger trucks will frequent the site, the proposed use will generate less vehicle trips per day than would an office use. 9. There should not be any particular problem with noise, light and glare. 10. The proposed landscaping will be sufficient to buffer the use and soften the facade. The entry will have larger landscape plantings to break up the parking lot. While only ten feet of frontage landscaping is required, the applicant is providing 15 feet. 11. Adequate public services are available and will not be burdened by the proposal. Site Plan 12. While similar to the analysis for a conditional use permit, site plan review places additional emphasis on site amenities both from the community standpoint and from the employee standpoint. The site plan, while relatively utilitarian, (it is after all a truck terminal), appears to be interestingly designed. 13. The false front will present an appearance similar to the other low rise facilities in the area. The landscaping will soften the affect and landscaping along the frontage will add to the affect. 14. It is not necessarily easy to provide pedestrian and employee amenities, at a truck terminal, but the area across from the entry could provide such a location by adding a couple of benches. 15. The plan requires a sidewalk across the frontage. 16. Manuevering appears to, be confined on the subject site with more than sufficient space to move and locate the large trucks. While 95 feet is recommended as a minimum, the applicant provides areas of 122 feet and 153 feet. DECISION The Short Plat is approved with the understanding that variances from the setbacks will not be available, and will be subject to the installation of standard off-site improvements. The Condition Use Permit is approved. The Site Plan is approved subject to the relocation of the street light standard (or the driveway as long as it remains conforming) subject to the approval of the Public Works Department. The Appearance of Fairness Doctrine provides that no ex parte (private one-on-one) communications may occur concerning land use decisions. This means that parties to a land use decision may not communicate in private with any decision-maker concerning the proposal. Decision-makers in the land use process include both the Hearing Examiner and members of the City Council. All communications concerning the proposal must be made in public. This permits all interested parties to know the contents of the communication and would allow them to openly rebut the evidence. Any violation of this doctrine would result in the invalidation of the request by the Court. SHINPOCH MAYOR MEMORANDUM DATE: December 20, 1985 TO: Fred Kaufman, Hearing Examiner FROM: ;, Roger Blaylock, Zoning Administrator SUBJECT: ' H/ arvey Dodd Associates Short Plat-094-85/Additional Position Statement During the public hearing on Tuesday, December 17th, the Hearing Examiner raised the issue of compliance of the short plat proposal with Section 9-1108(24)(E)(d). As observed by the Examiner, proposed lot B, the corner lot, will not be platted wider than the interior lots, proposed lot A, as determined. However, the Building and Zoning Department points to intent of the section, which is stated in Section 9-1108(24)(E). "The size, shape and orientation of lots shall meet the minimum area and width requirements of the applicable zoing classification and shall be appropriate for the type of development and use contemplated. (emphasis added). The subject short plat is zoned MP, Manufacturing Park, and specifically designated by the Comprehensive Plan for industrial or office uses. Prior to the recent modification of the MP Zone there were no minimum area or dimensional standards. If there were no standards then a lot 75 feet wide could be determined to be acceptable when an adjacent interior lot was 74 feet. This concept could be carried further by stating that if a 30 foot interior lot was created then a 31 foot corner lot would be accept and met the specificity of the code section. The new MP Zone established a minimum lot area of 35,000 square feet, but it did not set lot dimensions. Applying the the minimum lot area to this specific situation the minimum interior lot would 125 feet wide. Therefore, if a proposal had been made to create four (4) lots, three of them being 125 feet wide and the corner lot being 296 feet, it would have complied. The detail of the law would have been met, but not the intent. To determine intent the total situation has to be evaluated. Is the size, shape, and orientation of the proposed lot as proposed (ie. lot area and width) appropriate for the type of development and use contemplated? Memoradum to Fred Kaufe. _. Harvey Dodd/Sh.P1.-094-85 December 20, 1985 page 2 The Building and Zoning Department contents that this specific provision must be tempered by the intent of the Comprehensive Plan designation of Manufacturing Park/Multiple Office and MP, Manufacturing Park Zone. ' Again what criteria to use? The Zoning Administrator suggested that the actual lot size is a result of accessibility in industrial zones. Basically, what is functionality of the proposed lot based on critical design features. Both S.W. 27th Street and East Valley Highway are critical transportation corridors. Any impact upon the operation of the intersection of these streets creates an adverse environmental impact upon the funtion of these streets to the general public. In the Traffic Engineering Division response to the Zoning Administrator, they state that the lot is functional if driveway access is limited on proposed lot B for a distance of 125 feet west of the intersection on S.W. 27th Street and 250 feet south of the intersection on East Valley Highway. An industrial curb cut would be 40 feet in width; therefore, 290 feet is the minimum frontage that proposed lot B should have on East Valley Highway. The lot as proposed is acceptable to the Building and Zoning Department based upon the intent of the code section. We recommend that the Examiner reach the same conclusion based upon the application of the specific code section in light of the intent of the Manufacturing park nature of the subject site. Lot B has 281 feet of frontage on S.W. 27th Street and 296.5 feet of frontage on East Valley Highway. Because both of these streets are designated arterials, there was concern that Parcel B could be developed and still maintain the safety issue of turning movements at this intersection. The driveway off a collector roadway should be a minimum of 125 feet from the intersection. SW 27th Street could be classified as a collector at the present time. G. DEPARTMENT ANALYSIS: 1. The applicant, Harvey R. Dodd & Associates, Inc., representing Consolidated Freightways, is requesting the following three land use approvals: a. Conditional Use Permit to allow the location of a truck terminal facility in,the M-P, Manufacturing Park Zone. b. Short Plat approval to divide 2.42 acres of property into two lots. c. Site Plan Approval to allow the construction of a 5,350 square foot tilt-up concrete building with enclosed office space for the location of the truck terminal facility and associated warehouse. The analysis is divided into three parts addressing the specific criteria for each of the land use reviews requested. 2. The Environmental Review Committee has issued a declaration of non-significance. The appeal date will expire at 5 p.m. on Monday, December 16, 1985. CONDITIONAL USE 3. The proposed use of the site by Consolidated Freightways meets the definition intent of a truck terminal as outlined under Section 4-702(T)(4). Consolidated Freightways is a common carrier, which utilizes a dispatcher to direct the receipt, pick-up and delivery of orders placed by customers and for the storage of rolling stock of the common carrier. Therefore, the proposal is a truck terminal and has to comply with the criteria as outlined under Section 4-748. 4. The proposal as submitted complies with the 11 conditional use criteria as enumerated in Section 4-748. The Comprehensive Plan has clearly identified this area as an industrial area and the purpose of providing a transportation link to the industrial users is appropriate according to the Comprehensive Plan and zoning code. The community need is established as a result of increased demand in the general area and its location. There are other common carriers within the area and creates a strong competitive operation between those enterprises. This does not appear to result in any detrimental over-concentration of a particular use when viewed as part of the total development of the industrial area. The site itself is well suited because it PRELIMINARY REPORTOTHE HEARING EXAMINER HARVEY R. DODD & ASSOCIATES, INC. DECEMBER 17, 1985 PAGE 3 has easy access to a major arterial which has direct access into the freeway system. Lot coverage yards and the height of structures will all conform with the requirements of the zone and do not appear to be intrusive into the area. In general, the project is compatible as a.result of the setbacks and landscaping that the proponents have proposed. There will be no accessory uses or conversions of existing structures on the site so those criteria will not apply. The public improvements recently completed on East Valley Road provide an ease of access and traffic flow to and from the site which makes the site perfect for the intended truck terminal. All public facilities have been installed including sewer, water and storm drainage to the site. SHORT PLAT 5. The applicant proposes short platting the 4.33 acres into two lots. The 2.42 acre site will be utilized for the truck terminal by Consolidated Freightways. The dimensions of each of the lots complies with the minimum requirements of the M-P zoning classification and the subdivision code. All public improvements except the sidewalks were installed as part of the previous plat of Orillia Industrial Park or L.I.D. for East Valley Highway. 6. The original Orillia Industrial plat proposed extremely large lots, generally in excess of 4 acres, to facilitate the construction of manufacturing and warehouse facilities that relied upon heavy rail access. The marketplace has changed during the last five years to smaller scale manufacturing and office uses. Thus, there is a need for smaller parcels to be developed in the industrial areas. The short plat request provides that need. SITE APPROVAL 7. In the review of the site plan, the staff and the Hearing Examiner should normally consider the following criteria: • Compatibility of Adjacent Structures • Compliance with the Comprehensive Plan and Zoning Code • Access • Functionality of Parking Lot • Traffic Circulation • Pedestrian Circulation • Usable Public Open Space Compatibility of Adjacent Structures: The lots adjacent to the southwest and north are all vacant. General development in the area has been principally tilt-up concrete buildings occupied by manufacturing operations such as Mystic Company, Superior Fast Freight, and Garfield Transfer. The proposed structure will be constructed of tilt-up concrete with a maximum height of approximately 20 feet. A tilt-up concrete fence is also utilized for security • with chain link gates to allow observation of the operations yards. This structure is compatible with the other tilt-up concrete buildings in the area. Compliance with the Comprehensive Plan and Zoning Code: The proposed industrial development follows the basic intent of the Comprehensive Plan and its land use designation of Manufacturing Park/Multiple Option. The design requirements of the M-P Manufacturing Park zoning classification have been complied within the site design, except for the side ,yard landscaping requirement. This can be easily corrected. Access: Access is provided directly off of East Valley Highway which has been recently upgraded for industrial truck traffic. A middle turn lane is provided along 'with slightly wider lanes than the normal arterial for the movement of trucks. The site shows two direct access points. The southern access is appropriately designed for truck maneuvering. The northern access way is not. The problem is the location of an existing street light. It precludes, the proper turning radius on the south side of the northern curb cut. PRELIMINARY REPORT•THE HEARING EXAMINER 4? HARVEY R. DODD & ASSOCIATES, INC. DECEMBER 17, 1985 PAGE 4 The Public Works Department has commented that the access should be moved at least 10 feet from the light standard. There are two other alternatives. The first would be to move the light standard so the proper turning radius could be established. The second would be to move the proposed property line approximately 10 feet tol the north and enlarge the subject site by 2,810 square feet or approximately r.064 acres. Functionality of the Parking Lot: The parking lot is not as critical in a truck terminal as the functioning of the maneuvering space adjacent to the proposed dock area. The applicants have shown at least 122 feet of maneuvering space on the south side of the dock and 153 feet on the north side. The dock functions as a break in product transfer area and a reconsolidation area. Trucks are backed into both sides and the goods they are shipping are shuffled and reloaded for appropriate delivery. Both of these dimensions appear more than adequate to meet the demands of present day semi-trucks. Approximately 95 feet Is recommended to be available for the backing and maneuvering of those trucks. Parking has been provided for the rolling stock within the security fenced area, while the parking for the office users and clients has been provided on the east side of the building outside of the security area. A total of 27 parking spaces have been provided. Only 11 parking spaces are required for the proposed warehousing and office space per City code.. It is anticipated that this eastern parking lot would be utilized by some of the truck drivers that are stationed out of the facility. Traffic Circulation: Onsite traffic circulation clearly meets the needs and the present accepted industry standards for onsite maneuvering. Pedestrian Circulation: The site plan does not provide any pedestrian circulation in the security area. The site plan also does not show the required concrete sidewalk that will need to be extended across the frontage of the subject site as a requirement of-the short plat. Usable Public Open Space: The site plan does not provide any true outdoor open space for the use of the employees. However, it should be pointed out that in this type of operation, the truck drivers will be away from the site generally during most of the day. The office workers would be the only employees that will be utilizing the outdoor space and it does not seem as critical as in cases where we have large numbers of concentrated office workers. There is sufficient space out in front of the main entrance to place a few benches and tables within the 20-foot landscaped area. 8. Various City departments have reviewed the subject proposal. Design Engineering and Traffic Engineering are the only divisions that have not • recommended outright approval. The following are their comments: e Design Engineering: 1. Offsite improvements and storm water retention required as part of short plat. 2. Correct dimension that is incorrect on short plat. 3. Show onsite drainage, detention. 4. Provide temporary erosion control plan. 5. Driveways to be per City code standard plans for commercial driveway. 6. Sidewalk required on west side of East Valley Highway. Northerly driveway edge to be 10 feet from existing street light standard. 2. Driveway to be installed per City standards. 3. Off-street improvement -- missing sidewalk. H. DEPARTMENTAL RECOMMENDATION: Based upon the above analysis,.it is recommended that the short plat request by Harvey Dodd & Associates, Inc., file number Short Plat-094-85, be approved subject to the installation of concrete sidewalk per City standards along East Valley Highway and S.W. 27th Street. It is recommended that the conditional use permit request for Consolidated Freightways represented by Harvey Dodd & Associates, Inc., file number CU-093-85, be approved. It is recommended that the site plan approval request by Consolidated Freightways represented by Harvey Dodd & Associates, Inc., file number SA-095-85, be approved subject to the following conditions: 1. Relocation of the existing light standard on the south side of the proposed northern entrance to the south to allow redesign of the northern access to City standards. 2. Redesign and construction of the northern access to City standards. 3. Installation of an outdoor seating/eating area for the employees within the landscaped area adjacent to the main entrance. 4. This area is zoned M-P, and the Truck Terminal is listed as a Conditional Use. This use is consistent with other sites in the general area. b. The site will be used as a transfer dock used to distribute merchandise in the local Renton area which is required by other businesses. c. The adjacent property is vacant, but the proposed use should not have an adverse affect on any use permitted in the M-P zone. fib) d. The adjacent areas are all used for industrial or manufacturing uses which are compatible. e. Automobile parking will be provided in the 60-foot front setback, and the area will be landscaped to soften the effect of the parking. f. Separate entrance and exit driveways are provided for the trucks to mitigate potential traffic problems. g. The main noise from the operation is the trucks entering and leaving the site, which will occur during normal working hours. The yard lighting will be directed downward. h. Landscaping is being provided at the front, at the side yards in the front setback, and within the automobile parking areas. k. The site is presently served by a improved street and all the required utilities are available at the site. The project will not have a large demand for any services.
