The applicant, May Creek Associates. seeks approval of a two lot subdivision on 2.52 acres of commercially zoned property. Currently a single family house and guest cottage exist on proposed Lot 2 of the property together with a garage. These structures will have to be removed prior to development of the lot. 2. The proposed subdivision complies with the zoning classification of B-1. Business Use, but does not comply with the Comprehensive Plan designation of Low Density Multiple Family. The noncompliance issue, however, has been resolved with the rezone of the property in 1985. At that time, a determination was made that limited commercial activity (i.e.. office uses) was appropriate at the location. This determination was based on several factors. First, the location and topography of the subject property made the site undesirable for residential development due to the noise/traffic along I-405. Second, market and land use conditions have changed since the Northeast Renton Area Plan was adopted. In 1980. the area was envisioned as of a commercial/multiple family node but today development in the area is of a commercial/office use nature. Finally, an implementing policy in the Northeast Renton Area Plan encourages employment opportunities in the vicinity of N.E. 44th Street and Interstate 405 (see Section III(B)(4) on page • 56 of the City of Renton Comprehensive Plan Compendium dated March 1986). These factors together with the applicant's agreement to covenants limiting the use and height of structures on the site led to the approval of the rezone without an actual Comprehensive Plan amendment. 3.` The subject proposal is exempt from environmental review as provided in the State Environmental Policy Act of 1971. as amended. ti 4. Various City departments have reviewed the subject short plat. The Zoning Division, the Police Department. and the Building Division approved the subject proposal without conditions. The Policy Development Department, Fire Prevention. the Engineering Division and the Traffic Engineering Division approved the short plat subject to the following conditions: • Policy Development: 1) The request is consistent with the existing land use designation of Commercial and the B-1 (Business Use) zoning of the subject site. 2) It should be stipulated that the existing structures on proposed Lot #2 be removed prior to any future development. • PRELIMINARY REPORT TO THE HEARING EXAMINER MAY CREEK ASSOCIATES, FILE SHORT PLAT-052-86 JULY 15, 1986 PAGE 3 • Fire Prevention: City ordinance requires hydrant spacing not to exceed 330'. Additional hydrants will have to be installed prior to development. © Engineering: 1) Preserve natural retention volume over and above retention/detention requirements. 2) Off-site improvements required on Lake Washington Blvd. and S.E. 76th Street. 3) Utility extension required. 4) Road, storm and utility plans both on-site and off-site required and are to be 22" x 34" original mylars. • Traffic Engineering: 1) Overhead electrical and communications distributions cables should be undergrounded before the off-site improvements are installed such as curbs, gutters and sidewalks. The underground distribution should go underneath the sidewalk or a 10 foot utility easement provided on the back side of the right-of-way line. Underground should occur the full length of the property frontage on Lake Washington Blvd. N.E. and also S.E. 76th Street. 2) Provide street lighting as part of off-site improvements. 3) Development should be assessed for interchange traffic improvement. SHORT PLAT 5. The proposed short plat for future office uses is compatible with other commercial developments in the area. With respect to the residential developments to the north and east of the subject property. development on the proposed lots will provide a buffer from more intensive commercial projects. The specific layout of the site will be examined in the site plan review process required by restrictive covenants for the development of office projects on the subject property. 6. The proposed lots meet the minimum design requirements for commercial plats. 7. The applicant will need to either install or receive a deferral of off-site improvements as required by Section 9-1105(6)(A). The May Creek Associates are currently working with the Board of Public Works to obtain a deferral of the off-site improvements required by the Utility Engineering, the Traffic Engineering, and Design Engineering Divisions of the Public Works Department together with one additional fire hydrant(s) required by the Fire Prevention Bureau . H. BUILDING & ZONING The Building & Zoning Department Report was DEPARTMENT REPORT: received by the Examiner on July 9, 1986. PUBLIC HEARING: After reviewing the Building and Zoning Department Report, examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: The hearing was opened on July 15, 1986, at 9:05 A.M. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. The following exhibits were entered into the record: Exhibit #1 - Yellow file containing application, proof of posting and publication and other documents pertinent to this application. Exhibit #2 - Short Plat Map. Jeannette Samek-McKague, Zoning Research Technician, entered the above exhibits and presented the preliminary report to the Hearing Examiner. She stated the applicant's property currently has a single family home, guest house and garage on lot #2 that will have to be moved prior to development of the site, with a storm water retention area and utility easement located on lot #1 . The property is 2.52 acres in size; zoned for commercial uses; the request does not completely comply with the Comprehensive Plan designation of low density multiple family, but in 1985 a rezone application was approved and at that time it was determined that due to the location and topography of the project that it was conceivable to have some type of commercial activity on the site. Ms. McKague also advised the applicant at the time of rezoning had agreed to sign restrictive covenents limiting activity on the site to office-type uses and also limited the height of the building to 35 ft., which is compatible with the residential height limitations in the R-1 zone. The applicant also agreed to have further site plan review for the proposal . A review was given of the surrounding area and some of the other uses at this time. It was pointed out the topography and the predominance of I-405 noise would make this site undesirable for residential uses. MAY CREEK ASSOCIATES SP-052-86 July 28, 1986 Page 2 Continuing, a review was given of staff comments and Mrs. McKague mentioned the fire hydrants, and off-site improvements which include curbs, gutters, sidewalks, road improvements along with the undergrounding of utilities and participation by the applicant for assessment when developing the interchange at N.E. 44th and I-405. She stated the offices proposed for the site do not intrude into the area; the applicant did not request a waiver of off-site improvements; and recommended that this application be approved conditioned upon the removal of the buildings on lot 1 at the time of development; the off-site improvements are to be in place or a referral obtained prior to filing the short plat; they payment of traffic mitigation assessment fees and preservation of the natural drainage area located on Lot #1 . - The Hearing Examiner called for testimony in support of this application from the applicant or their representative. Responding was Dale Hollister, 5719 South Hawthorne Road, Seattle, Wa. , 98118. He stated there are 2 purchasers for the property, each of whom will be building their own individual office buildings; commented on the requirement by Traffic Engineering that they place the cables underground and wondered if this was done at the time of the development if it would not be premature. Mr. Hollister also questioned the plans of the County on developments in the area and if it would not be best to place all utilities underground at the same time. Mr. Hollister felt it would be practical to accomplish all of the undergrounding either at the time the buildings are placed on the property, or possibly have the other off-site improvements deferred until the proposal is completed. In closing, Mr. Hollister noted it is the plan of the applicant to retain the natural drainage area on Lot #1 . There was no one wishing to testify in further support of the application and no one wishing to, speak in opposition. Wishing to comment and question some points of the application were: Scott Miller, Architect, 9950 Lake Washington Blvd. N.E. , Bellevue, Wa. 98004 who stated the purchaser of lot i2 has plans for a two story, 13,000 sq. ft. building not to exceed 35 ft. in height. Also wishing to comment was: June Huson, 11030 S.E. 76th, Renton, Wa. 98056. Ms. Huson presented background information on her property and other property in the area referring to height and topography of the land. She feels a 35 ft. building on lot #2 would definitely block the view from her property, and on lot #1 a 35 ft. building would possibly also block her view. She requested that the Hearing Examiner recommend a view corridor or restrict the building height to 25 ft. to protect the aesthetic value of her property. Mrs. Huson also questioned the impact on traffic that may be created in their residential zone. Also wishing to comment was Katrina Hoof, 11030 S.E. 76th, Renton, Wa. 98056. Ms. Hoof was also concerned with traffic problems and stressed the need for a traffic signal to be placed at the Denny's Restaurant intersection as well as a system farther north of the site. Referring to the retention pond, she wanted to be sure the channels as well as the pond were going to remain and stressed the importance of the matter to all of the neighbors in the area. Also wishing to comment was Mrs.. Clifford Hoof, 7240 Lake Washington Blvd. N.E. , Renton, Wa. referring to the drainage from the lots and noted that previously the creek had become so overgrown she had to have the Highway Department clean it up. She requested the creek remain open and clean. Testifying for the Traffic Engineering Department was Gary Norris Traffic Engineering Department City of Renton Mr. Norris was asked to clarify the method used to determine the trip generation fee to be charged the applicant and stated an analysis had been completed regarding proposed new development in the area of the subject site and what facilities and improvements would be necessary to support the development. MAY CREEK ASSOCIATES SP-052-86 July 28, 1986 Page 3 From that analysis it was determined that $103.63 was appropriate to meet the improvements. As to the undergrounding of utilities, etc. , it was pointed out this is a ordinance requirement. Referring to the division of two lots fronting on Lake Washington Blvd. and their impact on the arterial network, Mr. Norris stated it was felt there should be no problem with lot #1 only permitted to exit off S.E. 76th Street, 250 ft. east of the intersection of Lake Washington Blvd., because of the drainage retention along the S.W. corner of the property. He said there are no concerns for access by lot #2 but did request that the access be maintained away from any utility poles. He had no further comments at this time. Addressing Mr. Norris's comments on access to Old Lake Washington Blvd. was Katrina Hoof. She questioned whether the north or south end of the triangle would provide access to Lake Washington Blvd. Mr. Norris stated the access could be provided anywhere along the frontage but Ms. Hoof made reference to the hill at the top of the property and the poor sight distance for entering onto th'e boulevard, and asked if a traffic signal could be placed at that portion of the frontage. Wishing to comment further was Dale Hollister. Referring to the drainage concern he stated the culverting would definitely be maintained, and drainage into the holding pond would be kept but may have to be diverted around the buildings. He said once the. northern tip of the property is filled in and the culvert in place, there is almost 75 ft. of level access off Lake Washington Blvd. onto the property to be used for driveway access. Final comments were presented by Jerry Slatter, 5032 Lake Washington Blvd. N.E. , Renton, Wa. 98056, stating he resides north of the site and added emphasis to the drainage problems. He said here have been problems in the past with the springs and clay, and referring to traffic in front of lot #2 there is a hill and curve with difficult sight distance and requested this be considered when the determination of access for lot #2 is made. There was no one else wishing to testify and no further comments from staff. The hearing was closed at 9:40 A.M. FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: 1 . The applicant, May Creek Associates, has requested approval of a two lot Short Plat on approximately 2.52 acres of property. 2. The application file containing the. application, the State' Environmental Policy Act (SEPA) documentation, the Building and Zoning Department Report, and other 'pertinent documents was 'entered in the record as Exhibit #1 . 3. Pursuant to the City of Renton's Environmental Ordinance and SEPA (RCW 43.21C, 1971 , as amended), a Declaration of Non-Significance has been issued for the subject proposal by the Environmental Review Committee (ERC), the responsible official . 4. Plans for the proposal have been. reviewed by all City departments affected by the impact of this proposal . 5. The subject site is located at 4904 Lake Washington Boulevard N.E., on the east side of Lake Washington Blvd. , just north of S.E. 76th Street (King County). 6. , The subject site . was annexed into the City with the adoption of Ordinance, 1823, enacted in April of 1960. The site was rezoned from G-9600 to R-2 (Duplex Residential ) by the adoption of Ordinance 3446 enacted in July, 1980. The site was again reclassified, this time to B-1 (Business/Commercial ) with the adoption of Ordinance 3952 enacted in October, 1985. MAY CREEK ASSOCIATES SP-052-86 July 28, 1986 Page4 7. The map element of the Comprehensive Plan designates the area in which the subject site is located as suitable for the development of low density multi-family uses, but does not mandate such development without consideration of other policies of the plan. 8. As part of the rezone, the City Council imposed Restrictive Covenants. The covenants limited the height of any structures to 35 feet, and the use to office use. 9. The subject site contains an existing single family residence, a guest house and a garage. These structures are located on what is proposed Lot 2. That lot's entire frontage is along Lake Washington Blvd. North. 10. Proposed Lot 1 is located at the northeast corner of the intersection of Lake Washington Blvd and S.E. 76th Street. That portion of the subject site closest to the southwest corner of the site contains a large water retention area. The applicant proposes maintaining the existing system. Water from the hillside will be channeled to this system. 11 . Sight distance along this segment of Lake Washington Blvd. is apparently less than optimal , although staff indicates site preparation including an at-grade driveway can accommodate adequate driveways for both proposed parcels. 12. Detailed plans were not submitted for site development at this time since they are not required. The applicant speculated that any development on the site would be limited to 2 stories or approximately 20 feet, and the buildings would contain approximately 13,000 sq ft. 13. Although neighbors were concerned about view blockage, the City does not have specific regulations regarding this issue. The applicant had previously executed covenants limiting the otherwise unrestricted B-1 height limits to 35 ft. when contained within single family zones. 14. Traffic Engineering indicated the short plat will not entail any major changes to traffic patterns, other than to provide 2 focal points for traffic to enter and exit the site. 15. The lots meet the standards for development in a B-i zone, with each of the lots exceeding 54,000 sq ft in area. CONCLUSIONS 1 . The proposed short plat appears to serve the public use and interest. While there have been some concerns regarding traffic and view blockage, these are not issues particularly attributable to a division of the subject site. 2. Traffic Engineering has indicated that access from proposed Lot #2 along Lake Washington Blvd can be accommodated by site preparation. The division itself will not encourage any additional traffic, and in fact may actually reduce traffic since with the division more property will be required in yards and landscaping, with less available for actual building envelope, resulting in smaller overall square footage and therefore, probably less traffic. 3. The question of view blockage was considered when the property was rezoned. The applicant voluntarily executed covenants limiting the height of buildings to that permitted single family homes, the type of development uphill from the site. Under existing City policy it would not appear appropriate to go beyond the already existing covenants. In addition, the subdivision will not necessarily affect view corridors any more than they could be affected on the unified lot, again considering existing policy. The Subdivision Ordinance indicates that natural features should be respected and incorporated into land use decisions. Therefore, the division should be conditioned upon the preservation of the natural pond or retention area on the site. This natural feature can be worked into the design of the ultimate site. 5. The division will provide a wider range of choices as far as lot sizes go. Utility infrastructure already exists and can service the site so the utilities will not be taxed by the ultimate development of the site. The applicant will have to provide a 15 foot utility easement across the eastern edge of proposed Lot 1 . 6. Development will increase the tax base of the City. Any improvements necessary along the frontages will be required by the applicant and will not burden the City. The applicant agreed to pay $103.63 per trip based upon development potential at the site plan review stage. DECISION The Short Plat is approved subject to the following conditions: 1 . Section 9-1105, Plat Requirements for Short Subdivisions. G. DEPARTMENT ANALYSIS: 1. The applicant, May Creek Associates, seeks approval of a two lot subdivision on 2.52 acres of commercially zoned property. Currently a single family house and guest cottage exist on proposed Lot 2 of the property together with a garage. These structures will have to be removed prior to development of the lot. 2. The proposed subdivision complies with the zoning classification of B-1, Business Use, but does not comply with the Comprehensive Plan designation of Low Density Multiple Family. The noncompliance issue, however, has been resolved with the rezone of the property in 1985. At that time, a determination was made that limited commercial activity (i.e., office uses) was appropriate at the location. This determination was based on several factors. First, the location and topography of the subject property made the site undesirable for residential development due to the noise/traffic along I-405. Second, market and land use conditions have changed since the Northeast Renton Area Plan was adopted. In 1980, the area was envisioned as of a commercial/multiple family node but today development in the area is of a commercial/office use nature. Finally, an implementing policy in the Northeast Renton Area Plan encourages employment opportunities in the vicinity of N.E. 44th Street and Interstate 405 (see Section III(B)(4) on page • 56 of the City of Renton Comprehensive Plan Compendium dated March 1986). These factors together with the applicant's agreement to covenants limiting the use and height of structures on the site led to the approval of the rezone without an actual Comprehensive Plan amendment. 3. The subject proposal is exempt from environmental review as provided in the State Environmental Policy Act of 1971, as amended. 4. Various City departments have reviewed the subject short plat. The Zoning Division, the Police Department, and the Building Division approved the subject proposal without conditions. The Policy Development Department, Fire Prevention, the Engineering Division and the Traffic Engineering Division approved the short plat subject to the following conditions: ® Policy Development: 1) The request is consistent with the existing land use designation of Commercial and the B-1 (Business Use) zoning of the subject site. 2) It should be stipulated that the existing structures on proposed Lot #2 be removed prior to any future development. Additional hydrants will have to be installed prior to development. • Engineering: 1) Preserve natural retention volume over and above retention/detention requirements. 2) Off-site improvements required on Lake Washington Blvd. and S.E. 76th Street. 3) Utility extension required. 4) Road, storm and utility plans both on-site and off-site required and are to be 22°' x 34°' original mylars. e Traffic Engineering: 1) Overhead electrical and communications distributions cables should be undergrounded before the off-site improvements are installed such as curbs, gutters and sidewalks. The underground distribution should go underneath the sidewalk or a 10 foot utility easement provided on the back side of the right-of-way line. Underground should occur the full length of the property frontage on Lake Washington Blvd. N.E. and also S.E. 76th Street. 2) Provide street lighting as part of off-site improvements. 3) Development should be assessed for interchange traffic improvement. The assessment amount would be for participation in the cost of a traffic signal installation at the following four locations: • Lake Washington Blvd./Port Quendall Access Lake Washington Blvd./Ripley Lane N.E. 44th/I-405 Southbound On/Off Ramp N.E. 44th/I-405 Northbound On/Off Ramp AND FOR O 5-lane roadway on N.E. 44th Street from Ripley Lane to Lake Washington Blvd./I-405 northbound on/off ramp Note: Total assessment amount $103.63 x trips (unknown). O The Utility Engineering Division did not approve the application due to the need for sewer plans at this time. SHORT PLAT 5. The proposed short plat for future office uses is compatible with other commercial developments in the area. With respect to the residential developments to the north and east of the subject property, development on the proposed lots will provide a buffer from more intensive commercial projects. The specific layout of the site will be examined in the site plan review process required by restrictive covenants for the development of office projects on the subject property. 6. The proposed lots meet the minimum design requirements for commercial plats. 7. The applicant will need to either install or receive a deferral of off-site improvements as required by Section 9-1105(6)(A). The May Creek Associates are currently working with the Board of Public Works to obtain a deferral of the off-site improvements required by the Utility Engineering, the Traffic Engineering, and Design Engineering Divisions of the Public Works Department together with one additional fire hydrant(s) required by the Fire Prevention Bureau . H.
