These poles sit in the developer’s proposed improvements which include new streetlights. PSE proposes to have Potelco Inc. relocate two (2) existing PSE utility poles and approximately 600 lineal feet of overhead wires. The replacement of the overhead wires would begin at the southeast corner of the 154th Ave SE and SE 2nd Place intersection, crossing to the north side of SE 2nd Place and ending at the northwest corner of the SE 2nd Place and 156th Ave SE intersection. The relocation of the utility poles is to facilitate the construction of the Cedar Ridge Short Plat that is anticipated to be constructed under City of Renton Civil Construction Permit C17004067. The Cedar Ridge Short Plat project is vested to utility standards in place prior to the latest code amendment (Ordinance 5875) adopted January 22, 2018. ANALYSIS: The City has considered the request for an exemption from RMC 4-6-090(D)(1)(g)(i). Ordinance 5834 grants Puget Sound Energy, the right to construct, operate, set, erect, support, attach, connect, maintain, repair, replace, enlarge and use facilities for purposes of transmission, distribution and sale of electrical energy and gas, in, upon, over, under, along, across and through the franchise area. The proposal would relocate overhead electrical facilities. Therefore, the City is granting an exemption with conditions, per RMC 4-6-090(D)(1)(g)(i) which allows for exceptions when lines are being relocated when existing poles are still currently needed. The code does however require conduit to be installed whenever feasible to facilitate undergrounding in the future. In this case, the Cedar Ridge Short Plat will be constructing the street improvements on the south side of the SE 2nd Place and reasonable accommodating the construction of a joint use trench within a proposed utility easement to facilitate future undergrounding of the facilities. In addition, the Cedar Ridge Short Plat has received approved to remove existing trees within the right of way that will affect the relocation of the overhead utilities. PSE Electric #105088365 Page 2 of 2 February 1, 2019 DECISION: The requested exemption from underground utility installation requirements (RMC4-6-090 (C) as requested by the applicant is approved with conditions subject to the conditions below as the request complies with exemption criteria of RMC 4-6-090(D)(1)(g)(i). Conditions of Approval: 1. Any existing height violations within the Project Reach must be resolved at the time of construction. New aerial lines within the Project Reach must have a minimum vertical clearance of 15’-6”. 2. Any abandoned or unused lines within the Project Reach must be removed at the time that construction is taking place. 3. A traffic control plan must be separately submitted to the City, and no construction may take place until the City has approved a traffic control plan. 4. A joint use trench shall be constructed along the south side of SE 2nd Place within a utility easement provided by the Cedar Ridge Short Plat (City Permit C17004067) to facilitate future undergrounding activities. 5. The relocated aerial fiber lines within the Project Reach must be converted to underground facilities in the future, at PSE’s cost, when a future permit application is proposed within the Project Reach that triggers undergrounding. The new aerial lines must be undergrounded within one year, or approved otherwise by the City, from the first event triggering the requirement to underground the aerial lines.
