Pre-Collision Driver 2 stated that he was on Aberdeen Ave NE facing North in the #1 lane preparing to perform a lefthand turn to proceed West on NE 27th St. Driver 1 stated that she was in the #1 lane of Westbound NE 27th St approaching Aberdeen Ave NE. This intersection is a 4-way stop. Collision Driver 2 stated that Unit 1 did not stop at the posted stop sign and proceeded to enter the intersection while he was in the midst of his lefthand turn. Driver 1 was nearly clear of the intersection when this collision occurred as evident by the debris that was present in the roadway. Driver 2 stated that the front drivers side bumper of Unit 1 collided with the front passenger side bumper of Unit 2. Driver 1 stated that she did come to a full and complete stop and that Unit 2 entered the intersection without stopping at the posted stop sign. Driver 1 stated that the front drivers side bumper of Unit 1 collided with the front passenger side bumper of Unit 2. Based on the area of debris and location of the collision, Unit 2 was nearly clear of the entire intersection when the collision occurred. Injuries None reported. Vehicle Disposition Both vehicles were operational. Proximate Cause I determined that Driver 1 is the proximate cause of this collision because except when directed to proceed by a duly authorized flagger, or a police officer, or a firefighter vested by law with authority to direct, control, or regulate traffic, every driver of a vehicle approaching a stop sign shall stop except as provided in (b) of this subsection at a clearly marked stop line, but if none, before entering a marked crosswalk on the near side of the intersection or, if none, then at the point nearest the intersecting roadway where the driver has a view of approaching traffic on the intersecting roadway before entering the roadway, and after having stopped shall yield the right-of-way to any vehicle in the intersection or approaching on another roadway so closely as to constitute an immediate hazard during the time when such driver is moving across or within the intersection or junction of roadways. Had Driver 1 yielded to Unit 2, which constituted an immediate hazard as he was still within and nearly clear of the intersection, this collision would not have happened. Driver 1 was cited per RCW 46.61.190 1 certify (declare) under penalty of perjury under the laws of the State of Washington that the foregoing is true and correct. Electronically signed by Officer C.
