V APPLICANT: V " Brady International Hardwoods Co. FILE NO. SP-011-80 LOCATION: East side of Lind Avenue S.W. approximately 500 feet north of S.W. 34th Street immediately north of Service Paper Company. SUMMARY OF REQUEST: The applicant requests approval of a special permit to allow the pr.eloading of the site with approximately 31 ,720 cubic yards of material prior to the construction of the Brady International Hardwoods Company building. SUMMARY OF ACTION: V Planning Department Recommendation: Approval with conditions. Hearing Examiner Decision: Approval with conditions. PLANNING DEPARTMENT The Planning Department preliminary report was received by the REPORT: Hearing Examiner on July 10, 1980. PUBLIC HEARING: After reviewing the Planning Department report, examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: The hearing was opened on July 15, 1980 at 9:40 a.m. in the Council Chambers of the Renton Municipal Building. V Parties wishing to testify were affirmed by the Examiner. . It was reported that the Hearing Examiner and the applicant had received and reviewed the Planning Department report. Roger Blaylock, Associate Planner, reviewed the report, and entered the following exhibits into the record: Exhibit #1 : Application File containing Planning Department report and other pertinent documents Exhibit #2: Grading Plan Map Mr. Blaylock advised concerns of the Police Department with traffic problems on Lind Avenue S.W. resulting from dirt and mud from the fill operation, and stated that the applicant will be required to mitigate those problems as necessary. The Examiner requested testimony by the applicant. Responding was: Gary Faull P.O. Box 26 Renton, WA 98055 Mr. Faull , legal counsel for the applicant, corrected the denoted size of the parcel contained in Section C. of the Planning Department report to 8.4 acres. The Examiner indicated that as parcels are individually filled, a moat or ditch is created adjacent to property lines, and he inquired regarding the proposed slope differential anticipated between the subject site and various adjacent lots. Responding to the Examiner's. inquiry was: . Lance Mueller 130 Lakeside ' Seattle, WA 98122 " Mr. Mueller, architect for the applicant, advised that floor elevations designated on the proposed fill and grade plan correspond with those of the adjacent property to the south occupied by Service Paper Company. He stated that due to the nature of the applicant's operation and the necessity for rail service, minimal latitude exists to vary floor levels. However, as a result of a lowering of the flood level in the area by the King County Hydraulics Division, the possibility exists to lower the building elevation by two feet , ' which would reduce the amount of fill on the site. Mr. Mueller did not anticipate any sharp grade transitions to adjacent properties since al.l sites require rail service. SP-011-80 Page Two The Examiner requested testimony in support or opposition to the application. There was no response. He then invited final comments from the Planning Department staff. Since there were no further comments offered, the hearing regarding File No. SP-011-80 was closed by the Examiner at 9:52 a.m. FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: 1 . The request is for approval of a special permit to fill and grade a +4.05 acre site with approximately _31 ,720~cubic yards of material in order to construct a warehouse/ office facility (See SA-012-80) . 2. The application file containing the application, SEPA documentation, the Planning Department report, and other pertinent documents was entered into the record as Exhibit #1 . 3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental Policy Act of 1971 , R.C.W. 43.21 .C. , as amended, a Declaration of Non-Significance has been issued for the subject proposal by, the Environmental—R"eview—Committee. --�v_ 4. Plans for the proposal have been reviewed by all city departments affected by the impact of this development. 5. There was no opposition to the proposal expressed. 6. All existing utilities are available and in close proximity. . • 7. The proposal is compatible with the required setbacks, lot coverage and height requirements of Section 4-730 (M-P; Manufacturing Park) of Title IV, Ordinance No. 1628, Code of General Ordinances. 8. The property is located on the southeast corner of Lind Avenue S.W. between S.W. 29th Street and S.W. 34th Street. 9. The site was annexed into the city in 1959. The current M-P classification was applied in 1969 and a final plat was approved in July of 1978. Subsequent to that approval the applicant applied for approval of a short •plat to redivide Lot 7 into two smaller - 1ots.-- Pursuant to an opinion of the City Attorney as to the effects of Attorney General Opinion, AGO, 1980, No. 5, the short plat was dismissed and the applicant filed a request for a preliminary plat (File No. PP-055-80) . The Hearing Examiner has recommended that the requested preliminary plat be approved by the City Council. This application concerns Lot 7b of that preliminary plat. 10. The subject site is generally level as the result of previous grading and filling which has occurred on the site. The only vegetation on the site are scrub grasses • and weeds. . 11 . The site is currently undeveloped. The applicant proposes to grade and fill the site pursuant to Section 4-2303.2(A) , which requires Hearing Examiner approval of a special permit. 12. Once filled, the grade of the site will be 21 .4 feet. The grade of the site is now approximately 16.5 feet. The site will then meet the requirements of the King County Division of Hydraulics for flood protection. 13. There will be no sharp grade transition between the subject site and adjoining sites; that is, no moat' will be formed along or adjacent to property lines. 14. The applicant proposes to allow the fill material to settle and stabilize before constructing an office/warehuse on the subject site. 15. A sedimentation pond will provide for temporary runoff retention on site as the grading and filling occurs. 16. The Police Department has the standard concern that debris from the operation must be cleared from the adjoining roadways on a daily basis. 17. Similar grading and filling has occurred on other properties, in the area as a . precondition to building on the various sites in the Orillia Industrial Park. SP-uil-80 Page Three CONCLUSIONS: 1 . The grade and fill permit will enable the applicant to raise the level of the site to 21 .4 feet which in turn will provide flood protection as required by the King County Division of Hydraulics. 2. The operation will not be materially detrimental to any other properties in the area nor will it harm the general public as long as debris tracked onto and off the site and onto• public rights-of-way is cleared on a daily basis. 3. In order to assure that streets in the area surrounding the site of the proposed grade and fill activity are kept clean, a cash bond should be posted with the Department of Public Works. The bond may be used if and when either the Public Works Department or the Police Department find that accumulated debris is a potential traffic hazard. The Public Works Department shall determine the amount of the bond. 4. The applicant has submitted plans for reuse of the site and such plans are covered by a separate application for a site approval (File No. SA-012-80) . DECISION: The special permit for fill and grade is approved subject to the posting of a cash bond, the amount subject to a determination of the Public Works Department, to ensure that the roadways adjacent to the subject site are kept clear of debris generated by the fill and grade operation. Any aggrieved person feeling that the decision of the Examiner is based on erroneous procedure, errors of law or fact, error in judgment, or the discovery of new evidence which could not be reasonably available at the prior hearing may make a written request for review by the Examiner within fourteen (14) days from the date of the Examiner's decision. This request shall set forth the specific errors relied upon by such appellant, and. the Examiner may, after review of the record, take further action as he deems proper. An appeal to the City Council is governed by Title IV, Section 3016, ,which requires that such appeal be filed with the City Clerk accompanying a filing fee of $25.00 and meeting , other specified requirements. PRELIMINARY REPORT TO THE HEARING EXAMINER PUBLIC HEARING : BRADY INTERNATIONAL HARDWOODS , SP-011-80 JULY 15 , 1980 PAGE TWO A special permit for fill and grade was granted on November 19 , 1975 and the subject site was part of the final plat of Orillia Industrial Park #1 approved by the Hearing Examiner on June 19, 1978. The original southern property line of Lot 7 of Block 1 , Burlington Northern Orillia Industrial. Park was adjusted by a Lot Line Adjustment LLA-020-79 . A request for a preliminary plat, File No . PP-055-80 is presently pending to legally divide the ±7.2 acre parcel into two pieces . D. PH 'SI CAL BACKGROUND: : 1 . Topography : The site is basically level . 2 . Soils : Primary Urban Land (Ur ) from the fill operation . The property has since been filled with a suitable granular material to a height acceptable to King County Hydraulics for flood proofing. 3. Vegetation : The only significant vegetation consists of scrub grass . • 4. Wildlife : The existing vegetation does not provide suitable wildlife habitat . 5 . Water : No surface water was observed on the subject site (July 3, 1980) 6. Land Use : The subject site is undeveloped except for the previous fill material . The Service Paper Company project is under construction to the south while the Superior Fast Freight facility is located on the adjacent property to the east . Properties to the west and north remain undeveloped. The Benaroya warehousing facility is located to the southwest. E .
