Short Plat 046-86, V-047-86 & W-048-86 LOCATION: 2224 N.E. 12th Street SUMMARY OF REQUEST: Approval of a Short Plat to permit a two lot subdivision on 0.71 acre of property, a Variance to allow a pipestem lot, and a Waiver of off-site improvements. SUMMARY OF ACTION: Building and Zoning Department Recommendation: Approval of short plat and variance but deny waiver. Hearing Examiner Decision: Short Plat and Variance are approved, with conditions. Waiver is denied. BUILDING & ZONING The Building & Zoning Department Report was DEPARTMENT REPORT: received by the Examiner on July 2, 1986. PUBLIC HEARING: After reviewing the Building and Zoning Department Report, examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: The hearing was opened on July 8, 1986, at 9:05 A.M. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. The following exhibits were entered into the record: Exhibit #1 - Yellow file containing application, proof of posting and publication and other documents pertinent to this request. Exhibit #2 - Short Plat Map Exhibit #3 "Fire Hydrant illustration. The hearing opened with the entering of the above exhibits and a presentation given of the staff report by Jeannette Samek-McKague, Zoning Research Technician. Mrs. McKague set forth such information as the short plat request complies with the Comprehensive Plan and the zoning designation of single family, and is compatible with the residential nature of the surrounding area. Reviewing staff comments it was noted that the short plat and variance requests were recommended for approval, with certain conditions, but the waiver request was recommended for denial. It was suggested by staff that road and utility improvement plans be submitted for review; the addition of one more single lot in the area will have no impact on services or utilities; and the variance for the pipestem lot (lot #2) meets the necessary criteria. .Due to the irregular shape of the lot, and access problems, it is felt there are special circumstances to be considered for the variance request. Mrs. McKague advised that there are other lots near the subject property that are developed which do not permit access to proposed lot #2; lots developed on N.E. 12th which do not permit access from N.E. 12th to the back of lot #2; this is not felt to be a special privilege as there have been various other approvals of pipestem lots which would make this request appropriate and in conformance with others in the area; and these lots are as large as others in the area so they will preserve the integrity of the area. It is felt there should be no traffic hazards from this proposal. Continuing with the review Mrs. McKague said the waiver request has been recommended., for denial as the only improvements in the area are located along Dayton Avenue which consists of curbs and gutters, with several other tracts approved in the area that have been required to provide full improvements. Reseaching plats in the area, Mrs. McKague stated there are, plats that have been asked to participate in future LID's for improvements; in discussions with the Engineering Department they seemed to feel at some point in time when the lots are developed they will require full improvements. 0 Patrick D. Hart SP-046-86, V-047-86 & W-048-86 July 17, 1986 Page 2 For those reasons it was felt staff could not recommend a waiver of off-site improvements. Concluding. Mrs. McKague read the recommendations of staff for the approval of the short plat and variance requests. The Hearing Examiner called for testimony in support of this proposal from the applicant or their representative. Responding for the applicant was: Wayne Chastain Consulting Engineer 409 South 3rd Street Kent, Washington, 98032 Mr. Chastain said the applicant is in agreement with the recommendations of staff, with the exception of the recommended denial of the waiver of off-site improvements. He said there is no objection to the 10 ft. utility easement; the lot they are requesting is creating nothing more than a driveway which would add one additional entrance onto N.E. 12th Street. With this in mind, due to the fact there are no improvements on N.E. 12th at the present time, and the length of the lot adjacent to N.E. 12th is 150 ft. in length and will be difficult to design off-site improvements for road grades etc. that may be required at some future date, they feel the waiver request should be approved. Regarding the fire r hydrant, Mr. Chastain presented Exhibit #3 showing how the driveway will enter onto N.E. 12th and said the hydrant is near the corner of the lot, there could be a 10 ft. driveway entering N. E. 12th entering at the same angle as the proposed lot line which would miss the fire hydrant. He said due to the width of the pipestem they could go to the eastern edge of the property, make an angle and enter onto N.E. 12th at a 90 degree angle, thereby missing the fire hydrant by 10 ft.. Mr. Chastain stated further that other short plats in the area have been able to participate in restrictive covenants stating they would participate in an LID at some future date and the applicant feels they should be afforded the same type of approval, rather than preparing plans now for future work in the area when exact LID plans for the area are not known at this time. The applicant is willing to commit to restrictive covenants. In closing, Mr. Chastain stated larger developments in the area are going to create a need for off-site improvements, and at that time it would be appropriate for the applicant to participate also. He had no further comments. The Examiner called for further testimony in support of this application, there was no one wishing to speak. No one spoke in opposition, and no further comments were offered by staff. The hearing was closed at 9:35 A.M. FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: 1. The applicant, Patrick D. Hart, has requested approval of a 2 lot Short Plat together with a, request for a Variance for pipestem access and request to Waive the required off-site improvements. 2. The application file containing the application, the State Environmental Policy Act (SEPA) documentation, the Building and Zoning Department Report, and other pertinent documents was entered in the record as Exhibit #1. 3. Pursuant to the City of Renton's Environmental Ordinance and SEPA (RCW 43.21C, 1971, as amended), the subject proposal has been determined exempt from environmental review by the Environmental Review Committee (ERC), the responsible official. 4. Plans for the proposal have been reviewed by all City departments affected by the impact of this proposal. 5. There was no opposition to the subject proposal from any member of the public. 6. The subject site is located at 2224 N.E. 12th Street. The site is located on the north side of the street between Aberdeen Avenue N.E. and Dayton Avenue N.E. Patrick D. Hart SP-046-86, V-047-86 & W-048-86 July 17, 1986 Page 3 7. The approximately .71 acre parcel is approximately 31,000 sq feet in area. The irregularly shaped lot is approximately 270 feet long and varies between approximately 96.88 feet and 151 feet wide. 8. The site was annexed into the City with the adoption of Ordinance 1822 enacted in March of 1960. The site was rezoned from the G-7200 it received automatically upon annexation, to R-1 with the adoption of Ordinance 3634 enacted in June 1982. 9. The map element of the Comprehensive Plan designates the area in which the subject site is located as suitable for the development of single family uses, but does not mandate such development without consideration of other policies of the plan. 10. Sewer and water utilities are available to the site, and as required, would be extended by the applicant. 11. The lot would be divided along an east/west line almost coinciding with the center of the lot. Each lot would exceed the minimum lot size, with the smaller of the two lots well over 10,000 sq ft. 12. An existing dwelling is located on proposed Lot 1. The home would be retained and meets the setback requirements of the R-1 zone. 13. The applicant proposes access to the second lot, Proposed Lot 2, via a pipestem driveway approximately 30 feet wide. Pipestem access is permitted by variance, but then the pipestem must be a minimum of 20 feet wide. 14. The area surrounding the subject site is developed primarily with single family homes. Lot sizes vary from older larger lots of a size similar to the subject site to lots more in keeping with the 7,200 sq ft standards in the zoning code. 15. Staff indicated that existing development in the area precludes access to the interior of the subject site. Homes surround the site on three sides. Pipestems similar to that requested have been approved for some similarly situtated lots in this area of the City where the old platting standards created large superblocks with substantial interior acreage and only perimeter development. 16. The applicant has requested a waiver of the required off-site improvements. The area is one of the older established areas of the City, with some off-site improvments installed with new subdivisions. A completely new subdivision just east of the site has installed complete improvements. A few other new small subdivisions such as that now requested have also installed improvements. 17. Staff has indicated that a fire hydrant located along the frontage of the subject site might be jeopardized by the proposed pipestem roadway and might have to be relocated to assure that it is not damaged by turning vehicles. The applicant has indicated that the roadway should not interefere with access to the hydrant and neither would it be endangered. 18. Staff has recommended that the waiver be denied since similar requests in the area have not been granted. Applicants have been free to apply for deferrals. Staff has indicated that a utility easement of 10 feet is required along N.E. 12th Street. DECISION 1. The proposed two lot subdivision appears to serve the public use and interest. The division will provide an additional single family lot in a developed area without forcing new development to the rural areas without services. 2. The utility infrastructure in the area is capable of serving the one additional lot. The additional lot will not tax the existing utility services, and when developed will add to the tax base of the City. 3. The large size and large depth of the lot creates unique access problems if the lot were to be divided as requested. The over 31,000 sq ft lot could reasonably be divided and still provide lots larger than required under the zoning code. Access by pipestem would permit this reasonable division and should be approved. Patrick D. Hart SP-046-86, V-047-86 & W-048-86 July 17, 1986 Page 4 4. The applicant is not the first subdivider to utilize pipestem access in the area, and it provides a reasonable means of permitting access to the larger than 10,000 sq ft interior lot without infringing upon the rights of others. 5. The proposed road meets the code requirements, it is less than 150 feet in length and more than the 20 feet required. 6. The Variance will not adversely affect the public health, safety or welfare and is approved. 7. This office will not intercede in any decision regarding the location of the fire hydrant. The applicant must receive the approval of the Public Works Department and the Fire Department regarding the location of the existing hydrant. If the applicant's plans for roadway location and/or safety bollards is acceptable to those departments, this office has no objections. The final discretion shall lie with those departments regarding only the existing hydrant. 8. The area has a mixture of improvements. Newer developments have installed improvements, and it would seem appropriate to require the installation of improvements, or at least leave the discretion to the Board of Public Works. Policies now dictate, as does the code, installation of improvements in the normal situation and that it can only be accomplished as property is divided and developed. The Waiver is therefore, denied. The applicant may apply to the Board of Public Works to defer the installation as that agency determines. The Short Plat is approved subject to providing a 10 foot easement for utility lines along the entire N.E. 12th Street frontage of proposed Lots 1 and 2. ORDERED THIS 17th day of July, 1986. FRED J. Hart, seeks approvals of applications for: 1) a two lot residential subdivision on 0.71 acre of property; 2) a variance to allow a pipestem lot per Section 9-1108(23)(F)(3)(d); and 3) a waiver of off-site improvements per Section 9-1105(6)(B). 2. The proposed subdivision complies with both the Comprehensive Plan designation of Single Family and the present zoning classification of R-1, Residential-Single Family. 3. The subject proposal is exempt from environmental review as provided in the State Environmental Policy Act of 1971, as amended. • 4. Various City departments have reviewed the subject short plat. The Building Division, the Fire Department, the Police Department, and the Parks and Recreation Department approved the proposal without conditions. The Policy Development Department, the Traffic Engineering Division, and the Engineering Division approved the proposal with the following conditions: Policy Development Department: We would offer the following recommendations: 1) The subject request is consistent with the existing single family zoning and land use designation of the Comprehensive Plan. 2) Approve the short plat except that the width of the pipestem (31.45 feet) exceeds the 20° maximum provided by Section 9-1108(23)(F)(3)(d) of the Subdivision Ordinance. Perhaps second variance for the width is in order. } PRELIMINARY REPORT THE HEARING EXAMINER PATRICK D. HART. FILE'NO. SHORT PLAT-046-86, V-047-86. 0-048-86 JULY 8, 1986 PAGE 3 3) Deny the waiver request and advise the applicant to seek a deferral of the required off-site improvements through the Board of Public Works. Traffic Engineering Division: A ten (10) foot utility easement should be provided along the full length of the south property line for future underground of the overhead electric and communications distribution systems and for future street lighting on N.E. 12th Street. Engineering Division: 1) Provide off-site improvements. 2) Provide plan and profile for roadway improvements and utility relocation on 22" x 34" mylar. 3) Relocate existing fire hydrant. The Utility Division did not approve the subject proposal due to the need for plans on the relocation of a fire hydrant near the subject property. The hydrant is located at the entrance of Lot 2 of the subject property. In addition. the applicant will also be responsible for paying the system development charges per the Utility Engineering comments. SHORT PLAT 5. The proposed short plat is compatible with the existing single family lots in the area. Only one additional single family residence will be added to the area since one residence is already located on Lot 1 of the proposal. This in-fill project will use existing services which are sufficient to support the additional residence. Thus. the proposed short plat will have minimal impact on the existing services and the surrounding area. 6. The proposed lots meet and exceed the minimum design requirements for residential plats as stated in Section 9-1108(23) of the Subdivision Ordinance and Section 4-706(C). Development Standards for Residential (R-1) Zoned Property. A variance request has been made with the short plat application to allow a pipestem lot as allowed by Section 9-1108(23)(F)(3)(d). VARIANCE 7. The applicant has requested a variance to allow a pipestem lot (proposed Lot 2). It appears the variance is appropriate based on the variance criteria in Section 9-1109(1) as follows: a. That there are special physical circumstances or conditions affecting said property such as the strict application of the provision of this ordinance would deprive the applicant of reasonable use or development of his land. The subject parcel of property is irregular in shape which appears to be the result of past property segregations on Tract 229. These segregations appear to have occurred prior to the establishment of subdivision regulations in 1971. Development has occurred around the parcel limiting the plat design on the site. Access to the back lot (lot 2) is only available from N.E. 12th Street as a result of a recently approved short plat immediately to the north (Short Plat-100-84. Prellwitz and Hewitt). Thus, the property owner is limited in the design of the property without seeking another variance for a private road. Since the property owner does not control the parcel immediately to the east. there may be .problems in the property owners working together to construct a private road. In addition, the issue of maintenance of such a road could arise with the possibility of property owners requesting the City to maintain it. The applicant has sought a variance which places the maintenance of an access driveway solely with the owner of Lot 2. b. That the variance is necessary to insure such property the rights and privileges enjoyed by other properties in the vicinity and under similar circumstances. . PRELIMINARY REPORT ' HE HEARING EXAMINER PATRICK D. HART, FILE NO. SHORT PLAT-046-86. V-047-86, W-048-86 JULY 8, 1986 PAGE 4 The applicant's request for a pipestem lot, while one of two such requests in the neighborhood, appears to be in keeping with the rights and privileges of other property owners in the area. Several of the lots in the neighborhood are larger than the required minimum lot size of 7,200 square feet. The proposed lots would be similar in size to several lots in the neighborhood especially those to the west and south of the subject property. c. That the granting of the variance will not be materially detrimental to the public welfare or injurious to other property in the vicinity. It appears the granting of the requested variance will not be detrimental to the public welfare or create any harm to adjacent properties. The design of the pipestem will allow fire and police vehicles access to Lot 2 and will most likely eliminate cars backing onto N.E. 12th Street. In addition, development of a residence on Lot 2 should not cause any intrusion onto adjacent lots due to the large size of the lot. WAIVER 8. A waiver of off-site improvements has been sought by the applicant due to the lack of improvements along N.E. 12th Street and in the surrounding area. Curbs and gutters have only been .installed on N.E. 12th Street along the frontage of the Hillcrest Lane plat approximately 100 feet east of the subject site. 9. Research into three short plat/waiver applications in the area reveals that outright waivers of off-site improvements have not been granted. Rather, applicants in two cases along N.E. 12th Street were required to sign covenants to participate in any future LID (reference: Short Plat-027-76, W-881-76, and W-886-76). The third case involved property located nearby on Aberdeen Avenue N.E. near N.E. 12th Street. In this situation. an indefinite deferral of curbs, gutters and sidewalks was granted until an LID was formed in the general area (reference: Short Plat-11-75 and W-799-75). In 1984, a short plat was granted immediately to the north along Dayton Avenue N.E. The applicants are responsible for full off-site improvements for the project. In addition to the past land use actions in the area, the Public Works Department does not favor granting waivers of off-site improvements. Engineering staff feels that in the future when the larger parcels of property are redeveloped, full off-site improvements will be constructed along N.E. 12th Street. 10. The applicant should contact the Board of Public Works concerning an application for a deferral of off-site improvements. The Board may wish to consider a covenant to participate in an LID rather than a bond since nearby • property owners have covenants on their property to participate in any future LID. H. DEPARTMENTAL RECOMMENDATION: Based upon the above analysis, the following is recommended that the Hearing Examiner: 1. Approve the short plat (file Short Plat-046-86) and the variance for a pipestem lot (file V-047-86) subject to (a): working with the Utility Engineering Division in relocating the fire hydrant, and (b): providing a ten (10) foot utility easement along the south property lines of Lots 1 and 2. 2.
