Council concur. Transportation: Logan Ave S Transportation Systems Division recommended approval of an agreement with Improvements,Joint Work the City of Seattle to allow Gary Merlino Construction Co., Renton's contractor with Seattle (Corrosion on the Logan Ave. S. improvement.project, to concurrently perform corrosion Control) control work in the same vicinity for Seattle,with Seattle reimbursing Renton for the expense of the change order plus six percent administrative costs. Transportation(Aviation) Transportation(Aviation) Committee Chair Corman presented a report Committee regarding a new lease with Pro-Flight Aviation, Inc. In April 1998, Council Lease: Pro-Flight Aviation approved the division of Lane Aviation's ground lease into two parcels,and authorized Lane Aviation to sell its leasehold interest in the two parcels. Lane Aviation has agreed to sell one parcel to Pro-Flight Aviation,Inc. and one parcel to Lane Hangar Condominium Association, Inc. The lease between the City and the Lane Hangar Condominium Association has already been executed. The Committee recommended that Council approve the new lease with Pro-Flight Aviation, Inc. and further authorize the Mayor and City Clerk to execute the lease. ORDINANCES AND The following resolution was presented for reading and adoption: RESOLUTIONS Resolution#3380 A resolution was read extending the moratorium on residential uses in the Planning:Moratorium on Center Suburban(CS), Center Neighborhood(CN),and Commercial Arterial Residential Uses in (CA)zones for an additional six months to September 8, 1999. Councilmember Keolker-Wheeler reiterated that it is Council's intent to lift the moratorium as soon as the ordinance approving the new regulations has taken effect. WHEREAS, by Resolution No. 3314, as continued by Resolutions Nos. 3345 and 3347, the City Council imposed a moratorium on residential development in commercial areas; and WHEREAS, the City Council, through its Planning and Development Committee, has had an opportunity to study the issue of residential development in commercial areas; and WHEREAS, the Planning and Development Committee recommended that the moratorium be extended in the Center Suburban (CS), Center Neighborhood (CN), and Commercial Arterial (CA) zones, and the City Council also concurred in that recommendation at its meeting of February 22, 1999; and • WHEREAS, a draft ordinance is being prepared, at Council direction, to remedy the concerns about residential development in commercial areas but will not be adopted before the current moratorium lapses on March 14, 1999; and WHEREAS, the City Council did hold a public hearing on March 8, 1999, extending this moratorium; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RENTON, WASHINGTON, DO RESOLVE AS FOLLOWS: SECTION I. The above findings are true and correct in all respects. SECTION H. The moratorium will continue in effect in the Center Suburban (CS), Center Neighborhood (CN) and Commercial Arterial (CA) zones for another six month period or until an ordinance has been adopted concerning residential development in the Center 69 RESOLUTION NO. 3380 *41110 Suburban (CS), Center Neighborhood (CN) and Commercial Arterial (CA) zones, whichever event occurs first. In addition to the message board sign,each individual facility may have one freestanding sign not higher than six feet above any established grade for each street frontage and no more than 100 square feet. The property has no exposure to NE 4t. St as it is lower in elevation and is the third lot in from the intersection. Duvall St. (138th. St. SE)is what I would refer to as a collector street feeding into a main arterial (NE 4t. St.)to the North and going South dead ends in approximately two blocks at a residential T intersection at SE. 136th St. The property could not be construed to be a retail piece of property as there is an extremely low traffic count on Duvall St. and no exposure to the main arterial for retail purposes. There is a extremely low probability that the property could be developed for office uses. The law of substitution applies since there are available commercial properties along NE 4t. St.that would have to be absorbed prior to any office use taking place on our property. In addition; our marketing studies indicate that this immediate area of the city is not conducive to mixed uses and/or general or professional office uses. The highest and best use for this parcel of land is certainly for Multi-family development as has been noted by the Owner on previous occasions. During our listing period, we have had 2 offers for this property both for Multi-family developments. Each time the offer has failed due to the existence of the current and possible extensions of the current moratorium. We are constantly getting calls from developers looking for Multi-family land anywhere on the Eastside from Bothell to Auburn. There is definitely a market demand for Multi-family property. Previous to the moratorium, this property could have been built out to a density of approximately 20 units according to the existing development standards prior to the moratorium. In reviewing your current residential land use element policies and text that were just amended, I find that this particular parcel meets the following land use policies: a. As part of constructing the continuous covered shelter, a cost-sharing agreement has been determined where Renton will not pay more than $205,000. This concept will be further developed in the engineering design phase, and will be brought back to the Committee of the Whole for further and more detailed review as the design details are developed. Having reviewed the concept, and the continuous shelter in the cut-thru,and having been briefed on the cost-sharing,the Committee of the Whole recommended that the City Council adopt the final concept for the Downtown Renton Transit Center. Finance: City Hall Phase II Council President Edwards presented a report regarding phase two funding for Improvements, Equipment City Hall improvements. The tenant improvements associated with the move to Expenditures the new City Hall building are nearing completion. The construction contract for the new jail has been let,and the design phase of the ramp and public access project is underway. After reviewing the third quarter financial reports and the current status of all project elements,the Administration feels it is appropriate to consider including additional resources to complete the"Phase II Improvements"and to restore an appropriate contingency reserve for the jail construction. After reviewing the budget worksheets for Funds 301 and 316,the Committee of the Whole recommended that: 1. Investment interest of$325,000 on this construction project be allocated as follows: $141,000 for completion of Phase I, and $184,000 to increase the contingency reserve for the jail construction. 2. The unallocated$469,000 fund balance be allocated as follows: $159,000 for building and parking garage security improvements; $175,000 for furniture and furnishings in the Council Chambers,Court Rooms,conference rooms,and in other areas of the building; $20,000 for miscellaneous items that may be needed; $40,000 for project management for the jail construction; and$75,000 to increase the jail contingency(to total$259,000). Working with your staff,Planners and the Council for the most part was a very good experience. They are true professionals that have the best interests of the citizens of Renton at heart. When the moratorium was place on all the Community Commercial Property in Renton,we never received a notice. We lost 4 potential sales and did not know why until one of the parties told us about the moratorium. We have been counting on the sale of this property for our retirement,now this is gone due to the moratorium and possible rezone. I sincerely hope that the folks deciding our fate will strongly consider the location of each property. Our property is located on Duvall over a block away from 128th,the main street. The best use for this property is condo's or apartments,it is not a desirable location for a business,not enough visibility. The location is down the street from the new Q.F.C.which Mr Marshall and myself helped to bring to Renton. We contacted Q.F.C.regarding our property for their new market. Unfortunately our properties would not work for them,but our efforts helped bring their interest to this location and eventual building of the new Q.F.C. Under a proposed amendment to the County-wide Planning Policies (CPPs), the Growth Management Planning Council (GMPC) would adopt PAAs. If this is done, no city would be able to act on its own to add to or delete from its potential annexation area. Other possible changes would establish a higher level of commitment to annex PAAs at some point. Continuing, Mr. Kattermann said if the West Hill area is removed from Renton's PAA, it would become an "unclaimed area." The cities of Renton, Seattle and Tukwila would then enter into discussions with King County and West Hill residents to talk about the future of this area. Staff recommends that the emergency Comprehensive Plan amendments be adopted as proposed, removing all but two portions of the West Hill area from Renton's PAA. The first property is east of Raininer Ave. north of Renton's Municipal Airport, and the second is located south of Martin Luther King, Jr. Way. Owners of these properties have expressed interest in annexing to Renton at some point. Mr. Kattermann concluded that the City will coordinate with King County on a governance study for the West Hill area, and the subject of Renton's potential annexation area will be revisited at a future date. Ricky Chang, 3010 - 77th Ave. SE, Suite #201, Mercer Island, WA, 98040, said while he understood the purpose of the moratorium and he currently did not have any property or projects affected by it, he was concerned that if moratoriums such as this continue too long, they can inappropriately limit the use of certain properties. Noting that some properties zoned for commercial use might not be entirely suitable for that type of development, he suggested that the City allow for some exemptions to the moratorium in a case-by-case basis. Harry Friebe, 14211 SE 37th St., Bellevue, WA, 98006, stated he owned property on NE 9th Place between Edmonds Ave. NE and Sunset Blvd. NE. Although his property is zoned commercial, he felt it was not at all suitable for this type of development considering its non-arterial location and the surrounding uses, all of which are residential. He requested that the moratorium not be extended or, alternatively, that his property and others like it be specifically exempted. As chair of the Planning & Development Committee, Councilmember Keolker-Wheeler expressed interest in taking action prior to the end of the moratorium to address situations such as Mr. Friebe's. City Attorney Lawrence J. Warren replied that Council can approve exemptions to the moratorium's provisions so long as these are made in terms of rational classifications (for example, properties located at least 100 feet from a major arterial). Mayor Tanner stated that the Administration would not object to exempting certain classifications of property which obviously have no commercial value. Responding to Mrs. Keolker-Wheeler, Mr. Kattermann said it would take at least a month for staff to compile a comprehensive list of all the properties affected by the moratorium, and to evaluate each property to determine if any of them should be exempted from the moratorium. NEW BUSINESS Councilman Parker stated it had come to his attention that Renton's Zoning Planning: Moratorium on Code currently allows large apartment developments to locate in several of the Residential Developments City's prime commercial areas. He felt this would not be appropriate. in Commercial Areas Mike Kattermann, Director of Neighborhoods & Strategic Planning, said staff has prepared a moratorium affecting three Comprehensive Plan land use designations in the City, and five zoning categories. The problem is that the Employment Area Commercial, Center Suburban and Center Neighborhood land use designations all allow multi-family development. Concerns were raised that the desired balance between commercial and residential development could inadvertently be upset, or that stand-alone multi-family housing might deplete prime commercial properties. Imposing the moratorium would give staff six months to analyze whether changes should be made to the Comprehensive Plan and/or Zoning Code in response to this matter. Parks: Lake Washington ' Councilman Corman asked whether the Lake Washington delta area located at DNR-Owned Property the mouth of the Cedar River, owned by the Department of Natural Resources (DNR), will be dredged along with the Cedar River portion of the project. Mayor Tanner replied that the delta is not causing the flooding. Ron Straka, Utility Engineering Supervisor, explained that the flooding is caused by the sedimentation on the bed of the river proper, which impedes the capacity of the river channel to convey flows. Dredging will be performed 20 to 30 feet beyond the north side of the Boeing bridge, however, to ensure 100-year flood event protection. Councilman Schlitzer suggested that staff provide a presentation on the Department of Natural Resources' Lake Washington properties for Council's information. Chief Administrative Officer Jay Covington clarified that the DNR has not precluded Renton from dredging the delta; in fact, the delta was dredged three years ago in an attempt to relieve flooding problems. Mike Snow, 14114 SE 132nd, Renton, 98057, stated that the residents of his neighborhood want their area to remain single family residential. He was concerned about a possible multi-family development within Renton's border along NE 4th St., just south of SE 128th Street. Saying this area lacks adequate transportation facilities to accommodate the addition of thousands of multi-family units, he felt that the moratorium was logical and deserving of support. Pete DeLeuw, 14410 Bel-Red Rd. #200, Bellevue, 98007, asked whether the moratorium applies to single family construction, or just multi-family. Mr. Kattermann replied that the resolution applies to all residential development in the named zones, whether single family or multi-family. He was not sure whether these zones allow any residential development other than multi-family. Chief Administrative Officer Jay Covington stated that although existing single family development is grandfathered in the City's commercial zones, no new single family development is allowed in these areas.
