The surveyor is referring to the document as ;a Record ,of Survey for a Short Plat. We are concerned that the liability associated with the Record of Survey is less, and different, than that required by a Short Plat. We have attempted to review the RCW's to determine what is required of a surveyor for a Record of Survey, and a Short Plat. We were not able to make any decisive decisions with regards to this matter. Therefore, I would request that you review the RCW's and advise, if it would be appropriate to refer to the division of a parcel as a Record of Survey, or a Short Plat by the surveyor. BUILDING & ZONING The Building & Zoning Department Report was DEPARTMENT REPORT: received by the Examiner on April 22, 1986. PUBLIC HEARING: After reviewing the Building and Zoning Department Report, examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: The hearing was opened on April 29, 1986, at 9:00 A.M. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. The following exhibits were entered into the record: Exhibit #1 - Yellow file containing application, proof of posting and publication, and other documents pertinent to this request. Exhibit #2 - Short Plat Map. The above exhibits were entered into the record by Roger Blaylock, Zoning Administrator. He proceeded with a review of this application noting such information as the subject property containing 0.42 acre which is requested to be short platted to permit the building of a duplex on one of the lots. Currently there is a duplex already constructed on the lot which meets the setback requirements. Both lots would meet the minimum 7200 sq. ft. required for the R-2 zone. Various departments within the City have recommended approval with the requirement that off-site improvements such as curbs, gutters, sidewalks, and street lighting be brought up to City standards. Utility Engineering Department suggested at the time of construction of the second duplex that water testing be accomplished to insure proper fire flow. Mr. Blaylock stated staff is recommending approval of this request, subject to off-site improvements being brought up to City standards. Calling for testimony in support of this application from the applicant or their respesentative, testifying was: William Blakley 2009 Dayton Drive S.E. Renton, Wa. 98055 Mr. Blakley responded stating he has applied for the short platting of this property because the eastern portion of the site is not used because it is difficult to take care of and is a detriment to the community in its present condition. He said he will be applying for a deferral from the off-site improvements rather than requesting a waiver. He had no further comments. There was no one wishing to speak in opposition, but audience comments were received from: Jim Wilkie 655 Jefferson N.E. Renton, Wa. 98056 Mr. Wilkie expressed concern over possible encroachment on the public right-of-way area between Jefferson and'Index. Mr. Blaylock stated there should be no encroachment as the walkway has an easement of 32 ft. in width, but it does suggest that the fence line is slightly out of place and may have to be relocated. It was also suggested that the property owner would more than likely delineate where the private property ends and public property begins to keep people off the lot. Mr. Wilkie had no further comments. Also wishing to comment was: Gordon Moser 3019 N.E. 7th Renton, Wa. 98056 Mr. Moser referred to the public right-of-way stating it has been used as a street at least since 1976. He said there used to be a 'No Vehicles' sign in the alleyway which subsequently disappeared in 1976. In 1981 the property owner came to him with a petition from the City and wanted to subdivide the strip with him, with the City donating the land to them both. Mr. Moser did not like the proposal and did not sign. He said last year he spoke with Larry Springer, Policy Development Director, requesting a sign be placed in the public walkway to keep cars out, and the City is now in the process of putting up 'No Vehicle' signs. Mr. Moser expressed concern over the safety of his and other children in the area with vehicles using the public area. He questioned the ownership of the public use area and staff noted that the parcel was given to the City by the Federal government for park purposes so there could be a problem with its vacation. Mr. Moser had no further comments. There being no further testimony or comments from staff or the audience, the hearing was closed at 9:20 A.M. FINDINGS. CONCLUSIONS & DECISION: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: 1. The applicants. William and Linda Blakley, have requested approval of a two lot Short Plat on approximately 0.42 acres of property. 2. The application file containing the application, the State Environmental Policy Act (SEPA) documentation, the Building and Zoning Department Report, and other pertinent documents was entered in the record as Exhibit #1. 3. Pursuant to the City of Renton's Environmental Ordinance and SEPA (RCW 43.21C, 1971, as amended), the subject proposal has been determined exempt from environmental review by the Environmental Review Committee (ERC), the responsible official. 4. Plans for the proposal have been reviewed by all City departments affected by the impact of this proposal. 5. The subject site is located at 2905 and 2907 N.E. 7th Street, just east of Index Place N.E. and abutting the Highlands Public use area. 6. The subject site is part of the original townsite of the City of Renton. The site was rezoned from R-1 (Single Family Residential: Minimum lot size - 7,200 sq ft), the classification it received with the adoption of the original zoning code, to R-2 (Duplex Residential), its current classification. 7. The map element of the Comprehensive Plan designates the area in which the subject site is located as suitable for the development of low density multi-family uses, but does not mandate such development without consideration of other policies of the plan. 8. The applicants propose dividing the approximately 18,192 sq. ft. lot into two lots. Proposed Lot 1, the westerly lot, would contain approximately 10,321 sq ft. Proposed Lot 2 would contain approximately 7,871 sq. ft.. William and Linda Blakley SP-025-86 May 8, 1986 Page 3 9. Both lots would front along N.E. 7th Street. Proposed Lot 2 would also abut the Highlands Public Use area. 10. An existing duplex is located on that portion of the site proposed for Lot 2. The existing unit meets the setback provisions of the Renton Zoning Code. 11. The division will permit the establishment of a second duplex unit on the site. 12. Access to the public use area just east of Proposed Lot 2, while somewhat limited, has created problems for residents in the area. CONCLUSIONS 1. The proposed Short Plat appears to serve the public use and interest. The division will create an additional lot capable of supporting two additional dwelling units. providing additional living choices and infilling an area with urban services. 2. The additional population of two dwelling units will not tax the utility infrastructure, nor will it unduely affect adjacent properties. 3. Ultimate development of the site will increase the tax base, and again it will prevent unnecessary spawl into undeveloped areas. 4. The applicants will have to provide the required on and off-site amenities required by Ordinance. DECISION The Short Plat is approved. ORDERED THIS 8th day of May, 1986. FRED J. An appeal to the City Council is governed by Title IV. Copies of this ordinance are available for inspection or purchase in the Finance Department, first floor of City Hall. The Appearance of Fairness Doctrine provides that no ex parte (private one-on-one) communications may occur concerning land use decisions. This means that parties to a land use decision may not communicate in private with any decision-maker concerning the proposal. Decision-makers in the land use process include both the Hearing Examiner and members of the City Council. All communications concerning the proposal must be made in public. This permits all interested parties to know the contents of the communication and would allow them to openly rebut the evidence. Any violation of this doctrine would result in the invalidation of the request by the Court. The Doctrine applies not only to the initial public hearing but to all Requests for Reconsideration as well as Appeals to the City Council. For purposes of these decisions and recommendations the terms "Should" and "Shall" are to be considered mandatory. The term "May" will be considered discretionary. The purchaser covenants to keep the buildings and other improve- ments on said real estate in good repair and not to permit waste and not to use, or permit the use of, the real estate for any illegal purpose.The purchaser covenants to pay all service,installation or construction charges for water,sewer,electricity, garbage or other utility services furnished to said real estate after the date purchaser is entitled to possession. (9) In case the purchaser fails to make any payment herein provided or to maintain insurance,as herein required, the seller may make such payment or effect such insurance,and any amounts so paid by the seller,together with interest at the rate of 10% per annum thereon from date of payment until repaid, shall be repayable by purchaser on seller's demand, all without prejudice to any other right the seller might have by reason of such default. (10) Time is of the essence of this contract, and it is agreed that in case the purchaser shall fail to comply with or perform any condition or agreement hereof or to make any payment required hereunder promptly at the time and in the manner herein required, the seller may elect to declare all the purchaser's rights hereunder terminated, and upon his doing so, all payments made by the purchaser hereunder and all improvements placed upon the real estate shall be forfeited to the seller as liquidated damages, and the seller shall have right to re-enter and take possession of the real estate; and no waiver by the seller of any default on the part of the purchaser shall be construed as a waiver of any subsequent default. • Service upon purchaser of all demands,notices.or other papers with respect to forfeiture and termination of purchaser's rights may be made by United States Mail, postage pre-paid, return receipt requested, directed to the purchaser at his address last known to the seller. (11) Upon seller's election to bring suit to enforce any covenant of this contract, including suit to collect any payment required hereunder,the purchaser agrees to pay a reasonable sum as attorney's fees and all costs and expenses in connection with such suit, which sums shall be included in any judgment or decree entered in such suit. If the seller shall bring suit to procure an adjudication of the termination of the purchaser's rights hereunder, and judgment is so entered,the purchaser agrees to pay a reasonable sum as attorney's fees and all costs and expenses in connection with such suit, and also the reasonable cost of searching records to determine the condition of title at the date such suit is commenced, which sums shall be included in any judgment or decree entered in such suit.
