HomeMy WebLinkAboutAddendum - 3AMENDMENT NO. 3 TO AGREEMENT FOR MONITORING SERVICES THIS AMENDMENT, dated for reference purposes only as December 1, 2025, is by and between the City of Renton (the “City”), a Washington municipal corporation, and Diane Whaley (“Consultant”), Attorney at Law. The City and the Consultant are referred to collectively in this Amendment as the “Parties.” Once fully executed by the Parties, this Amendment is effective as of the last date signed by both parties. Whereas, the City engaged the services of the Consultant under Agreement CAG-22-136, dated April 22,2022, to provide necessary public defense monitoring services (referred to herein as the “Agreement”); Whereas, the Parties wish to amend the Agreement to change the scope of work, change the time for performance, and change the compensation in order to extend the agreement and add to the scope of work. NOW THEREFORE, It is mutually agreed upon that CAG-22-136 is amended as follows: 1. Scope of Work: Section 1, Scope of Work, is amended to add consultation services as specified in Exhibit A-3, which is attached and incorporated herein. 2.Time of Performance:Section 3, Time of Performance, is amended to extend the agreementfor one year. All Workshall be performed by no later thanDecember 31, 2026. 3. Compensation: Section 4, Compensation, is amended so that the maximum amount of compensation payable to Consultant is increased by $12,600 from $41,110 to $53,710, plus any applicable state and local sales taxes. The additional compensation shall be paid based upon Work actually performed according to the rate(s) or amounts specified in Exhibit A-3 of the Agreement. 4.All terms of the Agreement not explicitly modified herein shall remain in full force and effect and such terms shall apply to Work performed according to this Amendment as if fully set forth herein. The general services to be provided will be: x Quarterly check-ins with the City representative to review the following services: x Review of public defenders (and conflict defenders) work on the data points identified inthe Public Defense contracts for the Public Defender and Conflict Counsel, including thefollowing: o Investigations o Meaningful communication with the client o Research o Motions practice o Trials o Infrastructure and resources o Caseload reports x Random unannounced in-court supervision, with documentation to be provided at quarterly check-ins with the City representative and email summaries that follow. x Review and analyze whether public defenders are compliant with the indigent standards with documentation provided at quarterly check-ins. Examples may include o Review of case resolutions/case appointments o data collection o case counts, including compliance with maximum counts, etc. x Personnel review of the individual public defender(s). o Include peer review (interviews and feedback from court staff, judges, and prosecutors). x Miscellaneous services relating to monitoring. Examples include, but are not limited to: o Provide a procedure for the public to provide comments and complaints.        PAGE 4 OF 4 o Provide third-party investigations of complaints. o Track whether the public defenders have access to convenient and confidential meeting rooms. o Track process for screening and appointment, both in-custody and out-of custody. o Tracking evolving practices in this area. x Consultation services Compensation for public defense monitoring services will be $925 per month. Compensation for additional consultation time will be at a rate of $73.35 per hour.
