operation and rnaintenance schedule included and attached herein as Exhibit B. Stormwater facilities
include pipes, swales,tanks,vaults,ponds, and otner engineered stz�uctures designed ta manage and/or
treat starmwater on the Property. Stormwater BMPs include dispersion and infiltration devices,native
vegetated areas,pe��x�eable paveinents, vegetated roafs,rainwater liarvesting systems,red��ced imperviaus
surf'ace covex-age, and other measures designed to reduce the amaunt af stormwater runoff on the
Propei�ty.
2. City of Renton shall have the right ta ingress and egress over tliose portions of the Property
necessary to perform inspectiarzs ofthe starmwater facilities and BMPs and canduct m.aintenance
activities specified in this Declaratian of Govenant and in accoxdance with RMC 4-6-f730.
3. If City af R.entan deternunes that maintenance or repair worl�is required to be done ta any of
the starrnwater facilities or BMPs,City of Renton shall give notice of the specific maintenance and/or
repair work required pursuartt to RMC 4-6-C130. T'lze Gity shall alsa set a reasanable time in which such

wark is ta be completed by the Owners. If the abave required maintenance or repair is not completed
within the time set by the City,the City may perfotm the required maintenance or repair,and hereby is
�iven access ta the Froperty,subject to the exclusion in Paragraph 2 abave, for such purposes. Writtan
natice wilI be sent ta the (�umers stating the City's intention to�ei-fari�such worlc. This work will not
cornmence until at least seven(7) days after such notice is mailed. If, within the sole discretion afthe
City,there exists an irnix�inent or present danger,the seven(7) day notice period will be waived and
maintenance andlar�°epair wark will�aegin iinmec�iately.
4. If at any time the City af Renton reasonably determines that a stoimwater facility or BMP on
the Property creates any af the hazardous canditions listed in RMC 4-4-060 G or relevant municipal
successor's codes as applicable and herein incarpc�rated by reference,the City may take zx�easures
specified therein.
5. The Owners sha11 assume all responsibility for the cost of any maintenance or repair wark
completed by the City as described in Paragraph 3 ar any measures talcen by the City ta address hazardous
conditions as descnibed in Paragraph 4. Such responsibility shall include reinlbursement ta the City
within t�urty(30) days of the receipt af the invoice far any such w�xk performed. (�verdue payments will
require payxnent of interest at the current legal rate as liyuidated damages. If legal actiot�ensues,the
prevailing party is entitled ta recover reasanable litigation costs aX7d attorney's fees.
6. The C7wners are hereby requ.ireci ta abtain�n-itten approval franx City of Rentan prior ta
filling,piping, cuttin�,or reniaving vegetatian(except in rautine landscape lnaintenance}in open
vegetated stormwater facilities(such as swales,channels, ditc;hes,ponds, etc.), or performing any
alterations c�r mvdifications ta the stormwater facilities and BMPs referencad in this Declaration of
Covenant.
7. Any notice or consent required to be given ar atherwise pravided far by the provisions of this
Agrecment shall be effective upon persanal delivery, ar three(3)days after znailiiz�by Certified Mail,
ret�urn receipt reqLYested.
$. With regard to the r�xatters addressed herein,tl�is agreeinent canstitutes the entire agreement
between the parties,and supersedes all prioz�dis�ussions,negotiatians, and all agreernents whatsaever
whetlxer oral ar written.
9. Th�s Declaratian af Covcnant is intended to pratect tlae value and desirability aftlie real
properiy described above, and shall inure to the bene�it of all the citizens of the City of Rentan and its
successors and assigns. 'I'his Declaratian of Cov�nant shall ruz7 with the land and be biridiiig upari
Grantor(s),and Cnrantor's(s") successors in interest, and assigns.
10. This Declaration of Covenan.t inay be terminated by execution of a written agreeinent by the

MAINTENANCE INSTRUCTIONS FOR LIMITED INFILTRATION
Your property contains an on-sitc BMP (bcst managcmcnt practicc) callcd"li�nited infiltration,"which
was installed to mitigate the stormwater quantity and quality impacts of some or all of the impervious
surfaces on your property.
Limited infiltration is a method of soaking runoff from impervious area(such as paved areas and roofs)
into the ground. Infiltration devices, such as gravel filled trenches, drywells, and ground surface
depressions, facilitate this process by putting runoff in direct contact with the soil and holding the
runoff long cnough to soak most of it into thc ground. To bc succcssful,thc soil condition around thc
infiltration device must be able to soak water into the ground for a reasonable number of years. This
on-site BMP shall be maintained per Appendix A of the City of Renton's Surface Water Design
Manual.
Infiltration Devices
The infiltration devices used on your property include the following as indicated on the site
plan(CHECK THE BOX(ES) THAT APPLY):

MAINTENANCE RESTRICTIONS
The size,placement, and composition of these devices as depicted by the site plan and design details
must be maintained and may not be changed without written approval from the City of Renton or
through a future development permit from the City of Renton.
INSPECTION FREQUENCY AND MAINTENANCE GUIDELINES
To be successful,the soil condition around the infiltration device must be able to soak water into the
ground for a reasonable number of years.
• Infiltration devices must be inspected annually and after major storm events to identify and
repair any physical defects.
• Maintenance and operation of the system should focus on ensuring the system's viability by
preventing sediment-laden flows from entering the device. Excessive sedimentation will result
in a plugged or non-functioning facility.
• If the infiltration device has a catch basin, sediment accumulation must be removed on a yearly
basis or more frequently if necessary.
• Prolonged ponding around or atop a device may indicate a plugged facility. If the device
becomes plugged, it must be replaced.
• Keeping the areas that drain to infiltration devices well swept and clean will enhance the
longevity of these devices.
• For roofs, frequent cleaning of gutters will reduce sediment loads to these devices.

MAINTENANCE INSTRUCTIONS FOR PERMEABLE PAVEMENT
(NON-VEGETATED)
Your property contains an on-site BMP (best management practice) called"perineable paveme�t,"
which was installed to minimize the stormwater quantity and quality impacts of some or all of the
paved surfaces on your property.
Permeable pavements reduce the amount of rainfall that becomes runoff by allowing water to seep
through the pavement into a free-draining gravel or sand bed,where it can be infiltrated into the
ground. "1'his on-site BMY shall be maintained per Appendix A of the City of Renton's Surface Water
Design Manual.
Permeable Pavements
The type(s) of permeable pavement used on your property is (CHECK THE BOX(ES)THAT

MAINTENANCE RESTRICTIONS
The area covered by permeable pavement as depicted by the site plan and design details must be
maintaincd as permeable pavement and may not be changcd without written approval from the City of
Renton or through a future development permit from the City of Renton.
INSPECTION FREQUENCY AND MAINTENANCE GUIDELINES
• Permeable pavements must be inspected after one major storm each year to make sure it is
working properly. More frequent inspection is recommended.
• Prolonged ponding or standing water on the pavement surface is a sign that the system is
defective and may need to be replaced. If this occurs, contact the pavement installer or the City
of Renton for further instructions.
• A typical permeable pavement system has a life expectancy of approximately 25 years. To help
extend the useful life of the system,the surface of the permeable pavement should be kept
clean, stable and free of leaves, debris, and sediinent through regular sweeping or vacuuin
sweeping. Aggregate fill in modular grid pavement may need periodic surface replenishment.
• The owner is responsible for the repair of all ruts, deformation, and/or broken paving grids or
pavers.
• Modular grid pavement and permeable pavers filled with gravel or with gravel in the joints
may need to be refilled periodically.
