SP-004-80 LOCATION: • 120 Factory Avenue North SUMMARY OF REQUEST: , Pursuant to Section 4-711(A) (7) , the applicant seeks approval . of a special permit to allow the revision ofnthe existing Dunn Lumber Company development by the installation of a new steel building replacing two older buildings currently on the, southerly two-thirds of the site. . . SUMMARY OF ACTION: Planning Department Recommendation: Approval with conditions Hearing Examiner Decision: Approval with conditions • PLANNING DEPARTMENT The Planning Department preliminary report was received by the REPORT: • Examiner on February 13, 1980. PUBLIC HEARING: After reviewing the Planning' bepartment report; examining • available information on file with, the application, and field checking the property and surrounding area, the Examiner • conducted a public hearing on the subject as follows: . The hearing was opened on February 19, 1980 at 9:05 a.m. in the Council Chambers of the Renton Municipal 'Building. . Parties wishing to•testify were affirmed by the Examiner. It was reported that the Hearing Examiner and the applicant had received and reviewed the Planning Department report, and the report was entered into the record as Exhibit #1. ,Roger Blaylock, Associate Planner, reviewed Exhibit #1, and entered the following . additional exhibits into the records Exhibit #2: Reduction of Site Plan Exhibit #3: Site Plan with staff comments Exhibit #4: Photographs of existing site (3) The Examiner requested testimony by the application. Responding was: Rob bunn • Vice President, DUnn Lumber Co. • P.O. Box 5050 ' Seattle, WA • 98105 • . ' Mr. Dunn indicated concurrence in recommendations contained in the report with the exception of sight-obscuring fencing on the eastern portion of the property adjacent to the Burlington Northern railroad tracks. He expressed his opinion that screening in • this location is unnecessary due to uses of property. to the east for commercial purposes as well as railroad right-of-way. Mr. ' Dunn also advised that police surveillance would be better facilitated and' vandalism deterred through the usexof chain link fencing on. the east' sid3 of -the site. 'The Examiner indicated that Section 4-711 (A) (7) of the special permit process requires provision of an eight-foot high sight-obscuring fence for the requesteduse, ' andvariance from the requirement can only be granted by application to the Board of Adjustment. The Examiner requested further testimony in support, or opposition to the application. There was no response. He then 'requested final comments from the Planning Department staff. Since Mr. Blaylock offered no further comments, the hearing regarding File No. SP-004-80 was closed by the Examiner at 9:27 a.m. X , . SP-004-80 Page Two • FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the Examiner now makes and enters the following: • FINDINGS: 1. The request is fOr approval of a special permit to operate a lumber storage. yard in a B-1 (Business) zone. 2. The Planning Department report sets forth the issues, applicable policies and provisions, and departmental recommendations in this matter, and is ,entered as Exhibit #1. 3. Pursuant to the City of Renton's Environmental Ordinance and the, State Environmental Policy Act of 1971, R.C.W. 43.21.C. , as amended,, a Declaration of Non-Significance has been issued for the subject proposal by Gordon Y. Ericksen, responsible official. 4. Plans far the proposal have been reviewed by all city departments affected by the impact of this development. 5. There was no opposition to the proposal expressed. 6. All existing. utilities are available and in close proximity. • 7. The proposal is compatible with the required setbacks, lot coverage, and height requirements of Section 4-711(A) (7) (B-1 District) of Title IV, Ordinance No. 1628, Code of General Ordinances. . 8. The subject site was annexed' into the city in.1909. The subject .property was rezoned by separate ordinances in 1953 and 1965 to B-1, its,current designation. 9. The'Comprehensive Plan indicates that the area in which the subject property is located is suitable for the-development of light industrial uses. 10. The subject site, developed with the Dunn Lumber Company, is a pre-existing non- conforming use, in the B-1 zone. 11. The applicant proposes to renovate the property and replace four of the existing structures en the center 'of the site With. a new 16,000 square foot lumber storage building. . Pursuant to Sections 4-711(A) (7) and 4-726(B) (2) , a. special permit is required to accomplish major renovation of the applicant's non-conforming lumber yard. 12. The subject property has been used as a lumber yard ,for over .twenty years. The record indicates that no complaints have been received• concerning the operation of the facility as a lumber yard. 13. In addition to requiring the special permit to operate. a lumber yard in.a B-1 zone, Section 4-711(A) (7) requires the property. to be screened from view' by an eight-foot' sight-obscuring fence 'or wall and the facility cannot be maintained within one hundred feet of the side line of a residential district. 14. Exhibit #3 indicates the location of the required eight-foot fence and the distance to the nearby residential districts is one hundred feet or greater. 15. ' There is a variety of land uses in the area adjoining the subject site. North of the' site are residential uses including single family and duplex uses. 'The ' . Burlington Northern Railroad and a number of businesses are east of the subject site. Just south of the site is a real estate office. Across Factory Avenue on the west-are vacant lot's, a motel, single family dwellings and duplex uses. • 16. The site is in a transitional area. The site, is zoned B-1, and R-1 (Single Family ` ' Residential; 'minirs:um lot size 7200, square feet) and R-2 (Duplex Residential) constitute zoning on 'the north and west. Coercial and industrial zoning is on the east including an L-1 (Light Industrial) zone, and 'Liberty Park and. the Maple Valley Highway/I-405 Interchange located to the south are zoned P-1 (Public) . 17. The new structure will .require 11 additional parking spaces which the applicant proposes to provide,., 'The parking area will have to be landscaped in accordance with the Parking and Loading Ordinance. • 18. In conjunction with the parking' area landscaping, the Planning Department recommends that all landscaping be coordinated with the landscaping already installed on the • northern portion of the subject property. SP-004-80 Page Three • 19. The building will present a rather long, 175 foot facade to the residential property on the west side of Factory Avenue North and the Planning Department recommended that the wall be treated with a "dull finish" material in order to cut down the reflected glare, and some hedges and shrubs be planted in front of it to soften the impact of this wall on adjacent neighbors. 20. The applicant indicated that they would plant the .landscaping, install the required parking and provide a dull finish for the building. The applicant indicated a preference of a cyclone fence along the east side which only faces the railroad tracks and would allow easy surveillance by police officers of the lumber yard. CONCLUSIONS: 1. Section 4-711(A) (7) 'requires a finding that the proposed use of the subject property will: not prove unduly detrimental to adjacent properties and that the design is acceptable in the proposed location. The subject proposal, . the renovation of an existing lumber yard, will permit the continued operation of an ongoing ,business in the same location in which it has been operating for over 20 .years. The location appears to be suitable in that there have been no complaints. registered about the use and no persons appeared at the hearing to oppose the request. 2. The proposal,will be 'modified to comply with the requirements of the approved special permit and will include landscaping.. While the existing lumber yard was not screened' with a view-obscuring fence the renovated facility will have to provide such screening along with landscaping of both the perimeter of the site and the parking area. 3. The applicant has agreed to the Planning Department's recommendation on plantings both 'in the parking areas and along the perimeter of the building, and further agreed to_ finish the exterior of the building with a "dull finish" to eliminate glare .en the homes to the west. • 4. The applicant also agreed to change the driveway configuration on Factory Avenue N. in order to lessen the impact on the homes on the west side of that street. 5. The storage of lumber outside of the•confines of the. screening fence would defeat the purpose of screening. the lumber yard and therefore, no display of lumber should be permitted outside of the screened area. 6. The purpose of the screening fence is to improve the image of the industrial uses in the city. from all vantage points. . While the property to the east of the subject site is railroad right-of-way,' the. subject site is generally' visible from the ,east and from nearby• businesses. The view obscuring fence will enhance the effects of the subject property upon the adjoining uses and therefore mitigate any resulting detriment to adjoining uses. . • 7. Both the design of the building and the improved landscaping will permit the renovated lumber yard to blend in with the mixed uses in the area, and the subject proposal will not adversely affect adjoining properties. DECISION: The special permit to establish a lumber yard in the B-1 zone is approved subject to the following conditions: ' 1. The construction of an eight-foot high, view-obscuring fence constructed as indicated in Exhibit 43. . 2. Landscaping of the. perimeter of the site along Factory Avenue N. and the landscaping of the parking area as required by Section 4-2204.8(B) (1) and (2) of the Parking and Loading Ordinance. 3. No storage of lumber or other goods for sale or display purposes shall occur outside of the view-obscuring fence. 4. The exterior finish. of the proposed new structure shall be finished in a "dull ' finish" material and•the entire structure shall be coordinated with the remaining . structures on the site. 5. The elimination of the center driveway on Factory Avenue N. 6. The Planning bepartment'shall approve the final landscaping plans prior to issuance of the building permit. • SP-004-80 Page Four 7. ENVIRONMENTAL ASSESSMENT/THRESHOLD DETERMINATION: J: Pursuant to the City of Renton ' s Environmental Ordinance and the State Environmental Policy Act of 1971 , as amended , RCW 43-21C , declaration of non-significant impact has been prepared by the Planning Director , the responsible official , in reviewing this application . • K . The applicant requests this Special Permit approval to allow the remodeling of the existing retail lumber. , yard located at the southwest corner of Factory Avenue North and Brooks Street . 2 ; The proposed remodeling involves the installation of a new 16 , 000 square foot lumber storage building which will replace 4 existing buildings in the central portion of the site . The existing office and retail ' structure located at the extreme north end of the site will remain . The development plan as submitted also proposes the installation of parking along Factory Avenue North to accommodate the required parking for the revised structures . 3 . The existing office and retail building currently provides adequate parking in the front and rear of that structure . ( 9 parking spaces for the office areas , and 10 parking spaces for the retail hardware area, ) The new 16 , 000 square foot building will • require one additional parking stall for each 1 , 500 square feet or 11 parking spaces . The submitted site plan does indicate the provision of 11 spaces as required . Section 4-11 (A) ( 7 ) requires that a lumber yard be separated from a residential district side line (emphasis added) by 100 feet . Further , that any such area be surrounded by a sight obscuring 8 ' fence . Due to the proximate of residentially zoned lots (see attached map ) to the west and north , the 8 ° fence should be erected 40 ' behind the street property lines . In conjunction with the 60 ' street right-of-way this will place the yard 100 ' from the nearest side (property) line of a residence district . Fencing design must be reviewed prior to issuance of a building permit . r 1• PLANNING DEPARTMENT PRELIMINARY REPORT TO THE HEARING EXAMINER PUBLIC HEARING : DUNN LUMBER CO . , SP-004-80 FEBRUARY 19 , 1980 PAGE FOUR 4 . Parking and Loading Ordinance requires that parking areas be separated from the streets rights-of-way with a minimum 5-foot landscaped area . Although the existing development provides this landscape buffer , the submitted site development plan does not provide for this 5-foot minimum landscaped strip along Factory Avenue North . In addition , the Parking and Loading Ordinance requires that 5% of the paved area of a parking lot be provided as landscaping . , The.;submitted ..landscaping plan does not provide • for this 5% interior landscaping . (See attached submitted site plan . ) 5 . In reviewing the site , the applicant has provided and maintained the required landscaped areas for the development at the northerly end of the site . This landscaped area will remain with redevelopment of the southerly 2/3 ' s of the site . There is adequate space within the development proposal to provide both the ' 5-foot minimum landscape separation between the parking area and Factory Avenue North as well as the 5% interior landscaping by providing landscaped islands adjacent to the driveway entries and a landscaped planter along the front of the building . 6 . Although the applicant has not submitted a detailed landscaping plan , it would be recommended that the landscaping scheme that exists within the northerly one-third of the site be extended across the Factory Street frontage , In addition , the driveway entry islands should be provided with canopy-type trees of sufficient size to provide fo-r a softening of the asphalt parking expanse . In addition , the 5-foot planter area adjacent to the building should contain both hedge plant materials and columnar tree plantings to provide architectural character and a softening of the expanse of the building wall which would face residential uses to . the west of this site . 71 The Police Department indicates there is little or no impact on police functions . The Building , Engineering , and Traffic Engineering Divisions have recommended approval of the plans . The Fire Dept. indicates that future building construction shall meet the Fire Chief ' s requirements 'for fire flow, and for the number , type and location of the fire • • hydrants . The building shall meet the occupancy requirements of the Uniform Fire Codes , specifically Article 21 , Title "Lumber Yards and Working Plants" . Access shall conform to the requirements of the Fire Chief . Water main installations shall conform to the requirements of the Utlity Engineering Division . The comments of the departments are attached for further review . 8 . The proposed building construction will be an engineered steel building with a rectangular shape with a nearly flat roof appearance . Due to the significant expanse of the building facade facing Factory Avenue North (in excess of 175 feet ) , the building exterior treatment • should be of a dull (non gloss ) type . If a glossy appearance is allowed , late afternoon or other low sun angle time frames may adversely affect the single family residences located to the west of this site . DEPARTMENTAL RECOMMENDATION: : Based upon the foregoing analysis , it is recommended that the Dunn Lumber Company Special Permit be approved subject to the following conditions : • 1 . That the center Factory Avenue North driveway be closed with access from the northerly driveway to both parking areas , or that a landscape separation be provided between the hardware area and the new parking area to soften the appearance of the chain ' link fence separating the two parking lots . • 2 . That the site plan be revised . to include the required 5-foot separation between the public right-of-way and parking lot . area , and the 5% interior landscaping as noted in the attached revised site plan . 3 . . An 8 ' high sight obscuring fence of architectural design to the approval of the Hearing Examiner shall be installed 40 ' inside the street property lines ` and surround the remaining property lines . No building permit shall be issued until such fence design is approved by the Hearing Examiner . 4 . ,No storage used for lumber sales or service or other lumber yard activity shall occur outside the 8 ° screen fence . y 5 . That the street planting now existing along the northerly end of Factory Avenue and Brooks Street be extended across the revised site area and to consist of similar ' trees located on the same center to center spacing . 6d' That prior to issuance of a Building Permit , a landscaping plan conforming generally to the landscape materials to be retained in the northerly portion of the site shall be extended throughout the revised site area. This landscaping 'plan to include canopy-type trees in the driveway entry planters , and hedge and columnar trees in the 5-foot planter adjacent to the new building structure . 7 .• All existing parking stall lines which have become worn shall be repainted concurrently With the completion ' of this development . 8 . Vehicle wheel stops shall be utilized in the diagonal parking in front of the new structure to protect the proposed chain link fence from damages from vehicle bumpers . - 9 . C . HISTORY/BACKGROUND : The' subject site was annexed into the City by Ordinance 156 in 1909 . The southerly six lots were zoned B-1 with the adoption of the Zoning Ordinance in 1953 , and the northerly five lots were zoned from R-2 to B-1 -by Ordinance 2149 in 1965 . Parking and Loading Ordinance requires that parking areas be separated from the streets rights-of-way with a minimum 5-foot landscaped area . Although the existing development provides this landscape buffer , the submitted site development plan does not provide for this 5-foot minimum landscaped strip along Factory Avenue North . In addition , the Parking and Loading Ordinance requires that 5% of the paved area of a parking lot be provided as landscaping . Theasubmitted ..landscaping plan does not provide for this 5% interior landscaping . (See attached submitted site plan . ) 5 . In reviewing the site , the applicant has provided and maintained the required landscaped areas for the development at the northerly end of the site . This landscaped area will remain with redevelopment of the southerly 2/3 's of the site . There is adequate space within the development proposal to provide both the 5-foot minimum landscape separation between • the parking area and Factory Avenue North as well as the 5% interior landscaping by providing landscaped ' islands adjacent to the driveway entries and a landscaped planter along the front of the building . 6 . Although the applicant has not submitted a detailed landscaping plan , it would be recommended that the landscaping scheme that exists within the northerly one-third of the site be extended across the Factory , ; Street frontage , In addition , the driveway entry islands should be provided with canopy-type trees of sufficient size to provide for a softening of ' the asphalt parking expanse . In addition , the 5-foot planter area adjacent to the building should contain both hedge plant materials and columnar tree plantings to provide architectural character and a softening of the expanse of the building wall which would face residential uses to the west of this site . 7 . The Police Department indicates there is little or no impact on police functions . The Building , Engineering , and Traffic Engineering Divisions have recommended approval of the plans . The F-ire Dept . indicates that future building construction shall meet the Fire Chief ' s requirements for fire flow, and for the number , type and location of the fire hydrants . The building shall meet the occupancy requirements of the Uniform Fire Codes , specifically Article 21 , Title "Lumber Yards and Working Plants" . Access shall conform to the requirements of the Fire Chief, Water main installations shall conform to the requirements of the Utlity Engineering Division . The proposed building construction will be an engineered steel building with a rectangular shape with a nearly • flat roof appearance . Due to the significant expanse • of the building facade facing Factory Avenue North (in excess of .175 feet ) , the building exterior treatment should be of a dull (non gloss ) type . If a glossy appearance is allowed, late afternoon or other low sun angle time frames may adversely affect the single family residences located to the west of this site . The landscaping proposal for the planter extending across the face of the structure will help to soften the affect , however , the exterior finish remains of concern . RAPARTHIMAL NRECUMIfMElfvl®A1iI ff 1: Based upon the foregoing analysis , it is recommended that the Dunn Lumber Company Special Permit be approved subject to the following conditions : 1 .i That the center Factory Avenue North driveway be closed with access from the northerly driveway to both parking areas , or that a landscape separation \ be provided between the hardware area and the new parking area to soften the appearance of the chain link fence separating the two parking lots . 2 . That the site plan be revised to include the required . 5-foot separation between the public right-of-way and parking lot area , and the 5% interior landscaping as noted in the attached revised site plan . 3 . 'An 8 ' high sight obscuring fence of architectural design to the approval of the Hearing Examiner shall 'be installed 40 ' inside the street property lines and surround the remaining property lines . No building permit shall be issued until such fence design is approved by the Hearing Examiner . 4 . , No storage used for lumber sales or service or other lumber yard activity shall occur outside the 8 ' screen fence . 5 . That the street planting now existing along the northerly end of Factory Avenue and Brooks Street be extended across the revised site area and to consist of similar trees located on the same center to center spacing . 6 . ;' That prior to issuance of a Building Permit , a landscaping plan conforming generally to the landscape materials to be retained in the northerly portion of the site shall be extended throughout the revised site area. ' This landscaping 'plan to include canopy-type trees in the driveway entry planters , and hedge and columnar ' trees in the 5-foot planter adjacent to the new building structure . 7 . '' All existing parking stall lines which have become worn shall be repainted concurrently with the completion of this development . 8 . Vehicle wheel stops shall be utilized in the' diagonal parking in front of the new structure to protect the proposed chain link fence from damages from vehicle bumpers . 9 .'
