Upon arrival, I contacted the parties involved and confirmed no injuries had occurred requiring immediate medical response at the time of report. There, I collected the involved parties driving documents and their independent recollection of events leading up to the collision. The driver of Unit#1 said he was the sole occupant of his vehicle and was traveling northbound through the McDonald's Drive-Thru, addressed above. The driver of Unit#1 stated he was traveling directly behind Unit#2 and saw as Unit#2 had come to a stop for queued vehicles in line. The driver of Unit#1 stated that he mistook the brake pedal for the gas pedal and unintentionally drove forward, subsequently colliding with the rear of Unit#2 causing minor damage to the front of Unit#1. The driver of Unit#2 said he was the sole occupant of his vehicle and was also traveling northbound in the same Drive-Thru line, addressed above, and directly in front of Unit#1. While Unit#2 was stopped for queued vehicles ahead in line, Unit#1 collided with the rear of Unit#2 causing significant damage to the rear of Unit#2. The driver of Unit#1 (Nguyen) was not paying attention to traffic in front of him. Nguyen violated Renton Municipal Code (RMC) 10-12-25-Inattentive Driving which is defined as any person to drive a motor vehicle on any public highway, street, alley, or road in an inattentive manner in the City of Renton. "Inattentive manner" in this section means a lack of: 1) attentiveness required to safely operate the vehicle under the prevailing conditions, including, but not limited to, the nature and condition of the roadway, the weather conditions, the presence of pedestrians, the presence of other traffic, or by the driver focusing or directing the driver's attention to something other than driving the motor vehicle; or 2) attentiveness that would permit the driver of a motor vehicle to observe anything resting on, or traveling on, or entering the roadway in time to take appropriate action as circumstances require. (Ord. 4462, 7-25-94, eff. retroactive to 7-1-94; Ord. 5635, 11-14-11). Based on the above statements, I determined that the Driver of Unit#1 (Nguyen) is the proximate cause for the collision due to inattention causing a collision. Nguyen should have been paying closer attention to the movement of traffic as well as the proper operation of the motor vehicle he was driving. I cited the driver of Unit#1 (Nguyen) by mail for violation of RMC 10-12-25-Inattentive Driving. Nguyen qualified for the City of Renton Youth Traffic Court (YTC) and was made aware of the details by providing his mother with a YTC business card. Unit#1 was able to be driven away without further incident. Unit #2 had to be towed away from the scene due to disabling damage. The driver of Unit#2 made a comment that he feared his vehicle would be totaled by his insurance company. An exchange of information was provided to all involved parties.
