The subject property is approximately 10,018 square feet (0.23 acres) and is located in the Residential-8 (R-8) zone within the Talbot Community Planning Area. The Site Plan (Exhibit 2) depicts the proposed 92 to 94 foot-long fence along the front yard property line at 108th Ave SE and around the corner of the property that follows the clear vision area until it intersects the secondary front yard fence. No portion of the fence is proposed to be located within the public right-of-way (ROW). The site plan includes landscaping in the ROW that will be installed during the construction of the transit stop shelter. The fence would be constructed as a solid western red cedar with the finished side facing the ROW. The applicant contends that the fence is similar to fences in the immediate vicinity that are along the ROW. The applicant seeks a Special Fence Permit to modify the height standard in order to provide additional privacy to the homeowner from the Metro RapidRide bus stop that will be constructed in the ROW abutting the property’s front yard. ANALYSIS: City staff agrees with the applicant's Justification (Exhibit 3) for an increased height limit within the front yard setback. Staff concurs that the proposed fence strikes an appropriate balance between preserving private space and protecting the safety and aesthetics of the neighborhood. The fence would ensure continued privacy for the residents once the RapidRide transit stop is constructed and it is aesthetically similar to the existing fence across 108th Ave SE. Therefore, staff recommends approval of this Special Fence Permit request as submitted. The proposed fence improves the privacy and security of the adjoining yard space. b. The proposed fence does not detract from the quality of the residential environment by being out of scale or creating vast blank walls along public roadways. c. The proposed fence compliments the environment it serves in an aesthetically pleasing manner. d. The proposed fence does not present a hazard to vehicular or pedestrian traffic. DECISION: The Special Fence Permit is hereby Approved. APPEAL: This administrative land use decision will become final if not appealed in writing to the Hearing Examiner on or before 5:00 PM on July 2, 2026. An appeal of the decision must be filed within the 14-day appeal period (RCW 43.21.C.075(3); WAC 197-11-680). Appeals must be submitted electronically to the City Clerk at cityclerk@rentonwa.gov or delivered to City Hall 1st floor Lobby Hub Monday through Friday. The appeal fee, normally due at the time an appeal is submitted, will be collected at a future date if your appeal is submitted electronically. The appeal submitted in person may be paid on the first floor in our Finance Department. Appeals to the Hearing Examiner are governed by RMC 4-8-110 and additional information regarding the appeal process may be obtained from the City Clerk’s Office, cityclerk@rentonwa.gov. The approval body may modify his decision if material evidence not readily discoverable prior to the original decision is found or if he finds there was misrepresentation of fact. After review of the reconsideration request, if the approval body finds sufficient evidence to amend the original decision, there will be no further extension of the appeal period. Any person wishing to take further action must file a formal appeal within the 14-day appeal time frame.
