Appeal of Zoning Administrator's Decision
Pursuant to Renton City Code Section 4-3011(B) , we hereby request that
the Hearing Examiner reverse the Zoning Administrator's decision of
April 25th (copy enclosed) to reject our short application SP-018-86.
The Zoning Examiner erred in rejecting the application because he failed
to comply with the Subdivision Ordinance's requirement that "(s)hort
plats . . . be approved, disapproved or returned to the applicant within
thirty (30) days from date of submission unless the subdivider consents
to 'an extension of the time period." Renton Code Section 9-1105.5.
Because our January 23rd application submittal was not "rejected" until
April 25th, and because we did not consent to an extension of the time
period, the purported rejection of the application is untimely and of
no effect. See Norco Construction v. King County, 970 Wn.2d 680.
The Zoning Administrator should be directed to complete the processing
of the short plat because the size of all of the proposed lots is con-
sistent with the L-1 zoning of the site that was in effect during the
thirty-day approval period. The subsequent change of the site vicinity's
zoning to MP (when the,Valley Rezone became effective on April 23, 1986)
does not alter the Zoning Administrator's duty to process this short
plat in accordance with the L-1 zone requirements that were in effect
during the thirty-day period.
Please also note that in addition to the purported rejection of our
short plat application, the Zoning Administrator, in his April 25th
letter, also discussed dedication of land within the proposed short
plat for the P-9 Channel. While we do not deny that the City has
authority in appropriate circumstances to require the reservation or
dedication of necessary easements and rights-of-ways for public streets

and utilities, we do dispute the appropriateness of a dedication con-
dition being attached to this short plat. However, because the Zoning
Administrator's discussion of dedications is apparently not an admin-
istrative determination that land for the P-9 Channel must be reserved
or dedicated, no appealable decision on that issue appears to exist.

Dear Mr. Halinen:
Recently in the application review process by.the Building and Zoning Department of the
four lot short plat application submitted by yourself for AnMarco on January 23. 1986
with additional information submitted on February 21. 1986. it came to our attention that
either the short plat must be modified or rejected in its present form.
In the processing of development applications before a governmental body in the State of
Washington the issue of when a proposal is "vested" always appears. Specifically what
regulations are utilized to review the application request. In this specific case. your
application was recieved prior to the enacted of an area wide rezone which rezoned the
subject site to MR Manufacturing Park. Your application request was not "vested" under
the previous zoning. Land use applications such as short plats do not "vest" a property
owner under the existing zoning designations.. Only the application for a building permit
"vests" a property owner. This is termed the "Bright Line Rule".
The proposal as submitted does not meet the minimum lot area requirements of one acre
in the MP. Manufacturing Park Zone. Also the setback requirements of the MP Zone
would make proposed Lot 4 unbuildable. The application could be revised to two lot short
plat and comply with the requirements of the MP. Manufacturing Park Zone. The only
other option that the Building and Zoning.Department has is reject the application
outright.
Please contact me in writing by Friday. May 2. 1986. if you plan to revise the short plat
application.

The only other issue that was raised in the review process was whether the dedication of
the P-9 Channel was appropriate. The City in previous decision concerning the filling of
the subject site has specifically limited the filling of the northern 90 feet because it is a
natural water way. Natural watercourses whether they are intermittent or perineal are
protected. The City does have the right to require the reservation or dedication of
necessary easements and rights-of-ways for public streets and utilities. Storm water
drainage is a critical public utility.
Under Section 4-3011(B) appeals of administrative decisions must be made within 14 days
of the date of the decision. Therefore, an appeal would have to be submitted by 5 p.m. on
Friday. May 9. 1986.

DIVISION OF PROPERTY CONTRARY TO PENDING ZONING
REGULATIONS
Pursuant to our telephone conversation of last week, I am following up with my
understanding of your verbal response to several questions.
The first situation is that Gary Merlino has requested a short plat of property along East
Valley Highway that is presently allowed under the zoning code. However, with the
adoption of the new area-wide zoning for the Valley, the property in question would
become non-buildable as a result of setback requirements. It is my understanding that the
City does have the right to inform and control the development of the property based
upon the pending ordinance. In fact, the underlying Comprehensive Plan clearly showed
the property as Manufacturing Park which would imply the anticipated setback
requirements.
In addition, the issue of dedication of the P-9 Channel was raised. It appears that the
City has the right to require dedication for public uses including streets and utilities. The
P-9 Channel location has been firmly established as part of not only the City plan but by
the Soil Conversation Service plan. In fact, an extensive environmental impact
statement have been prepared on the design proposals and have not been challenged in
court. If the dedication and construction (the P-9 and P-1 Channel) were not completed,
serious environmental damage would occur. In the past, the applicant had received fill
permits based upon a solution for the entire storm water drainage issue in the Green River
Valley.
If the above two points of my understanding are not correct, please contact me
immediately for clarification.

Gentlemen:
We object to the proposed P-9 channel dedication condition of approval, suggested
by Design Engineering in its March 5th "Environmental Checklist Review" (copy
enclosed) .
This proposed condition of approval is not rationally related to the proposed
short plat and is unfair. As Engineer Don Monaghan told me yesterday in
response to my inquiry concerning P-9 channel construction scheduling, it may
be ten years before the channel is built (if it ever is built) . Further, con-
struction of the channel across the subject site would primarily benefit the
public at large while benefitting the subject property owners only tangentially.
Given the uncertainty of the channel project's construction and the fact that
the benefit of such a project, if ever built, will be to the public at large,
requiring right-of-way dedication for the channel as a condition of this short
plat, would be both unreasonable and unfair.
We thus urge the ERC to recommend approval of the short plat without the
proposed channel dedication condition.

Purpose of Checklist:
The State Environmental Policy Act (SEPA), chapter 43,21C RCW, requires all
governmental agencies to consider the environmental impacts of a proposal before making
decisions. An environmental impact statement (EIS) must be prepared for allproposals
with probable significant adverse impacts on the quality of the environment. The purpose
of this checklist is to provide information to help you and the agency identify impacts
from your proposal (and to reduce or avoid impacts from the proposal, if it can be done)
and to help the agency decide whether an EIS is required.

proposal. Governmental agencies use this checklist to determine whether the
environmental impacts of your proposal are significant, requiring preparation of an EIS.
