SUMMARY OF REQUEST: Approval to subdivide 0.76 acre of property into four
(4) single family residential lots and approval for a
waiver of required off-site street improvements.
SUMMARY OF ACTION: Building and Zoning Department Recommendation:
Approval

BUILDING & ZONING The Building & Zoning Department Report was
DEPARTMENT REPORT: received by the Examiner on March 4, 1986.
PUBLIC HEARING: After reviewing the Building and Zoning Department
Report, examining available information on file with
the application, and field checking the property and
surrounding area, the Examiner conducted a public
hearing on the subject as follows:
The hearing was opened on March 11, 1986, at 9:30 A.M. in the Council Chambers of the
Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner.
The following exhibits were entered into the record:
Exhibit #1 - Yellow file containing application, proof
of posting and publication, two letters from residents
in the area, and other documentation pertinent to
this request.
Exhibit #2 - Short Plat Map
The hearing opened with the Zoning Administrator, Roger Blaylock, presenting a review of
the staff report. He commented on such information as the subject site being 0.76 acre
from which the applicant wishes to obtain 4 single family lots; a request to waive off-site
improvements for curbs, gutters and sidewalks is requested; zoning on the property and
surrounding area is R-1, single family residential. He stated the site slopes from west to
east; the site contains a vacated right-of-way for N.W. 4th Street; a utility easement
already running through the site would affect lots 3 and 4; water and sewer service is
available to the area, with a fire hydrant located on the N.E. corner of Lind Avenue N.W.
and N.W. 4th Street. Mr. Blaylock stated access to the site will have lots 1 and 3 using
Stevens N.W. with lots 2 and 4 accessing Lind Avenue N.W.. All lots meet the minimum
requirements for size with lots 3 and 4 being the largest. There is currently a house
located on proposed lot #3 which meets all setback requirements.
Continuing, Mr. Blaylock reviewed staff comments noting the Fire Department is
requesting an additional fire hydrant on Stevens Avenue N.W. to serve lots 1 and 3, with a
hydrant also on the N.W. corner of Stevens and Seneca Ave. N.W. which may require
existing water lines in the area to be upgraded. It was noted that the West Hill area was
recently improved with the construction of a reservoir. The waiver request for off-site
improvements is made by the applicant due to the absence of curbs, gutters and sidewalks
in the immediate area. With this review, Mr. Blaylock recommended approval of this
request with the condition that a fire hydrant be installed that will meet the approval of
the Fire Department and Public Works Department.

Mr. Haydon stated the applicant is agreeable to the installation of the fire hydrant but
asked that they y be permitted to put up a bond to guarantee the installation of the hydrant
at some time in the future, with the proviso that no building permits'be issued until the
hydrant is in place. Mr. Blaylock stated this procedure would have to be discussed with
the Board of Public Works. Mr. Haydon stated the applicant would even be willing to have
the bond stipulation placed on the face of the short plat map.
Calling for further testimony in support of, or in opposition to this application, there was

Ms. Meldrum commented regarding the various springs located in the West Hill area and
inquired if storm drainage was going to be provided with this project, or if the City has
any plans to extend drainage into the area. She said her yard and driveway catches water
run-off from the west-east sloped properties as well as the south-north slope on adjacent
property, causing erosion. She also questioned if curbs could be used to alleviate the
water run-off problem on her property and surrounding properties. Mr. Blaylock
commented that the applicant's property will have to meet the City storm drainage
requirements when construction begins for the residences on the lots.
The Hearing Examiner called for further testimony or comments from those in
attendance. There being no one else wishing to speak, the hearing was closed at 9:45 A.M.
FINDINGS, CONCLUSIONS & DECISION: •
Having reviewed the record in this matter, the Examiner now makes and enters the
following:
FINDINGS
1. The applicant, John Yeager, has requested approval of, a four lot Short Plat,
together with a Waiver from the requirement to install off-site improvements.
2. The application file containing the application, the State Environmental Policy Act
(SEPA) documentation, the Building and Zoning Department Report, and other
pertinent documents was entered in the record as Exhibit #1.
3. Pursuant to the City of Renton's Environmental Ordinance and SEPA (RCW 43.21 C,
1971, as amended), the subject proposal has been determined exempt from
environmental review by the Environmental Review Committee (ERC), the
responsible official.
4. Plans for the proposal have been reviewed by all City departments affected by the
impact of this proposal.
5. The subject site is located at 402 Stevens Avenue N.W. on the West Hill above the
Renton Municipal Airport. The site is approximately 2 blocks west of Taylor
Avenue N.W.
6. The parcel is part of the original town site of Renton. It was reclassified from
G-6000 to R-1 (Single Family Residential: Minimum lot size - 7,200 sq ft) in
November, 1979 during an area-wide rezone of the West Hill vicinity.
7. The map element of the Comprehensive Plan designates the area in which the
subject site is located as suitable for the development of single family uses, but
does not mandate such development without consideration of other policies of the
Plan.

8. The subject site is approximately .76 acres in area. The rectangular parcel is 165
feet wide by 200 feet deep. The southernmost portion of the parcel consists of the
vacated right-of-way of N.W. 4th Street. The parcel has access on both Stevens
and Lind Avenue N.W.
9. The property slopes downward from west to east. Springs underlay the site and the
general hillside, and storm runoff in the area has caused some damage.
10. The applicant proposes a four lot plat. Lots 1 and 2 would each be 100 feet deep
and 72 feet wide. Both proposed lots are vacant. Lots 3 and 4 would also be 100
feet deep but they would be 93 feet wide. An existing single family home is
located on proposed Lot 3. All the lots meet or exceed both the zoning and
subdivision standards for lot dimensions and area. The home on Lot 3 meets the
required yard dimensions and would be conforming.
11. Some neighbors objected to the approval of the Waiver, citing the drainage
problems and the presence of a curb on the east side of Lind Ave across from the
site.
12. The Fire Department indicated a hydrant is required on Stevens N.W. to serve Lots
1 and 3.
13. Comments were not received back from the Public Works Department regarding
street improvements or the possible drainage problems.
CONCLUSIONS
1. The proposed Short Plat appears to serve the public use and interest, and is
approved. The subdivision will permit the establishment of additional single family
homes in an area where urban services, sewer and water already exist. There will
be less sprawl as a result of infilling.
2. The additional homes will provide additional housing choices near downtown
Renton. The eventual construction of the homes will increase the tax base without
burdening the utility infrastructure.
3. The requested Waiver should not be approved at this time. While the applicant is
not responsible for the lack of comments regarding the waiver request, the
questions pertaining to storm water runoff and the need for curbs and gutters to
route such runoff require the waiver to be denied. The applicant is free to apply
for a deferral from the Board of Public Works, which can review the request with
more information.
4. The applicant should pursue the same course concerning the required hydrant and
potential latecomers arrangements or deferral.
DECISION
The Short Plat is approved.
The Waiver is denied.

Pursuant to Title IV, Section 3015 of the City's Code, request for reconsideration must be
filed in writing on or before March 26, 1986. Any aggrieved person feeling that the
decision of the Examiner is based on erroneous procedure, errors of law or fact, error in
judgment, or the discovery of new evidence which could not be reasonably available at the
prior hearing may make a written request for review by the Examiner within fourteen (14)
days from the date of the Examiner's decision. This request shall set forth the specific
errors relied upon by such appellant, and the Examiner may, after review of the record,
take further action:as he deems proper.
An appeal to the City Council is governed by Title IV, Section 3016, which requires that
such appeal be filed with the City Clerk, accompanying a filing fee of $75.00 and meeting
other specified requirements. Copies of this ordinance are available for inspection or
purchase in the Finance Department, first floor of City Hall.
The Appearance of Fairness Doctrine provides that no ex parte (private one-on-one)
communications may occur concerning land use decisions. This means that parties to a
land use decision may not communicate in private with any decision-maker concerning the
proposal. Decision-makers in the land use process include both the Hearing Examiner and
members of the City Council.
All communications concerning the proposal must be made in public. This permits all
interested parties to know the contents of the communication and would allow them to
openly rebut the evidence. Any violation of this doctrine would result in the invalidation
of the request by the Court.
The Doctrine applies not only to the initial public hearing but to all Requests for
Reconsideration as well as Appeals to the City Council.
For purposes of these decisions and recommendations the terms "Should" and "Shall" are
to be considered mandatory.. The term "May" will be considered discretionary. When the
report is a recommendation to the City Council the terms "should" and "shall" are
intended to inform the City Council that if they approve the recommendation the items
should be mandatory to preserve the intent of the decision.

G. DEPARTMENT ANALYSIS:
1. The applicants, John F. and Florence Yeager and H. C. and Ida May Grohs,
are requesting a short plat of two lots into four residential lots along with a
waiver of off-site improvements.
2. The proposal is exempt from the State Environmental Policy Act of 1971.
3. The subject site is designated as single family residential on the
Comprehensive Plan map and presently is zoned R-1, Residential.
4. A single family residence located at 402 Stevens Avenue N.W. presently
occupies proposed lot #3. Lot #1 would have access on Stevens Avenue N.W.,
while lots #2 and #4 would access Lind Avenue N.W.
5. The house that presently exists on proposed lot #3 complies with the
minimum front yard, side yard and rear yard setback of the R-1 zone.
6. The lots as proposed meet the minimum requirements for lot width, lot depth
and square footage of the R-1. Residential, zone.
7. Comments have been received from all City departments except the Public
Works Department. These departments have recommended approval with the
Fire Department requiring an additional fire hydrant to be located on Stevens
Avenue N.W. to provide service to lots #1 and #3. This may require some
upgrading of the existing water lines in the area from N.W. Fourth Place
approximately 300 feet to the north. A fire hydrant is located on the
northeast corner of Lind Avenue N.W. and N.W. Fourth Street across from
proposed lots #2 and #4.
8. Curbs, gutters and sidewalks are lacking in the general area. The City is
presently improving Taylor Avenue N.W. approximately two blocks east of
the subject site. However, most of West Hill does not have curbs, gutters or
sidewalks.
H. DEPARTMENTAL RECOMMENDATION:
Based upon the above analysis, it is recommended that the short plat request, file
number Short Plat-013-86, and the waiver request, file number W-014-86, be
approved subject to the installation of a fire hydrant per Fire Department's and
Public Works Department's approval.
