The Grantee shall innocase be responsible for the restoration of private features such as, but not limited to, artificial turf, trench drains, irrigation, fences or other private features o, surface treatments encroaching within the easement area. Grantor shall retain the right to use the surface of the easement as long assuch use does not interfere with the easement rights granted mthe Grantee. Prvate features, such as, but not limited to, artificial turf, trench drains, irrigation, fences orother private features, shown onthe drawings per City ofRenton Public Work Project number42sa ("Fi|e4zamr) may he maintained, repaired, and replaced provided the Grantor's features are not unreasonably expanded beyond what was permitted under file 4238 such that it increases the costs to the Grantee to use the easement area for the purposes defined herein. With exception tothose items identified above, Grantor shall not have the right to: a. Erect ormaintain any buildings orstructures within the easement; o, b. Plant trees, shrubs or vegetation having deep root patterns which may cause damage to or interfere with the utilities to be placed within the easement by the Grantee; or C. Develop, landscape, or beautify the easement area in any way which would unreasonably increase the costs to the Grantee of restoring the easement area and any private improvements therein; or d. Dig, tunnel or perform other forms of construction activities on the property which would disturb the compaction or unearth Grantee's facilities on the right-of-way, or endanger the lateral support facilities; or e Blast within fifteen (zs)feet ofthe easement; or f. Erect fences in such a way as to prevent access by the Grantee's vehicles to the Grantee's facilities. Any fence construction must provide for an opening (gated, removable sections, barriers, etc.>ofat least ten (oo) feet inwidth; vr 9. Erect any objects within fifteen (15) above the ground surface within the easement. 3. Grantor acknowledges that in the event there is damage, failure, breakage, or othe impairment of the Grantee's water mains that water service tnthe Property may be interrupted for an indefinite period of time until the repairs and/or replacement of the damaged water mains are completed. Grantor expressly releases Grantee from any and all liability for any interruption in water service to the Property, Instrument Number: 1 Docun/ont:EA8Roc: S310.50Pugo'3of8 Record Date:6/3/2026 3:40 PM Ving County, WA « Grantor agrees, at its sole cost and under Grantee's direction, that in the event that the Grantee's water mains need to be excavated or unearthed for repair, replacement, maintenance, or alteration, that Grantor will be responsible for providing such excavation or unearthing of the water mains pursuant to applicable law, including trench safety and shoring and protection of the existing private utilities and infrastructure. Unless in the event of an emergency, Grantee agrees to give Grantor fourteen (14) calendar days' notice of routine maintenance or replacement of the water mains requiring excavation or unearthing. /f an emergency occurs requiring immediate excavation or unearthing of the water mains, Grantee agrees to provide Grantor up to twenty-four (24) hours nmotice, to the extent practicable. This easement shall run with the land described herein, and shall be binding upon the parties' their heirs, successors in interest and assigns. Grantor covenants that it is the lawful owner of the above property(ies) and that ithas ogood and lawful right toexecute this agreement. Grantor shall protect, save and bald harmless, and defend, with counsel of its sole reasonable choice, Grantee, ostenunt(s), and their successors, assigns, customers and invitees from all claims, actions, Ned or threatened, costs, damages, or expenses of any nature whatsoever arising out of or in connection with any acts or omissions o|Grantor in connection with this easement. The obligation to protect, save and hold harmless, and defend shall not include such claims, actions, costs, damages, or expenses which may be caused by the sole negligence ofGrantee urits tenant(s), or their successors or assigns; Provided that if the claims actions, costs, damages, or expenses are caused by or result from concurrent negligence of (a) Grantee or its tenant(s), or their successors or assigns and (b) Grantor, its agents, contractors or assigns, and involves those actions covered by ncxv 4.24.115, this indemnity provision shall be valid and enforceable only to the extent of the negligence of Grantor, its agents, contractors orassigns.
