THE CITY COUNCIL OF THE CITY OF RENTON, WASHINGTON, DO ORDAIN AS FOLLOWS: SECTION I. Section 4-2-110.F of Chapter 2, "Land Use Districts," of Title IV (Development Regulations) of Ordinance No. 4260 entitled "Code of General Ordinances of the City of Renton, Washington" is hereby amended, by adding a new note#24 to the "U" suffix of the RM zone column of the Maximum Housing Density row, to read as shown in Attachment «A» SECTION II. Section 4-2-110.H of Chapter 2, "Land Use Districts," of Title IV (Development Regulations) of Ordinance No. 4260 entitled "Code of General Ordinances of the City of Renton, Washington" is hereby amended by adding a new note #24, which reads as follows: 24. Density bonus may allow up to 100 dwelling units per acre within the RM-U zone located within the Urban Center Design Overlay and north of South 2nd Street pursuant to requirements in the RMC 4-9-065. SECTION III. Sections 4-9-065.A, B, and C of Chapter 9, "Permits - Specific," of Title IV (Development Regulations) of Ordinance No. 4260 entitled "Code of General Ordinances of the City of Renton, Washington" are hereby amended to read as follows: 1 ay 41100 ORDINANCE NO. 4 9 8 5 4-9-065 DENSITY BONUS REVIEW: A. PURPOSE: The purpose of the Density Bonus Review is to provide a procedure to review requests for density bonuses authorized in RMC Chapter 4-2. Density Bonuses are offered to meet the intent of the Comprehensive Plan policies, including but not limited to Land Use and Housing Element policies and the purpose and intent of the Zoning Districts. B. APPLICABILITY: 1. The Density Bonus Review procedure and review criteria are applicable to applicants who request bonuses in the Zones which specifically authorize density bonuses in RMC Chapter 4-2. This Subsection of Chapter 4-9 contains Density Bonus Procedures and Review Criteria for the R-14, RM-U, COR-1, and COR-2 zones. C. REVIEW PROCESS: 1. Concurrent Review: Density Bonus Review shall occur concurrently with any other required land use permit that establishes the permitted density and use of a site, including subdivisions, site plan review, and conditional use permits. When the development proposal does not otherwise require a subdivision, site plan review, or conditional use permit to establish the permitted density of a site, but includes a Density Bonus request, the development proposal shall be reviewed under Administrative Site Plan Review requirements. 2. Reviewing Official: The Reviewing Official for the required land use permit as described in subsection C.1, Concurrent Review, shall also determine compliance with the Density Bonus Process. 2 ORDINANCE NO. 4 985 3. Submittal Requirements and Fees: An applicant shall submit applications and fees in accordance with the requirements for the primary development application per RMC 4-1 and 4-8. SECTION IV. Section 4-9-065.D of Chapter 9, "Permits - Specific," of Title IV (Development Regulations) of Ordinance No. 4260 entitled "Code of General Ordinances of the City of Renton, Washington" is hereby amended to read as shown on Attachment "B." NEW BUSINESS At the request of Councilwoman Keolker-Wheeler,Planning/Building/Public Airport: Aerodyne Bldg(Sky Works Administrator Gregg Zimmerman gave a briefing on the Sky Harbor Harbor), Site Hazard Aviation site hazard assessment(now known as the Aerodyne building airport Assessment leased area). He explained that until 1976,the site contained an aviation gas pump island with a single-wall,underground storage tank system(UST), and in 1985,the existing Aerodyne hangar was constructed above the location of the former UST site. Mr. Zimmerman stated that the Washington State Department of Ecology (DOE)has completed a site hazard assessment and determined the site to be a category 5, where category 1 represents the highest relative risk and 5 the lowest. Noting that airport leases written before 1995 did not address responsibilities for remedial actions in the event of a hazardous substance release, he reported that when the Aerodyne hanger is demolished,the site will need to be retested and may need to be cleaned up if the pollutant levels remain above the DOE's threshold. Mayor Tanner stated that since Sky Harbor Aviation no longer exists,the City would be liable for any cleanup costs. He added that the City's airport leasing policies will be reviewed. Transportation: Queen Ave Councilman Clawson reported a citizen concern regarding the intersection of NE/NE 6th St Traffic Concern Queen Ave.NE and NE 6th St. where a collision recently occurred, and requested investigation of the intersection. Transportation: I-405 Corridor Councilman Corman reported on the I-405 Executive Committee's commitment Program to a multi-phase plan for the I-405 corridor, and described the potential impact of adding additional lanes to I-405, including an additional truck climbing lane in the Kennydale area. He stated that now is the time for citizens to express their opinions on the I-405 improvements design concepts. He displayed pictures of various design guideline options within the four existing categories which are: building siting and design; parking, access and circulation; landscaping,recreation, and common open space; and building architectural design. Explaining that the density bonuses are only applicable to the RM-U zone north of S. 2nd. St.,Mr. Cerise explained that this portion of the RM-U zone is within the Downtown Core Area and will blend more easily with the Center Downtown(CD) zone. A development application has recently been submitted in the RM-U zone in this area which meets all City development standards with the exception of falling within the density allowed for this area following implementation of the South Renton Neighborhood Plan. RECOMMENDATION: • Staff recommends adding a density bonus for projects located in the RM-U zone north of S. 2nd Street. • Density bonus would allow up to 100 dwelling units per net acre. This would still be less than the 150 dwelling units per acre currently allowed in the CD zone, and less than the 150 dwelling units per acre that were formerly allowed in the RM-U zone prior to the South Renton Neighborhood Plan. • Density bonus would be possible for residential projects that exceed the minimum design guidelines for the Urban Center Design Overlay District Guidelines. BACKGROUND: The maximum zoning density for the RM-U zone was reduced from 150 dwelling units per acre (with design review) to 75 dwelling units per acre as part of the South Renton Neighborhood Plan. This change included portions of the RM-U zone in South Renton as well as the RM-U area north of South Second Street and south of the Cedar River. The code amendment did not allow for any bonus density. Although property owners of the area north of South Second Street were included in the notice of public hearing for the South Renton Neighborhood Plan, they were RMU density bonus memo.doc not specifically invited to the planning meetings for the South Renton Neighborhood Plan. Therefore, they may have been unaware that the maximum density was reduced. A pre-application for the Chateau de Ville condominium proposal occurred during the South Renton Neighborhood planning process. At that time, the density of 91 dwelling units per acre fit within the 25-150 dwelling units per acre allowed in the RM-U zone. However, when the Chateau de Ville proposal was submitted in July 2002, the South Renton Neighborhood Plan had been approved with code amendments to Title IV that changed the zoning density range to 25-75 dwelling units per acre in the RM-U zone throughout the City. The Chateau de Ville condominium proposal would have to remove 9 dwelling units in order to comply with the new zoning density range, affecting the economic feasibility of this project. Based upon staff review it appears that the Chateau de Ville project meets all zoning and development regulations with the exception of the zoning density. The project appears to be well-designed and goes above the minimum design requirements contained within the Urban Center Design Overlay District Guidelines. The Chateau de Ville project demonstrates a development's ability to mask higher densities with high quality design. The code amendments proposed will provide incentive for other developers who want to achieve higher densities to provide excellent quality design in exchange. The result will achieve two City goals of adding residents to the Downtown area and facilitating quality development of land located near the Cedar River. CONCLUSION: Staff proposes to reinstate a density bonus program in the RM-U zone north of South Second Street. The rationale for the density bonus can be oriented around compliance with additional optional design guidelines currently contained within the Urban Center Design Overlay District Guidelines such that the development fits in the with downtown neighborhood. The proposed density bonus is limited to area zoned RM-U north of the Downtown Core because that area blends more easily with the Downtown Core. The South Renton Neighborhood has more distinct and defined borders, making a density transition to 75 dwelling units per acre more logical. If Council is interested in seeing a more broadly applied density bonus, staff can revise the attached code to apply it to the entire RM-U zone, including the South Renton Neighborhood. However, staff recommends applying a density bonus only to the RM-U zone located north of South Second Street. Implementation: Staff proposes implementation of a density bonus through addition of a new note (#24) within the development standards table (RMC 4-2-110H) of the RM zones. The note will refer users to the Bonus provisions of the Renton Municipal Code contained in RMC 4-9-065 of RMC. Although developers are currently required to implement the "Minimum standards" design guidelines, those listed as "Guidelines" are currently not required. This proposal will require a developer to not only meet the "Minimum standards," but to meet one "Guideline" for each of the four categories in the Urban Center Design Overlay Regulations (RMC 4-3-100).
