Your protest asserts that the apparent low bidder, CR Construction LLC, failed to provide the name of the rebar installation subcontractor with whom it intends to directly subcontract if awarded the contract. Review and Determination: The City carefully reviewed the bid requirements and applicable statutory provisions, including RCW 39.30-060 as amended. Under the statute, bidders are required to identify certain subcontractors, including for structural steel and rebar installation, only for public works contracts exceeding $1,000,000. For this project, the engineer’s estimate range is between $475,000 and $500,000. Accordingly, the statutory subcontractor listing requirement does not apply to this bid solicitation. Therefore, CR Construction LLC, as well as all other bidders, was not required to provide to complete or submit a subcontractor listing form including the rebar installation subcontractor as part of its bid. Although the subcontractor listing form was included in the bid documents, its inclusion does not create a mandatory requirement beyond the applicable statutory threshold, nor does it create a material bid requirement inconsistent with state law. Therefore, the omission identified in your protest does not constitute a material defect, irregularity, or basis for bid rejection. Based on the foregoing, the City denies the bid protest. Raudenbush Earthworks is protesting CR Constructions bid due to the sub-contractor document being incomplete. The bid submittal package provided by the city of Renton states that their bid is considered non-responsive/void.
