Hi Kyle,
I apologize for some of the confusion on the submittal requirements – I thought Clark may have already waived the
unnecessary items. With regards to the Master Application – there are no critical areas located on your property.
The following items under the variance submittal items are waived for this project:
- 14 (only waived if no trees proposed for removal)
- 15 (same condition as 14)
- 16 (same condition as 14)
- 17
- 18
- 19
- 20
- 21
- 22
- 23
- 24 (only waived if new structure not located over utility lines – it doesn’t appear to be)
- 26 – you don’t need a full drainage plan, but show where you’re tying into the existing gutters
- 27 (only waived if on-site grading is greater than 24” of earth disturbed (or 500 cubic yards))
- 29
Please provide this email as a PDF when you submit the application as documentation of the waiver approval for these

I have cc’ed Brian Ashley, my contractor on this mail because we were chatting tonight and he indicated he may be
reaching out to you this week. In the meantime, I’m struggling to figure out where to go to gather a few pieces of
information, and was wondering if you could point me in the right direction. I am basing the application off the
requirements in the attached file, can you please confirm this is the right one for our project? And if any of these items
aren’t needed for my variance application, please let me know so I can stop looking. 😊 Specifically I’m trying to find:
The Land Use Permit Master Application asks if the site is located on any environmentally critical area, such as
an Aquifer protection area, wetland, etc. We are building on an existing residential lot, so is it safe to say none
of these apply to our project?
17. Wetland Assessment – There is a drainage pond next to the house, where do we look to determine if it’s
considered a wetland? I checked the King County iMap and it didn’t indicate any wetlands in the vicinity, but I
figured it was best to double check with you. 19. Flood Hazard Data – Same here, I checked iMap and saw
nothing, plus our homeowners insurance says we are not in a flood zone, but I’m not sure how to prove that.
How do we verify that?
22. Geotechnical Report – we’re building on the existing lot from the original building permits, do we need this
report if we aren’t changing the grading?
26. Drainage Control Plan – We are tying into the existing gutters from the house, are there other drainage
considerations we need to account for?

On Wednesday, 5/30 I dropped by the office to ask a few questions about a project my wife and I are planning. Initially I
spoke to Adriann, and she quickly realized I needed to connect with you, so she made the introduction. During our
conversation, we discussed the possibility of a variance, and you suggested I send over a high-level overview of the
proposed variance so you could review and discuss with your boss before we submitted the formal application. Based
on our conversation and the variance application provided, below and attached is the information I think would be most
helpful. Please take a look and let me know if there’s any other info I can provide, and of course we’d love to hear your
thoughts after speaking with your boss.

Project Narrative:
Please provide a clear and concise description of the proposed project, including the following:
Project name, size and location of site: Covered deck, Width: 29’-5” w/gutters, Depth: 18’-00”, placed in back
yard of 613 Kitsap Ave NE, Renton 98059
Zoning designation of the site and adjacent properties: R-4
Current use of the site and any existing improvements: Residential property, no existing improvements
Special site features (i.e. wetlands, water bodies, steep slopes): Borders greenbelt on 2 sides
Statement addressing soil type and drainage conditions: Site is on improved topsoil.
Proposed use of the property and scope of the proposed development: Residential property, proposing to add
attached, covered patio .
Access: Street access and HOA-managed gravel path runs length of property.
Proposed off-site improvements (i.e. installation of sidewalks, fire hydrants, sewer main, etc.): None
Total estimated construction cost and estimated fair market value of the proposed project: Target cost is $50k,
currently value engineering to reach that amount.
Number, type and size of any trees to be removed: None
Explanation of any land to be dedicated to the City: None
Any proposed job shacks, sales trailers, and/or model homes: None
Variance Request Justification
Please provide a written statement separately addressing and justifying each of the issues to be considered by the City.
The burden of proof as to the appropriateness of the application lies with the applicant. In order to approve a variance
request, the Reviewing Official must find ALL the following conditions exist:

The applicant suffers practical difficulties and unnecessary hardship and the variance is necessary because of
special circumstances applicable to subject property, including size, shape, topography, and location or
surroundings of the subject property, and the strict application of the Zoning Code is found to deprive subject
property owner of rights and privileges enjoyed by other property owners in the vicinity and under identical
zone classification;
The granting of the variance will not be materially detrimental to the public welfare or injurious to the property
or improvements in the vicinity and zone in which subject property is situated;
The approval shall not constitute a grant of special privilege inconsistent with the limitation upon uses of other
properties in the vicinity and zone in which the subject property is situated; and
The approval is the minimum variance that will accomplish the desired purpose
Justification is as follows:
We are requesting a variance because our community was permitted in unincorporated King County, then transitioned
into the City of Renton planning/zoning requirements after construction was complete. The current R-4 zoning for
detached structures requires a 25’ setback from the rear property line, a standard which the vast majority of homes in
our community do not currently comply with, and can be readily seen on the City of Renton COR Maps website. In fact,
the new developments across Nile Ave from our community (albeit in unincorporated King County) also do not comply
with this standard, either. Our proposal to build an attached structure is intended to place the structure in a similar
setback to our next-door neighbor’s home as well as the majority of homes in the community. Specifically, we are
requesting an approved setback from the rear property line of 17 feet which allows us to achieve our desired result of
constructing a 28’7” x 18’ roof to cover a deck.
Our position is the enforcement of the code as it is written (forcing us to build a detached structure) negatively impacts
welfare of our next-door neighbor and neighborhood residents and increases construction costs by approximately
$3500, whereas granting a variance allows the construction of a structure which blends in with existing structures, costs
less and preserves sight lines to the greenbelt for all residents.
