PROJECT LOCATION: Springbrook Trail from SW 7th Street to Grady Way SW
PROJECT DESCRIPTION: The applicant, Terry Flatley, is requesting a Shoreline Exemption and Critical Areas
Exemption for maintenance of 39 Red Adler trees along Springbrook Trail. The work will
be done on a stretch of Springbrook Trail between SW 7th Street and Grady Way SW
(APN 2423049098) in the Heavy Industrial (IH) zoning district. The 371,448 square foot
(8.52 acre) site is located within a high seismic hazard area, and a 100-year flood hazard
area (FEMA Zone – AE), within Reach A of the Black River/Springbrook Creek
(BRSC-A). The natural vegetation of concern with this project are a series of dead red
alder trees between the trail’s east edge and the creek. Past prolonged flooding has
resulted in numerous dead trees that have since lost their bark and dropped branches
and trunks onto the trail area. This project will reduce the risk to the public traveling on
the trail from falling tree debris. There are 39 trees to be treated in this project; 35 are
rated with condition of zero or completely dead; 3 trees are rated at 10% or nearly dead
and; 1 tree is rated 60% which will not be removed but pruned of deadwood hanging over
the trail. None of the trees will be completely removed but will be reduced in height to
ensure public safety and remain to provide wildlife habitat. All proposed work would occur
landward of the Ordinary High Water Mark and no other trees would be d isturbed. The
proposal would be exempt from SEPA in accordance with WAC 197-11-800(3) Repair,
remodeling, maintenance activities. The pruning is anticipated to be completed by the
end of December, 2018.

EXEMPTION JUSTIFICATION: An exemption from a Shoreline Management Substantial Development Permit is hereby
Approved on the proposed project in accordance with RMC 4.9.190C 'Exemption from Permit System' and for the
following reasons:
Maintenance and Repair: Normal maintenance or repair of existing structures or developments, including damage by
accident, fire or elements.
a. “Normal maintenance” includes those usual acts to prevent a decline, lapse, or cessation from a lawfully established
condition.
b. “Normal repair” means to restore a development to a state comparable to its original condition, including but not limited
to its size, shape, configuration, location and external appearance, within a reasonable period after decay or partial
destruction, except where repair causes substantial adverse effects to the shoreline resource or environment.
c. Replacement of a structure or development may be authorized as repair where such replacement is the common
method of repair for the type of structure or development and the replacement structure or development is comparable to
the original structure or development including, but not limited to, its size, shape, configuration, location and external
appearance and the replacement does not cause substantial adverse effects to shoreline resources or environment.
The proposed development is:
Consistent with the policies of the Shoreline Management Act.
Not Applicable to the guidelines of the Department of Ecology where no Master Program has been finally approved or
adopted by the Department.
Consistent with the City of Renton Shoreline Master Program.

RECONSIDERATION: Within 14 days of the decision date, any party of record may request that the decision be

reopened
by the approval body. The approval body may modify his decision if material evid ence not readily discoverable prior to the
original decision is found or if he finds there was misrepresentation of fact. After review of the reconsideration request, i f
the approval body finds sufficient evidence to amend the original decision, there will be no further extension of the appeal
period. Any person wishing to take further action must file a formal appeal within the 14 day appeal time frame.
APPEALS: The administrative land use decision will become final if not appealed in writing together with the required fee
to: Hearing Examiner, City of Renton, 1055 South Grady Way, Renton, WA 98057 on or before 5:00 pm, on December
18, 2018 (RCW 43.21.C075(3); WAC 197-11-680). RMC 4-8-110 governs appeals to the Hearing Examiner and
additional
information regarding the appeal process may be obtained from the Renton City Clerk's office, Renton City Hall, 7th Floor,
(425) 430-6510.
