Garbage: King County Status of $10.00 per ton incineration fee at King County landfill (referred Incineration Fee 11/13/89): Letter from City Attorney Lawrence J. Warren reported that King County does not intend to refund the $10 fee and plans to switch existing funds from the incineration account to an account labeled general utility account. He also indicated that it would be difficult for cities to file a lawsuit against King County due to ambiguities in legislation creating the incinerator fee. WA 98056 • Dear Mr. Tibbils: I am writing in response to your letter of October 16 to the City Council in which you address several issues. I will speak to each issue you presented. 1. Cul-do-scc length • Because the City Code limits cul-de-sacs to a maximum of 500 feet, your request for lengthening will need to be considered when the Subdivision Code is revised in 1990. One of the major concerns we have is that roadway length could hinder response time of emergency service units to aid calls: the greater the roadway length, the greater the potential for one or more blockages when a roadway has only one access. . 2. Liner The owner 'developer of the Swan Meadow development has been notified about the litter and it has been removed. This should not be a problem in the future; however, if you have continued difficulties with litter please contact Land Use Inspector Jerry Lind at 235-2550. 3. Environn n:cj review: When the preliminary plat for Swan Meadow was first submitted in 1987, the City evaluated the environmental impacts of the twelve-lot plat. During this review the City required the original owner;developer to provide a second means of access for the plat known as Swan Meadow 1. As part of the review process, traffic impacts are evaluated as well as other aspects of developing property: Before the Swan Meadow plat had finished this review process, the application was modified to include an easement across an adjacent parcel of property which connected NE 13th P1. and Blaine Ave. NE. 4. Speeding vehicles • Because of the nature of this area, it is not practical to set up a radar monitoring program; however patrol officers are checking the area as often as possible. • • I UNDERSTAND your frustration and concern with new traffic entering your neighborhood. The question of traffic routing along Blaine Avenue NE was raised during the preliminary plat and final plat reviews for Swan Meadow, and it was determined that the roadway between NE 13th and Blaine should remain open in order to accommodate vehicular and emergency traffic services. Mayor Clymer reported selection of art for the Cedar River Trail by the 1% Board/Commission: for Art Committee of the Municipal Arts Commission. Ron Ringwood, Municipal Arts Municipal Arts Commissioner, explained that the Centennial Committee and Commission, Cedar River the Municipal Arts Commission had worked together on the project to select 1% for Art Selection jurors and distribute a prospectus to,artists in Washington, Oregon and Idaho. A stainless steel sculpture by noted Washington artist.Harold Balazs was selected by jurors and will be located along the Cedar River Trail on the bridge pier at the Senior Center. The 13-foot long, 5-foot high sculpture, based on the idea,"We're all in this boat together," will be constructed of heavy-guagesteel and will be maintenance-free. Mr. Balazs was also commissioned by the City to craft the mosaic mural at the entrance of the downtown fire station when it was built several years ago. Council members requested that safety measures be taken to protect children climbing on the sculpture from falling. Mr. Ringwood agreed to work with the artist to ensure safety without detracting from the aesthetic quality of the piece or preventing public access to the sculpture. Commission, Renton Committee member Karen Lunder presented the painting which was selected Annual Arts First Place by a panel of expert jurors, a water color of the Pike Place Market by Lois Donation Silver. Final . Plat Review Process 4-19-89 The applicant, Dan Swanson, filed final plat application for Swan Meadows Plat consisting of thirteen (13) lots as approved under the preliminary plat application, file PP-013-87. 5-22-89 Petition signed by homeowners located along Blaine Avenue N.E. asking that the same decision regarding improvements to Blaine Avenue N.E for Swan Meadows No.2 preliminary plat be rendered by the Council with respect to the Swan Meadows plat. 5-30-89 Final plat staff report submitted to Hearing Examiner. Recommendation included condition on Blaine Avenue be modified to reflect Council decision on Swan Meadows No. 2 plat. 6-12-89 Hearing Examiner issued recommendation to City Council, denying the plat. The Examiner determined that his office did not have the authority to revise conditions imposed as part of the approval of the Preliminary Plat. Summary of Laws/Court Cases o RCW 82 .02.020 Excise Taxes: The pertinent portion of this law reads as follows (See Attachment) : ". . .No county, city , town, or other municipal corporation shall impose any tax, fee, or charge, either direct or indirect, on the construction or reconstruction of residential buildings, commercial buildings, industrial buildings or on any other building or building space or appurtenance thereto, or on the development, subdivision, classification, or reclassification of land._ However, this section does not preclude dedications of land or easements pursuant to RCW 58.17. 110 within the proposed development or plat which the county, city, town, or other municipal corporation can demonstrate are reasonably necessary as a direct result of the proposed development or plat to which the dedication of land or easement is to apply. " o Nollan v. California Coastal Commission, 107 S.Ct. 3141 (1987) • The Nollan case established the need to have a tight nexus between an exaction and an impact of development. An exaction is a contribution by a developer to a municipality which includes such contributions as the dedication of land for streets, parks, and similar infrastructure, fees paid in lieu of such dedications, and construction of affordable housing and other public facilities. Swan Meadows Division No. 2 8-23-89 A preliminary plat of nine single family residential lots was submitted by Dan Swanson. 11-28-88 The Hearing Examiner issued a recommendation on the plat which included the following condition: "The applicant should participate in a Latecomers Agreement to improve that portion of Blaine Avenue N.E. between the north property line of the subject site and N.E. 16th Street to city access standards. In any event the applicant shall be required to improve Blaine to its full width dimensions in order to provide a safe method of ingress and egress for the proposed plat. " 12-12-88 , Applicant appealed the above identified condition, stating "This off-site condition amounts to .a tax upon the application in that it has no relation to the impacts of the proposed plat and will benefit a variety of other property owners." 4-17-89 The City Council modified the Examiner's decision regarding off-site improvements to Blaine Avenue N.E. The Council required that applicant to post a bond for the following improvements Blaine Avenue N.E. as follows: 1) provide a 2 inch asphalt overlay and install striping to provide a 4 foot walkway along the east side of Blaine Avenue N.E. and 3) provide "No Parking" signs on the east side of the street. The applicant was asked to post a bond since the City needs to install utilities within the roadway. 1 a_. CORRESPONDENCE Letter was entered from George Post, 1122 S. 27th Place, Renton, Victoria PUD: Final, Victoria Hills Hills resident, regarding progress of the Phase II Victoria Hills project. He Phase II, FPUD-042-85 expressed concern that the project will not be completed by the January 14, 1990, deadline established by Council; that the developer has not yet submitted a bond for road improvements which violates the signed contract; and that the landscape buffer has not been installed between the residential and apartment uses nor along S. 26th Street. He urged that the project be terminated or completed on specific dates. OLD BUSINESS Planning and Development Committee Chairman Reed presented a report Planning and regarding an appeal of the hearing examiner's recommendation on the Development Committee Warford/Ellenswood Joint Venture preliminary plat and rezone. The Appeal: applicant has requested a rezone of 5.5 acres located at 2015 and 2113 Duvall Warford/Ellenswood Joint Avenue NE from G-1, general, to R-1, single family residential, zone, along Venture Rezone, R-015- with a 21-lot plat. 89, and Preliminary Plat, PP-015-89 (Brandal The report stated that although the applicant had not filed a timely appeal of Wood) the conditions imposed by the Environmental Review Committee (ERC), the Committee elected to consider the applicant's appeal of the ERC condition that the applicant dedicate one lot of the preliminary plat for recreational purposes, or voluntarily contribute to the establishment of a city park facility in the vicinity. The Committee considered the applicant's appeal of that requirement based on the fact that the hearing examiner had varied his language in imposing the same condition. The Comprehensive Parks and Recreation Plan (CPRP) was adopted by the City in 1984 (Resolution No. 2539). The Comprehensive Parks and Recreation Plan was adopted as a SEPA policy on 2/25/85 by adoption of Ordinance No. 3891 (Renton City Code Section 4-2822(E)(3)). That CPRP calls for the dedication of one lot of the plat for park or other recreational purposes, or alternately, contribution towards development of a city park in the vicinity of the subject site. The availability of recreational sites is a consideration under SEPA (WAC 197-11-444(2)(b)(v). If one lot is not dedicated or other arrangement is made for provision of recreational amenities, then this plat is not in the public's best interest. This would be grounds for denial of the plat. The Committee found no error of fact or law and recommended that the recommendation of the hearing examiner be upheld by the Council. If the above items are found improper, and the applicant fails to dedicate a lot or make other provisions for adequate recreational facilities, then the Committee finds that there is inadequate provision for "open spaces," "parks," and "playgrounds," and pursuant to RCW 58.17.110, recommends denial of the plat. Upon Council inquiry, City Attorney Warren reiterated SEPA requirements for either dedication of a portion of the plat or contribution of funds towards development of parks. SUMMARY OF REQUEST: Final Plat approval to allow the subdivision of 2.965 acres of property into thirteen (13) single family residential lots. SUMMARY OF ACTION: Planning Division Recommendation: approval, with conditions PLANNING DIVISION REPORT: The Planning Division Report was received by the Examiner on May 30, 1989 FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: 1. The applicant, Dan Swanson, filed a request for approval of a 13-lot Final Plat. 2. The yellow file containing the staff report, the State Environmental Policy Act (SEPA) documentation and other pertinent materials was entered into the record as Exhibit #1. 3. The Environmental Review Committee (ERC), the City's responsible official, issued a Declaration of Non-Significance (DNS) for the subject proposal. 4. The subject proposal was reviewed by all departments with an interest in the matter. 5. The subject site is located in the 1400 to 1500 block of Camas Avenue N.E. The site is located between Aberdeen Avenue N.E. on the west and Edmonds Avenue N.E. on the east. 6. The subject site was annexed into the City with the adoption of Ordinance 1822, enacted in March, 1960. The site was classified R-1 (Single Family; Lot size - 7,200 sq ft) with the adoption of Ordinance 3634, enacted in June, 1982. A lot line adjustment was approved in May, 1985. The Preliminary Plat was approved in September, 1988. 7. The Final Plat includes the twelve lots originally intended as part of the plat and a thirteenth lot which had been improperly segregated. 8. Obviously the final plat complies with both the Zoning Code and the Comprehensive Plan which requires single family lots with a minimum area of 71200 square feet. These and other issues were fully explored during review and approval of the preliminary plat. 9. The preliminary plat was subject to a number of conditions as a result of both environmental review and plat review. One condition particularly required the marking of significant trees and their preservation. During work on preparing the subject site, some tree loss resulted. Staff has suggested that the applicant execute covenants requiring tree preservation and city approval of removal. Staff also suggested that the face of the plat reflect the same condition to alert purchasers of the condition. 10. A major concern, and one not completely resolved at this time, was over the second means of access, access to the west and north. A second access was required to permit emergency response and ordinary access since the cul-de-sac would have exceeded permitted lengths. The applicant provided a link between N.E. 13th Place and Blaine Avenue N.E. The access was to have been completed to city standards. The applicability of the condition was not questioned when the preliminary plat was reviewed. Upon review and approval of a second preliminary plat that was to use the same method of access, the condition was questioned. The City Council Dan Swanson ' FP-038-89 June 12, 1989 Page 2 . permitted the applicant to install lesser improvements and to defer those to some future date. The applicant proposes the same standards apply to the instant matter. 11. The applicant was to modify grades at the perimeter of the plat to create modest, tapering grades and to avoid drop-offs greater than two (2) feet. Staff inspection shows the condition has been complied with by the on-site grading. 12. Grade differentials along the newly created Camas may exceed city standards. These grades will have to- be modified to comply with code. 13. An easement was omitted along the east property line. Apparently a variety of calculations for field computations are in error and these must be corrected to satisfy the Public Works Department. The applicant also altered the plat name which complicates record keeping and recording conventions. These items will have to be corrected. The plat will have to be titled Swan Meadows Division I. The mylar currently prepared for recordation does not accurately reflect review and approval authority, and signature lines for the Mayor and King County Health Department are necessary, as are signature dates for the Public Works Director and Traffic Engineer. RECOMMENDATION 1. The review of the Final Plat by the Hearing Examiner and City Council is limited to assuring that the applicant has complied with the conditions imposed during Preliminary Plat review. The Final Plat generally appears to satisfy the conditions imposed by the preliminary plat process, with the exception of the necessary roadway improvements, and some minor discrepancies. But this office cannot forward a Final Pplat to the City Council which contains a number of errors and omissions, as minor as they may appear. They must be corrected prior to submission of the matter to the City Council. 2. The Appearance of Fairness Doctrine provides that no ex parte (private one-on-one) communications may occur concerning pending land use decisions. This means that parties to a land use decision may not communicate in private with any decision-maker concerning the proposal. Decision-makers in the land use process include both the Hearing Examiner. and members of the City Council. All communications concerning the proposal must be made in public. This public communication permits all interested parties to know the contents of the communication and would allow them to openly rebut the evidence. Any violation of this doctrine would result in the invalidation of the request by the Court. Northeast Renton Plan, City of Renton Comprehensive Plan Compendium, 1983 , pages 40-45. 3 . Section 9-1106 (3) , Final Plat Requirements. G. DEPARTMENT ANALYSIS: 1. The applicant, Dan Swanson, seeks final plat approval of single family residential subdivision with thirteen lots (13) lots on a 2 . 965 acre parcel of property. The subdivision is known as Swan Meadows 2 . The applicant originally had submitted a preliminary plat application for a twelve (12) lot subdivision on January 9, 1987 . However, it was discovered that an, adjoining property fronting on N.E. 16th Street, owned by Roger Suttle, was not properly segregated from the parcel owned; by Mr. Swanson. The property was divided by the use of a Quit Claim Deed in 1976 which conveys legal title possessed by the grantor. The City adopted its Subdivision Ordinance in 1971 which requires property to be divided either through a subdivision application or a lot line adjustment application. Neither of these methods were used by the owner of the property in 1976. In this case, , PRELIMINARY REPORT TO 3 HEARING EXAMINER Final Plat of Swan Meadows 2 Page 3 since the lot was not legally created, the ownership could not be conveyed by the Quit Claim Deed. Thus, it was determined 411111 that in order to correct this situation, a revised preliminary plat application which included the Suttle property was necessary and a public hearing was held on the revised application on August 9 , 1988. 2 . , The proposal complies with the single-family designation for the property as shown on the City of Renton Comprehensive Plan Map as well as the R-1, Residential-Single Family zoning shown on the City's Zoning Map. 3 . Pursuant to the City of Renton's Environmental Ordinance and SEPA (RCW 43 . 12C, 1971, as amended) , a Determination of Non- Significance-Mitigated was issued by the Environmental Review Committee on April 11, 1988, and adopted by the Committee for the revised plat application on July 27, 1988. The mitigation measure required for the plat is as follows: a. That the applicant work with the City's landscape planner in reviewing and preparing a plan which incorporates, where feasible, the mature trees into the design of the plat. Note: The applicant worked with the City's land use inspector who visited the site on November 9, 1988 with the applicant and marked trees for saving (See Attachment A) . To further ensure that the trees are preserved, the applicant shall provide a covenant to the City stating that, before a tree is cut on individual lots, the owner shall contact the City's landscape planner to evaluate the health of a tree(s) and the potential hazard posed by leaving the subject tree(s) . It should be noted that the City Council did receive a letter dated November 11, 1989, advising the Council of a possible violation of the condition to preserve trees on the site. The citizen, based upon a conversation with a contractor cutting trees on the site and the owner, reported that the owner was not complying with the environmental mitigation measure. The ' matter was reviewed and a letter was sent by the land use inspector discussing the agreement reached with Mr. Swanson on the retention of the trees and the fact that trees were to be retained where flagged. As the inspector noted in the letter, the saved trees may need to be removed if a tree or trees pose a safety hazard for a residence or if a tree or trees are _ located within the buildable portion of the lot. Occasionally, when plats have been recorded and new owners purchase and improve the lots., trees are cut. Since the retention of the trees in the plat was important and an environmental condition requiring the retention of trees was required as part of the preliminary plat approval, it is important to provide the new home owners guidance with respect to the removal of the trees. The face of the plat should contain a note stating that property owners shall not remove the existing trees without first receiving approval from the City's land use inspector. 4 . The Environmental Review Committee was also concerned with the access to the subject property. As originally proposed, the only access to the plat was through Dayton Avenue N.E. and N. E. 13th Place. This design violated the subdivision code in that the length of roadway from N.E. 12th Street to the end of the new street in the plat (to be known as Camas Avenue N.E. ) was over 500 feet. The design was viewed as a Cul-de-Sac street. Section 9-1108 (7) K states that "cul-de-sacs are permitted provided that they do not exceed five hundred feet (500' ) feet in length. " In addition, the Fire Department requires the provision of a second means of access serving the • PRELIHINARY REPORT TO HEARING EXAMINER Final Plat of Swan Meadows 2 Page 4 plat. The previous owner, after discussing the matter with staff, contacted adjacent property owners on acquiring additional property for the secondary access road. During the process of seeking a means for providing the additional access road, the owner decided to sell the property to the current owner, Swanson Homes. Swanson Homes, worked with the property owner to the southwest, to obtain a right of way easement across Tract 230. The easement document does have a reversion clause stating that, should the applicant not receive final plat approval from the City within the next two years, the 'easement would revert back to the property owner of Tract 230. Tract 230 is currently owned by Dan Swanson, who owns Swanson Homes. Mr. Swanson applied for and has received preliminary plat approval for a nine (9) lot single-family residential plat known as Swan Meadows 1. The easement roadway connecting N.E. 13th Place with Blaine Avenue N.E. has been graded and a layer of crushed rock placed on the easement roadway. The applicant noted that the easement would be improved; and the City Council, based upon a recommendation of the Hearing Examiner, required that the easement be developed to City standards. 5. In addition to the environmental mitigation measure required for the plat, conditions were also placed on the plat by the City Council as part of the approval of the preliminary plat application. These conditions are listed below with a brief discussion as to the applicant's compliance with the conditions as part of the subject final plat application: a. That the applicant develop both the easement connecting N.E. 13th Place with Blaine Avenue N.E. itself, to City standards. The status of the easement is discussed above under No. 4 . Since the easement has not been developed to City standards, the applicant will need to either improve the roadway or post a bond to ensure that the required improvements will be completed. . The applicant is willing to do this once questions are answered with respect to the necessary improvements to Blaine Avenue. This is further discussed under No. 5 of this section of the report. b. The grading and filling of the site shall consider and attempt to preserve the existing trees, if at all possible. See comments under No. 3 (a) above. c. Grading at the perimeter of the site should consider the impacts on adjacent property and no drop-offs greater than one to two feet shall be created which coincide exactly with any property line. The applicant's plans for the preliminary plat showed that the site would be regraded. The property was approximately seven feet lower than the adjoining property to the east. The land use inspector, based on a field visit, determined that the grading which has occurred appears to comply with the requirements of this condition. Some of the property adjacent to the east property line varies in elevation which results in a difference of two (2) to four (4) feet with the Swanson property. However, in looking at the actual grading done on the Swanson property, the land use inspector determined that the actual grading on the site complied with the requirements of this condition. • PRELIMINARY REPORT TO HEARING EXAMINER ,,. Final Plat of Swan Meadows 2 Page 5 Finally, the inspector noted that there was a difference in elevation between the street, Camas Avenue N.E. and the adjacent lots which may result in fill being added to the property reducing the grade difference. If such filling and regrading of the property should occur, the slopes particularly along the eastern property line will need to ,,, , taper gently and/or some method of retention such as a rockery should be used. As specified by the mining, grading and excavation ordinance slopes may not exceed a 2: 1 slope. In order to ensure that this is not a problem in the future, the applicant shall note on the face of the plat that any filling or grading of the site will be subject to review by the City's land use inspector. 6. Various City Departments have reviewed and commented upon the project. The comments generally favor approval of the final plat application. However, there are items which the applicant needs to address before the City can approve the plat for recording with King County. These items are discussed below: Utility Engineering The Utility Engineering Division did not approve the final plat application due to: 1) the need for a sanitary sewer and storm sewer easement located along the east property line not being shown on the face of the plat (Ref. AF 6284197) ; and 2) that the applicant revise the name of the plat to Division 1. With respect to the first concern, the applicant will need to revise • the plat mylar to show the existing easement along the east property line. With respect to the second item, the -applicant submitted the plat map with the name of the plat showing as Swan Meadow 2 instead of the name submitted with the preliminary plat as "JR's Garden Addition" . The name change creates a problem because the various permits issued for the plat by Public Works lists the name as "Swan Meadows Division I" . This creates several problems for the Public Works staff when attempting to make sure fees and other costs are tied to the appropriate plat. Either. all the existing paperwork (permits, etc. ) need to reflect the new name or the name needs to be changed. It is much easier at this time to change the name of the plat than all the existing paperwork. As a result of this name change, the applicant will need to revise the plat name for the adjacent nine (9) lot plat to read as "Swan Meadows No. 2" since the word "addition" is considered the same as "No. 1" . Fire Prevention The Fire Prevention Bureau staff required that the applicant provide secondary access as required as part of the approval of the preliminary plat application. Traffic Engineering The Traffic Engineering staff noted that the applicant needs to: 1) correct items noted in the final street light inspection (apply sealant between service/contractor cabinet and foundation, dirt and stains on pole need to be cleaned (3486B) , retighten nuts on the pole foundation anchor, and tighten bolts holding arms to pole to avoid side to side movement) ; 2) install a street sign at the intersection of Camas Avenue N.E. and N.E. 13th Place; and 3) provide a bill of sale required for the street lighting system. These items will not prevent the plat from being recorded but need to be completed before the City will accept, the street lighting system. • PRELIMINARY REPORT TO E HEARING EXAMINER ' Final Plat of Swan Meadows 2 ' Page 6 Current Planning Reviewer noted that the signature page of the plat mylars needs to be corrected by adding the following: Mayor and King County Health Department signature lines, dates for the signature lines, and dates for the Public Works Director and Traffic ,, , Engineer. These items together with the bonding of the improvements which have not been installed (including Blaine Avenue N.E. and the secondary access easement) must be completed before the plat is recorded. Engineering Division The Engineering Division staff noted several items needing to be addressed: plat certificate, field computations and calculations, modifications to plat 'mylar showing easement along east property line and various corrections (addressing wrong figures and labeling of easement and -other items not referenced or referenced incorrectly, and the installation of improvements or bonds for required improvements. 7. The applicant questioned the extent of improvements actually required for installation to Blaine Avenue N.E. to satisfy the condition for such improvement imposed by the City Council as part of the approval for the preliminary plat. As noted above under 4 (a) , the condition requires the applicant to improve Blaine Avenue N.E. to City standards. The applicant has questioned interpretations by the City staff of the meaning of "to City standards" to mean full street improvements, curbs, gutters, sidewalks, etc. , within the City right-of-way. Due to decisions on a preliminary plat application (Ref. File PP-082- 88) on an adjacent parcel by the same owner, Mr. Swanson, the matter of the type of improvements to Blaine Avenue N.E. which are necessary to satisfy the condition has once again been raised. The applicant's attorney, in correspondence dated May 10, 1989, is asking that consideration be given to revising the condition to improve Blaine Avenue N.E. to reflect the decision made by the City Council as a result of an appeal filed for a similar condition for the adjacent plat known as Swan Meadows Addition. The Council decision on that appeal was to require the following improvements on that portion of Blaine Avenue N.E. between N.E. 16th Street and the north property line of Tract 230: a. A two-inch asphalt overlay on the existing road surface. b. Striping to provide a four-foot walkway on the east side of Blaine Avenue N.E. c. "No Parking" signs on the east side of that street. Note: The Council also stated that " . . .because the City of Renton has need for future installation of utilities along Blaine Avenue N.E, and the extent of those needs has not yet been determined, this applicant should not be required to make the improvements to Blaine Avenue N.E. at this time. Rather the applicant should be required to post a bond to cover the cost of the 2-inch asphalt overlay and the stripping to ensure that the work will be done when the City installs utilities (Ref. City Council minutes of April 17, 1989) . " PRELIMINARY REPORT TO -_E HEARING EXAMINER Final Plat of Swan Meadows 2 Page 7 8. On May 22 , 1989, a petition was submitted to the City which was signed by some of the homeowners along Blaine Avenue N.E. The petition states that the homeowners on Blaine Avenue N.E. which is being improved according to the City Council's decision on the Swan Meadows Addition plat appeal as discussed above under No. 7 . 9 . Staff in the Planning Division and the Traffic and Design Engineering Divisions of the Public Works Departments have reviewed the matter of the extent of improvements to Blaine Avenue N.E. in order to assure safe access for both vehicular as well as pedestrian traffic along the roadway. The issue was researched as a result of the appeal filed for the Swan Meadows Addition plat (Ref. File PP-082-88) . Staff determined that safe access would be assured with the conditions imposed by the City Council as a result of the appeal. Staff's review included an evaluation of the traffic study prepared by Stephan B. Lovell and Associates on the traffic impacts generated by the development of the Swan Meadows Addition plat as well as a review of the traffic generated by the adjacent plats owned by the applicant (the subject plat and the Dan Swanson Short Plat) . It was determined that there was sufficient capacity on Blaine Avenue to accommodate the traffic impacts generated by 'the . additional 25 new residences. .(the two major plats and the short plat owned by Dan Swanson) to be developed between N.E. 13th Place and N.E. 16th Street together with any additional traffic from existing residences along Dayton Avenue N.E. Based upon staff's evaluation of the traffic impacts of the new development and necessary roadway improvements to accommodate such traffic, and the City Council decision on improvements to Blaine Avenue, it is recommended that the condition -regarding improvements to Blaine Avenue N.E. as part of the approval of the preliminary plat be modified to reflect the decision of the City Council on the Swan Meadows Addition appeal. 10. The design of a subdivision includes the design of all on-site improvements (roadways and utilities) . At times, when warranted, off-site mitigation measures may sometimes be necessary to mitigate off-site impacts. Recent court decisions, however, have held that there must be a direct relationship between the impacts of a development and the required off-site improvement. Further, the adoption of RCW 82 . 02 . 020 in 1982 restricts a jurisdiction's authority to require off-site improvements. 11. The final plat application, as conditioned below under the departmental recommendation section of this report, is in compliance with approval of the preliminary plat approved on the site (Ref, File PP-013-88) and should be recommended to the City Council for approval . H. DEPARTMENTAL RECOMMENDATION: Based upon the above analysis, it is recommended that the final plat application for Dan Swanson, file number FP-023-89, be approved subject to the following conditions: 1. The applicant shall provide covenants to the City for each lot and tract stating that before any tree with a diameter greater than 6" is cut, the owner of said lot shall contact the City's landscape planner to evaluate the health of a tree(s) and the potential hazard posed by leaving the subject tree(s) . 2 . That the applicant shall provide a note on the face of the plat stating that property owners shall not remove the existing trees without first receiving approval from the City's land use inspector. PRELIMINARY REPORT TO .E HEARING EXAMINER Final Plat of Swan Meadows 2 Page 8 3 . That the applicant shall place a note on the face of the plat that any proposed filling or grading in excess of four (4) cubic yards of the individual lots for the development will be subject to review by the City's land use inspector. 4. That the applicant revise the plat mylar as follows; . a. Show the existing easement along the east property line (REF. Af 6284197) . b. Revise the name of the plat to "Swan Meadows Division No. 1" . c. Revision of the signature page of the plat mylars be revised as follows: Mayor and King County Health Department signature lines, dates for the signature lines, and dates . for the Public Works Director and Traffic Engineer. d. Revision of the plat map errors identified by Design Engineering staff including numerical errors on the plat, the placement of the easement along the east property line on the plat map and the labeling of items which either were not referenced or referenced incorrectly. • 5. That the applicant either bond for the completion of the on-site and off-site improvements which have not been completed or provide the City with a bond for 150 percent of the costs of any, improvements to be deferred. 6. That the required conditions to •Blaine Avenue N.E. be defined as approved- for the. Swain Meadows Addition Plat: a 2-inch asphalt overlay, striping a four foot walkway along the east side of Blaine Avenue N.E. , and the posting of "No Parking" signs on the east side of the street. Further that the applicant will not be required to install these improvements but rather shall post a bond to ensure that the asphalt overlay and the striping are done at such time when the City installs utilities along Blaine Avenue N.E. The applicant seeks approval to subdivide 2 . 18 acres into 9 single-family residential lots . The hearing examiner recommended approval of the proposed 9 lot preliminary plat subject to two conditions . The applicant appealed only one of those conditions - that applicant make off-site improvements to Blaine Avenue N.E. to city access standards . The committee found that full street improvements are not necessary for this 9 lot plat. However, the cumulative effect of development in this area may require full street improvements in the future. The committee did find that the applicant should be required to improve Blaine Avenue N.E. (north of applicant's north property line to N.E. 16th) with a 2" asphalt overlay and install striping to provide a 4 foot walkway along the east side of Blaine Avenue N.E . Further, that "No Parking" signs be placed on the east side of the street. However, because the City of Renton has need for future installation of utilities along Blaine Avenue N.E. , and the extent of those needs has not yet been determined, this applicant should not be required to make the improvements to Blaine Avenue N.E. at this time. Rather, the applicant should be required to post a bond to cover the cost of the 2 " asphalt overlay and the striping to ensure that the work will be done when the city installs utilitieq, or the equivalent amount be applied to future street improvement projects. Lovell and Associates with respect to the most recent plat demonstrated that the platting of approximately 25 lots by Mr. Swanson in the vicinity will not produce any adverse traffic circulation impacts . Swanson is prepared to submit \for final plat approval but in order to do so, requires clarification of certain issues . The City hearing examiner imposed a preliminary plat condition with respect to this plat which requires the applicant to develop "Blame. Avenue N.E. itself to City standards . " Please identify with specificity what the applicable "City standards" are and exactly what improvements will be required for final plat approval. Additionally, please confirm that deferral of these improvements and bonding for them is an acceptable, if not preferred, alternative since the City has near-term plans for utility work in this area. As you are aware the City Council Planning Committee determined on April 6, 1989 to reduce the same hearing examiner imposed improvements with respect to Swan Meadow Addition (PP-082-88 ) . The new improvement requirement for Blaine Ave. N.E. , between the plat and N.E. 16th Street, will be a 2-inch asphalt overlay with a 4-inch white stripe creating a 4-foot wide pedestrian walkway. These improvements are more consistent with the limited transportation impacts of the two plats collectively. It is evident that this more limited level of offsite improvements should also be substituted for the excessive offsite improvements that have been required for the J. R. ' s Garden Addition plat. It is expected that this issue will be addressed during the City' s review of the final plat submittal. Inasmuch ONISION Y OP RENTON APR 19 1989 Ti, Ms . Jeanette Samek-McKague April 12 , 1989 Page Two as the offsite improvement conditions for the two plats should be consistent, it is foreseeable that the first plat conditions may be amended to conform to the second plat in this respect. Therefore, it is proposed that the bonding requirement for the final plat of J. R. ' s Garden Addition be an amount consistent with the cost of the improvements required for Swan Meadows . In the event that the offsite improvements for the final plat are not reduced to correspond to that of the second plat as expected, Swanson Homes will agree to increase the amount of the bond prior to the recording of the final plat to correspond with costs of the actual offsite improvements determined by the City Council. Due to the delays caused by the many meetings regarding the Swan Meadows plat, it is urgent to Swanson that clarification of the foregoing issues be made on an expedited basis .
