SITE PLAN REVIEW COMMITTEE CITY OF RENTON REPORT AND DECISION May 30, 1990 APPLICATION NO. : ECF; SA-098-89 APPLICANT: Ron and Jackie Forte LOCATION: 101 Park Ave. North SUMMARY OF REQUEST: Applicants seek approval for a change of use for the second floor of an existing mixed use structure from residential apartments to a retail use and storage facility. COMMITTEE REVIEW: The second review was conducted at 10: 00 a.m. on, May 15, 1990, in the third floor conference room of the Renton Municipal Building. The Committee review was conducted after receiving written comments from all divisions of the Public Works Department, all divisions of the Community Development Department, and the Fire, Police, and Parks Departments. The following exhibits were entered into the record: Exhibit No. 1 Yellow file containing application, proof of posting and publication and other documentation pertinent to this request. Exhibit No. 2 Site plan (revised site plan received March 15, 1999) . Exhibit No. 3 Landscape plans (received March 15 and April 27, 1990) . Exhibit No. 4 Building elevation plans. FINDINGS, CONCLUSIONS, AND DECISION Having reviewed the written record in the matter, the Site Plan Review Committee now makes and enters the following: Findings: 1. The applicants, Ron and Jackie Forte, have requested site plan approval to allow a change of use for the second floor of an existing mixed use structure from residential apartments to a retail use and storage facility. 2 . The applicant's file containing the application, the State Environmental Policy Act (SEPA) documentation, the comments from various City departments, the public notices requesting citizen comment, and other pertinent documents was entered as Exhibit No. 1. 3 . Pursuant to the City of Renton's Environmental Ordinance and SEPA. (RCW 43 .21C, 1971 as amended) , a Determination of Non- Significance was issued for the subject proposal on February 21, 1990. 4. Plans for the proposal have been reviewed by all City departments affected by the impact of this proposal. Site Plan Review Commi se Report and Decision May 30, 1990 Page 2 5. The subject proposal is consistent with the Comprehensive Plan designation of Commercial Use. 6. The site plan, as revised on March 15, 1990, provides sufficient parking to comply with the Parking and Loading Ordinance of the City of Renton. 7. The subject site was annexed into the City in 1909 by the Adoption of Ordinance No. 156. The site was zoned B-1, Commercial Use, in 1953 when zoning was first adopted by the City of Renton. 8. Land use surrounding the subject site is commercial uses. 9. The applicant's site plan complies with the requirements for information for site plan review. SITE PLAN APPROVAL CRITERIA Section 4-31-33 lists ten criteria that the Hearing Examiner is asked to consider along with all other relevant information in making a decision on a Site Plan Approval application. These include the following: General Criteria 1. Conformance with the Comprehensive Plan, its elements and policies; The Comprehensive Plan Map designates this site for commercial use. The site plan conforms to this designation and generally conforms to the objectives and policies of the Commercial Goal of the Comprehensive Plan. 2. Conformance with existing land use regulations; The revised site plan (March 15, 1990) conforms with Section 4-31-10, B-1 Business Zone; Section 4-31-34, Landscaping; and Chapter 14, Parking and Loading Ordinance. 3. Mitigation of impact to surrounding properties and uses; The revised site plan (March 15, 1990) includes several measures intended to mitigate adverse impacts on surrounding properties. These mitigation measures include: a. Landscaping: Planters will be installed along Park Ave. North and North First Street, planted with evergreen plant materials as approved by the City's Landscape Planner, and watered, preferably mechanically, by the owner/tenant. A renewable maintenance bond in the amount of one thousand dollars ($1000. 00) will be required for a minimum of five years to ensure that the plant materials are maintained in good condition and replaced when necessary. b. Parking: Eight (8) parking spaces at 130 Park Ave. North (property also owned by Party Line Rentals and located within 200 feet of the subject site) will be striped and signed for exclusive use by employees/patrons of 101 Park Ave. North. • Site Plan Review Commi, :.e Report and Decision May 30, 1990 Page 3 c. Signage: Wall/awning signage will not exceed the 184.5 square feet shown on the March 15, 1990 revised site plan. Only the graphic typeface will be illuminated on the awning sign. 4. Mitigation of impacts of the proposed site plan to the site; The proposed action is the remodeling of the second floor of an existing building. The landscaping and signage mitigation measures listed above should enhance the appearance of the site. 5. Conservation of area-wide property values; Improvement of the appearance of this existing building should assist in conserving area-wide property values. The building is prominently located near one entrance to the downtown area and its appearance consequently is important to the appearance of the Central Business District of Renton. 6. Safety and efficiency of vehicle and pedestrian circulation; The provision of the required eight (8) additional parking spaces at 130 Park Ave. North should ensure sufficient parking to serve the employees/patrons of 101 Park Ave. North. The area in which the subject building is located is fully developed with streets and sidewalks. The on-site parking is located on the North First Street side of the building where traffic is somewhat less congested than on Park Ave. North. 7. Provision of adequate light and air; The proposed action is a remodeling project in an existing building and the present situation regarding light and air will remain the same. 8. Mitigation of noise, odors, and other harmful or unhealthy conditions; Noise and odors in the vicinity of the subject site come primarily from traffic on city streets and probably will remain the same. 9. Availability of public services and facilities to accommodate the proposed use; and Police, fire, and utility services in the area are adequate to accommodate the proposed use. 10. Prevention of neighborhood deterioration and blight. Improvements in the appearance of this building should assist in preventing neighborhood deterioration and blight. Conclusions: 1. The subject proposal generally complies with the policies and codes of the City of Renton. 2 . Specific issues raised by various City departments and focused on were: Site Plan Review Commi', ;e Report and Decision, May 30, 1990 Page 4 a. Landscaping: The site has no landscaping at present and the Zoning Code requires a minimum of ten (10) feet of landscaping on each street frontage. However, because the building is an existing structure with no setbacks along either the Park Ave. North or the North First Street frontages, and existing sidewalks are too narrow to support street trees, staff are recommending, as a minimum, that concrete planter boxes approved by the City's Landscape Planner be installed as shown in the revised site plan (March 15, 1990) and be planted with evergreen plant materials also approved by the City's Landscape Planner. These planters preferably shall be mechanically watered by the owner/tenant. b. Parking: The subject site has eleven (11) parking spaces at present. After discussion between the applicant and Current Planning Division staff, it was determined that the first floor of the existing building could be considered as a legal non-conforming use and the eleven parking spaces as the required parking for this retail use. (If this retail use were to be constructed today, twenty-five (25) parking spaces would be required by the Parking and Loading Ordinance. ) The remodeled second floor of the existing building is to be used for a combination of warehouse space and limited, seasonal retail use (primarily during holiday seasons when costumes are in demand) . Calculated on the basis of approximately one-third of the second floor net space in warehouse use and two-thirds in "other" retail use, a minimum of six (6) additional parking spaces would be required off-site since there is no room for additional parking spaces on-site. The applicant proposes to reserve eight (8) parking spaces at 130 Park Ave. North (property also owned by Party Line Rentals, zoned B-1, and located within 200 feet of the subject site) for exclusive use by employees/patrons of 101 Park Ave. North. The applicant has agreed to place signs on these eight (8) parking places, designating them for use by 101 Park Ave. North employees/patrons only. c. Signage: The Sign Code, Section 4-20-12 (C) (3) , allows up to twenty percent (20%) of any commercial building facade to be covered by a wall sign and the original proposal by Party Line Rentals called for 13 .8% wall coverage on the Park Ave. North side of the building. Preliminary review by the Site Plan Review Committee indicated that this amount of signage was not acceptable and the amount of signage was reduced to 185 square feet on the revised site plan submitted on March 15, 1990. The wall signage shall not exceed that shown on the March 15, 1990 revised site plan. In order that the awnings not be counted as back lit signs, the applicant will have to ensure that only the graphic typeface will be illuminated on the awning signs. 3 . The proposal complies with the Comprehensive Plan designation of Commercial Use. Decision: The site plan for Party Line Rentals, file no. ECF; SA-098-89 is subject to the following conditions: 1. Concrete planter boxes shall be installed as approved on April 27, 1990 by the City' Landscape Planner. These planter boxes will be twelve (12) inches deep, no more than eighteen (18) inches tall, and the length of each box will be determined by the length of the specific space between Site Plan Review Commi, ,e Report and Decision May 30, 1990 Page 5 the exterior columns of the building that it occupies. Each planter box will be equipped with drainage holes, planted with evergreen plant materials approved by the City's Landscape Planner, and preferably be mechanically irrigated by the owner/tenant. The information required by the Committee is as follows: 1. A plan of the second floor of the 101 Park Ave. North building that shows that no more than one-third of the total floor area of the second floor will be used for storage as is required by the B-1, Commercial Zone, City of Renton Zoning Code. It was decided by Don Erickson, Chief, Current Planning, at a meeting with you on October 17, 1989 that the first floor of the 101 Park Ave. North building could designated as an existing, legal, non-conforming use and that the existing on-site parking would be considered sufficient for this first floor retail use. The second floor is being changed from residential use to "other retail" use with a separate entrance and parking to be supplied at 130 Park Ave. North. In order to decide on the adequacy of the parking you propose to supply at 130 Park Ave. North, a plan of the proposed configuration of the second floor is needed by the Committee. 2 . A site plan that clearly shows the two separate entrances for the existing retail use on the first floor and the proposed "other retail" use on the second floor. In our April 13 , 1990 telephone conversation, it appeared to me that you might have forgotten the agreement made between you and Don Erickson on October 17 , 1989 to treat the two floors of the 101 Park Ave. North building as two separate uses with separate entrances and separate parking calculations. Therefore, we need, for our records, a site plan 200 Mill Avenue South - Renton, Washington 98055 showing the two separate entrances and labeling them plainly. 3 . A design for planter boxes that shows their height (18 inches to 24 inches) , shows how the boxes will fit between the existing exterior building columns and be even with the columns, shows the exterior material proposed for the boxes, and shows the drainage proposed for the planter boxes. A statement of the type of irrigation system that will be used also is required for the record. Enclosed for your convenience are two copies of the application form you will need to complete for the street use permits for your awning and the planter boxes. The applications should be submitted to the Board of Public Works as soon as the awning and . planter designs are approved by the Site Plan Review Committee. The Board of Public Works meets at 8:45 a.m. on Wednesday mornings in the fifth floor conference room of the Municipal Building. Because of the unique nature of your site and the difficulty in doing more typical on-site parking and landscaping, the Committee is looking at ways to allow you to do your major remodeling and expansion while also enhancing this gateway into North Renton and downtown. In order to work with you, the Committee requires a revised site plan on 24 inch by 36 inch paper before it can continue site plan review of this project. The revised site plan should include the following: 1. The location of all street signs and light standards. 2 . The location and a detailed description of the proposed awnings. The City of Renton Downtown Merchants Association has established guidelines supporting the use of traditional wooden or metal awnings in this part of downtown Renton and the Environmental Review Committee concurs with this recommendation. The Board of Public Works, which must approve this project, also is more likely to approve this type of awning for a street use permit since they are less prone to vandalism and deterioration by the elements. 3 . A landscaping plan that shows rectangular planters from twelve (12) to fifteen (15) inches in width located between the existing protruding exterior wall columns. This plan needs to address how these planters will be irrigated ,(we suggest a low pressure drip system) and the type of evergreen plant material you are considering. 4 . A signage plan that reduces the maximum amount of awning graphics and wall signage graphics to ten percent (10%) of the wall area. (NOTE: Back lit awnings with written or symbolic messages are treated the same as other signs. ) The amount of 200 Mill Avenue South - Renton, Washington 98055 - (206)235-2550 ' signage presently proposed is inconsistent with Site Plan Review Ordinance standards and traffic safety standards and creates a potential traffic safety hazard. For example, Site Plan Review (Renton City Code, Section 4-31-33) requires that a site plan shall "ensure convenience and safety of vehicular and pedestrian movement within the site and in relation to adjacent areas" [4- 31-33 (A) (4) ] . The amount of graphics on wall signage and awnings presently proposed for this project could distract drivers passing though this major traffic intersection and exacerbate an existing poor level of service (LOS E) traffic flow during the afternoon peak volume period. 5. A parking plan that shows the present on-site parking and how the proposed off-site parking located at 130 Park Avenue North is: (1) within 500 feet of the subject property and (2) on property owned by your company. Details of the signage to reserve five (5) parking spaces in the off-site parking for use by Party Line Rentals patrons should be shown. The relationship between the existing structure and the proposed off-site parking spaces needs to be clearly indicated on the revised site plan. We would appreciate receiving a complete revised site plan by March 22 , 1990 so that the Site Plan Review Committee will be able to conclude its review of this project in a timely manner. ISSUES: ENVIRONMENTAL ELEMENTS. 1. Whether the applicant has adequately identified and addressed environmental impacts likely to occur in conjunction with this development? As the site is essentially fully developed now, no major environmental impacts are anticipated in conjunction with this development, nor are environmental mitigation measures necessary (see #2 below for a discussion of housing impacts). However, because the development is located at a busy, fully developed intersection, which also serves as a gateway to the City, and because entry way development tends to reflect the essence of a community as well as establishing standards for development, it is important to provide a project here which is attractive, durable and functional. In order to ensure that adequate improvements are made, mitigation measures to address on-site and off-site impacts will be required in conjunction with site plan review (e.g. landscaping, signage as described above) and the applicant will also be required to comply with all Zoning Ordinance (e.g. Parking and Loading, Commercial Use) and Building Ordinance requirements prior to the issuance of building permits. For example: Parking The subject site presently has eleven (11) parking spaces. Section 4-2208 (2), Parking and Loading, requires an increased number of parking spaces for this expanded retail use and storage use based on regulations requiring that when any part of a building is changed to another use requiring additional parking stalls, parking shall be provided to meet the parking requirements of the new use [Section 4-2203 (2)]. Specific requirements for this development would include 14.5 spaces for retail sales area and 1.5 spaces for the storage facility, totalling 16 spaces or five more than the existing 11 spaces (Note: Section - 4- 2208.2.f. requires one parking space per 500 net square feet -- typically 85% of the gross square foot area and Section 4- 2208.3.b. requires one parking space per 1500 net square feet for the storage area -- typically 85% of the gross square foot area). Since the subject site does not have sufficient space for the five (5) additional parking spaces required by Code, the applicant will be providing additional off-site parking within 500 feet of the development at 130 Park Avenue (that property is developed with a warehouse also owned by the proponent and has ample parking spaces. beyond those required for that site). Signs A wall sign comprising approximately 13.8 percent (13.8%) of the total wall area is proposed for the Park Ave. N. facade of the building. This is the largest sign area proposed on any side of the building. Section 4-1918 (C)(3) of the Renton Zoning Code allows a wall sign covering up to twenty percent (20%) of the facade to which it is applied. The proposed signage meets Code requirements with respect to size and location. It is our understanding that the subject application would be approved subject to submission of revised plans that include the following conditions: 1 ) Addition of planter boxes along the building face at the Park Ave. sidewalk elevation (East). This will not require any special street use permit or fees. 2) Provide landscaping at the southeast corner of the existing parking lot. 3) The quantity and size of proposed signage is allowed as shown on the submitted plans. However, it is noted that the review committee thought the continuous graphics were "tacky". The proponent noted that the exact type style is only indicated schematically on the plan. The bidder—design sign company will show the precise style specified (Bookman Bold Italic) under a saeperate awning and signage permit. It was also noted that the quantity of signage would be no more than if the building had many smaller tenants. 4) The change of use parking requirements for the second floor from apartments to "Other Retail" will require 9 on—site stalls if the second floor is occupied as a seperate business. (See parking analysis attached to original submission. ) The owners indicated this is a seperate seasonal business to be known as "Costume Rentals". A sign has been erected above the west entry doorway so indicating. 5) Mary made comments indicating she thought the building was "not pretty", specifically, that it is outright "ugly". The owners have invested a considerable amount of money remodeling this previously dilapidated, unoccupied building, and are very concerned about these comments. The building interior is now finished, but the exterior is not yet complete. I believe judgement should be reserved until completion. The owners are very concerned over aesthetics for their retail business. However, it is our under— standing the City does not have a formal aesthetic design review process and that the forementioned mitigations will meet the City's final approval. Technical Advisory ',mmittee Staff Report Party Line Rentals Page 2 October 6, 1989 B. ISSUES: LAND USE 1. Is the proposed use consistent with the Comprehensive Plan Map and Policies? This proposal to change the use of the second floor to retail use (first floor is retail already) is consistent with the Comprehensive Plan designation of Commercial Use for the subject site. 2 . Does the proposed use conform to the zoning designation on the Land Use Map? The subject site is zoned Business Use (B-1) on the Land Use Map. The proposed retail use of this property conforms to the B-1 designation. 3 . Does the proposed use conform to all applicable sections of the Zoning Code? Parking The subject site presently has eleven (11) parking spaces . Section 4-2208 (2) , Parking and Loading, requires thirty-five (35) on-site parking spaces for this expanded retail use.• When any part of a building is changed to another use requiring additional parking stalls, parking shall be provided to meet the parking requirements of the new use [Section 4-2203 (2) ] . Since the subject site does not have sufficient space for the twenty-four (24) additional parking spaces required by Code, additional parking must be provided within 500 feet of the proposed change of use, e.g. in the parking lot directly east of the subject site [Section 4-2204 (2) (a) ] , or a variance must be requested. Signs A wall sign comprising approximately 13 .8 percent (13 . 8%) of the total wall area is proposed for the Park Ave. N. facade of the building. This is the largest sign area proposed on any side of the building. Section 4-1918 (C) (3) of the Renton Zoning Code allows a wall sign covering up to twenty percent (20%) of the facade to which it is applied. Although the proposed signage meets Code requirements, the design submitted to the Planning Division does not appear aesthetically pleasing. The final design should be approved by the City's landscape planner. Technical Advisory nmittee Staff Report Party Line Rentals' Page 3 October 6, 1989 Landscaping In the Business District (B-1) , a minimum ten-foot landscaping strip is required fronting public streets. [Renton Zoning Code, Section 4-711 (D) (6) ] The subject building has no landscaping. It is suggested that some landscaping be added in the existing parking area in the triangular spaces located between the parking stalls numbered 10 and 11. Alternatively, a variance from the landscaping requirements could be requested. 4 . Is the proposed use compatible with other uses in the vicinity? The proposed use is compatible with the commercial uses in the vicinity. ENVIRONMENTAL ELEMENTS . 1. Are adequate public services and infrastructure currently available to serve the site? The Fire, Police, and Parks Departments • indicated that the proposal would have only minor impacts on the services their departments provide. The Transportation Services, Storm Water, and Design Engineering Divisions stated that impacts on their services also would be minor. The Utility Engineering Division noted that this property has never participated in utility fees and that these fees will be due if a new or larger water heater is installed or if an additional fire hydrant is required in the future. 2 . Whether construction impacts of the change of use have been adequately identified and addressed? The Building Division stated that the change of use remodeling must meet the requirements of the Uniform Building Code. 3 . Have the impacts of the change of use from multi-family residential use to commercial use been adequately addressed? Seven multi-family residential units will be eliminated by the remodeling of the second floor of the subject building. All of these apartments have been vacant since January, 1989 , or before. Being bounded on two sides by busy and noisy streets, the location of the building is more suited to commercial use than residential use. The loss of seven apartment units does not constitute a major impact on the City's housing stock. . Technical Advisory ' mmittee Staff Report Party Line Rentals Page 4 October 6, 1989 C. RECOMMENDATIONS: It is recommended that the ERC issue a Determination of Non-Significance - Mitigated with the following conditions: 1. That the applicants provide a total of thirty-five (35) parking spaces either on-site or within 500 feet, as required by the Renton Zoning Code, or a variance be requested. 2 . That landscaping be added to the existing parking lot in the triangular spaces between spaces 10 and 11 and other landscaping be added as advised by the City's landscape planner, or a variance be requested. 3 . That the signage of the building be approved by the City's landscape planner for aesthetic considerations. D. The existing first floor is occupied by "Party Line" for retail sales and rentals. The existing second floor is currently unoccupied apartment use. The owner would like to change the use of the second floor to "Other Retail" (Category 2.F., Sect'.ion 4-2208) for display and retail storage of rental costumes that is' acessory to their existing retail rental business on the first floor. The existing property has 11 parking stalls on site that are allocatedd to the 6 apartment units. The existing first floor retail space does not currently have any on—site parking. The change in use from apartment to "Other Retail" would require no additional parking stalls since the new use requires only 9 stalls. The Site Plan Review process appears to be unnecessary in this case since there will be no interior or exterior changes to the property or building for this change of use application. The owner is anxious to occupy the second floor as soon as possible and the minimum 6 month review period for typically new building projects would prove to be a hardship for them in permit fees, consultant fees and time and business lost. N., Renton Dear Mr. Erickson, I represent Ron and Jackie Forte who are the owners and tenants of an existing 2 story commercial building located at 101 Park Ave. N. (B-1 Zone). Mary Savela recommended that I write you regarding a change of use application in order to be exempted from the Site Plan Review process, since there will be no physical changes to the existing property. The existing first floor is occupied by "Party Line" for retail sales and rentals. The existing second floor is currently unoccupied apartment use. The owner would like to change the use of the second floor to "Other Retail" (Category 2.F., Section 4-2208.) for display and retail storage of rental costumes that is acessory to their existing retail rental business on the first floor. The existing property has 11 parking stalls on site that are allocated:. to the 6 apartment units. The existing first floor retail space does not currently have any on—site parking. The change in use from apartment to "Other Retail" would require no additional parking stalls since the new use requires only 9 stalls. The Site Plan Review process appears to be unnecessary in this case since • there will be no interior or exterior changes to the property or building for this change of use application. The owner is anxious to occupy the second floor as soon as possible and the minimum 6 month review period for typically new building projects would prove to be a hardship for them in permit fees, consultant fees and time and business lost. We therefore request an exemption of Site Plan Review for this proposal.
