The request is for approval of a special permit to permit the applicant to remove approximately 50,000 cubic yards of earth material from an approximate 3.8 acre site. 2. The application file containing the application, SEPA documentation, the Planning Department report, and other pertinent documents was entered into the record as Exhibit #1 . 3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental Policy Act of 1971 , R.C.W. 43.21 .C. , as amended, a Declaration of Non-Significance has been issued for the subject proposal by the Environmental Review Committee, responsible official . 4. Plans for the proposal have been reviewed by all city departments affected by the impact of this development. 5. The subject site is located near the southeast corner of the Greenwood Cemetery in the vicinity of Queen Avenue N.E. and 132nd Street. 6. The portion of the subject site for which the permit is being requested is a high knoll . The applicant proposes to level the knoll to permit the eventual expansion of the adjacent cemetery. 7. The subject property is currently classified as G (General ; Single Family Residential ; Minimum lot size - 35,000 square feet) . The current cemetery is a legal non-conforming use. No expansion of non-conforming uses is permitted pursuant to Section 4-726(B) (3) . The Planning Department indicated that the applicant will have to apply for and be granted a reclassification of the subject property to P-1 (Public/Quasi-Public) to permit the expansion of the cemetery. 8. The applicant has applied for the grading permit pursuant to Section 4-2307. 9. The reuse of the site after the grading operation is the proposed expansion of the cemetery subject to the reclassification of the property. 10. The Comprehensive Plan designates the area in which the subject property is located as suitable for the development of public and quasi-public uses. 11 . The operation will level off the knoll from its current height of 375 feet to 348 feet to conform with the existing topography of the remainder of the cemetery. 12. The removal of the approximate 50,000 cubic yards of material will require approximately 2,000 round trips by heavy dump trucks. 13. The subject site is surrounded by an apartment complex to the east and a 'mobile home park to the south. There are some scattered single family homes in the area. 14. The removal operation will retain the natural slopes adjacent to the neighboring properties. These adjoining properties will be higher and the Public Works Department is reviewing drainage plans to prevent erosion and runoff onto the subject property after removal of the material . 15. The Police Department indicated that the roadways must be signed for truck crossing, kept clear of debris, and the hours of operation must be limited to avoid conflicts with peak hour traffic demands. CONCLUSIONS: 1 . The subject proposal to level the existing knoll by removing 50,000 cubic yards of fill will not adversely affect the adjoining properties nor will it injure the public health, safety and welfare as long as the operation is carried on in a reasonable manner. 2. The removal of the fill will require the use of heavy dump trucks and will require 2,000 round trips onto and off of the site. This type of activity must be closely monitored so that debris is not carried onto the various roadways surrounding the site and so that dust does not disturb the adjacent properties . The removal operations are guided by Section 4-2314 which provides for the control of mud and dust. July 11 , 1980 OFFICE OF THE LAND USE HEARING EXAMINER CITY OF RENTON REPORT AND DECISION. APPLICANT: Greenwood Memorial Park, Inc. FILE NO. SP-051-80 LOCATION: Southwest corner of N.E. 4th Street and Queen Avenue N.E. (extended). • SUMMARY OF REQUEST: The applicant requests approval of a Special Permit to allow removal of approximately 50,000 cubic yards of earth material to provide for expansion of an existing cemetery. SUMMARY OF ACTION: Planning Department Recommendation: Approval with conditions and the requirement to post a cash bond. Hearing Examiner Decision: Approval with conditions and the requirement to post a cash bond. PLANNING DEPARTMENT The Planning Department preliminary report was received by the REPORT: Examiner. on July 3, 1980. PUBLIC HEARING: After reviewing the Planning Department report, examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: The hearing was opened on July 8, 1980. at 11 :00 a.m. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. It was reported that the Hearing Examiner and the applicant had received and reviewed the Planning Department report. Roger Blaylock, Associate Planner, reviewed the report and entered the following exhibits into the record: Exhibit #1 : Application File containing Planning Department report and other pertinent documents Exhibit #2: Site Plan with staff comments Exhibit #3: Cross Sections (2 sheets) The Exami©er corrected Exhibit #2 which designates the extension of Queen Avenue N.E. as N.E. 4th Street. The plan was subsequently corrected by Mr. Blaylock. Mr. Blaylock referenced Section J. of the report, and noted that the appeal period for the , declaration of non-significance expired on July 2, 1980. He also clarified the recommendation for posting a cash bond denoted in Section L.6.b. because of difficulty in foreclosing on performance bonds. The Examiner requested testimony by the applicant, and inquired regarding the location of proposed truck access from the site. Responding was: Jack Ewing 622 S. Central Kent, WA 98031 Mr. Ewing advised that access would be provided off of Queen Avenue N.E. and he referenced an aerial photograph which had been previously submitted and contained in the application file to depict the location of the site and access road. He indicated concurrence in the Planning Department recommendations; however, he inquired if extension of the proposed hours of operation would be feasible. Mr. Blaylock advised that due to severe traffic congestion during peak hours on N.E. 4th Street, established hours of operation must be enforced. The Examiner requested testimony in support or opposition to the application. There was no response. He then requested final comments from the Planning Department staff. Since there were no further comments, the hearing regarding File No. SP-051-80 was closed by the. - Examiner at 11 : 15 a.m. ''i I e SP-051 .,., Page Three 3. In order to ensure the prompt removal of any debris from the roadways , a cash bond must be posted to permit the city to perform the work if the applicant fails to clean the roadways. • 4. The hours ,of operation must be restricted so that the trucks do not interfere with the residential uses surrounding the site nor with traffic on N.E. 4th Street during the peak demand hours of 7:00 to 9:00 a.m. and 3:00 to 6:00 p.m. Therefore, operations should be limited to Monday through Friday, and on those days to the hours of 9:00 a.m. to 3:00 p.m. 5. Because of the topography of the site and slopes adjoining property, no grading shall occur until the drainage plans have been approved by the Public Works Department. DECISION: The special permit for grading of the subject site is approved subject to the following: 1 . The posting of the site and adjacent roadways to inform passing motorists of the truck crossing zone. 2. Approval of storm drainage plans by the Public Works Department prior to the issuance of the annual grading permit. 3. The posting of a cash bond prior to issuance of the annual permit to ensure that the roadways surrounding the subject site are kept. free of debris generated by the operation, including mud and dust. 4. No trucks may enter or leave the site except during the hours between 9:00 a.m. and 3:00 p.m. , Monday through Friday. ORDERED THIS 11th day of July, 1980. Vegetation : Parts of the subject site have already been excavated ; what little vegetation remains consists of scrub grass . 4. Wildlife : Existing vegetation on the site provides suitable habitat for birds and small mammals . 5. Water : No surface water was evidenced on the site (June 27 , 1980 ) . 6. Land Use : The subject site is undeveloped at this time . To the east is an apartment complex and to the south a mobile home park . The grounds of the cemetery are to the west and north . E . The public interest would appear to be protected in the proposal in that the proposed re-use of the site will be an activity generally consistant with Comprehensive- Plan designation of Public/Quasi Public use . b . The area to be excavated is relatively small in relation to the total site , and extremely small in relationship to the overall grading activity which has previously occurred in the near vicinity . The re-use , as noted above is consistant with the general public welfare in the Renton area c . The adjoining uses to the east and south are a combination of developed and undeveloped activity . The slopes to the east and south as they join the adjoining property will be retained essentially in their existing configuration . This should provide an adequate buffer from adjoining uses . d . With the exception of off-site movements of trucks from this excavation , no safety aspects appear to be of any substantial consequence . 5 . The Public Works Department has stated that the drainage situation is being worked out with the adjacent properties . 6 . The Police Department was the only other city 'department with signigicant comments concerning the operation of the grading and excavation operation . Their specific concerns • are as follows ; a . The area should be properly signed for truck crossing as specifiediby traffic engineering . b. The roadway should be kept clear of dirt and mud at all times . A cash bond should be posted to pay for street cleaning by the City if the contractor does not keep the street clean . c. The hours of operation should be so as not to conflict with rush hour traffic . M . PLANNING DEPARTMENT RECOMMENDATION : Based on the above analysis , it is recommended that the Hearing Examiner approved the special permit for filling and grading as requested , File Number SP-051 -80 , with the following conditions : 1 . Approval of drainage plans prior by the Public Works Department prior to the issuance of the annual grading license . 2. Signing of the area for truck crossing in a satisfactory manner acceptable to the Traffic Engineering Division . 3 . Limiting of operating hours from 9 A , M . to 3 P , M . on Mondays thru Fridays . 4. Posting of a cash bond , the amount to be determined by the Public Works Department , to assure that the roadway is be kept clear of mud and dirt . Either the Police Department or the Public Works Department can require the contractor to clean the roadways . Natural Systems : Excavation of the site will distrub soil and vegetation, increase storm water runoff and increase traffic and noise levels in the area on a temporary basis . However, through proper development controls and procedures, these impacts can be mitigated. 2. Population/Employment: Minor . 3 . Schools : Not applicable. 4. Social : Not applicable. 5. Traffic : Assuming 25 cubic yards per truckload , 50,000 cubic yards would require 2000 truckloads or 4000 total truck trips . J . ENVIRONMENTAL ASSESSMENT/THRESHOLD DETERMINATION: Pursuant to the City of Renton ' s Environmental Ordinance and the State of Washington Environmental Policy ' Act of 19,71, as amended , RCW 43-21C, the Environmental Review Committee issued a declaration of non-significance for the subject proposal . With completion of the proposed excavation , the site will be . utilized as an extension of the existing Greenwood Cemetary . 2 . Greenwood Cemetary is a legal non-conforming use . The proposed extension is minor in scale to the etire site , representing approximately a 15% increase in total area not previously in use for cemetary purposes due to the topographic constraints proposed to be removed by this application rapproval . 3 . The excavation is designed to level off a mound from elevation 375 ' to approximately elevation 348' to correspond with the existing ground of the cemetary site . It is anticipated that approximately 50 , 000 cubic yards of material will be removed . This will involve approximately 2000 truck trips to accomplish , a total of 4000 one-direction truck movements . 4 .
