PUBLIC HEARING: After reviewing the Building and Zoning Department Report, examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: The hearing was opened on April 15, 1986, at 11:00 A.M. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. The following exhibits were entered into the record: Exhibit #1 - Yellow file containing application, proof of publication and posting, 2 returned hearing notices to property owners, and other documents pertinent to this request. Exhibit #2 - Short Plat Map. Exhibit #3 - By reference, Rezone File #007-86. A review of the applicant's request was presented by Zoning Administrator, Roger Blaylock. Mr. Blaylock said the Short Plat is to divide 0.26 acre of property into two lots. The present zoning on the property is B-1, but the applicant has requested a rezone to L-1 under application R-007-86. There is a double frontage on this lot, and the applicant feels it could be divided in half which would follow a pattern already established in other land uses in the area. This is a pre-existing lot 56.99 ft. wide, limited by existing buildings and lot patterns established years ago in the surrounding neighborhood as part of its original subdivision. Staff comments regarding improvements was reviewed with suggested sidewalks to be provided as well as improvements for South Tillicum to be installed under the proposed building permit. Staff does not feel the proposal will present any intrusion into development patterns in the area, and Mr. Blaylock recommended approval of the Short Plat request as requested. Calling for testimony in support of this application from the applicant or their representative, responding was: Walter L. Cook 903 No. 36th Street Renton, Washington, 98056 Mr. Cook said the purpose of the Short Plat request is to provide legal and financial flexibility for possible future development, and the owner of the property wishes to have more control over what happens to that portion designated at lot #2. Mr. Cook agreed with the staff review of the application and departmental comments and requested approval by the Examiner. There being no one else in attendance, and no further comments offered by staff, the hearing was closed at 11:15 A. M. O. J. HARPER ENGINEER. Short Plat 020-86 April 18, 1986 Page 2 FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: 1. The applicant, O.J. Harper Engineering, has requested approval of a two lot Short Plat of .26 acre of property. 2. The application file containing the application, the State Environmental Policy Act (SEPA) documentation, the Building and Zoning Department Report, and other pertinent documents was entered in the record as Exhibit #1. 3. Pursuant to the City of Renton's Environmental Ordinance and SEPA (RCW 43.2IC, 1971, as amended), the subject proposal is exempt from review. 4. Plans for the proposal have been reviewed by all City departments affected by the impact of this proposal. 5. There was no opposition to the subject proposal from any member of the public. 6. The subject site is located at 150 South Tobin Street. The site extends through the block and therefore, also has frontage along South Tillicum Street on the north. The site is almost midblock between Lake Avenue S. and. Shattuck Avenue S., approximately one block south of the Renton Municipal Airport and one block east of Rainier Avenue South. 7. The site is part of the original townsite of the City of Renton. The site was initially zoned R-1, or its equivalent, when zoning was first adopted in 1953. The site was rezoned to B-1, its current classification in August. 1956 by the adoption of Ordinance 1553. A lot line adjustment was approved in September, 1981 which created the site's current dimensions of 56.99 feet wide by 200 feet deep. 8. The map element of the Comprehensive Plan designates the area in which the subject site is located as suitable for the development of light industrial uses, but does not mandate such development without consideration of other policies of the plan. 9. A number of existing businesses are located in the vicinity of the site, including: Sunset Press and O. J. Harper Company, an engineering/manufacturing facility owned by the applicant. 10. The nature of these existing businesses are generally small scale low level manufacturing or industrial processes located on parcels ranging in size from approximately 6,000 to 12,000 square feet. 11. The proposed Short Plat would create two lots. Each of the lots would be 56.99 feet wide and 100 feet deep. One of the lots. Lot 1, would front along Tillicum to the north, while the other lot. Lot 2, would front on Tobin, south of the subject site. 12. The area contains a mixture of uses. Commercial and other light industrial uses are located north and east of the site. Rainier Avenue with its combination of uses is located west of the site. South of the site are a row of single family homes. 13. New buildings have been constructed on the site and are designed to house either commercial level uses or industrial uses. They remain unoccupied subject to approval of the rezone application. R-007-86, now pending before the City Council. 14. The proposed lots meet the minimum requirements of the L-1 zone proposed for the site and also the existing requirements of the current B-1 zoning for the site. 15. The Short Plat has been requested to simplify financing for the subject site and to permit independent ownership and control of the properties. CONCLUSIONS 1. The subject proposal appears to serve the public use and interest. The division will provide additional choices for businesses needing minimum space requirements. The proposed lots each meet the minimum requirements of the B-1 zone, the current zoning in place on the site, and would also meet the minimum requirements of the proposed L-1 zoning, a request now pending before the City Council. 3. Ultimate development will provide additional tax revenue for the City, and the subdivision in an already developed urban setting will not tax the utility infrastructure and will avoid forcing premature development in still rural areas. Any aggrieved person feeling that the decision of the Examiner is based on erroneous procedure, errors of law or fact, error in judgment, or the discovery of new evidence which could not be reasonably available at the prior hearing may make a written request for review by the Examiner within fourteen (14) days from the date of the Examiner's decision. This request shall set forth the specific errors relied upon by such appellant, and the Examiner may, after review of the record, take further action as he deems proper. An appeal to the City Council is governed by Title IV, Section 3016, which requires that such appeal be filed with the City Clerk, accompanying a filing fee of $75.00 and meeting other specified requirements. Copies of this ordinance are available for inspection or purchase in the Finance Department, first floor of City Hall. The Appearance of Fairness Doctrine provides that no ex parte (private one-on-one) communications may occur concerning land use decisions. This means that parties to a land use decision may not communicate in private with any decision-maker concerning the proposal. Decision-makers in the land use process include both the Hearing Examiner and members of the City Council. All communications concerning the proposal must be made in public. This permits all interested parties to know the contents of the communication and would allow them to openly rebut the evidence. Any violation of this doctrine would result in the invalidation of the request by the Court. The Doctrine applies not only to the initial public hearing but to all Requests for Reconsideration as well as Appeals to the City Council. For purposes of these decisions and recommendations the terms "Should" and "Shall" are to be considered mandatory. The term "May" will be considered discretionary.
