SP-032-80 LOCATION: South side of N.E. 4th Street approximately 160 feet east of Union Avenue N.E. SUMMARY OF REQUEST: The applicant requests approval of a special permit for fill and grade of approximately 2,000 cubic yards in preparation for construction of a future building in 1981 . SUMMARY OF ACTION: Planning Department Recommendation: Approval with conditions Hearing Examiner Decision: Approval with conditions PLANNING DEPARTMENT The Planning Department preliminary report was received by the REPORT: Hearing Examiner on July 23, 1980. • PUBLIC HEARING: After reviewing the Planning Department report, examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: • The hearing was opened on July 29, 1980 at 9:00a.m. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. It was reported that the Hearing Examiner and the applicant had received and reviewed the Planning Department report. Roger Blaylock, Associate Planner, reviewed the report, and entered the following exhibits into the record: Exhibit #1 : Application File containing Planning Department report and other pertinent documents Exhibit #2: Site Plan with staff comments Exhibit #3: Temporary Sedimentation Plan with staff comments Exhibit #4: Vicinity Map Referencing Section B.8 of the Planning Department report which discusses existing zoning of the property, the Examiner requested Mr. Blaylock to designate the R-3 portion. Utilizing Exhibit #2, Mr. Blaylock pointed out the residentially zoned property on the southernmost portion of the site, and indicated that the fill project will occur only on the B-1 zoned property. Referencing Section L.4.a. , which requliires approval of a temporary storm water sedimentation plan by the Public Works Department, Mr. Blaylock advised that due to submission of Exhibit #3 prior to the public hearing, the requirement has been met. The Examiner requested testimony by the applicant. Responding was: Dominic Colasurdo 3546 N.E. 4th Street Renton, WA 98055 Mr. Colasurdo indicated concurrence with recommendations contained in the Planning Department report. The Examiner requested comments in support or opposition to the application. There was no response. He then requested final comments from the Planning Department staff. Since no further comments were offered, the hearing regarding File No. SP-032-80 was closed by the Examiner at 9:20 a.m. SP-032-80 Page Two FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: 1 . The request is for approval of a special permit to place approximately 2,000 cubic yards of fill on a portion of an +82,755 square foot site. 2. The application file containing the application, SEPA documentation, the Planning Department report, and other pertinent documents was entered into the record as Exhibit #1 . 3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental Policy Act of 1971 , R. C.W. 43.21 .C. , as amended, a Declaration of Non-Significance has been issued for the subject proposal by the Environmental Review Committee, responsible official . 4. Plans for the proposal have been reviewed by all city departments affected by the impact of this development. 5. There was no opposition to the proposal expressed. 6. All existing utilities are available and in close proximity. 7. The subject property is located on the south side of N.E. 4th Street approximately 160 feet east of Union Avenue N.E. 8. The site is generally level . There is a low area adjacent to N.E. 4th Street which the applicant has proposed to fill pursuant to Section 4-2305 of the Mining, Excavating and Grading Ordinance. 9. The subject site is zoned both B-1 (Business/Commercial ) and R-3 (Medium Density Multifamily) . The B-1 zoning fronts along N.E. 4th. The R-3 zoning lies along the south property line. 10. The Comprehensive Plan indicates that the area is suitable for commercial development. 11 . An intermittent stream crosses the site from the north to the south. 12. The fill will consist of approximately 2,000 cubic yards and will be placed along the northeast portion of the subject site as preparation for future development. Specific building plans have not been submitted for the subject site. 13. Temporary storm sedimentation plans have been submitted for the fill operation and have been approved by the Public Works Department. 14. Permanent storm drainage plans must be submitted for. the site to accommodate the flow generated by the seasonal stream. The applicant proposed to underground and culvert the stream. 15. The Police Department has recommended that the approximately 80 vehicle trips required for the fill operation be routed to the site via Union Avenue N.E. rather than the heavily traveled N.E. 4th Street. They also recommended that operations be curtailed prior to the evening peak traffic hours. 16. Section 4-2316 requires every effort to preserve both perennial and intermittent streams. The Comprehensive Plan at page 10 indicates that conservation and restoration of natural resources is a primary goal of the city. CONCLUSIONS: 1 . The applicant proposes to fill a low depression on the subject site with approximately 2,000 cubic yards of fill material . This will require about 80 vehicle trips. In doing so, the applicant will eliminate an intermittent stream. The applicant has failed to demonstrate that the elimination of a natural drainage system is required. Section 4-2316 of the Mining, Excavation and Grading Ordinance requires that "every effort" at preservation of natural water courses is required. The Comprehensive Plan has also indicated that natural features should be incorporated into new developments and such features should be preserved. The applicant has the burden of demonstrating that the ultimate plans for reuse of SF-u32-80 Page Three the site, cannot be reasonably altered to provide the continued vitality of the stream coursing through the subject site. 2. Undergrounding the stream will not aid in the retention of•other runoff which would have entered the stream through natural surface runoff. The continued loss of even minor and,temporary drainage systems has led to periodic flooding. Such flooding can be lessened or eliminated if natural drainage was minimally altered. 3. Unless the applicant is prepared to demonstrate that reasonable development cannot be designed for the subject property incorporating the natural drainage feature of this site, the intermittent stream must be protected. 4. In order to insure the daily removal of debris from the public roadway, a cash bond should be posted with the Department of Public Works for that purpose. 5. Since traffic i.n the afternoon rush hour could be hampered by the entrance and exit of fill vehicles, the operation should terminate prior to 3:00 p.m. and all access to the site should be via Union Avenue N.E. 6. Other than the plans to fill the natural stream, the applicant may fill and grade the site in preparation for further development. As conditioned, the filling and • grading of the subject site will not harm neighboring properties or the public health, safety or welfare. DECISION: The special permit to fill and grade the subject site is approved subject to: 1 . Posting of a cash bond in the amount of $1 ,000 (one thousand dollars) to insure the cleaning of debris off the roadway on a daily basis. 2. No vehicle shall enter or leave the site after 3:00 p.m. weekdays, and all access to the site shall be via Union Avenue N.E. 3. The plans, subject to the approval of the Planning and Public Works Departments, shall be changed to protect the intermittent stream. ORDERED THIS 1st day of August, 1980. AN.A-S Fred J. Runoff is slow to moderate and the erosion hazard is moderate . This soil is used for timber, pasture , berries , row crops , and for urban development . 3 . Vegetation : Virtually all of the natural vegetation on site has been removed . What remains consists principally of scrub grass . 4 . Wildlife : The existing vegetation provides minimal , if any , habitat forarea wildlife . 5 . Water : No surface water was observed on the subject site (July 16 , 1980 ) . The subject: area is a seasonal stream flowing from north to south. 6 . Land Use : The site is presently vacant . Fill material in the public right-of-way for N .E . 4th Street is to be no higher than the adjacent roadway and be Class B pit run . 5 . The placement of only 2 ,000 cubic yards of fill does not appear significant . However , the fill is to be placed in a natural drainage area . The placement of that drainage into underground culverts addresses the functional engineering of the situa- tion . However , it does not address the aesthetic impacts of removing the natural area nor the cumu- lative impacts of undergrounding the entire natural drainage system . Functionally natural drainage areas could be either a land use separation or focal points in various stages of urban development . The 1965 Comprehensive Plan specifically sets forth as a policy that "significant" natural areas, be retained within development . The level of the significance of this particular stretch of stream is probably minor . However , the cumulative effect of similar "minor" disruptions to the natural stream system could be considered unacceptable. Due to the current intrusion of urban uses and activity into this specific area, the special permit should be approved . M .
