A RESOLUTION OF THE CITY OF RENTON, WASHINGTON,
APPROVING FINAL PLAT (MONTEREY PLACE M FILE NO. LUA-
07-040FP).
WHEREAS, a petition for the approval of a final plat for the subdivision of a certain tract
of land as hereinafter more particularly described, located within the City of Renton, has been duly
approved by the Planning/Building/Public Works Department; and
WHEREAS, after investigation, the Administrator of the Planning/Building/Public Works
Department has considered and recommended the approval of the final plat, and the approval is
proper and advisable and in the public interest; and
WHEREAS, the City Council has determine that appropriate provisions are made for the
public health, safety, and general welfare and for such open spaces, drainage ways, streets or

WHEREAS, a petition for the approval of a final plat for the subdivision of a certain tract
of land as hereinafter more particularly described, located within the City of Renton, has been duly
approved by the Planning/Building/Public Works Department; and
WHEREAS, after investigation, the Administrator of the Planning/Building/Public Works
Department has considered and recommended the approval of the final plat, and the approval is
proper and advisable and in the public interest; and

The yellow file containing all staff reports, the State Environmental Policy Act (SEPA) documentation, and
other pertinent materials was entered into the record as Exhibit No. 1.
The 2-lot preliminary plat was not subject to Environmental Review.
The subject proposal was reviewed by all departments with an interest in the matter.
The subject site is located at NE 16th Street and Monterey Ave NE. The new plat is located in the SE ''A of

The Preliminary Plat received City of Renton Council approval on August 09, 2006.
The site has a R-8 (Single Family) land use zoning, with the adoption of Ordinance 4404 enacted in June

Dear Dave,
The purpose of this letter is to provide an update on the status of the plat. There are several outstanding
items, which must be completed and resubmitted for review before project closeout can be completed and
the final plat can be recorded.
Property Services
Property Services has reviewed the final plat submittal and has provided the following comments:
1. Note the City of Renton land use action number and land record number; LUA-07-040-FP and <-
LND-10-0448, respectively, on both final drawing sheets.. Note that the final land use action number
is different from the preliminary plat number that is currently noted on the plat submittal. Replace
the Iand use action number, now shown, with the correct final plat number. NOTE: The land record
number is currently not noted at all. The type size used for the land record number should be smaller_
than that used for the land use action number.
2. The legal description (Sheet 1 of 2) currently notes the City of Renton short plat number- as
"LND-20-0273". Said short plat number is actually LUA-00-113-SHPL. The plat submittal's
current legal description should be corrected, as well as the legal description noted in the title report
(Pacific Northwest Title Company document, Order No. 617823, dated April 5, 2007). A number of .
recently recorded conveyances of the subject property do use the correct "LUA" number - none use
the "LND" :number.
3. Supplemental Report #1 to the Pacific Northwest Title Company Plat Certificate document,
Order No. 617823, dated April 5, 2007, refers to an easement benefiting PSE, Inc., for a 10' wide
easement, as constructed, across the subject plat property, recorded under Rec. No..

Utility Improvements Punchlist
Completion of all utility, drainage, paving, grading, street lighting, landscaping, street improvements,
including all street signs for the project. This includes all punch list items from the Public Works Inspector
and/or the City Maintenance Division. These items will be forthcoming when all utility improvements
have been installed. When all punch list items are completed, please call Tom Main at 206-999-1833 for
re -inspection: The utility construction permit must be signed off by the inspector prior to recording of the
plat. Continue working with the inspector to insure that the project has a final walk through and a final
permit sign off has been completed.
As -Built Submittal
The construction plan mylars must be checked -out from the sixth floor Public Works counter and updated
or replaced with a complete As -Built plan set. All plan sheets, including those constructed per design, must
be verified, stamped and signed as As -Built by a licensed surveyor or engineer_ The civil drawings shall
accurately reflect the construction activity. The civil drawings also need to show all water main, sanitary
sewer, and storm drainage systems easements, which shall be consistent with the As -Built location of the
utility. Once the above have been addressed, submit one set of As -Built blue lines of the civil drawings to
me. The inspector will review the blue lines. If they are in,. order, I will call for the civil mylars to be
returned. These final mylars must .be submitted for our per herit records. The mylars shall be labeled
"AS -BUILT" in a large block letters and stamped by a PE or PLS. Submit a CAD file along with your

Maintenance Bond
A Maintenance Bond is required in the amount of 10% of the grand total of the water, sewer, storm, street,
and street lighting costs as shown on the Cost Data Inventory form. The permit bond will be released upon
receipt and acceptance of the maintenance bond. A form is enclosed.
Easements
Separate utility easements, where applicable for off site improvements will be required to be submitted for
review. Easement documents must be submitted, approved, and recorded by the City. Please submit all
easements for our review and approval before signing and notarizing by the property owner. We will return
for final signature and notarization once our Technical Services Section has approved the legal description
and easement form. Please include legal description as "Exhibit A" and map showing location of easement
as "Exhibit B".
All Fees Paid
All outstanding mitigation fees including Tranmortation, Fire, Parks, etc. and all special assessment fees
for each new single-family lot prior to the recording of the final plat. Payment will be required to be made
prior to recording of the plat. Payment required of all overtime inspection billed to the job.

Bob Mac Onie and I have reviewed the above referenced final plat submittal and have the
following comments:
Comments for theApplicant:
Note the City of Renton land use action number and land record number, LUA-07-040-FP
and LND-10-0448, respectively, on both final drawing sheets. Note that the final land use
action number is different from the preliminary plat number that is currently noted on the
plat submittal. Replace the land use action number, now shown, with the correct final plat
number. NOTE: The land record number is currently not noted at all. The type size used
for the land record number should be smaller than that used for the land use action number.
The legal description (Sheet 1 of 2) currently notes the City of Renton short plat number as
"LND-20-0273". Said short plat number is actually LUA-00-1 13-SHPL. The plat
submittal's current legal description should be corrected, as well as the legal description
noted in the title report (Pacific Northwest Title Company document, Order No. 617823,
dated April 5, 2007). A number of recently recorded conveyances of the subject property
do use the correct "LUA" number - none use the "LND" number.
Supplemental Report #1 to the Pacific Northwest Title Company Plat Certificate document,
Order No. 617823, dated April 5, 2007, refers to an easement benefiting PSE, Inc., for a 1.0'
wide easement, as constructed, across the subject plat property, recorded under Rec. No.
20070118000558. Include said exception tinder the "EXCEPTIONS TO TITLE" block on
Sheet 2 of 2.
Include the recording number for the hydrant water easement on the plat drawing (Sheet 2
of 2).

Directly tie the subject plat property to the City of Renton Survey Control Network. The
geometry will be checked when the ties have been provided.
Note what was set at the SW/SE corners, respectively, of Lots i and 2.
The addresses for the two lots are as follows: 2006 NE 161h Street and Lot 2 is 2012 NE 16`h
Street. Note said addresses on the plat submittal.
The small Baima & Holmberg business block, shown on both drawing sheets is not needed.
The Baima & Holmberg title block (lower right-hand side of both drawing sheets) contains
the same information.
The Aquifer Protection Notice (Item No. 5 under "NOTES") should indicate that the
pertinent zone is 2, not "1 or 2",
The "VICINITY MAP" (Sheet 2 of 2) should include a north arrow.
Note the street dimension between the south line of the plat property and the centerline of
NE 16`h Street (Sheet 2 of 2).
The statement regarding frontage improvements, on Sheet 2 of 2, includes a reference to
"MONTEREY PLACE LND-20-0273". Said reference should be to Monterey Place City
of Renton Short Plat No. LUA-00-113-SHPL.
The reference to the recording number (noted under the "DEEDED TO CITY OF
RENTON" statement on Sheet 2 of 2) is not needed. The dedication of this corner of Lot 2
for street purposes is accomplished via the recording of this subject plat.
The reference to "WATER DISTRICT NO. 90", in Item No. 2 under the "NOTES" block,
is not needed. Water Dist 90 is some distance from the subject plat property and not likely
to be the water provider for said property in the future.
The reference to "14e Avenue SE", "Lyons Avenue NE" and "Nile Ave NE", also in said
Item No. 2 under the "NOTES" block, does not appear to be relevant. Said streets are not
located near the subject plat property. Review and revise as needed.
There is a reference to a Declaration of Covenants, Conditions and Restrictions for the Plat
of Monterey Place II document in Item No. 4 under the "NOTES" block. If said document
has not yet been provided to the city for review, provide it at this time.
Pursuant to the recently revised WAC l 96-23-020, the surveyor's expiration date now
needs to be applied manually. Any final document must contain the seal/stamp,
handwritten license expiration date by the licensee (, ] signature and date of
signature of the licensee who prepared or directly supervised the work. For the
purpose of this section "document" is defined as plans, specifications, plats,
surveys [,] as -built documents prepared by the licensee [J and reports.

The undersigned, as owner of the company, entered into this Operating
Agreement effective August 10, 2005, under the name style of Kirkland Condo Property,
LLC (the "company").
The principaI office of the Company in the state of Washington will be located at
3113 Fairweather Pl, Bellevue, WA 98004. The Company may have other offices, either
within or without the State of Washington, as the Owners may designate or as the
business of the Company may require. The registered office of the Company required by
the State of Washington to be maintained in the State of Washington way be, but need
_mot be, identical with the principal office, and may be changed from time to time by the
Owners.
The sole purpose for wbich this Limited Liability Company is organized is to
own, and operate a real estate development company.
M. Duration of the Company
The Company will commence immediately, on the signing of this Agreement, and
Will continue for a term of not to exceed thirty five (3 5) years ffimafter unless terminated
sooner by operation of law or by agreen a t between the owners or reestablish after the
primary team for additional periods as are mutually detammed by the owners. The
owners agree for themselves and their successors, assigns as heirs, that their participation
is considered a long-term inv,t, that this commitment to advance funds is
enforcomMe by the company, and that after five years they may elect by majority vote to
terminate the company.
IV. Capital Contribidions
The mdersigned owner agrees to share in all post formation capital contributions,
profits, and surplus of the Company =cording to the percentage oftheir ownership. Each
Owner owns an undivided interest in the business and company as follows:

The owners may contribute in proportionate amounts any additional capital
deemed necessary for the operation of the Company provided, however, that in the event
that any Owner deems it advisable to refuse or hits to contribute his share of any or all of
the additional capital, then the other owners or any one of them may contribute the
additional capital not paid in by the refusing Owner and shall receive therefore an
increase in the proportionate share of the owner or interest in the entire company in direct
proportion to the additional capital contributed. Unless otherwise agreed, the right to
make up additional capital contributions of a refusing Owner shall be available in the
same order as the right to purchase in the ease of withdrawal or death of an Owner, as set
forth in Paragraphs MV and XV.
VI. Division of Profits and Lasses
Each of the owners will own an interest in the Company as set forth in paragraph
IV, entitled "Capital Contributions", except as the same may hereafter vary or change as
providod in p mgrq h V, entitled "Additional Capital Contri"butigas". All profits of the
C.oMmy uprise will be shared by each of the Owners woording to the percentage of
interest each Owner owns. A separate capital account will be maintained for each
Owner. No Owner may make any withdrawals fium capital without prior approval of the
Company. If the capital account of the Owner becomes impaired, his shade of ant

restored.
VIL Rights and Duties of the Parties
Ken Nelson shall be the Manager from the effective date of this Agreement until
he elects to rein and appoint a new manager. Cerny decisions and anions will be
decided by a mority in interest of the Owners, at meetings regularly called with notice
to all Owners. For purposes of determining a "majority in interest," an Ownces interest
will be his interestin profits and losses as set forth in Paragraph VI, and a majority will
mean 51 % or more.
Except as otherwise provided in this Ate#, no owner will be separately
compensated on it salaried basis for service performed in carrying out the operation of the
Company. No salaries or individual caompensation shall be otherwise payable, without
the consent of the Company, for the normal management although the Company may
from time to time employ one or more managers or other representatives at a designated
Wary.
IX. Management Duties and Restrictions
The initial Manager is designated for a teen of two years and thereafter until he
resigns or is removed by a majority vote of the owners. No Owner may, without the
consent of the other Owners endorse any note or act as an accommodation party, or
otherwise become surety for any person in any transaction involved in the company.
Without the consent of the company, no Owner may on bebalf of the company borrow or
lend money, or make, deliver or accept any commere W paper, or execute any mortgage,
security agreement, bond, or lease, or purchase or contract to purchase, or sell or contract
to sell any property for or of the company. No Owner, except with the consent of the
other Owners, may grant a security wterest in its share in the Owner's or m the
company's capital assets or property, or do any act detrimental to the best interest of the
compaany or which would make it impossible to cagy on the ordinary purpose of the
company.

All funds of the Company will be deposited in its name in the checking account or
accounts as shall be designated by the Manager. All withdrawals are to be made on

The Company books will be maintained at the offices of such firm as the Manager

The Company may be dissolved at any time by agreement of a majority of its
owners, m which event the Owners will proceed with reasonable promptness to liquidate
the Company. The assets of the Company will be distributed in the following order:
I. To pay or provide for the payment of all LLC liabilities to creditors other
than owners, and liquidating expenses and obligations;
2. To pray debts owing to Owners other than for capital and profits;
3. To pay debts owing to Owners in respect to capital; and
4. To pay debts owing to Owners in respect to profits.
M. Death of an Owner
In the event of a death of an owner, the deceased's heir or heirs will be entitled to
succeed to the economic share and interest of the deceased owner. The Company may,
on unanimous consent of the remaining Owners, as soon as practicable, provide a
document by which the heir or heirs personally affirm and accept all the terms, conditions
and provisions of this Operating Agreement binding themselves to the same m writing,
and select a designated representative of the deceased owner as an Owner.
XV. Distribution
Prior to dissolution and at least annually as income has been received by the
Company, accounts determined and tax returns filed., the Owners will determine funds
available for distribution On liquidation, a reasonable reserve as mutually det=mcd
amount shall be established to cover follow-on or subsequent complaint and warranty
lion requirements, if any. Liquidation of the Company need not be delayed
provided that such amounts are properly escrowed and arrangement made for
performance of sash services as may be required in the interest of the Company.

The following is a narrative describing how the Final Plat of Monterey Il is in
compliance of the Preliminary Plat Conditions of approval as provided on page 5 of the
October 19, 2006 Hearing Examiners Report.
i. A revised Landscape Plan is a part of this submittal Package. As per the
condition of approval, one additional tree has been added to the southwest corner
of Lot 1.
2, Fees will be paid to comply with this condition prior to the recording of the Final
Plat,
3. Fees will be paid to comply with this condition prior to the recording of the Final
Plat.
4. The information to show compliance with this condition has been provided to the
City of Renton as a part of the Revised Engineering plan set for Monterey Place
that also includes the site. The plans have been approved are on file at the City of
Remton
S. Fees will be paid to comply with this condition prior to the recording of the Final
Plat.

CONNECTION TO THE FACILITIES.
THE CITY COUNCIL OF THE CITY OF RENTON, WASH NGTON, DO ORDAIN
AS FOLLOWS:
SECTION L There is hereby created a Sanitary Sower Service Special,
Assessment Distnct for the arcs served by the East Kennydale Sanitary Sewer iufill Pbase I
project in the north quadrant of the City of Renton and w4hin King County, which area is more
particularly descnbed m Exhibit "A" attached hereto. A map of the service area is attached as
Exhibit "B." The recording of this document is to provide notification of potential connection
and interest charges. While this comrxtion charge may be paid at airy time, the City does not
require payment until such time as the parcel is connected to and thus benefiting from the sewer
€tcild= The property maybe sold or many other way change hands without tnggermg the
requirement, by the City, of payment of the charges associaiod with this district.
ff CTION IL Persons connecting to the sanitary sewer facilities in this Special
Assessment District and which ,properties have not been charged or assessed with all costs of the
East Kwnydale Sanitary Sewer Infnll Phase I, as detailed in this ordinance, shall pay, in addition
to the payment of the connection permit flee and in addition to the system development charge,
the following additional fees:

Per Unit Charge. New connections of residential units shall pay a fee of $6,122.35 per
dwelling unit.
SECTION HL In addition to the aforestated charges, there shall be a charge of
4.86% per entum added to the Special Assessment District charge. The interest charge shall
accrue for no more than ten (10) years from the date this ordinance becomes effective. Interest
charges will be simple interest and not compound interest.
SECTION IV. This ordinance is effective upon its passage, approval and thirty
(30) days alter publication.

tiuse of said driveway, NOW, THEREFORE, it is agreed by ane between
the parties as follows:
1. That Second Party has the permission and a permit to
continue theuse for driveway purposes of the existing driveway
over the approximate north six feet of First Party's property above
described.
2. That Second Party acknowledges their use is by per-
mission of First Party only and makes no claim of adverse use for
said driveway.
3, That First Party has the right to terminate this
permit and Second Party's use of First Party's property at any
time on giving ninety (90) days' written notice prior to the ter-
mination date.
s. -Should second Party fail to terminate the -use of
First Party's property on the termination.date and should it be
necessary for First Party to bring a legal action to enforce this
Agreement, Second Party shall pay, besides all court costs incur-
red by First -Party, a reasonable attorney's fee as may he incurred
by First Party.
S. This Agreement shall be binding on the parties hereto,
their heirs and assigns.
