REIMBURSEMENT AGREEMENT FOR SPRINGBROOK CREEK
WETLAND AND HABITAT MITIGATION BANK
THIS AMENDMENT, dated for reference purposes only as January 1, 2026, is by and between
the City of Renton (the “City”), a Washington municipal corporation, and Forterra NW
(“Forterra”), a Washington non-profit organization. The City and Forterra are referred to
collectively in this Amendment as the “Parties.” Once fully executed by the Parties, this
Amendment is effective as of the last date signed by both parties.
Whereas, the City engaged the services of Cascade Land Conservancy under Agreement CAG-06-
176, dated September 21, 2006, to provide services associated with the Conservation Easement
Reimbursement Agreement for Springbrook Creek Wetland and Habitat Mitigation Bank
(referred to herein as the “Agreement”);
Whereas, Cascade Land Conservancy rebranded and changed its name to Forterra NW on
October 17, 2011.
Whereas, the Parties wish to amend the Agreement to change the time for performance and
change the compensation in order to increase the contract amount to account for services
provided through 2025 and to add services associated with the Conservation Easement through
2034.
NOW THEREFORE, It is mutually agreed upon that CAG-06-176 is amended as follows:
1.All mentions of Cascade Land Conservancy in the Agreement will be replaced with
Forterra NW.

2.Section 1 Paragraph B of the Agreement is supplemented with:
(iv). Fees from 2026 to 2034 totaling $91,733.53 shall be paid annually based upon the
following table, which represents a 3% annual inflation increase:

Through 2034, the compensation made under this contract shall be increased to
$255,565.87 which includes $163,832.34 paid between 2006 and 2025.
3.All terms of the Agreement not explicitly modified herein shall remain in full force and
effect and such terms shall apply to Work performed according to this Amendment as if
fully set forth herein.
IN WITNESS WHEREOF, the Parties have voluntarily entered into this Amendment as of the date
last signed by the Parties below.
