July 2024: property owners knew via various emails between the owners, their real estate broker and the city that they could not store or operate a contractor's/construction building from this property. April 16, 2026, Notice of Violation & Order to Correct Fourth Notice issued. April 21, 2026, Appeal to Notice of Violation & Order to Correct Fourth Notice received by the City. NOT RESOLVED: RMC 4-2-060: Regulates uses allowed in specific zoning designations. Specifically RMC 4- 2-060.N, prohibits construction/contractor's offices in residentially zoned areas, such as RC, R1, R4, R6, R8, RMH, R10, R14, RMF. Construction/contractor's office is defined as: "An area where a construction contractor maintains its office, as well as storage for equipment and materials, for the construction and landscaping trades" This property has had construction equipment on the property since September 9, 2024. A site inspection on April 13, 2026, noted piles of concrete, piping and a "Caution Steel Plates Ahead" sign on the property. Additional vehicles may be allowed if: a. More than four (4) licensed drivers reside at the same address, an additional motor vehicle for each licensed driver over four (4) may be parked at that particular address, provided that each licensed driver and said vehicle are registered to the same address; or b. An Additional Vehicles Permit is obtained (see RMC 4-9-105). NOT RESOLVED: RMC 4-4-085.D.3 Parking of Vehicles on Residential Property: General: Impermissible Parking Locations Except for recreational vehicles and commercial vehicles being used for development activity pursuant to a valid City -issued permit, all motor vehicles shall be parked on a Lawfully established driveway or an approved impervious surface. A separate violation of this Section shall be deemed to have occurred when, after issuance of a citation, twenty four (24) or more consecutive hours passes and the offending vehicle remains in an impermissible location, regardless of whether or not the vehicle has been relocated from the original location. For the purpose of this Section, driveways consisting of compacted dirt and/or gravel established prior to the effective date of this Section shall be considered a permissible parking location. Any owner or owner's authorized agent who intends to construct, enlarge, alter, repair, move, demolish, or change the occupancy of a building or structure, or to erect, install, enlarge, alter, repair, remove, convert or replace any electrical, gas, mechanical or plumbing system, the installation of which is regulated by the Construction Codes and the Construction Administrative Code, or to cause any such work to be done, shall first make application to the building official and obtain the required permit. A site inspection on April 13, 2026, noted the motor home remains and a white Bad Boyz van WA license #Bkk6439 remain parked on dirt/grass. Additional parking for this residence is available on the public street. NOT RESOLVED: 4-5-060 Construction Administrative Code: E. Section 105 - Permits: Any owner or owner's authorized agent who intends to construct, enlarge, alter, repair, move, demolish, or change the occupancy of a building or structure, or to erect, install, enlarge, alter, repair, remove, convert or replace any electrical, gas, mechanical or plumbing system, the installation of which is regulated by the Construction Codes and the Construction Administrative Code, or to cause any such work to be done, shall first make application to the building official and obtain the required permit. A site inspection on March 16, 2026, noted there is a shed -like structure on the property. The structure is covered with plastic and tarps and does not meet building code. It is also over 200 square feet in size which requires a building permit. A check of building permit records on April 13, 2026, noted the structure remains and a building permit has not been submitted for review and approval. The structure must be removed if a building permit cannot be obtained. There are no electrical permits on file. The homeowner never contacted the city to discuss violations or explain what they were intending to accomplish on the property. The Warnings were ignored and violations not brought into compliance. The vacant portion of the lot may not be used for storage or parking of any kind. Having their broker contact the city specifically spelled out what was and was not allowed on the property prior to their purchasing the property. It is our position that the homeowner ignored the city's request for compliance, did not communicate with the city and knew they were in violation of city codes. This case was opened due to a citizen fence complaint and other violations noted by the code compliance inspector. We would like the Chaname property to be brought into compliance with all city codes.
