In addition, staff was requested to prepare a detailed analysis of the DEIS responding to the following Council concerns: 1) Impact of weaving action between inside and outside HOV lanes north of the Sunset interchange; 2) Mitigation measures to protect residents against construction noise and lights, particularly at night; 3) design of access • roads to Renton hill to ensure safety when icy; 4) possibility of rebate to Renton Hill residents who contributed to street LID; 5) guarantee that access, pedestrian and vehicular, will be provided at all times and emergency access roads will not be used for non-emergency traffic; and 6) notification of any plans for ramp metering, which Council opposes. Council President Mathews advised receipt of confirmation from WSDOT that the hearing on 7/24/86, has been postponed and indicating the hearing will be rescheduled after the City Council has had sufficient time to thoroughly review the draft EIS. Upon inquiry, Mr. Parness advised that the suggestion for use of I-405 HOV lanes by general traffic has also been included in report to WSDOT. MOTION CARRIED. Planning and Planning and Development Committee Chairman Keolker presented a Development report regarding the H.A.S. Short Plat Appeal, File No. Sh. Pl. 029-86, Committee • three-lot subdivision located at 134 Rainier Avenue South, which was H.A.S. Short Plat denied by the Hearing Examiner. The Committee recommended that the Appeal, Hearing Examiner's decision be upheld since there is little evidence that File No. Sh. Pl. the buildings on the site meet the definition of a shopping center, parking 029-86 space on site is inadequate, and subdivision would create irregularly shaped lots, which, in turn, would hinder redevelopment and require use of cross-easements for parking and access. MOVED BY KEOLKER, SECONDED BY REED, COUNCIL CONCUR IN THE COMMITTEE REPORT. CARRIED. National Pride Car Planning and Development Committee Chairman Keolker presented a Wash Site report regarding the National Pride Car Wash site approval appeal, File Approval Appeal No. SA-008-86, self-service facility between NE 3rd Street and NE 4th File No. Street, near Jefferson Avenue NE. The Committee recommended remand SA-008-86 of this application to the Hearing Examiner to be reviewed concurrently with application to develop property to the east of the subject site for a gas station and a 24-hour mini-mart. The Committee recommended the following conditions attached to the remand: 1) owners of the four single family residences facing these two parcels be notified of future hearings; 2) site plan be reviewed under criteria of new Site Plan Ordinance, as agreed to by applicant; 3) site plan receive unlimited review by Hearing Examiner, not just items appealed; 4) Site Plan criteria should be reviewed with intent to minimize conflicts between two separate parcels and integrate improvements including curb cuts,directional lighting, landscaping, etc. MOVED BY KEOLKER, SECONDED BY REED, COUNCIL CONCUR IN THE COMMITTEE REPORT. Utilities Utilities Committee Chairman Clymer presented a report concurring in Committee the recommendation of the Public Works Department to accept the low Bid Award for bid of Samish Construction Company, Inc. in the amount of $60,794.10 Renton Hill Alley for the Renton Hill Alley Sewer Replacement and South 5th Street Paving Sewer/S. 5th and Storm Drainage Project. The Committee also recommended that the Paving & Storm Mayor and City Clerk be authorized to execute the contract documents. Mayor Shinpoch agreed to check on a consideration raised by Councilman Reed regarding expense of a project which will be eliminated by the I-405 "S" curve project. MOTION CARRIED. v. PLANNING AND DEVELOPMENT COMMITTEE REPORT TO: Renton City Council July 16, 1986 FROM: Planning and Development Committee RE: H.A.S. Appeal H.A. S. appeals a denial of a. short plat. The Committee recommends that the Hearing Examiner' s decision be affirmed as the Committee finds no error in fact or law. The appellant claims that the property is a shopping center. The property consists of a restaurant, a Color Tile outlet and a building with a mix of offices and storage. The appellant claims that the City had previously permitted development as a shopping center. Both the appellant and the City staff acknowledge that parking is a problem. A portion of the property, representing the Denny 's restaurant, has previously been sold even though the parcel has insufficient parking when standing alone . Parking is supplied through the use of parking on the adjoining parcels. There is little evidence that the shopping center is managed as a unit and there is limitation placed on the parking which further indicates that the buildings are not being managed as a unit. It seems that the first sale probably destroyed any claim that these three buildings are a shopping center. This subdivision is acknowledged to be a vehicle to permit another sale. This would further point to the conclusion that this is not a shopping center. The building with the mix of offices and storage may, in fact, have a use that is in violation of the zoning. Storage is not permitted outright as a use in this zone . However, retaining the storage in this building is necessary if the shopping center is to have adequate parking to meet City Code . The shopping center concept is necessary in the first instance or else there is insufficient parking. The subdivision would create irregularly shaped lots that would create problems in the future for redevelopment. Cross easements for parking and access would also be necessary and the City generally discourages the use of that approach. The appellant was unable to show the Committee that this subdivision would be in the public interest as required by City Code. The appellant was also unable to provide the Committee with adequate evidence that the development, after subdivision, would meet the current definition of a shopping center. CARRIED. 1987 Housing and Community Development Block Grant Program Community Services Committee Chairman Stredicke presented a report recommending that the City Council take the following steps with regard to the 1987 Block Grant Program: 1) Authorize the Mayor to submit a letter of intent for up to $25,000 of public service funds; 2) Authorize the Mayor to submit a letter of intent requesting planning/administration funds at the 1986 program funding level; 3) Adopt the 1987 Program Policies; 4) Endorse a joint project request for the Renton Area Multi-Service Center. Housing Coordinator Ed Hayduk was commended by Mayor Shinpoch for successful H & CD funding awards during his tenure with the City, and was wished well in new employment in California. TRANSPORTATION COMMITTEE LID 329 and Valley Medical Center Transportation Committee Chairman Trimm presented a report indicating that the Committee has met with appropriate staff and Valley Medical Center to determine the future course of Local Improvement District #329. Valley Medical Center is required to install certain roadway improvements and other improvements as part of the mitigation for environmental impacts caused by a proposed modification to the Medical Center. VMC and the City anticipated that the improvements could be installed as part of LID #329. Seattle Northwest Securities has indicated to the City that it needs letters of credit or other guarantees from the participants in the LID because of the small number of participants and because of the substantial portion of the property owned by Dr. Lomas. The letter of credit by Dr. Lomas is not forthcoming and the LID cannot proceed without that letter of credit. The Committee was told by City staff that it would be impractical and inefficient to split the LID into two portions allowing Valley Medical Center to proceed with its portion and that the entire LID must therefore proceed. Valley Medical Center is unsure as to its legal authority to pay for the entire LID and take a latecomer's agreement. The Transportation Committee recommends that the City Attorney work with Valley Medical Center's attorneys to try and resolve the legal difficulties. The City Attorney also indicated that Seafirst Mortgage is in the process of foreclosing on the Lomas parcel and that he would likewise try and involve Seafirst Mortgage in the process. The matter will be tabled by the Committee to permit the City Attorney time to resolve the legal difficulties with this LID. Ever since the construction, initially, of Lyons Restaurant immediately to the west of our property, which premises were then taken over by the present owner, Denny ' s , our parking lot, which fully meets City Code , has been used continuously by restaurant patrons and others for many years . All kinds of vehicles , including large trucks , pick-up trucks and passenger cars utilize our parking lot on week days , evening hours and on weekends to patronize the restaurant . It is obvious , even upon cursory inspection of Denny ' s rest- aurant , that they do not have sufficient parking to accommodate their patrons . We have notified the then owners of Lyons and Denny' s on various occasions to advise their patrons not to park in our lot, all without any success or response . This has been an ongoing nuisance now for many, many years . On various occasions , over the last few years , we constructed concrete piers with chains to keep out unauthorized parking from the restaurant - but all without success . Within a matter of days , these parking barriers were torn down, uprooted and even the chains stolen. There is no practical way to control the parking problem and any shortp1 tting would exacerbate the situation and impact our property adversely . 2 . I also concur with the findings of the Hearing Examiner that the subject properties seeking shortplat is not a "shopping center" as that term is generally understood, and as defined by ordinance. (Ord. 3725, 5-9-83) ATTACHMENT ONE SPECIFICATION OF ERRORS NOTE: The discussions which accompany each correction are based solely on facts and conclusions contained in the Hearing Examiner's Report and Decision (hereinafter "Report and Decision") and the requirements of applicable Sections of the City of Renton Parking and Loading Ordinance. References to Exhibits are those exhibits which accompany the record of the Hearing. I. FINDINGS OF FACT a. No. 8 Error: "Parking requirements will not be met if the lots are segregated into three separate lots, without joint access and cross parking agreements." Correction: Parking requirements will be met if the site is subdivided into three lots as proposed. The site is a shopping center as the term is defined in City Ordinance 4-2202 for the purposes of the City of Renton Parking and Loading Ordinance. The available parking complies with the required parking for a shopping center set forth in City Ordinance 4-2208. Exhibit 4, entitled "H.A.S. Shopping Center Parking Layout," illustrates how the parking requirements set forth in City Ordinance 4-2208 are met by the project. The total building areas of Denny's (Building 1), Color Tile (Building 2) and the Office Building (Building 3) equals 18,000 square feet. The parking space required by this site is the amount designated for a shopping center in City Ordinance 4-2208, i.e., 5.5 units/1,000 square feet. The storage area located in the Office Building which equals 3,000 square feet requires 1 unit/1,500 square feet. Therefore, the buildings require 99 spaces and the storage area requires two spaces for a total of 101 parking spaces. Exhibit 4 also illustrates that there are 101 parking spaces available on the site. Therefore, the parking available on the site meets the requirements set forth by City Ordinance 4-2208 for a shopping center. The three lots on the site will share access and parking areas. As the Zoning Administrator suggested at the hearing (Report and Decision, p. 2), easements for reciprocal parking and access will be obtained by the owners to accommodate mutual use. These easements are consistant with the planning, development and approval of the site as a shopping center (see Exhibit 5, entitled "H.A.S. Properties--Sites & Grading Plan"), while also accommodating the owners' goal to divide ownership of Lots 2 and 3 by implementing the proposal. The short plat procedure provides the mechanism for placing an easement across the property for access and parking circulation. (Report and Decision, p. 2.) b. No. 10 Error: " . . . This Office finds the uses are not an example of a shopping center . . . . " Correction: This site does constitute a shopping center as the term is defined in City Ordinance 4-2202(6). 4-2202(6) defines shopping center for the purposes of the Parking and Loading Ordinance as: 0TY OF RE TON JUN 18 1986 -1- CITY CLERK'S OFFICE j I { • a group of buildings, structures, and/or uncovered commercial areas planned, developed, and managed as a unit related in location and type of shops to the trade area that the unit serves. The site meets the requirements set forth in the definition. First, appellant refers the City Council to the language "planned, developed, and managed as a unit." This site was initially planned and developed by its owners as a shopping center. Furthermore, it was approved by the City of Renton as such on 11/13/79 (see Exhibit 5, "H.A.S. Properties-- Site and Grading Plan"). Its owners and Mr. Tom Touma (architect with respect to this project) have justifiably relied on the prior approval of the site as a shopping center with respect to their planning on the current proposal. Second, appellant refers the Council to the language "related in location and type of shops to the trade area that the unit serves." The Hearing Examiner stated in Finding No. 10 that the uses of the three buildings are "totally unrelated" and not "legally unified in ownership." Denny's, Color Tile, and the Office Building do represent different uses with respect to each other. However, 4-2202 does not require the uses to be identical or even similar with respect to each other. Rather, it requires that the buildings be related, with respect to the type of businesses, to the trade area served. The area which the site serves is zoned B-1 (Report and Decision, p. 1.) B-1 zoning is designated a business district by City Ordinance 4-711. The purpose and intent for a business district is to "provide for retail sales of products of every type and description, a wide variety of personal and professional services to clients and/or customers at the business location. . . . " 4-711(A). Denny's, Color Tile, and the Office Building fall within this description as retail businesses and a professional office, respectively. Therefore, their use is related to the trade area served as 4-2202 requires. The Hearing Exmainer also stated in Finding No. 10 that Mr. McGinnis had testified that the term shopping center was a "misnomer." The Hearing Examiner then further noted that joint parking and access had previously been applied to lots "more legally unified in ownership than those now proposed." (Report and Decision, p. 3.) Appellant responds by pointing out to the City Council that (a) Mr. McGinnis' statement that the site is not a shopping center does not change the fact the site fulfills the definition of shopping center designated in City Ordinance 4-2202 and (b) City Ordinance 4-2202 does not require the site to be legally unified in ownership for it to be designated a shopping center for the purposes of the Parking and Loading Ordinance. c. No. 11 Error: " . . . the proposal creates individual lots without sufficient parking and with aisle access on adjoining lots." Correction: The proposal does divide the site into three individual lots for purposes of ownership. However, the site remains a shopping center as discussed under (b) above and has enough parking available to fulfill the requirements of City Ordinance 4-2208 for a shopping center. The "aisle access on adjoining lots" will be remedied by executing the necessary easements for reciprocal parking and access, as the Zoning Administrator suggested was necessary at the hearing. (Report and Decision, p. 2.) II. CONCLUSIONS a. No. 1 Error: "The building on proposed Lot 3 does not now have, nor can it have, sufficient parking. -2- Correction: The office building, as part of the site which has been designated and approved as a shopping center on 11/13/79 by the City of Renton, does have sufficient parking to comply with City Ordinance 4-2208. Appellant refers the City Council to Exhibit 4, entitled "H.A.S. Shopping Center Parking Layout" which specifies the City Ordinance parking requirements and the available parking on the site. 101 stalls are necessary to comply with the ordinance and 101 stalls are actually available. Furthermore, Mr. McGinnis and Mr. Touma both testified that the current storage area in the office building will remain storage. (Report and Decision, p. 2.) Therefore, the need for additional parking due to future office occupancy in the current storage area will not arise. If the City is concerned it will arise, restrictive covenants can be filed against Lot 3 preventing the storage area from being used as office space until additional parking is available, as the Zoning Administrator suggested at the hearing (Report and Decision, p. 2). b. No. 3 Error: "This office will not be bound by the earlier determination that the three proposed lots are a shopping center. First, that determination is solely a parking issue. . The term 'shopping center' cannot honestly be applied to one retail use, one restaurant, and an office building . . . . " Correction: While the Office's prior determination that the site is a shopping center is a parking issue, it is precisely the required and available parking at the site which is a major issue in this project and a recurrent theme throughout the Report and Decision. This site and project comply with the definition of shopping center set forth in City Ordinance 4-2202. Appellant refers the City Council to (b), Findings of Fact-Error 10 above, for full discussion of how the three lots meet the requirements of the ordinance. To briefly recap, appellant points out that the buildings/businesses need not engage in similar uses to each other, but must relate to the trade area. Denny's, Color Tile, and the Office Building all relate to the business usage of the area which is zoned B-1. The Hearing Examiner further stated that the sites "layout disassociates the uses from one another" and that "it is not a classic shopping center in its access on visibility." Appellant responds as follows. The layout will not disassociate the uses from each other, if all three buildings share access and parking. Futhermore, there is no requirement in Ordinance 4-2202 which requires a certain "visability characteristic" to exist for a site to be designated a "shopping center" for parking purposes. Finally, appellant points out to the City Council that Mr. McGinnis' statement the site is not a shopping center does not alter the fact the site does comply with the definitional requirements of City Ordinance 4-2202. c. No. 4 Error: "The purpose violates the standards of the Parking and Loading Ordinance." Correction: The Parking and Loading Ordinance is not violated by the proposal. The proposal will divide the site into three individual lots. However, the site has previously been approved as a shopping center and complies with -3- both City Ordinance 4-2202 and City Ordinance 4-2208 for parking purposes. Private agreements for access and parking are necessary, but this is easily provided for via easements allowing joint-access and cross-parking as the Zoning Administrator pointed out at the hearing. (Report and Decision, p. 2.) SUMMARY Appellant H.A.S. Properties requests the City Council of Renton to reverse the Hearing Examiner's Decision and approve its Short Plat Application based on the following factors: a. The site was planned, developed, and approved by the City of Renton on 11/13/79 as a shopping center. (See Exhibit 5, entitled "H.A.S. Properties, Inc.--Site and Grading Plan.) b. The site and proposal comply with the definition of Shopping Center set forth in City Ordinance 4-2202 and meet the requirements for parking set forth in City Ordinance 4-2208 (See Exhibit 4, entitled "H.A.S. Shopping Center Parking Layout"). c. The storage area located in the Office Building will remain storage and will not be used as offices. (See Report and Decision, p. 2.) Therefore, the parking require- ments for the site will not increase. d. The joint access and reciprocal parking necessary for the site is easily provided for by easements for those purposes. The short plat process provides the mechanism to accomplish this. (See Report and Decision, p. 2.) e. The easements for joint access and reciprocal parking can appear on the face of the short plat map, so that future purchasers will be aware of obligations under those agreements. (See Report and Decision, p. 2.) f. There is at least one other site in the City of Renton which has successfully used easements for joint access and reciprocal parking in a similar situation. PROPERTIES (Dan McGinnes) FILE NO. Short Plat 029-86 LOCATION: 134 Rainier Avenue South SUMMARY OF REQUEST: Approval to subdivide 1.68 acres of property into three lots. SUMMARY OF ACTION: Building and Zoning Department Recommendation: Denial. Hearing Examiner Decision: The Short Plat is Denied. BUILDING & ZONING The Building & Zoning Department Report was DEPARTMENT REPORT: received by the Examiner on May 14, 1986. PUBLIC HEARING: After reviewing the Building and Zoning Department Report, examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: The hearing was opened on May 20, 1986, at 9:15 A.M. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. The following exhibits were entered into the record: Exhibit #1 - Yellow file containing application, proof of posting and publication, and all other documents relative to this request. Exhibit #2 - Short Plat. Exhibit #3 - Short Plat Map showing easement across the parking lot. Exhibit #4 - Site Plan showing building locations and parking requirements. Exhibit #5 - Applicant's Site Plan presentation. A presentation was made of the applicant's request by the Zoning Administrator, Roger Blaylock. He reviewed such information as the applicant's wish to subdivide 1.68 acres of property into 3 lots; existing zoning on the property is B-1; the property had previously been divided into three buildings which include a restaurant, a retail business, and an office building with storage. Utilities are all developed and available to the site; the proposal creates 2 lots which do not have adequate individual parking, and the applicant proposes using cross-parking across the site because the site functions as a shopping center with limited shared access. Mr. Blaylock stated the applicant had previously applied to remodel the building on lot #3, and at that time was required to provide additional parking to support the proposal. The applicant acquired temporary parking east of Lake Street as a part of that requirement. That parking is no longer available to the applicant. The problem with the site is there does not appear to be adequate parking to permit the entire site to be used as an office park or shopping center. He stated if the entire floor space in building #3 is utilized there would be a need for 140 parking spaces, and only 102 are provided. It was pointed out that the new Parking and Loading Ordinance has not been applied to the subject site but the parking provisions for a shopping center have not changed, still requiring 5.5 spaces/1000 sq. ft. Mr. Blaylock stated staff feels the site is not sufficient to permit the full development of a shopping center. It was recommended, based on the information at hand, to deny the request stating the site may be over-utilized with insufficient parking on each of the lots, therefore creating non-conforming lots. H.A.S. Properties (Dan Short Plat 029-86 June 4, 1986 Page 2 A brief review was given the Examiner as to how much parking would be required on each of the lots to bring them into conformance, and the closing comment made that originally the project was a total design and should remain in that fashion. Calling for testimony in support of this proposal from the applicant or their representative, testifying was: Tom Touma 201 S.W. 41st Street Renton, Wa. 98055 Mr. Touma is the architect for this project. He stated the intent of the applicant is to divide lots 2 and 3, which are under one ownership at the present time. Lot 1 is also an individual lot, and was created based on a lot line adjustment when the applicant applied for the shopping center in 1981. He stated the applicant's intent is to segregate the balance of the property which is a Color Tile Store and an existing office building. Mr. Blaylock approached the map and pointed out the lot lines for the site and stated there is a problem with access to lots 2 and 3, with lot 1 not changing at all but providing access to the other two lots. Mr. Blaylock stated if lot 2 is divided there will be no access to that lot except by crossing another piece of property. He also stated that the short plat process provides a mechanism to place an easement across the property for access and parking circulation. Mr. Touma continued stating they feel the property is still functioning as a shopping center and does not feel there is a problem with parking as it now exists. He said they had met with the Building Department before they submitted Exhibit #2, and several other exhibits which referred to parking, and on that.basis they proceeded on the short plat request. He referred to another site within the City that also has a cross-parking easement and stated it works for that site and should work for their site also. Referring to building 3 and the possibility it may be remodeled, Mr. Touma stated the building will stay as it is now as a storage area, thereby fulfilling their parking requirement. Mr. Touma concluded saying he feels the applicant meets the requirements of the ordinances, and having worked closely with staff does not understand why the proposal is being recommended for denial. Also wishing to speak in support of this proposal was the applicant, Dan. McGinnes, 910 Fifth Avenue, Seattle, Washington, 98104. Mr. McGinnes wanted to assure the Examiner that the lower portion of building 3 is used for storage and will remain as storage. He said the shopping center use is a misnomer as the use of the building should be professional: and this is not a classic shopping center retail environment due to access and visability. He stated the occupants of the building should be professionals as the building is currently leased to professionals and they intend to continue in that direction. He had no further comments at this time. The Zoning Administrator again addressed the Examiner stating parcel 1 was placed in this Short Plat request because access to lots 2 and .3 is across lot 1. This is presently provided for by way of single ownership for both parcels. He continued stating should this request be approved, the easement for reciprocal parking and access should appear on the face of the short plat map so that anyone purchasing the property will be aware of their responsibilities. The short plat divides the property and will be available for purchase, and he suggested that Restrictive Covenants be filed against lot #3 to show that the bottom floor of the building would not be used for office space until additional parking is provided as required by City code. He feels this would be a fair disclosure to any future owner. There was no one else in the audience wishing'to testify in support of, in opposition to, or present any further questions regarding this application. No further comments were offered by staff. The hearing closed at 9:50 A.M. FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: - 1. The applicant, H. A. S. Properties, has requested approval of a 3 lot Short Plat on approximately 1.68 acres of property. 2. The application file containing the application, the State Environmental Policy Act (SEPA) documentation, the Building. and Zoning Department Report, and other pertinent documents was entered in the record as Exhibit #1. Pursuant to the City of Renton's Environmental Ordinance and SEPA (RCW 43.21C, 1971, as amended), a Declaration of Non-Significance has been issued for the subject proposal'by the Environmental Review Committee (ERC), the responsible official. 4. Plans for the proposal have been reviewed by all City departments affected by the impact of this proposal. 5. The subject site is located at 134 Rainier Avenue South, at the corner of Rainier and South 2nd Street. The irregularly shaped site has frontage along Rainier Avenue, So. 2nd and Lake Avenue South, at its eastern perimeter. 6. Located on the site's northeastly segment is an office building, while Color Tile and Denny's Restaurant are located along the Rainier frontage. 7. Actually, proposed Lot 1 is a separate legal lot, but since proposed Lot 2 has its access across proposed Lot 1, it was included in the subdivision. 8. Parking requirements will not be met if the lots are segregated into three separate lots, without joint access and cross parking agreements. Private agreements which are difficult to enforce. The office building on proposed Lot 3 does not have sufficient parking to allow full occupancy. The lowest level of the building which was at one time developed for office space is now limited to storage uses because of insufficient parking. 9. With the exception,of proposed Lot 1, the other two lots are irregularly shaped, creating areas with no useful legal purpose. They are insufficient as building envelopes or parking areas without crossing the proposed lot lines. 10. Shopping center parking requirements were permitted on the site but this Office finds that the three uses are totally unrelated except for the parking provision. The uses do not relate to one another and the application of shopping center definitions beyond that already permitted would serve no useful purpose. The applicant testified that the term was a misnomer and that the uses are not a classic example of a shopping center. This Office finds the uses are not an example of a shopping center. In the past, the joint parking and access was at least applied to lots which were more legally unified in ownership than those now proposed. 11. Staff recommended the Short Plat be denied since the proposal creates individual lots without sufficient parking and with aisle access on adjoining lots. Staff indicated that the current uses were permitted under a plan which treated the design as an integrated total, and division would change that configuration. CONCLUSIONS 1. The proposed subdivision does not serve the public use and interest. The sole purpose of the subdivision is to allow individual ownership of the various parcels, but the public purpose is not served by the proposed segregation. Not only will cross access easements be necessary, but shared parking agreements will also be necessary and these would additionally be complicated by insufficient parking for the office building. Enforcement will be difficult, if not impossible. The building on proposed Lot 3 does not now have, nor can it have, sufficient parking. While part of the building is unoccupied, the original approval was an unfortunate oversight which creates enforcement problems. 2. The proposed lots are oddly shaped, with panhandle projections which cannot support a legal building envelope or even legally accessible parking. While the proposal may, and this Office has indications that it does not (see next conclusion), support the current uses, future redevelopment would be greatly hampered by the creation of such small irregularly shaped parcels. Good land use practice requires possible lots that can meet not only current provisions but reasonable future provisions. These lots do not meet current standards standing alone, and would only complicate future review because of their size and shape. H.A.S. Properties (Dan Mc les) Short Plat 029-86 June 4, 1986 Page 4 3. This Office will not be bound by the earlier determination that the three proposed lots are a shopping center. First, that determination is solely a parking issue and is not a binding land use determination. Second, this Office has difficulty with the application of such a definition to only two retail uses. The term 'shopping center' cannot honestly be applied to one retail use, one restaurant and an office building. The uses are disparate, and the layout disassociates the uses from one another. Other than the request that staff analyze the parking from a shopping center standpoint at some time in the past, the request fails. The applicant admitted so in the testimony - the applicant testified that the shopping center use is a misnomer - it is not a classic shopping center in its access or visability characteristics. The subdivision will not rectify this situation, but only complicate it. 4. The request is not justified as it unnecessarily complicates governmental enforcment, creates odd shaped lots which do not, nor cannot provide legal parking or access without private agreements. The creation of new lots when possible should meet existing zoning and subdivision requirements, and in fact, the proposal violates the standards of the Parking and Loading Ordinance, if the uses were truly treated as what they are - separate, distinct and totally unrelated uses, with no resemblance to a shopping center. Properties (Dan ML.....nes) Short Plat 029-86 June 4, 1986 Page 5 An appeal to the City Council is governed by Title IV, Section 3016, which requires that such appeal be filed with the City Clerk, accompanying a filing fee of $75.00 and meeting other specified requirements. Copies of this ordinance are available for inspection or purchase in the Finance Department, first floor of City Hall. The Appearance of Fairness Doctrine provides that no ex parte (private one-on-one) communications may occur concerning land use decisions. This means that parties to a land use decision may not communicate in private with any decision-maker concerning the proposal. Decision-makers in the land use process include both the Hearing Examiner and members of the City Council. All communications concerning the proposal must be made in public. This permits all interested parties to know the contents of the communication and would allow them to openly rebut the evidence. Any violation of this doctrine would result in the invalidation of the request by the Court. The Doctrine applies not only to the initial public hearing but to all Requests for Reconsideration as well as Appeals to the City Council. For purposes of these decisions and recommendations the terms "Should" and "Shall" are to be considered mandatory. The term "May" will be considered discretionary. Properties, is requesting a short plat of 1.68 acres of property into three lots. The proposal would divide the property to allow the individual sale of the three existing buildings on separate lots. 2. The short plat is exempt from the State Environmental Policy Act of 1971. Therefore. an environmental determination has not been made by the Environmental Review Committee. 3. The proposal as submitted creates lots that do not have adequate individual parking. The project was originally approved as a shopping center with major areas of storage. When the applicants requested remodeling and tenant improvements in Building #3 in 1981. the City required that auxiliary parking be provided to the east across Lake Avenue South. The new Parking and Loading Ordinance could be applied to the specific designs of the building; however, it is doubtful that enough on-site parking could be provided. The applicant has not provided justification that there is sufficient parking for each of the buildings. 4. The short plat also divides the parking aisles access so that each lot is dependent upon one another. The project was designed as a total and should. therefore. be kept in that configuration. H.
