described above, the Grantor(s), the owner(s) in fee of that Property, hereby covenants(covenant) with the
City of Renton, a political subdivision of the state of Washington, that he/she(they) will observe, consent
to, and abide by the conditions and obligations set forth and described in Paragraphs I through 10 below
with regard to the Property, and hereby grants(grant) an easement as described in Paragraphs 2 and 3.
Grantor(s) hereby grants(grant), covenants(covenant), and agrees(agree) as follows:
1. The Grantor(s) or his/her(their) successors in interest and assigns ("Owners of the described
property") shall at their own cost, operate, maintain, and keep in good repair, the Property's stormwater
facilities and/or best management practices ("BMPs") constructed as required in the approved
construction plans and specifications Sonic - Renton on file with the City of Renton and submitted to the
City of Renton for the review and approval of permit(s) U160068 "- 29 The
property's stormwater facilities and/or best management practices ("BMPs") are shown and/or listed on
Exhibit A. The property's stormwater facilities and/or BMPs shall be maintained in compliance with the
operation and maintenance schedule included and attached herein as Exhibit B. Stormwater facilities
include pipes, swales, tanks, vaults, ponds, and other engineered structures designed to manage and/or
treat storinwater on the Property, Stormwater BMPs include dispersion and infiltration devices, native
vegetated areas, permeable pavements, vegetated roofs, rainwater harvesting systems, reduced impervious
surface coverage, and other measures designed to reduce the amount of stormwater runoff on the
Property.
2. City of Renton shall have the right to ingress and egress over those portions of the Property
necessary to perform inspections of the stormwater facilities and BMPs and conduct maintenance
activities specified in this Declaration of Covenant and in accordance with RMC 4-6-0300
3. If City of Renton determines that maintenance or repair work is required to be done to any of
the stormwater facilities or RMI's, City of Renton shall give notice of the specific maintenance and/or
repair work required pursuant to RMC 4-6-030. The City shall also set a reasonable time in which such

work is to be completed by the Owners. If the above required maintenance or repair is not completed
within the tirne set by the City, the City may perform the required maintenance or repair, and hereby is
given access to the Property, subject to the exclusion in Paragraph 2 above, for such purposes. Written
notice will be sent to the Owners stating the City's intention to perform such work. This work will not
commence until at least seven (7) days after such notice is mailed. If, within the sole discretion of the
City, there exists an imminent or present danger, the seven (7) day notice period will be waived and
maintenance and/or repair work will begin immediately,
4. If at any time the City of Renton reasonably determines that a stormwater facility or IMP on
the Property creates any of the hazardous conditions listed in RMC 4-4-060 G or relevant municipal
successor's codes as applicable and herein incorporated by reference, the City may take measures
specified therein.
S. The Owners shall assume all responsibility for the cost of any maintenance or repair work
completed by the City as described in Paragraph 3 or any measures taken by the City to address hazardous
conditions as described in Paragraph 4. Such responsibility shall include reimbursement to the City
within thirty (30) days of the receipt of the invoice for any such work performed. Overdue payments will
require payment of interest at the current legal rate as liquidated damages. If legal action ensues, the
prevailing party is entitled to recover reasonable litigation costs and attorney's fees.
6. The Owners are hereby required to obtain written approval from City of Renton prior to
filling, piping, cutting, or removing vegetation (except in routine landscape maintenance) in open
vegetated stormwater facilities (such as swales, channels, ditches, ponds, etc.), or performing any
alterations or modifications to the stormwater facilities and BMPs referenced in this Declaration of
Covenant.
7. Any notice or consent required to be given or otherwise provided for by the provisions of this
Agreement shall be effective upon personal delivery, or, three (3) days after mailing by Certified Mail,
return receipt requested.
& With regard to the matters addressed herein, this agreement constitutes the entire agreement
between the parties, and supersedes all prior discussions, negotiations, and all agreements whatsoever
whether oral or written.
9. 'This Declaration of Covenant is intended to protect the value and desirability of the real
property described above, and shall inure to the benefit of all the citizens of the City of Renton and its
successors and assigns. This Declaration of Covenant shall run with the land and be binding upon
Grantor(s), and Grantor's(s') successors in interest, and assigns.
10. This Declaration of Covenant may be terminated by execution of a written agreement by the
Owners and the City that is recorded by King County in its real property records.

Inspect project upon completion to correct accumulation of fine material. Conduct periodic
visual inspections to determine if surfaces are clogged with vegetation or fine soils. Clogged
surfaces should be corrected immediately.
Surfaces should be swept with a high -efficiency or vacuarn sweeper twice per year-,
preferably, once in the autumn after leaf fall, and again in early spring. As long as annual
infiltration rate testing demonstrates that a rate of 10 inches per hour or greater is being
maintained through the pervious surface, the sweeping frequency can be reduced to once per
year.

Stormwater flows through a specialty designed filter media mixture contained in a
landscaped concrete container. The mixture immobilizes pollutants which are then
decomposed, volatilized and incorporated into the biomass of the Filterro@ system's
micro/macro fauna and flora. Stormwater runoff flows through the media and into on
underdrain system at the bottom of the container, where the treated water is discharged.
Higher flows bypass the Filterra@ to a downstream inlet or outfall. Maintenance is a simple,
inexpensive and safe operation that does not require confined space access, pumping or
vacuum equipment or specialized tools. Properly trained landscape personnel can effectively
maintain Filterro®R Stormwater systems by following instructions in this manual.

Why Maintain?
All stormwater treatment systems require maintenance for effective operation. This necessity
is often incorporated in your propert;s permitting process as a legally binding BMP
maintenance agreement.
—Avoid legal challenges from your jurisdiction's maintenance enforcement program.
—Prolong the expected lifespon of your Filterra media.
—Avoid more costly media replacement.
—Help reduce pollutant loads leaving your property.
Simple maintenance of the Filterra@ is required to continue effective pollutant removal from
stormwater runoff before discharge into downstream waters. This procedure will also extend
the longevity of the living biofilter system. The unit will recycle and accumulate pollutants
within the biomass, but is also subjected to other materials entering the throat. This may
include trash, silt and leaves etc. which will be contained within the void below the top
grate and above the mulch layer. Too much silt may inhibit the Filterro's9 flow rate,which
is the reason for site stabilization before activation. Regular replacement of the mulch
stops accumulation of such sediment.

It is the responsibility of the owner to provide adequate irrigation when necessary to the
plant of the Filterra®R system. Clean up due to major contamination such as oils,
Chemicals, toxic spills, etc. will result in additional costs and are not covered under the
Supplier maintenance contract. Should a major contamination event occur the Owner must
block off the outlet pipe of the Filterra®R (where the cleaned runoff drains to, such as drop
inlet) and block off the throat of the Filterro®R. The Supplier should be informed
immediately.
Maintenance Visit SumMg_ry
Each maintenance Visit consists of the following simple tasks (detailed instructions below).
1. Inspection of Filterra@ and surrounding area
2. Removal of tree grate and erosion control stones
3. Removal of debris, trash and mulch
4. Mulch replacement
5. Plant health evaluation and pruning or replacement as necessary
6. Clean area around Filterra@
7. Complete paperwork
Ideal tools include: camera, bucket, shovel, broom, pruners, hoe/rake, and tape measure.
Appropriate Personal Protective Equipment (PPE) should be used in accordance with local or
company procedures. This may include impervious gloves where the type of trash is
unknown, high Visibility clothing and barricades when working in close proximity to traffic
and also safety hats and shoes. A T—Bar or crowbar should be used for moving the tree
grates (up to 170 lbs ea.), Most visits require minor trash removal and a full replacement
of mulch. See below for actual number of bagged mulch that is required in each unit size.
Mulch should be a double shredded, hardwood variety, do not use colored or dyed mulch.
Some Visits may require additional Fil terra@ engineered soil media available from the
Supplier.

1. Inspection of Filterra® and surrounding area

After removal of mulch and debris, measure distance from the
top of the Filterra® engineered media soil to the bottom of the
top slab. If this distance is greater than 12", add Filterra®
media (not top soil or other) to recharge to a 9" distance.
