planned fo��the inspection af drainage facilities�,�Afte��the 30 days,the Owners s1ia11 allow the City of
Ronton to enter for lhe sole purpose of ilispectiug drainage facilities. In lieu of inspection Uy the City,the
Owne��s may elect to engage a IicBnsed civil engiiieer registered in the state of Washington who has
axpertise in drainage to inspeet ihe draii�age facilities and provide a written repoz�t describing their
condifion. If the engineer option is ohosett,the Ownars sha11 provicle written iiotice to the City of Renton
within fifteeu days o£x•eceiving the City's notice o£inspection, Within 30 days of giving this notice,thc
Owners,or engineer on behalf of the Owu.ers,shali�rovide the engi�ieer's z•e��ort to the City of Renton. If
the report is not provided in a tnnely mauiier as specificd aUove,the Cify of Reiiton may inspect the
drainage facilities without further notice.
3. If City of Renton detex•mines fi•om its ii�spection,or fi�oni an enginaer's z�epoz•t provided in
acco�dance witl�paragcapli 2,that inaintenance,repair,rastoration,and/or mitigation worlc is required to
be done to any of the drainage facilities,City of Renton shall notify the Owners o�the specific
maintenance,�•epair,restoration,and/or raitigation worlc(Worlc)required pursuaut to the Renton
Municipal Code. The City sha11 also set a reasonable deadline fo��the OwMers to complete the Worlc,or to
provida au engiueer's report that veriftes completzan ofthe Worlc. After the deadline has passed,the
Owners shall allow tlie City access to re-inspect the drainage facilities unless an engiueer's report has
been provided verifying completiou of the Worlc, If the Worlc is not completed within the time fi•anie set
by tkie City,the City tnay iuitittte an enforcemeizt action and/or perForm fhe reqtiired mainfenatzce,repair,
resCoratioi�,and/or xz�itigation worlc and hereby is given access to the Proparty for such piuposes, Written
notice will l�e sent to the Owizers statiug the City's intention to pexform such vsvork. This wo�•k will not
commence until at least seven(7)days after such notice is mailed. If,within the sole discretiotz of the
City,tliere exists an in�nninent or present danger,the seven(7)day notice period will be waived aud
maiutanance aud/or repair worlc will Uegin immediately.
4. The Owners shall asstuue alI responsibility for tl�e cost of any mainfenance,repair worlc,or
any measures talceu by the City to address conditioiis as desc�iUed in Paragraph 3. Such res�onsibility
shall inchtde reimbiirsement to the City withan thirty(30)days of the receipt of tlie invoice for any such
work performed. Ove��dtte payments will require pay�nent of iuterest at tlie maximum legal rate allowed
by RCW 19.52,020(cumeutly twelve percent(12%)), If the City initiates legal action to enforce tliis
agreement,the prevailing party zn such action is entitled to recovez�reasonaUle Iitigation costs and
atfoxuey's fees,
5, The Owners are reqnired to obtaizi written appr.oval fi�ozn City of Renton prioz•to filling,
piping,cutting,or removing vegetation(except in rotYtine landscape maisatenance)in open vegetated
st�rmwater ft�cilities(such as swales,cha�uiels,ditches,pouds,etc,),or perfo�•miug any alteratiotis or
modifications to the drainage facilities iefex•ei�ced in this I7aclaration of Covenant.
6. Auy notice or consent required to be giveu or otheitivise provided for by tha provisions of this
Agreement shall be effective upon personal deli��ery,or tl�ree(3)days after rnailing by Certified Mail,
return receipt reqttasted,
7. With z•egard to ihe n�atters addressed k�exein,this agceement constihrtes the entire agceement
Uetween the parties,and supersedes all prior disci�ssiot�s,negotiations,and all agreemants wl�atsoever
whethei•oral or wxitten,

This on-site BMP has Lwo primazy components that must be maintained per Appendix A of the City of
Renton's Stirface Water Design Manual;

(2)The vegetated flowpath area over which runoff is dispersed.
Mainfenauce of Dispersion Devices
• Dispersioii devices must be inspected annually and after major storm eveirts fo identify and
repair an�physical defects,
• Wtien native soil is exposed or erosion channels are present,the sources of the erosion or
concantrated flow need to be identified and mitigated.
• Coneenfiated flow can be mitigated by leveling t1�e edge of tIie pervious area and/or reaiigning
or replenisl�ing tl�e rocics i�x thc dispeision clevice,such as in rocic pads auci gravel filleci
trenches.
