The Planning and Development Committee met twice on this topic. City ordinance permits deferral of certain on and off site improvements for single family short plats. The subject short plat is multi-family (R-2) , located on Monroe NE. However, because of topography and distance to certain utilities, circumstances are' unique and the Committee finds that it would constitute a hardship for the owner to install the improvements 400 ' beyond subject property to connect to the storm sewer or to bond for those improvements at this time. There are no current development plans for this property. The Planning and Development Committee, therefore, recommends that, because of the unique circumstances, the subject short plat be permitted deferral of improvements as outlined in City Code Section 9-1108. 21.H for R-1 property. PROCLAMATION A proclamation by Mayor Shinpoch declared April 5 through 11, 1987, as Building Safety Week Building Safety Week in Renton, to honor the untiring efforts of state and local building officials and their cooperative relationship with the construction industry in assuring administration and enforcement of health and safety regulations for the benefit of the public. MOVED BY TRIMM, SECONDED BY CLYMER, COUNCIL CONCUR IN THE PROCLAMATION. CARRIED. SPECIAL Personnel Director John McFarland reported that as a result of the employee PRESENTATION safety incentive program instituted last year, the City has experienced a 73% Personnel: 1986 Employee reduction in monetary loss from employee accidents and a 35% reduction in Safety Award actual reported accidents. In view of the hazardous nature of their work, he was particularly pleased to present the 1986 employee safety award to the Fire Department for achieving the most improved safety record with a reduction in lost time from 105 days to one day. Mayor Shinpoch thanked Mr. McFarland for successfully implementing the safety program, and presented Fire Chief Lee Wheeler and Fire Captain Greg Bergquist with two trophies, a permanent plaque to be displayed in the department and a traveling trophy which will be passed on to subsequent honorees. On behalf of the entire Fire Department, Chief Wheeler expressed appreciation for the award, and credited the safety incentive program for the improvement demonstrated by employees. Special thanks were extended to Mayor Shinpoch and Council members for their concern with safety and well-being of employees by approving mid-year request to replace outdated protective clothing for firefighters. Captain Bergquist, safety team leader, indicated that the safety program created an atmosphere in which employees could discuss safety problems and reduce the chance for accidents to occur. Councilwoman Mathews also noted that the various safety and health awareness programs promoted by the City, including the Vital Signs publication, have contributed to the success of the City's self-insurance plan. AUDIENCE COMMENT Ray Brown, 1309 Monroe Avenue NE, Renton, asked the City Council to Citizen Comment Brown override the Board of Public Works and grant deferral of off-site - Deferral of Off-Site improvements for Short Plat 002-86, same address. He advised that a waiver Improvements, Short Plat requested concurrently with the short plat was denied by the Hearing 002 86 Examiner on February 12, 1986. Following denial of subsequent request for deferral to the Board of Public Works, an administrative appeal, File No. AAD-026-86, was filed with the Hearing Examiner. The Examiner determined that neither his office nor the Board of Public Works had the authority to grant a waiver of the required improvements; however, a deferral I j April 6. 1987 Renton City Council Minutes Page 116 could be authorized by the Board subject to bonding. Mr. Brown felt that the required $36,000 bond was unreasonable in view of estimated cost of improvements of.$24,000 and lot value of $30,000. He also pointed out that if improvements were installed at this time, street and sidewalk grades would not match existing grades; and instead offered to sign restrictive covenants agreeing to participate in any future LID in the area. Following discussion regarding avenues available to Mr. Brown, it was MOVED BY TRIMM, SECONDED BY CLYMER, THE SUBJECT MATTER OF OFF-SITE IMPROVEMENTS, WAIVERS AND DEFERRALS BE REFERRED TO THE PLANNING AND DEVELOPMENT COMMITTEE. It was noted that by reference, the motion includes review of costs associated with bonding and letters of credit. MOTION CARRIED. Mayor Shinpoch warned Mr. Brown that regardless of the motion, he is still obligated to comply with appeal time limits established for his deferral request. ' Citizen Comment: Carson Franklin G. Carson, 1737 Lake Avenue South, Renton, inquired regarding - Environmentally status of the proposed Environmentally Sensitive Areas (ESA) Ordinance. Sensitive Areas Ordinance Mayor Shinpoch anticipated that following adoption of associated legislation by the City Council, the Planning Commission will begin holding public hearings on the proposed ESA Ordinance by mid-July. Mr. Carson requested that all affected residents be notified of hearings. Citizen Comment Carson Secondly, Mr. Carson requested that legislation be adopted by the City - Pressure Brakes Council prohibiting large trucks from using "jake" or pressure brakes to gear down on steep grades since the noise disturbs residents' sleep. He relayed information obtained from the Washington State Patrol that if legislation is passed by the City Council prohibiting this practice, the State Patrol will post signs and enforce the law. MOVED BY REED, SECONDED BY STREDICKE, COUNCIL REFER THIS MATTER TO THE TRANSPORTATION COMMITTEE. CARRIED. Citizen Comment Carson On the matter of garbage rates, Mr. Carson questioned whether the City - Garbage Rates would consider eliminating the mandatory collection requirement for each residence. Mayor Shinpoch advised that to obtain affordable rates from the contractor, each household in the City must be obligated for service. Councilwoman Mathews also pointed out that the City is able to offer reduced rates to senior citizens by having a guaranteed number of rate payers to absorb those costs; and the potential for health hazard in some neighborhoods would be increased since not all residents would dispose of their garbage. Exhibit #2 - Short Plat Map. Exhibit #3 - Letter of February 3, 1986 expressing concern over adequate fire protection and waiver of off-site improvements. Presenting a review of the staff report for the Examiner and those in attendance was Roger Blaylock, Zoning Administrator. He stated the applicant is seeking approval to subdivide an approximate one-half acre site into two lots with off-site improvements to be waived. Existing zoning on the subject site is R-2, established in 1968, and there is a single family home located on the southern portion of the subject site. Since that time there have been no other short plat divisions in the area. Utilities are provided to the site, curbs, gutters and sidewalks are located north of this low-key residential area, and there does not appear to be much potential for future subdivision or redevelopment of the immediate area. The Fire Department has noted the fire main and hydrants are substandard and will have to be upgraded prior to construction on the site. Staff comments were reviewed with the Policy Development Department recommending that off-site improvements not be waived but suggesting the applicant seek a deferral through the Board of Public Works; and the Zoning Division commenting they felt there was no justification to waive said improvements. Mr. Blaylock continued stating the 8 inch water main will have to be extended for approximately 450 ft to provide adequate fire flow to the site. He advised Monroe is being improved up to 12th Avenue in the vicinity of the site so there is no problem with additional right-of-way, and the only reason there could be a land use issue is due to the fact this is the first redevelopment in the neighborhood for the past 20 years. Mr. Blaylock recommended approval of the Short Plat and Waiver of off-site improvements, stating the application meets with the goals and policies of the Comprehensive Plan, Subdivision Ordinance and Zoning Codes. ' Ray Brown SP-006-86 and W-003-86 February 12, 1986 Page 2 Calling for testimony in support of this application from the applicant or his representative, responding was: Ray Brown 1309 Monroe Avenue N.E. Renton, Wa. 98056 Mr. Brown acknowledged his agreement with the recommendation presented by Mr. Blaylock and stated he is willing to cooperate with the City on this proposal. He said he has owned the property for the past 37 years, and watched all of the other large lots become divided over the years, with only 2 remaining to be subdivided. He said there are 13 homes on his street, and a total of 7 rentals. He said he is agreeable to extending the water line to provide proper fire flow. Calling for further testimony, there was no one wishing to speak in opposition, but wishing to comment on this proposal were Ms. Pat Johnson-Rasmussen, 1300 Monroe N.E., Renton, 98056 and Mr. Eugene Methven, 1316 Monroe N.E., Renton, 98056. These property owners expressed concern over such matters as the provision of proper fire protection to their area with the addition of new residences and the waiver of the off-site improvements. At this time Exhibit #3 was entered into the record. Ms. Rasmussen felt the waiver of off-site improvements may set a precedent for future developments, and felt they should be provided for youngsters in the area as well as persons that 'walk' in the neighborhood. Mr. Methven questioned the ramifications of waiving the improvements with emphasis on future fire protection. He stated the present 4" water main will not be • able to accommodate many more residences, but noted so far there is no problem with the water pressure. He stated he and the neighbors would like to keep the view they now enjoy and requested a height limit be set to protect this view. Mr. Brown spoke again stating he felt he should not be singled out to put in all the improvements as there are none in the immediate area now. He stated he would be willing to participate in a future LID. He said there would be no loss of view with his proposed buildings, and could see no traffic impacts due to this proposal. He asked that the application be approved as recommended by staff. FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: 1. The applicant, Ray Brown, has requested approval of a 2 lot Short Plat together with a requested Waiver of required off-site improvements. 2. The application file containing the application, the State Environmental Policy Act (SEPA) documentation, the Building and Zoning Department Report, and other pertinent documents was entered in the record as Exhibit #1. 3. Pursuant to the City of Renton's Environmental Ordinance and SEPA (RCW 43.21C, 1971, as amended), a Declaration of Non-Significance has been issued for the subject proposal by the Environmental Review Committee (ERC), the responsible official. 4. Plans for the proposal have been reviewed by all City departments affected by the impact of this proposal. 5. The subject site is located at 1309 Monroe Avenue N.E., about one block south of Monroe's intersection with Sunset Boulevard N.E. 6. The subject site is on the west side of Monroe. The rear property line (west) abuts commercial development along Sunset. 7. The subject site was annexed into the City by the adoption of Ordinance 1490. The site was rezoned to its current R-2 (Duplex Residential) zoning by the adoption of Ordinance 2403 in May, 1968. 8. The map element of the Comprehensive Plan designates the area in which the subject site is located as suitable for the development of low density multi-family uses, but does not mandate such development without consideration of other policies of the Plan. A single family home is located on the southern half of the subject site approximately 10 feet from the southern property line, and 60 feet from the front (eastern) property line. 10. The applicant proposes dividing the subject parcel into 2 lots, Lots A and B. Lot A would contain the existing residence, would be the southerly lot, and would be approximately 148 feet deep by approximately 90 feet wide. Lot B would be the northern lot, would be vacant and would be approximately 148 feet deep and 60 feet wide. Lot A would contain approximately 13,491 square feet while Lot B would contain approximately 8,912 square feet. 11. Neighbors want to assure adequate fire protection and want the installation of off-site improvements. While much of the block does not have improvements, some have been installed at the north end of the block. Staff reports that other lots along the west side of Monroe may be candidates for further subdivision and development in this small R-2 zone. 12. Staff consensus recommends against the requested waiver. CONCLUSIONS 1. The proposed Short Plat appears to serve the public use and interest. The development will permit infilling in an area with an adequate infrastructure. 2. The development of additional low density multi-family housing will provide additional housing opportunities in the City and a wider range of choices in housing types. 3. The area, already zoned for duplex-type development, is close to the urban retail services provided by Sunset Boulevard's retail development just west of the subject site. 4. The lots both exceed the minimum size required and the lot dimensions comply with the minimum standards. The existing home complies with the required setbacks. 5. While the immediate area in front of the subject site does not contain off-site improvements, such improvements have been installed north of the site. There is the potential for additional subdivsions along the block frontage, and duplex residential development of the site will increase the flow of cars and pedestrians on the block. Off-site improvements should be installed. The Waiver is not justified. • 6. The site will have to be provided with minimum fire flow regardless of the other improvements required. This permits all interested parties to know the contents of the communication and would allow them to openly rebut the evidence. Any violation of this doctrine would result in the invalidation of the request by the Court. The Doctrine applies not only to the initial public hearing but to all Requests for Reconsideration as well as Appeals to the City Council. For purposes of these decisions and recommendations the terms "Should" and "Shall" are to be considered mandatory. The term "May" will be considered discretionary. G. DEPARTMENT ANALYSIS: 1. The applicant, Ray Brown, is requesting approval of a short plat of 0.51 acre of property into two residential lots and an approval of a waiver of off-site improvements. The property is located at 1309 Monroe Avenue N.E. 2. The proposal complies with the Comprehensive Plan designation of low density multiple family and the R-2 Residential-Two Family zoning designation. 3. The proposal is exempt from the State Environmental Policy Act of 1971. 4. Various City departments have reviewed the proposal to short plat. Their combined comments are as follows: • Police Department: Approved. January 17, 1986 • Parks and Recreation Department: Approved. January 21, 1986 • Fire Department: Approved with conditions. Present fire main and hydrants are substandard. Water main and fire hydrants shall be upgraded to provide required fire flow prior to construction on these lots; other offsite improvements could be waived at this time. January 23, 1986 • Zoning Division: Approved. Short plat -- approved recommended. Waiver -- no justification is shown by applicant to waive offsite improvements_ January 10, 1986 • Building Division: Approved. January 21, 1986 • Utility Engineering: Not approved. Needs water plan. System development charge -- water/$170 each unit. System development charge -- sewer/$175 each unit. 5. The issues raised by the various City departments focus primarily on the problem of the waiver of offsite improvements. The problem of adequate fire flow with only an existing 4 inch water main is one of public safety and should be required to be upgraded at this time. It appears that approximately 450 feet of an 8 inch water line would have to be extended to provide adequate fire flow to the subject site. There does not appear to be any other offsite improvements such as curbs, gutters or sidewalks in the area nor does there appear to be the potential for further subdivision or redevelopment of the area. Thus, it does appear there are grounds for the waiver to be approved. 6. In conclusion the short plat request appears appropriate based upon the intent of the Comprehensive Plan and the specific requirements of both the subdivision and zoning codes. The waiver appears appropriate since there are no other visible public improvements in the area and the introduction of those at this time would appear unappropriate and unnecessary for the general demand of the ultimate development of the site. H.
