Dear Alex Morganroth:
Thank you for the opportunity to provide comments on the State Environmental Policy Act
(SEPA) notice of application utilizing the optional determination of nonsignificance (ODNS/NOA)
process for the WareSpace project. Based on review of the checklist associated with this
project, the Department of Ecology (Ecology) has the following comments:
Section B. Environmental Elements; Subsection 7. Environmental health:
The proposed SEPA project is located immediately north of a site listed on the Contaminated
Sites List – Orca Bay Seafoods at 900 Powell Ave SW. The Orca Bay Seafoods site is
contaminated with gasoline-range petroleum hydrocarbons (TPH-G) in soil, and TPH-G, diesel-
range petroleum hydrocarbons (TPH-D), and 1,2-dibromoethane (EDB) in groundwater. The
Orca Bay Seafoods site is currently enrolled in the Pollution Liability Insurance Agency’s
Technical Assistance Program. A link to relative documents is Public Project: PNW181 / Perry
Brothers. Please add this information to the checklist.
It appears that no ground disturbance work will be conducted. However, due to the close
proximity of the contaminated site, contingency actions should be planned if contaminated soil
or groundwater is encountered during the project. The contingency actions should include
removal and proper disposal of contaminated soil and/or ground water if encountered, and
worker health and safety measure, including air monitoring.
