HomeMy WebLinkAboutContractPage 1 of 5 PERMISSION TO PARK/STORE AT SENIOR CENTER PARKING LOT AND CITY CENTER PARKING GARAGE Doxtater & Co. dba The Workshop THIS Permission (“Permission”) is made and entered into this DĂLJϮϳ, 2026 (the “Effective Date”), by and between the City of Renton (“City”), a Washington municipal corporation, and Doxtater & Co. dba The Workshop, (“The Workshop”) a limited liability company. The City and The Workshop are at times collectively referred to as “Parties.” Doxtater & Co. dba The Workshop is currently under contract CAG-25-317 with the City to provide necessary services for the event management services for Legacy Square. The City of Renton Public Works Division – &ĂĐŝůŝƟĞƐ hereby gives The Workshop and its ĂŐĞŶƚƐ͕ĞŵƉůŽLJĞĞƐ͕ĐŽŶƐƵůƚĂŶƚƐĂŶĚƌĞƉƌĞƐĞŶƚĂƟǀĞƐ͕ĐŽŶƚƌĂĐƚŽƌƐ͕ĂŶĚƐƵďĐŽŶƚƌĂĐƚŽƌƐĞdžĐůƵƐŝǀĞ permission to park certain wheeled vehicle (24' long x 8' wide x 13' high RV) in the parking lot ƵƉŽŶƚŚĞĚĞƐŝŐŶĂƚĞĚƉŽƌƟŽŶŽĨ real property known as 21ϭƵƌŶĞƩǀĞE͕ZĞŶƚŽŶ͕tϵϴϬϱϳ ;͞^ĞŶŝŽƌĞŶƚĞƌ͟ͿĂŶĚƚŽďŽƚŚƐƚŽƌĞƐƵƉƉůŝĞƐĨŽƌƐƚĂŐŝŶŐĂŶĚƵƟůŝnjĞϱƉĂƌŬŝŶŐƐƉŽƚƐŝŶƚŚĞ ĚĞƐŝŐŶĂƚĞĚƉŽƌƟŽŶƐǁŝƚŚŝŶƚŚĞ property known as 655 S 2nd ^ƚ͕ZĞŶƚŽŶ͕tϵϴϬϱϳ;͞WĂƌŬŝŶŐ Garage”) and ĨŽƌŶŽŽƚŚĞƌƉƵƌƉŽƐĞ͕ƐƵďũĞĐƚƚŽƚŚĞƚĞƌŵƐĂŶĚĐŽŶĚŝƟŽŶƐƐĞƚĨŽƌƚŚŚĞƌĞŝŶ͘^ĞŶŝŽƌ Center and Parking Garage are together referred to as “PROPERTY” in this Permission. CONDITIONS ARE AS FOLLOWS: 1. The Workshop may park vehicle and store equipment and other supplies in the designated areas of the parking lot at the Renton Senior Center and the storage areas as set forth in Exhibit A & Exhibit B for parking and storage purposes. 2. The Workshop must take all necessary precautions and coordinate all efforts with CITY STAFF to ensure the safetLJĂŶĚƐĞĐƵƌŝƚLJŽĨƚŚĞƉĞƌƐŽŶƐĂŶĚƉƌŽƉĞƌƚLJƵƚŝůŝnjŝŶŐWZKWZdzͬSenior Center & Parking Garage, at all times, prior to placing the vehicles, and supplies. The Workshop shall not interfere with the use of any of the Tenants at the WZKWZdzͬSenior Center & Parking Garage. 3. The Workshop shall take all reasonable precautions to protect the PROPERTY and City - owned improvements. The Workshop ƐŚĂůůƌĞƐƚŽƌĞĂŶĚͬŽƌĐŽƌƌĞĐƚĂŶLJnegative physical impact (including contaminants and vehicles leaking) to the WZKWZdzͬSenior Center & Parking Garage, to the satisfaction of the Administrator of the Public Works Department, or their designee. 4. The Workshop shall not use, store, generate, process, transport, handle, release, or ĚŝƐƉŽƐĞŽĨĂŶLJŚĂnjĂƌĚŽƵƐƐƵďƐƚĂŶĐĞ͕ŽƌŽƚŚĞƌƉŽůůƵƚĂŶƚƐŝŶŽƌŽŶƚŚĞWZKWZdzĞdžĐĞƉƚŝŶ accordance with all applicable laws. ! "        CAG-26-150 Page 2 of 5 5. The term of this permission is effective on June 1, 2026 and shall terminate September 30, 2026. CITY retains the right to terminate this WZD/^^/KEupon 30 days’ notice to The Workshop for any reasons it desires. 6. Either party shall deliver notices required or permitted under this permission to the following locations. The Workshop must be insured for damage resulting from liability of The Workshop (including agents or employees) in the minimum amount of $1,000,000 per each occurrence. SCI Infrastructure or agent ŵƵƐƚĨƵƌŶŝƐŚƚŽ>/E^KZͬCITY proof of insurance in the forms and amounts satisfactory to City. 8. The Workshop is fully responsible for the vehicles and supplies. The Workshop shall defend, indemnify, and save harmless CITY, its officers, agents, and employees from and against any and all claims (whether valid or alleged), demands, actions, suits, damages, losses, judgments, liabilities, expenses and costs, including but not limited to, court costs and reasonable attorney’s fees incurred by City on account of any such claims, demands, or liabilities, and from loss of any kind or nature or nature arising out of, resulting from, or in connection with this Permission. The Workshop obligation shall apply whether or not there is concurrent, active, or passive negligence on the part of the CITY, its agents, officers, or ĞŵƉůŽLJĞĞƐ͕ĞdžĐĞƉƚǁŚĞƌĞ>/E^KZͬ/dz is solely negligent. It is further specifically and expressly understood that the indemnification provided constitutes The Workshop waiver of immunity under the Industrial Insurance Act, RCW Title 51, solely for the purposes of this indemnification. The parties have mutually negotiated and agreed to this waiver. The provisions of this section shall survive the expiration or termination of this license. ϵ͘ EŽƚŚŝŶŐŝŶƚŚŝƐtemporary permission shall be construed to grant The Workshop an easement or right by implication, prescription, or any other operation of law, or to extend the term of the permission past its expiration date as stated herein. !
