LUA-06-152 PZ, ECF). WHEREAS, under Section 4.2.020 of Chapter 2, Zoning Districts — Uses and Standards, of Title IV (Development Regulations) of Ordinance No. 4260 entitled "Code of General Ordinances of the City of Renton, Washington," as amended, and the maps and reports adopted in conjunction therewith, the property hereinbelow described has not been zoned in the City of Renton; and WHEREAS, the City sought the input of an advisory task force on prezoning; and WHEREAS, the City Council updated its Comprehensive Plan on November 1, 2004, pursuant to Growth Management Act mandates, including changes that replaced the R-5 zone with the R4 zone; and WHEREAS, the City held two public hearings to consider a prezoning application, with the first hearing held on November 6, 2006, and the second hearing held on December 11, 2006, and the zoning request was in conformity with the City's Comprehensive Plan, as amended, and the City Council has considered all matters relevant thereto, and all parties have been heard appearing in support thereof or in opposition thereto; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RENTON, WASHINGTON, DOES ORDAIN AS FOLLOWS: SECTION L The following described property in the City of Renton is hereby zoned to R-8 as hereinbelow specified. The annual ordinance adopting the maps of the City's ORDINANCE NO. 5 2 5 7 Zoning Ordinance is amended to evidence said rezoning and the EDNSP Administrator is authorized and directed to change the maps of the Zoning Ordinance, as amended, to evidence the rezoning, to wit: See Exhibit "A", attached hereto and made a part hereof as if fully set forth herein. Councilmember Palmer replied Prezoning it was an oversight due to the large number of similar ordinances. Citizen Continent: Petersen - Inez Petersen, PO Box 1295, Renton, 98057, expressed her hope that the City Various will grandfather in Jeff Colee's over -height fence under the ADA (Americans with Disabilities Act) requirements for zoning. Additionally, Ms. Petersen objected to the granting of multi -family housing property tax exemptions to developers and the return of lodging tax funding to businesses while sidewalk repairs and other infrastructure improvements in Renton are needed. Councilmember Persson explained that State law requires that tax collected from the rental of hotel rooms only be used for promotional purposes to encourage people to come to Renton. He noted that some members of the Renton Lodging Tax Advisory Committee are business representatives required to collect taxes. MITIGATION MEASURES None required for this non -project action. D. ENVIRONMENTAL IMPACTS In compliance with RCW 43.21 C. 240, the following non -project environmental review addresses only those impacts that are not adequately addressed under existing development standards and environmental regulations. The proposed non -project prezoning will result in less density for future development than would be realized under the existing King county zoning for this area. Less overall density would be achieved in this area for the following reasons. 1. The entire 1,938.4 acres area is designated Urban Residential 4-12 dwelling units per acre in the King County Comprehensive Plan, and zoned R-4 in King County zoning. The area is Residential Low Density 4 dwelling units per net acre in the Renton Comprehensive Plan. In the proposed Renton zoning the R-4 area would be reduced to 1,350,41 acres. In the remaining area, 7.34 acres would be up -zoned to R-8, an additional 445.11 acres would be down -zoned to R-1 with a potential bonus to 2 du/net acre, and 135.53 acres would be down -zoned to Resource Conservation, (very low density 1 dwelling unit per 14 acres). 2. The Renton zoning system uses net density rather than the gross density system used in King County and as a result the achieved density in each zone is, on average, 20% less than is achieved in comparable County zoning. This difference occurs because in the Renton net density system the critical areas and road are deducted from the net developable area whereas in the County density system these areas are counted toward density. 3. King County zoning allows density bonuses up to 20% above the maximum density allowed in each zone. For example in County R-4 zoning two dwelling units per acre for a potential 6 dulgross acre could be achieved in the entire 1,968 acre area. These bonuses are achieved through either transfer of density from the rural area, affordable housing, energy efficiency, or location close to transit lines. Proposed Renton zoning would only allow a density bonus in the 445-acre R-1 zone, where a bonus of 1 dwelling unit per net acre could be achieved subject to design standards. Major portions of the East Renton Plateau have critical areas. In the Renton system, overall density would be reduced through mapping of areas with pervasive critical areas into the lower density designations of R-1 and Resource Conservation. These designations are created to provide additional protections to lands with pervasive environmental constraints where, due to the location and extent of critical areas, the remaining net developable area is difficult to accumulate into larger parcels with the configuration needed to achieve a quality subdivision, and/ or the developable area occurs in disconnected pieces that are difficult to access with standard city road systems. The attached spread sheet shows the estimated change in potential units under the County R-4 zoning with bonus compared with the City zoning using the proposed RC, R-1, R-4 and R-8 zones. Under this assumption County zoning could achieve 6,535 units and City zoning 3,580 units. This is a net reduction of 2,956 units comparing existing County to proposed City zoning. King County completed a Final Supplemental EIS for the King County Comprehensive Plan in 1994. As a result of the overall reduction in density the proposed pre -zoning would likely result in fewer impacts on air from traffic (fewer trips) surface water and ground water (less impervious surface), vegetation removal and habitat (larger undeveloped portions of lots and fewer structures) and fewer demands for public services (lower population). We have been impressed with the growth and forward thinking that the city of Renton has adopted over the past few years. We were 100% behind the annexation until we discovered the change in zoning. Presently our property is zoned R-4. If the Pre -zoning were to be adopted we would revert to R-1. This would reduce our properties value significantly. We have a 4.25 acre parcel and though we have no intent of selling or developing the land the value and in the current zoning is the precise reason we bought the property. I have recently had the property and house appraise and the difference in zoning would reduce the value by 400 — 450 thousand dollars. That i s real value and all of our net worth. Again we are very impressed with the direction the city is taking and want to be a part of it. However, I do not want to subsidizes down town and non land owners to the tune of close to lie a million dollars. The street where we drive down to get to the end, where our residence is on a gravel driveway (176"' Ave SE), is SE 140"' Street. It is a narrow and windy road which, if another car is coming the opposite way, makes the other pullover to let the other cargo by. We, however, do not mind this as it keeps our street less traveled. My purpose in writing you is this: the map you sent us with information as to the zoning plan has our area starting the R-1 zoning (our house is included as R-1), yet the map shows the lots at the end of our street (SE I72°1 and SE 140"') as having a bonus up to 4 houses per acre! This makes no sense to have such a small area which is in the R-1 area allowing that many houses! As well as aesthetically being wrong. at the corner of SE 172" d and SE 140t', we have seen over the years herds of deer, duck pairs returning each spring to have their ducklings, rabbits, coyotes, raccoons, oppossums, and numerous other wildlife live and thrive, and to have their natural habitat destroyed by allowing this area alone to have that many houses built on an acre would be horrific. Please consider changing this zoning to only allow'I house per acre in this area. 1 would like to see it remain untouched, but as an alternative, we would be content with 1 per acre. The City of Renton prezoning for the plateau is zoned R-8 on 6.15 acres, R-4, R-1, and Resource Conservation. The R-1 designation allows development to a maximum density of one unit per acre; R-4 allows development to a maximum density of four units per acre. The area in the R-1 zone west of 175a' Avenue SE can achieve a density bonus up to 4 dwelling unitslacre, the area east of 175a' Avenue SE can achieve a density bonus up to 2 dwelling units/acre.
