Upon arrival, I contacted the parties involved and confirmed no injuries had occurred requiring immediate medical response at the time of report. There, I collected the involved parties driving documents and their independent recollection of events leading up to the collision. The driver of Unit#1 (Stanger) said she and her adult passenger were traveling eastbound on SW Grady Way just west of the intersection of Rainier Ave South in lane 3 of 4. The driver of Unit#1 stated she got into the left-turn lane (lane 4 of 4) to make a left turn at the upcoming intersection. The driver of Unit#1 stated that as she got into the turn lane, Unit #2 made a lane change into her vehicle. Due to the impact with Unit#2, Unit#1 began to rotate uncontrollably until striking Unit#3, which was stopped in traffic. Evidence and scene investigation indicate that Unit#1 attempted to pass Unit#2 by crossing over the painted chevron or hash-marked area (neutral/gore area) separating merging or adjacent lanes, in violation of traffic control devices and safe lane usage. The driver of Unit#2 said he was the sole occupant of his vehicle and was also traveling eastbound on SW Grady Way just west of the intersection of Rainier Ave South in lane 3 of 4. The driver of Unit #2 stated he was intending to turn left at the upcoming intersection and proceeded to turn into the left turn lane. While Unit#2 waited appropriately for the lane opening (per road paint markings), Unit#1 crossed over the painted chevron or hash-marked area at a high rate of speed and collided with the front driver's side quarter panel of Unit#2, causing moderate damage. The driver of Unit#2 stated that there was no prior opening via road markings and that no one should have been traveling in that specific area of the roadway. The driver of Unit#3 said he was the sole occupant of his AAA tow truck vehicle and was also traveling eastbound on SW Grady Way just west of the intersection of Rainier Ave South in lane 3 of 4. The driver of Unit#3 stated he was stopped in queued traffic at the controlled intersection ahead. As a result of the initial collision, Unit#1 rotated out of control and struck Unit#3, causing moderate damage to the rear of Unit#3, to include damage to the operational controls of the tow truck vehicle. The driver of Unit#3 stated that prior to the collision, Unit#1 had been traveling too fast for the conditions. The driver of Unit#1 (Stanger) was not paying attention to traffic conditions and improperly attempted to pass or change lanes by driving over the painted chevron or hash-marked area separating lanes. By doing so, Stanger violated RCW 46.61.670 (Driving with wheels off roadway), as crossing such a marked neutral/gore area constitutes operating the vehicle with wheels off the designated roadway. This action directly caused Unit#1 to collide with the front driver's side quarter panel of Unit#2. Unit #1 then rotated out of control and struck Unit#3, which was stopped on SW Grady Way in queued traffic. Additionally, Stanger was found to have no liability insurance in violation of RCW 46.30.020 (Liability insurance or other financial responsibility required). Based on the above statements, physical evidence at the scene (including damage locations, vehicle positions, and roadway markings), and investigation, I determined that the Driver of Unit#1 (Stanger) is the proximate cause for the collision due to inattention and improper lane usage/crossing of marked areas, causing the initial sideswipe collision and subsequent chain reaction. Stanger should have maintained proper lane discipline, obeyed traffic control markings (including chevrons/hash areas designating non-travel zones), and paid closer attention to the movement of traffic and roadway conditions ahead. The driver of Unit#1 was cited via mail for violating RCW 46.61.670-Driving with wheels off roadway and for RCW 46.30.020 -No Liability insurance. All parties involved received an exchange of information. Unit#1 and Unit#2 required towing due to disabling damage; Unit #3 was able to be driven away without further incident.
