The Reece Shy Council stwk upon ststing an equitable or legal reason for waiver, have the authority to waive any and all
fees authorized under this Chapter of Title 4. (Ord. 6153, 9-28-2005)

1. Pwpow. T`o owner -occupied housin in the CD, CV R-14, and RMF Zones that are also locatedwithin either
the DownWMnt or Sunset Area, as represented In the oMchd map of the Efgible Areas for MuWFamgy Housing Incentives, by
waiving certain development and mft%o n fees for "For Sale" housing, subject to City Council approval.

Map and are hereby made part of this Section, which shall be read and Interpreted In light of the contents of the Map.
3. 9#40b ty Criterhu To qualify for waived fees, projects shall consist of new construction with all of the housing units
Platted or condominium "For Safe" housing, and either:
a. The project will be a minimum of ten (10) units if in the R-14 Zone and within the Downtown, or a minimum ten (10)
dwelling units and in the RMF or R-14 Zone and within the Sunset Area; or
b. The project will be a minimum of thirty (30) dwelling units if In the CD Zone and within the Downtown, or a minimum
of thirty (30) dwelling units if in the CV Zone and within the Sunset Area.
4. Applicable Fees: Fees which may be waived are:
a. Building permit fees;
b. Bu8dhlg permit plan review fees;
c. Water, surface water, and wastewater system development charges;
d. Public Works plan review and inspection fees; and
e. Fire, transportation, and parks impact mitigation fees.
5. Applics0ork Process: Persons who intend to apply for the owner -occupied housing incentive fee waivers must disclose
their Intard to apply for waived fees prior to the conclusion of the administrative site plat development review period. The
application for waived fees must be made to the Community and Economic Development Administrator (or any other City
office, department or agency that shall succeed to its functions with respect to this Section) at the time of the land use
applichdon, unless otherwise approved by City Council.
6. ReaMIEtWe Covenant AN residential units which obtain a successful fee waiver must contain a restrictive covenant
Indicating that the units will bar platted or wig be restricted to condominium housing. After review and approval of the waiver
Council and the review and approval of the ~covenant Community and Economic Development
by the City
Admbnbstmator, the restrictive covenant must be executed and recorded at the applicant's expense prior to the issuance of the
building permit for the project, unless otherwise approved by City Council. Failure to timely execute and record time covenant
will result In the applicant being responsible for any and all applicable fees and Interest accrued as a result of the delay.

C. RENTAL HOUSING M

i. To encoumage new rental housing In the CV, RMF, and R-14 Zones within the Sunset Area, certain development
and mitigation fees for rental housing may be waived for eligible projects, subject to City Council approval.
Def#titions: in construing the provisions of this subsection, the following definitions shall be applied:
