Renton, Washington 98055 • RE: Request to extend expiration period of Prellwitz/Hewitt Short Plat, File ShP1-100-84, V-101-84 Dear Mr. Prellwitz: • The Building and Zoning Department has completed their review of your request for an extension of the expiration period for your short plat. We have found your request reasonable and have approved an extension of the approval period for your plat for a maximum for six (6) months as stated in Section 9- 1105 (10) . The plat will expire on May 13, 1988. Originally your request went to the City's Hearing Examiner. The Examiner after reviewing the subdivision regulations found that extensions of short plat are approved by the Building and Zoning Department and then referred the matter to this Department. Renton, WA 98056 Re: Prellwits/Hewitt Short Plat, File Short Plat-100-84, V-101-84 Dear Mr. Prellwits: This letter is a follow-up on items needing to be included on the short plat mylar when one is prepared. First, the legal description which was provided to the City with the land use application needs to include a reference to or a description of the 30 feet of street deeded to the City. Blaylock, Zoning Administrator RE: PRELLWITZ/HEWITT SHORT PLAT 100-84 REQUEST FOR CLARIFICATION In Finding No. 9, it appears the Hearing Exciminer is stating that a street will be extended northward between Lots 3 and 4. However, the preliminary plan and staff presentation in the public hearing stated that it was an easement for "future" roadway extension. PUBLIC HEARING: After reviewing the Building and Zoning Department Report, examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: The hearing was opened on October 23, 1984, at 9:25 A.M. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were affirmed by the.Examiner. The following exhibits were entered into the record: Exhibit #1 - Yellow file containing application, proof of posting and other pertinent documents pertaining to this application. Exhibit #5 - Staff comments from the Fire Department and Engineering Department to be made a part of the permanent yellow file. Roger Blaylock, Zoning Administrator, was called upon to review the staff report, and the following areas were discussed. Referring to the vicinity map he advised that previously in this area some very large superblocks had been created between Edmonds and Jones and 12th and 27th streets. At the turn of the century this area was divided into large lots and many are still present. With urbanization of the city, many of the homes were built along the streets which precluded central access. In this case, Hillcrest Lane was established as a dead-end street, with the intention it would eventually go through. Continuing to use the vicinity map Mr. Blaylock further reviewed the previous developments in the vicinity of this proposal. In this particular case, the applicant has proposed a 50 ft. easement for future roadways between proposed Lots 3 and 4 to the north to allow access to Tract #228. The continuation of this street will allow a circulation pattern to develop for the. interior of this superblock. When this occurs, Dayton Avenue will have to be extended and improved to city standards. The Fire Department comments for this proposal requested Prellwitz/Hewitt SP-100-84 & V-101-84 October 30, 1984 Page 2 that a turnaround be provided because the street is in excess of 150 feet; and it was recommended that the turnaround be provided in the 50 foot easement in the form of a hammerhead. All utilities will have to be up-graded, and a sewer extension will be required. It was noted that traffic generated would be approximately 40 trips per day. The proposal complies with the intent of the Comprehensive Plan and R-1 zoning requirements. This short plat is unique in that it is located on two sides of an existing partial street, which may be considered desirable because otherwise, the interior areas of the partial streets may never have been developed any further than a deadend street and there would not have been sufficient public access. Reviewing the second portion of the request - a variance to allow two smaller lots than required by code - Mr. Blaylock stated it appears the variance is appropriate. The size of the property is a result of previous subdivisions along Dayton Avenue N.E. Two lots to the east of the subject site are 66 feet in width. The square footage in these lots does exceed the code requirement of 7200 sq. ft. There will be large rear yards. The creation of two lots will preserve the integrity of the surrounding area by not creating a pipestem lot. In summation, Mr. Blaylock recommended approval of .the Short Plat and Variance as submitted. The Hearing Examiner called for testimony from the applicant or their representative. Responding was: Floyd Hewitt 1806 N.E. 27th Street Renton, Washington, 98056 Mr. Hewitt advised the Examiner that even though lots 1 and 2 are less than the required width, they are going to build the houses back far enough on the lots so there will be no problem with off-street parking. Presently this is a deadend street cluttered with debris at the end which would make it very difficult for emergency vehicles to turn around. Mr. Hewett admitted the traffic may be a concern due to the shortness of the streets, but feels that the short streets could also be considered useful in diminishing the possibility of speeding cars through the area. Other than the above comments, he stated he is in concurrence with the staff report, and made himself available for questions from staff or the audience. The Hearing Examiner called for further testimony in support of, or in opposition to the application. Wishing to speak from the audience was: Joan Paddon 1329 Dayton N.E. Renton, Wa. 98055 Ms. Paddon stated she owns a home next to the lots to be developed and .questoned Mr. Hewitt as to the street program proposed, the quality of the proposed homes to be built, noise, and impact of more traffic. Mr. Hewett responded the homes have not been designed yet but will be compatible with other homes in the area. Traffic will not be a problem. The street will continue to be a deadend but will be expanded to full width. The woods to the west and the north will not be removed. He advised the tentative plan is for single story homes. No date has been set for construction due to the fact street improvements must be completed first to avoid providing a bond to the city. He predicted it may be close to spring before construction would begin. Ms. Paddon expressed concern over the narrow lots which could place a new home right on her property -line, but the Hearing Examiner stated it was his understanding the proposed lots would only be 6 feet narrower than the lot Ms. Paddon's home is on at the present time. Mr. Hewitt said the property lines will be surveyed and stakes will be placed in the ground. Ms. Paddon reiterated her desire that the newly constructed homes be compatible in size and value to the present homes in the area. Mr. Hewitt replied stating he felt anytime a builder is in a new area it is their desire to build compatible dwellings, without over-building. He assured her their finished product will be pleasing to the neighborhood. There were no further comments from the audience, but Mr. Hewitt closed by stating he wanted to clarify the fact he felt it was within their right to build whatever type of home they wanted as long as it met all City codes and requirements. The Hearing Examiner confirmed that new construction must meet City codes but the style is totally up to the builder or the owner. There being no further comments from the audience, or staff, the hearing was closed at 9:55 A'.M. Prellwitz/Hewitt SP-100-84 & V-101-84 October 30, 1984 Page 3 ' FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: 1: The applicants, Douglas Prellwitz and Floyd Hewitt, filed a request for approval of a four lot short plat, together with a variance, to create two lots with less than the required width. 2. The application file containing the application, the State Environmental Policy Act (SEPA) documentation, the Building and Zoning Department Report, and other pertinent documents was entered into the record as Exhibit #1. 3. Pursuant to the City of Renton's Environmental Ordinance and SEPA (RCW 43.21C, 1971, as amended), the subject proposal has been determined to be exempt from the threshold determination by the Environmental Review Committee (ERC). 4. Plans for the proposal have been reviewed by all city departments affected by the impact of this development. - 5. The subject site is located at the western end of the Dayton Avenue N.E. cul-de-sac in the vicinity of N.E. 12th St. The site straddles the road's westerly projected extension. The site is 240 feet west of Dayton and approximately 450 feet north of 12th. 6. The site is essentially level and is covered with deciduous trees, brambles and grasses. 7. The subject site was annexed into the City by Ordinance 1822 in March of 1960. The site was automatically zoned G-7200 upon annexation. Consolidation of residential districts resulted in the subject site being zoned R-1 (Single Family Residential; Minimum Lot Size - 7,200 sq ft). 8. The map element of the Comprehensive Plan designates the area in which the subject site is located as suitable for the development of single family dwellings but does not mandate such development without consideration of other policies of the plan. 9. The applicants propose dividing the subject site into four separate lots. The applicants would also , extend the east/west extension of Dayton Ave westerly through the subject site and an extension to the north to provide future access to large interior parcels. 10. The subject site is approximately 38,000 sq ft which would be divided as follows: Lots 1 and 2 would be approximately 7,819 square feet each; while Lot 3 would be approximately 10,807 sq ft; and Lot 4 would be approximately 10,839 sq ft. 11. Lots 3 and,4 would each be corner lots and will observe the 20 foot setbacks along both frontages. Each of these lots will be approximately 101 feet wide by 107 feet deep. 12. Lots 1 and 3 would be approximately 130 feet deep by a proposed 60.15 feet wide whereas the Zoning Code and Subdivision Code require a minimum width of 75 feet. Each of these lots will be approximately 600 sq ft larger than required by the 7,200 sq ft lot area requirements. 13. Previous subdivision patterns in the area resulted in lots with a width of approximately 60 feet, and lot widths vary considerably in the area from 50 feet to greater than that required by the zoning code. Lots immediately adjacent to the subject site are 66 feet in width. These patterns also precluded ordinary access to the subject site and other interior parcels. They also resulted in wider and narrower lots to accommodate the street patterns for access. 14. , The Building and Zoning Department has demonstrated that the lot area is sufficient for construction of ordinary dwelling units. The Fire Department requires that the two roadway extensions have sufficient area _for maneuvering and turning emergency vehicles. 16. The four lots will accommodate four homes which would be anticipated to increase the population of the area by approximately 10 persons, increase the traffic by approximately 40 vehicle trips per day, and increase the school age population by approximately 1 student. CONCLUSIONS 1. The proposed short plat appears to serve the public use and interest. The creation of additional building opportunities in developed areas with sufficient public utilities prevents unwarranted urban sprawl while at the same time increasing the city's tax base. 2. The four new lots will not burden existing urban services, nor will it crowd the neighborhood. The up to 40 additional trips can be accommodated on the roads in s the area, and the one new student will not tax the school system. 3. The variances requested appear reasonably related to the pre-existing platting and street layout which created certain lots which are some multiple of 60 feet in width. These conditions prevent accommodation with the newer standards. Additionally, the dedication of two areas for future expansion of roads through the subject.site further limited the utility of the applicants' property. 4. The existence of similarly sized lots next door indicates that the applicants' will not be in receipt of a special privilege. Nor does there appear to be any reason to anticipate that approval of the variances will adversely affect adjoining property or the public welfare. 5. An alternative would have been to create pipestem access, but this solution would have been unprecedented in the immediate area. The proposal therefore appears to be the minimum relief necessary which enables the applicants to make reasonable use of the subject site. 6. Weighing heavily in this decision is the fact that the applicants are extending two separate roadways through the site, thereby decreasing the buildable lot area to provide access to other properties. The fact remains that the Zoning and - Subdivision Codes were amended to provide wider lots, and the existence of smaller lots approved under the earlier codes would not, by itself, justify approval of the requested variances. 7. Safe and efficient maneuvering of emergency vehicles on the extended roadways must be assured, and is'therefore subject to the approval of the Fire Department. DECISION The proposed short plat and associated variances are approved subject to the dedication and improvement of the roadway extensions - subject to the approval of the Fire Department. The short plat is unique in that it is on two sides of an existing street, Dayton Avenue N.E., a fifty foot wide street was anticipated in the 1960's with the development of the plat of Hillcrest Lane to the east of the subject site. The applicant is- also showing a fifty foot easement for future roadway_ purposes between proposed Lots #3 and #4 to the north to allow access to Tract 228. Continuation of the street through this area will allow an ultimate circulation pattern for the interior of this large superblock. VARIANCE 4. The applicant has requested a variance to allow two of the lots on the south side of Dayton Avenue N.E. to have a frontage of 60.15 feet instead of the required 75 feet per code. Applying Section 9-1109(1), it appears that the variance is appropriate;- a. PL.-100-84, V-101-84 October 23, 1984 PAGE 4 The size of the property is,'a direct result' of a previous 'subdivision along Dayton Avenue N.E. when 60 foot lots were allowed in the R-1 zone and the subdivision ordinance. The- applicant is actually working with a piece of property that was left over after divisions of Tract 229 and is therefore a physical limitation resulting from size. The lots themselves will have sufficient area to meet the minimum lot size standards of the code and still provide a buildable area as shown in'-the schematic development plan that the applicant has' submitted. The applicant can provide the necessary function of the house by placing the garage in front of -the living area of the house and creating an "L" shaped residence. b. That the variance is necessary to insure such property the rights and privileges enjoyed by other properties in the vicinity and under similar circumstances. The general area was developed in the 1960's with lots approximately 60 to 70 feet in width. None of the single family lots in this area developed'to the 7200 square foot -lot size standard, are pipestem lots. The applicant did have the right to apply for a variance to allow a pipestem lot but it would create a street scape that is not typical-of the area and possibly reduce eventual property rights and value enjoyed by other lots in the vicinity. Therefore, it would appear that since the proposed lots are buildable in a typical style for the existing neighborhood and a comparable size residence could be constructed, that the variance is appropriate. c. That the granting of the variance will not be materially detrimental to the public welfare or injurious to other-property in the vicinity The creation of two lots having direct frontage onto a public street preserve the integrity of the neighborhood by not creating a pipestem lot. The variance requested is not substantial enough to either create a hazard, because of traffic movements of automobiles backing onto the streets, or unusual construction designs that would force the structure upward and create an aethestic intrusion into a -neighbors- yard. Emergency access can be provided on the lots for both police and fire activities. It would appear that'the proposal is not detrimental` to adjacent residences or-the general neighborhood. 5. The Policy Development, Parks, Police, and Building Departments of the City of Renton have responded to the proposal and-have recommended approval without any conditions. No' comments have been received from the Public Works Department. It is recommended'that the Hearing Examiner formally request from the Public Works Director that all available personnel be present to answer any questions at the public hearing. M.
