("Agreement")dated May 6, 1996 between the City of Renton("Owner")and Sprint Spectrum,L.P.
("Tenant").
RECITALS
A. The Agreement and this Amendment pertain to real property located at 3410 NE tat Street,
Renton,Washington,also known as known as the Highlands Reservoir,and legally described
in Exhibit A,which is attached hereto and made a part hereof(hereinafter the"Site").
B. Owner is the owner of the Site. Tenant has constructed and installed two sectors of antennas
and related equipment as part of its personal communications service system facility ("PCS
Facility")on the Site and as described in the Agreement.
C. The parties hereto have identified several additional issues, subsequent to the execution of the
Agreement,upon which they have reached agreement and intend for this Amendment to
reflect those understandings.
NOW,THEREFORE,for and in consideration of the mutual covenants contained herein and other
good and valuable consideration,the adequacy of which is hereby acknowledged,Owner and Tenant
mutually agree as follows:
1. Owner authorizes Tenant to install a third sector of a maximum four(4)antennas,
approximately six(6)feet high by one(1)foot wide, and related equipment for its PCS
Facility at the Site on the southwest leg of the water tank,which leg currently holds the cable
tray for the PCS Facility,at a height of forty(40)feet,Azimuth of 255 degrees. All
construction shall be in accordance with Exhibit B and B-1,drawings to be approved by
initials attached thereto of the City of Renton.
2. Prior to construction of the third sector,owner will dictate painting requirements of the tank
leg under the third sector at that time.
3. Tenant shall plant four(4)-four foot high Pyromydalius' around the Meter base facing the
road;
4. Tenant shall plant eleven(11)Thuja Pyramidalis `Emerald Green' trees 6-7' high along the
west fence line where there currently exists a hole in the planting, instead of placing the same
trees around the BTS equipment pad as previously illustrated in the construction drawings.
5. Tenant shall reseed the grass around the BTS equipment.
6. Tenant shall attach sheet metal to both sides of the cable tray attaching to the leg of the tower
to prevent unwarranted tank climbing. The sheet metal shall be at least six(6)feet high.
7. Tenant shall maintain the installed PCS Facility,equipment and appurtenances in the"as
installed"condition,normal wear and tear and casualty loss excepted, for the term of the
agreement,at Tenant's sole cost.
8. Tenant shall clean up all debris and materials leftover from the installation process at the
completion of construction.
9. If Owner chooses to repaint the tank,Tenant shall remove the equipment during painting,or,
at its option,Tenant agrees to reimburse Owner for the reasonable additional costs of working
around and accommodating Tenant's equipment. Owner shall provide a bid breakdown
showing the additional costs of this accommodation.
10. Owner shall review and approve all modifications, additions,and major repair activities
proposed by Tenant prior to commencement of any future work. Owner's approval shall not
be unreasonably withheld or delayed.
11. In all other respects the Agreement remains unchanged and is hereby ratified by Owner and
Tenant. In the event of a conflict between the terms of the Agreement and this Amendment,
the terms of this Amendment shall prevail and control over the inconsistent terms of the
Agreement.
