Erickson, Zoning Administrator Lenora Blauman, Senior Planner SUBJECT: Kalasountas Rezone (R; SA 063-88) The purpose of this memorandum is to document a meeting which was held on November 22 , 1988 with Mr. Kalasountas and Mr. Panagakis, proponents of the above-referenced project. The proponents requested this meeting in order to discuss alternative development options which they are proposing in response to guidance provided at previous meetings and in correspondence with staff members. The proponents provided the City with written information concerning these alternatives on November 17th. Staff has considered the information in the interim in preparation for this meeting. The applicant' s representative looked at the impacts of R-3 development on the site and then compared difference levels of mixed-use development of which impacts were the same or less. The proponents favor the option which includes a structure on the west side of the property, to include 4500 square feet of office space and two residential units above the offices. No underground parking will be included in this option -- all parking will be provided on a surface lot on the eastern portion of the property off Sunset Blvd. As this option is preferred by the proponent, and believed to be a potentially reasonable option by the staff, discussion was focussed upon materials which would need to be provided by the applicant to ensure that the application is complete and that the proposed project is designed and presented to both the community and the City as a safe, attractive development. 200 Mill Avenue South - Renton, Washington 98055 - (206)235-2550 Memo to File Kalasountas Rezone November 28 , 1988 Page 2 Specifically, the applicant was advised to submit an amended application with: 1) an accurate topographical survey, 2) a report on the potential electromagnetic impacts of the existing and future nearby power lines, 3) a statement from Puget Power concerning any future upgrades of those power lines, 4) new site plans (and landscaping plans) which reflect aesthetic concerns, through revised design, elevations, and planting/screening for the project, 5) a complete soils analysis; 6) a traffic analysis; and 7) revisions to the Environmental Checklist to reflect amended land use plans. Staff informed the proponents that the preferred alternative is one that is potentially acceptable to the City as an appropriate use of this property, if City staff and community members are convinced that this development meets legal requirements, and provides a desirable addition to the area. It was noted, however, that there are some continuing concerns about rezoning of the property to accommodate the proposed use, in view of the fact that the proposed rezone is not consistent with the Comprehensive Plan and that local development is predominantly residential in character (single-family and multi-family units) . (Mr. Erickson noted that if the rezone is permitted, it is likely that it will be a "contract rezone" which limits the type and density of development upon the property. ) As such, the acceptability of the proposed rezone and amended development plan remains uncertain. Another alternative available to the proponent is that of the development of an office space of less than 4, 000 square feet on the eastern portion of the property -- which would, because of the size, be exempt from environmental and site plan review. The applicant will submit amended materials by November 30. Formal review of the project will resume when those materials have been received and evaluated by staff. Using the ITE average trips generated as an equating factor, it is shown that 5220 sq. ft. of office equals the ITE trips allocated for the site if developed as a Multiple Unit Complex. Also, the enclosed analysis indicates a mixed use of 4470 sq. ft. of Office and (2) multiple dwellings on the second floor, also satisfying the multiple developement traffic coefficient. The original submittal for this rezone contained 11 ,920 sq. ft. of office, one dwelling rent house, and 43 car parking. In response to your letter and our meeting, this preliminary analysis proposes 5220 sq. ft. of office with 2f,' car parking or 4500 sq. ft. of office with two dwelling units and 26 car parking. Under this condition, parking beneath the building will be illuminated and the building will become a one story office with (2) dwelling units above. The site plan will remain substantially the same with the above exceptions, and the building foot print will reduce in size to the area noted above. The owner wishes to cooperate with the city officials and ordinance and thereby has reduced the property use as suggested and noted herein. The meeting took place on November 1st, beginning at 10:00 a.m. 4► Mr. Kalasountas and Mr. Panagakis requested this meeting in response to a letter sent by the Planning Division to the applicant. That letter explained that TAC had reviewed the application and had raised some substantive questions about its viability. In the letter (see file Correspondence dated 10/14/88) staff outlined the City's specific concerns, provided information about options, and invited the proponent to meet with staff to discuss the application. Mr. Kalasountas and Mr. Panagakis requested the meeting to: 1) obtain a more detailed explanation of the reasons that the City is unable to support the presented application; 2) discuss options; and 3) obtain an extension of the deadline for application revision from October 28th to November 30th. (An extension to November 10th had already been provided in a telephone conference with Lenora Blauman on October 24 . ) At today's meeting, staff informed Mr. Panagakis and Mr. Kalasountas that: 1) the proposed rezone does not conform to the City's Comprehensive Plan which designates the site for residential development rather than for commercial use, as proposed by the proponent; 2) the proposed rezone and proposed development are not consistent with residential uses on neighboring properties; 3) the property is considered in the Comprehensive Plan to be acceptable for zoning for medium-density residential use and suitable for 200 Mill Avenue South - Renton, Washington 98055 - (206)235-2550 Kalasountas Rezone (R ---063-88) Memo to File November 1, 1988 Page 2 such a level of residential development; 4) the proposed development. is anticipated to adversely impact traffic at the Sunset/I-405 corridor, an area which currently has a low level of service. A residential use, a mixed use (residential/commercial) development, or.a smaller commercial development would likely reduce the number of vehicular trips, particularly in the a..m. and p.m. peak hours, thereby reducing the level of negative traffic impacts. As a result of traffic concerns, staff consider it necessary for the applicant to provide more detailed A information about the specific traffic impacts which would be anticipated from a range of use options for the property; and 5) the greenbelt designation and nature of the underlying soils are such that staff are requiring more extensive information about these features of the property 1 and its suitability for the .proposed development. Mr. Panagakis and Mr. Kalasountas reviewed with staff the relative merits and disadvantages of placing different types of development and different levels of density of development upon the site -- including multi-family residential, office, and mixed-use activities pt (commercial/office/residential) on the site. Residential development would be consistent with zoning designations, and with neighboring uses, however, the proximity of the high voltage power lines and I-405, together with limits on access from Sunset Boulevard pose difficulties for this type of development too. Office development on the site would provide Mr. Kalasountas with the use he seeks, however, it is not consistent with the. zoning designation or neighboring uses. Impacts upon local circulation would be more intense than would impacts from a residential use, based upon ITE trip generation figures. Staff noted that a mixed-use development with commercial space on the first floor and residential space above (allowed with B-1 zoning on the whole site) could provide a compromise that both provides housing, possibly some services for neighboring property owners, and also meet Mr. Kalasountas' needs for additional office space. The disadvantage of this proposal is that some of the traffic impacts would remain to the property and the local community_ from this use. Staff provided Mr. Kalasountas with information about the application procedures required for the above-referenced project options. Particular emphasis was placed upon options for pursuit of the application now on file -- including project redesign, reduction of the project from 12,000 square feet to 8,000 square feet or 4,000 square feet, or retention of the application as it was submitted. Presentation of the processes included detailed discussion of: 1) SEPA review requirements, 2) guidelines and restrictions related to the Zoning Map and the Comprehensive Plan, 3) Zoning Code requirements for rezoning, site plan review, development standards for various activities, and for conditional uses. ,l Mr. Kalasountas expressed considerable frustration with the J, nature of the regulations and review processes which direct the review process. Mr. Kalasountas expressed his disappointment with the fact that it would not be possible 1 for staff to negotiate a compromise with respect to his need to address requirements set by those regulations and processes and at one point became somewhat accusatory as to '1 Staff and the City's "politics" . ,l Mr. Kalasountas and Mr. Panagakis requested an opportunity -..f to consider options available to them for development of . . � this property and to advise us of their preference by .g. BACKGROUND: APPLICANT: George Kalasountas PROJECT: Kalasountas Rezone/Site Plan ENVIRONMENTAL CHECKLIST: ECF 063-88; R 063-88; SA 063-88 DESCRIPTION OF PROPOSAL: Application to: 1) rezone . 278 acres of the . 554 acre site from R-1 to B-1 so that there is a single zoning designation for the total site (the remaining .276 acres is presently zoned B-1) ; and 2) obtain site plan approval for a 12, 000 square foot office building on the .554 acre site. LOCATION OF PROPOSAL: 701 Sunset Boulevard N.E. / • B. ISSUES: '(LAND USE) 1. Whether the proposed rezone is consistent with the Comprehensive Plan? The proposed rezone is not. :consistent with the Comprehensive Plan yvhich designates the portion of the site requested to be rezoned as Greenbelt. The Greenbelt designation is based upon the fact that this eastern portion of the site. is steeply sloped (27% maximum ' slope) and that 230K utility lines cross this section of the property. The western portion of the property is zoned B-1 on the Land Use Map, but is designated for Medium Density Residential development on the Comprehensive Map. The property was rezoned from G-1, General Use, to B-1, Commercial Use in 1961, over the objections of the Planning Director who . contended that, such an action did constitute a spot rezone and that it would lead to additional requests f similar rezones in the area. The Planning Division agrees that the 1961 action was a spot rezone. The present action is the first submitted request for another rezone in the area. 2. Whether the proposed rezone and development are consistent with uses in the adjacent community? The subject property is abutted by property zoned for and developed with residential uses on the northern, and eastern boundaries. To the west of the property lies I-4.05. To the south of the subject property is a vacant parcel which is zoned for single-family residential development, but because of slopes and utility lines, that property . is believed to be an unlikely candidate for development as a separate site; if it could be combined with the subject property the likelihood of development would increase. . The rezoning of . 278 acres to B-1 would provide consistent zoning within the subject parcel and, thereby, facilitate development of this property. However, .4 . that action would not conform to ri neighboring uses. It would also per4it the development of the property with a variety of uses which are sufficiently intense to create negative impacts to the site (e.g. interference with the natural environment on the western section of the property) and to the immediate community (e.g. traffic service) . Placement of the proposed 12, 000 square foot office use on that site would generate a substantially greater number of trips (approximately 200 per day for consumers [depending upon type of office] and for, the estimated 50 office workers based upon ITE Trip Generation Manual Reports) . Both the volume of use and the fact that access points to the site are located in close proximity to adjacent residential driveways pose potential difficulties with respect to the proposed use. If the total parcel were zoned for Medium Density Residential Use, approximately seven (7) units could be built upon the site, generating approximately 50 trips per day. Additionally, the proximity of the ingress points on the site to the signalized intersection of Sunset Boulevard and N.E. 7th Street poses potential for congestion-related impacts. For example, as there is n ' left turn lane on Sunset Boulevard At the site, persons queueing up on Sunset to turn left into the site might block traffic leading to a spill over into that intersection with N.E. 7th Street. 2. Whether the applicant has identified and addressed the impacts of the proposed rezone and development upon that western area of the lot which is identified as a Greenbelt? The applicant makes note of the fact that a substantial portion of the eastern side of the subject property is sloped to 27%, but does not acknowledge development limitations in the Zoning Ordinance (Section 4-745) related to this slope in the submitted site plan. The Code (Section 4-745 D, l,d) requires a reduction in density to one-quarter (1/4) of the total buildable area, and for each one percent (1%) of slope in excess of twenty-five percent (25%) , the remaining buildable area shall be reduced by an additional five percent (5%) . In order to accommodate to the Code requirements, the planned structure which is to be located in the Greenbelt •4 area would either need to be reduce or relocated to the eastern portion of"the lot, which is not in the sloped section. Neither is there any acknowledgement of or accommodation to the presence of major utility lines along the eastern portion of this site. Such • acknowledgement is necessary as there is evidence that there are substantial environmental health risks to people who live and work close to such lines. Additionally, the City prohibits the location of structures under these lines. 3 . Whether the existing drainage basin can accommodate to the proposed rezone and development activities? , An existing drainage basin has been identified to the west of I-405. Question has been raised as to whether this basin can accommodate the proposed development. This question has not yet been addressed by the Engineering Division -- a final determination depends, in part, upon obtaining this information. 4. Whether sufficient information exists concerning soil content and slope stability on the western portion of the site? Because of the steepness of the slope, it is recommended that the applicant provide a soils report prepared by a licensed soils engineer to confirm suitability of the site for construction activities and for development. 5. Whether sufficient information provided concerning measures to be undertaken to mitigate construction impacts on the site and on neighboring properties? It is recommended that the applicant be required to: a) develop an erosion control plan to be implemented on the site during the period of construction, b) undertake on-site watering to limit construction-related dust and debris; c) wash down wheels of construction vehicles before they depart from the site in order to avoid tracking dust off-site, and d) be bonded in the amount of $2 , 000. 00 to ensure funds for street clean-up if. necessary. C. RECOMMENDATIONS: SUGGESTIONS FOR DISCUSSION -- 1. It is recommended that the ERC issue a Determination of Non-Significance - mitigated -- with the following environmental conditions: a. That the applicant provide a soils report prepared by a licensed .4 geological engineer which confirixs that soil type and slope stability are suitable for proposed development. b. That the applicant provide a revised site plan which is designed and located in a way which addresses environmental issues with respect to the Greenbelt area on the site (e.g. steep slopes, utility lines) . c. That the applicant provide a drainage plan subject to approval by the Public Works Department. d. That the applicant provide a plan to mitigate traffic impacts with respect to access to the site and with respect to off-site vehicular circulation, subject to the approval of the Traffic Engineering Division. e. That the applicant develop an erosion control plan for implementation during construction activities, subject to the approval of the Public Works Department. f. That the applicant be required to water down the construction site periodically and to wash wheels of construction vehicles prior to their leaving the site to minimize tracking of dust and debris off-site. g. That the applicant be required to establish a bond in the amount of $2, 000. 00 to ensure roadway clean-up. 2 . It is recommended that at the time of Land Use review this application fot4 rezone and site plan either be recommended for denial by the Planning Division or be recommended for mitigation in a manner which restricts the kind of development permitted on the property and limits development to a design, size and location on the site appropriate to site configuration (greenbelt slope and utility lines) as well as to the residential community in which the site is situated. Another option might be one of rezoning the property to R-3, in its entirety, to match the Comprehensive Plan, and to allow residential development within density parameters permitted by the Greenbelt Regulations in the Zoning . Ordinance. D. COMMENTS OF REVIEWING DEPARTMENTS: Various City departments have reviewed and commented upon the project. Rezone Legal : Tract 1 and South 1/2 of Tract 2' of Harries Gardenhome Tracts, Vol. 34, Page 38, King County Washington To: Whom It May Concern: In accordance with City requirements , this letter summarizes the con- ditions substantiating the request to extend the B-1 zoning to cover the entire lot for the referenced site. This site has been in the same ownership since 1977 and consists of one piece .of.land with two zoning designations. The easterly 75' . fronting on Sunset Blvd.• N.E. is Zone B-1 and is used for office and parking. The remainder of the land, zoned R-1 , abuts the Puget Power transmission line Right of Way on the west.. The adjoining site to the north was recently ioned R-3. Unimproved 'N.E. 7th Street adjoins the site on. the south property line. This application requests that the existing B-1 zoning be extended ' from the, front 75' to cover the entire site. The westward extension of the B-1 zoning will change only that land abutting the high voltage power line easement to the west. ' Upon extensive study it was found that the dual zoning of the property adversely affects improvements of the property in one zone and/or the other.. To improve and expand the existing office within the present zoning limits invites "force planning" with major esthetic limita- tions. Equally undesirable would be the improvement of the R-zoned portion due to the restricted access and surrounding noise level from I-405 to the west. Recently the subject property frontal street was improved, making the subject site easily accessed from the nearby major I-405 highway net- work. ' City of Renton Building & Zoning Department July 11 , 1988 page two The improvements planned for the subject site shall add substantially more landscaping than existing at this time, thereby improving the general environment. The noise level created by I-405 and Sunset Boulevard is not detri- mental to the existing office use of this site and would have more of an impact on residential use at this location. The proposed ex- panded office use at this site will not cause adverse noise impact in the area. The site has not been modified by the comprehensive plan and has re- tained the B-1 and R-1 zoning for some time. The site has been sub- stantially used for office and parking since purchased by this owner in 1977 and, therefore, the use will not change. The greater area contains single residence, multiple residence, com- mercial and heavy industrial zones, plus the I-405 corridor and power line right of way. The surrounding residences are mainly east of Sunset Boulevard. These buildings are located on a rising topography and are in excess of 200' away from the proposed new building. Thus, . the proposed office building shall have a minimum impact on the sur- rounding residential development. The Greenbelt designation in the general area extends from I-405 to Sunset Boulevard. The subject site has been filled through the years, resulting in a substantially flat site, with sloping embankments on the west, northwest and southwest sides. The natural grade slopes to the west approximately 28 feet vertically across the 170 ' subject property. No .green area or treed area will be destroyed by this project. The present site topography is shown on the accompanying site plan. The site development and landscaping plans indicate im- provements to the areas abutting adjoining properties. The Greenbelt area, designated from I-405 to the east side of the power line Right of Way, shall remain intact. The Greenbelt policy for steep slope sites does not appear to be adversely affected by the area of this improvement. . The subject site is served with public improvements , water and sewer lines, with capacity for this project improvement. In conclusion, this request to extend the existing B-1 zoning to the west property line of the subject site will allow a more environmentally acceptable and attractive improvement.
