SPECIFIC CODE SECTION(S) RELATED TO THIS DOCUMENT RMC 9-14-5 Street VacaƟon Process RMC 4-8-090 Public NoƟce Requirements SECTION I: STREET VACATION REVIEW FLOW CHART The review and approval process is summarized on the flow chart below and further explained in subsequent pages. Note: The established Ɵmelines do not account for unintended findings, modificaƟon requests and review Ɵme, or omissions which may delay the review process. SECTION II: REQUIREMENTS VacaƟon of a street or public right of way A Street VacaƟon is a procedure in which the City may relinquish its interests in a street or alley. Upon receipt of an applicaƟon, the City will determine whether the right-of-way is no longer necessary for public use. Criteria for a vacaƟon The City Council may vacate a street or alley only if the City finds that the vacaƟon is in the public interest; and no property will be denied direct access as a result of the vacaƟon. This summary outlines the procedure of filing a Street VacaƟon applicaƟon in the City of Renton. The applicaƟon packet is designed to obtain all the informaƟon necessary to allow the City to make a well-informed decision on your applicaƟon. The applicant is responsible to agree upon and coordinate with any other property owner who signed the peƟƟon in meeƟng the requirements imposed. A public benefit of a long-term nature must be provided by the vacaƟon. Marking an item as “Not Applicable” or “N/A”, without acceptable jusƟficaƟon, may result in the submiƩal being rejected at Intake. The applicant must submit a completed PeƟƟon for Street VacaƟon. …1. Signatures: This peƟƟon must be signed by the owners of more than two-thirds (2/3) of the property abuƫng upon the part of the right-of-way to be vacated. (Ord. 3635, 6-7-1982). Note: It is recommended that the peƟƟoner(s) obtain the signatures of all (100%) of the owners whose property abuts the part of the right of way to be vacated. It is also recommended that the peƟƟoner work out all potenƟal objecƟons or, at a minimum, idenƟfy areas of concern from abuƫng property owners prior to the public hearing. …2. Legal DescripƟon labeled as “Exhibit A”: Please aƩach a full and correct legal descripƟon of the right-of-way for which a vacaƟon is requested. The legal descripƟon must include the perƟnent secƟon, township, and range informaƟon must state that the described area is situated in the City of Renton. It should be labeled Exhibit A and be suitable for recording with the final ordinance. …3. Map Exhibits labeled as “Exhibit B”: Please aƩach the map exhibit of the right of way for which a vacaƟon is requested. The VacaƟon Area Map Exhibit should be labeled Exhibit B and be suitable for recording with the final ordinance. …4. Public Benefit labeled as “Exhibit C”: Please aƩach a brief explanaƟon of the purpose and long-term public benefit of the requested vacaƟon. …5. Payment: A street vacaƟon filing fee is required as set forth in the current City of Renton Fee Schedule. This fee compensates the City of administraƟve costs and expenses in the processing, checking, and handling of the iniƟal vacaƟon peƟƟon. This fee also includes the publicaƟon and posƟng expense of any noƟce pertaining to the vacaƟon. SECTION IV: PROCESS STEP 1: APPLICANT SUBMITS PETITION Timeline depends on Ɵme required for peƟƟoner(s) to obtain and submit signatures, map and legal descripƟon. STEP 2: CITY REVIEW PERIOD Timeline is approximately two (2) weeks plus an addiƟonal eight (8) weeks for resoluƟon to set and hold a public hearing. Review of VacaƟon Request: A validated peƟƟon will be circulated for review and comments to all City departments, as well as other local agencies and uƟliƟes. The purpose of this review is to determine if the requested vacaƟon is acceptable and to determine if easements are needed. PreparaƟon for Public Hearing: Staff shall prepare a report and presentaƟon for the public hearing. Public hearing date to be set by staff once review is complete. STEP 3: CITY COUNCIL PUBLIC HEARING Hearing is approximately fiŌeen (15) to forty-five (45) minutes Public Hearing: The hearing shall be held before the City Council in accordance with RCW 35.79.020. It is not necessary for the peƟƟoner to aƩend. AŌer the close of the public hearing, the City Council shall determine whether the vacaƟon should be granted, the classificaƟon of the right-of-way and the compensaƟon to be paid, if any, in accordance with SecƟon 9-14-5 of the Renton Municipal Code. (RMC 9-14) STEP 4: COMPENSATION AND APPRAISAL Timeline depends on Ɵme required for peƟƟoner(s) to obtain and submit appraisal plus approximately two (2) weeks to set compensaƟon. Appraisal: Following a recommendaƟon for vacaƟon aŌer the public hearing, the peƟƟoner(s) shall obtain a wriƩen appraisal from an M.A.I. or other qualified appraiser, as approved by the City, and furnish the results to the Property and Technical Services Manager for evaluaƟon. PeƟƟoner(s) shall pay the actual cost for preparaƟon of the appraisal report. The appraisal fees are in addiƟon to the filing fee and the processing fee. (RMC 9-14) EvaluaƟon and RecommendaƟon: Through the Assistant Economic Development Director, staff shall evaluate the appraisal and make a recommendaƟon to the City Council regarding its acceptance. The appraisal is used to help the City Council make a determinaƟon of the compensaƟon due the City. Note: In the event that the compensaƟon for the vacaƟon has not been paid within ninety (90) days of the determinaƟon by the City Council of the compensaƟon to be paid, the peƟƟon shall be deemed to have been abandoned and shall be denied. (RMC 9-14) Payment: A processing and compleƟon fee is required. This fee defrays the remaining administraƟve costs of processing and compleƟng the proposed vacaƟon. Thus, aŌer Council has approved the peƟƟon request, a processing fee will be due before staff’s compensaƟon recommendaƟon is taken to Council. This fee is based on the value of right -of-way which is determined by the Council. City CompensaƟon and Payment: The City shall receive payment in accordance with RCW 35.79.030. The City Council shall have authority, upon recommendaƟon of the administraƟon, to accept real property or a property right in lieu of a part or all of the cash compensaƟon that would be paid. STEP 5: FINALIZE VACATION Timeline is approximately three to six (3-6) weeks. Upon Payment to the City of CompensaƟon, if any, the City Council shall pass an Ordinance vacaƟng the street. Recording: Following payment, City Clerk’s office will transmit the Ordinance vacaƟng the street for recording to King County. Although the definiƟon is correctly stated as a "land" descripƟon, it is generally called a "legal" descripƟon because it must stand up under the law and liƟgaƟon. There are generally five types of legal descripƟons: 1. A series of lines around the perimeter of an area known as a metes and bounds descripƟon; "metes" means bearings and distances and "bounds" means and refers to monuments both physical and legal. 2. A boundary descripƟon stated totally by reference to other parcels already on record in the public repository. It merely makes Ɵes by reference to the deeds of the owners adjoining each boundary line of the property being described. 3. All or part of a secƟon in the Public Land Survey System. 4. A lot in a recorded subdivision. 5. Strip descripƟons for right-of-ways of pipelines, roads, etc., which may cross many parcels. The following guidelines consist of elements which are recommended for use in the preparaƟon of legal descripƟons. They are not intended to be all inclusive and may not be applicable in all situaƟons: 1. In a descripƟon of a lot, tract, parcel, or porƟon thereof in a recorded plat, short plat, or record of survey: a. Lot and block number or designaƟon and addiƟon or subdivision name; b. Official recording data and idenƟficaƟon of recording office; c. LocaƟon by secƟon, township, and range with respect to the WillameƩe Meridian, (if applicable); d. Property locaƟon by city, county, and state. 2. In a descripƟon of an easement, lot, tract, or parcel described by metes and bounds: a. In addition to building a new school building for RHS students, while preserving the IKEA performing arts center and 1930s high school building for RSD support, the project creates a cohesive and functional campus and learning environment to serve Renton students for another 100 years. The expansion of the campus north to Airport Way (and thus the reason for this street vacation) is necessary to provide èĺıŕôťĖťĖĺIJϙŜĖƏôîϙæÍŜôæÍīīϙÍIJîϙŜĺċťæÍīīϙƱôīîŜϙwith turf surfacing and athletic lighting for the student athletes at RHS, ÍϙıŪīťĖŕŪŘŕĺŜôϙƱôīîϠϙÍIJîϙother improvements consistent with modern high school campuses. There are additional considerations that aƯôèťôîϙŜĖťôϙŕīÍIJIJĖIJČϙċĺŘϙťēĖŜϙproject and necessitated the amount of property acquisition north and east of the existing Renton High School Property Area: 1. RSD wanted to retain the original location of the high school campus, the historic 1930’s building and the IKEA PAC. Renton High School has occupied the location since 1911, and the city has grown around it. It serves as an important cornerstone of the community and city center. Other locations were considered, but ultimately the expansion of the existing campus best met the District, community and student priorities; however, the existing property was not large enough to accommodate the needs for the high school. 2. The presence of the Renton Municipal Airport restricts development types on this site and where high school activities may occur. The Runway Protection Zone restricts ground level use on much of the west portion of the existing Renton High School property, and heights are more restricted to the west and north of the site. Therefore, the new building was placed as far east as possible, and the ƱôīîŜ were designed north of this. In addition to the FAA restrictions, the site plan designs incorporated the City’s preferences and goals expressed in the Comprehensive Plan and design standards. In conjunction with the RHS replacement and site expansion project, the City will be receiving dedications of right of way along all adjacent streets for pedestrian improvements, road widening, and other types of infrastructure such as a public plaza along Logan Ave S and S 2nd St. Additional infrastructure improvements, such as those to the sewer and stormwater systems will be made as well. This is a forward-looking, long-lasting project that will provide decades of use, improvements and continuity for the City as a whole, and the city center in particular. The street vacation requested here makes that a reality.
