SUBJECT: Removing Old Residential Development Standard Condition
BACKGROUND: The Middle Housing code amendments (Ord 6160) updated the Residential Development Standards Tables and associated conditions, including removing the following condition: 39. In addition to the applicable yard setback requirements of thezone and to ensure adequate vehicular maneuvering area, garagesand carports that are accessed through alleys shall be set back asfollows:a.Nine-foot (9’) garage doors shall be at least twenty six feet (26’)from the back edge of the alley; orb. Sixteen-foot (16’) garage doors shall be at least twenty four(24’) from the back edge of the alley.
Since yard setbacks were reviewed with middle housing, former condition 39 was removed. However, condition 39 was referenced in multiple development standard tables and as an exception to condition 11, which also relates to garage setbacks. In order to rectify the outdated reference, the exception from condition 11 and all instances of condition 39 in the development standard tables should be removed.

DECISION: Amend RMC 4-2-110A, 4-2-110B, and 4-2-110I.11, to remove the references to 4-2-110I.39.
JUSTIFICATION: The reference is to a section which has been intentionally removed.

APPEAL PROCESS: To appeal this determination, a written appeal accompanied by the required filing fee must be filed with the City's Hearing Examiner (1055 South Grady Way, Renton, WA 98057, 425-430-6551) no more than 14 days from the date of this decision. Section 4-8-110 of the Renton Municipal Code provides further information on the appeal process.
