Protect Description
The proposal is to construct a community dock with a fully grated 6' x 172' (1,032sgft) main walkway and 8' x 56' (448sgft) 7. Total size
of the fully grated dock will be 1,480sgft. The dock will be supported by (4) 5", (12) 6" and (8) 8" diameter battered steel inwater piles and
(2) 4" vertical steel piles installed upland of the OHWL. A planting plan of native vegetation has been installed along the riparian buffer in
conjunction with the upland development. A copy will be provided for review by local, state and federal regulatory agencies.
Construction Sequence
1. Mobilize construction barge to the site with all construction materials and equipment on board. Moor the barge as to prevent
grounding on the lake bottom at any time during construction.
2. Install silt containment curtain around work area to contain any debris that may fall into lake waters. In the event any materials enter
lake waters they will be retrieved immediately and placed in debris containers on the barge.
3. Using the barge -based crane and vibratory insertion/extraction system, install (4) 5", (12) 6", (8) 8" steel battered inwater piles and
(2) 4" vertical piles upland of the OHWL to practical refusal. If required, proof piles using a drop hammer pile driver with a 6"
minimum block of wood between pile driver and pile.
4. Cut steel piling as necessary at the appropriate elevation.
5. Install pre -fabricated dock and "ELL" sections onto pipe collar assembly and secure to piling.
6. Demobilize and dispose of all debris at approved upland disposal site.
General Notes:
1. All treatments will be applied and fully cured prior to delivery to the site.
2. Dock and "ELL" section will be prefabricated at contractor's Lake Union Facility and delivered to the site via construction barge.
ATTENTION: If at any time; as a result of project activities, fish are observed in distress, a fish kill occurs, or water
quality problems develop (including equipment leaks or spills), operations shall cease and the WDFW at (360) 534-
8233 and Washington Department of Ecology at (425) 649.7000 shall be contacted immediately. Work shall not
resume until further approval is given by the WDFW.

Thank you for placing a hold on your permitting process while the Department of Natural
Resources (DNR) reviewed and came to a decision on how to proceed with the Conner Homes
community dock proposal. This letter is to inform you that a decision has been made and once a
formal agreement has been signed with Conner Homes, DNR will provide you notification. If
you have any comments or questions on the tentative agreement, please contact me within the
next two weeks for input.
Conner Homes put together a plan to mitigate for their proposal to build a community dock in
the middle of a DNR withdrawal area. DNR reviewed this mitigation proposal and felt it was not
adequate for the development that is being proposed on a piece of property that is currently 560
feet of restored shoreline that provides a naturally sloped beach, no over water structures, and
appropriate sized substrates for salmon habitat. This area is currently protected from any type of
development.
DNR worked with Conner Homes to find a compromise for both parties that will allow for
recreational use of the Barbee Mill shoreline as well as provide protection for habitat and an
increase in shoreline restoration within Lake Washington.
The following proposal has been tentatively agreed upon by DNR and Conner Homes.
1. Update the withdrawal area to allow a community dock to be built within the withdrawal
area. The design of the dock must be approved by DNR. No other development will
occur within the withdrawal area.
2. DNR will go through SEPA and the public process to modify the withdrawal before the
community dock is approved and granted a lease.

3. DNR is willing to authorize a total of 12 mooring buoys for waterfront property
owners who live in front of the withdrawal area. These buoys must be located
outside of the withdrawal area and must use a mid -line float system.
4. Conner Homes will complete the plantings as shown in the final mitigation plan
dated August 22, 2008. A monitoring and maintenance plan must be developed
as shown in the Cheney report dated September 12, 2008. DNR must review and
approve the final plan.
DNR and Conner Homes will sign an agreement that will form a partnership to
restore 3 acres of DNR property in South Lake Washington. Conner Homes will
provide $200,000 towards this restoration. This agreement acts as in -kind, off
site restoration of state-owned aquatic lands.
DNR is excited to be moving forward with planning a large shoreline restoration project
in South Lake Washington adjacent to the Boeing Plant. This property has great potential
and is located just east of the mouth of the Cedar River. We look forward to working
with you on increasing Chinook and Sockeye salmon habitat at this location.

The following is a comparison of the environmental impacts of the proposed Conner
Homes/Barbee Mill community dock versus shoreline mitigation/restoration measures and
related actions at the Barbee Mill site near the May Creek area on southeast Lake Washington.
This comparison is based on information provided to me by the client's consultant, Amy
Leitman, Marine Surveys and Assessments (MSA); Sean Howe, of the law firm Cairncross &
Hempelmann; and relevant literature and reports available in our files. Recommended
changes or modifications to reports or planning documents are highlighted.

Existing site conditions
These are described, for general lake and shoreline conditions in the dock BE, overview of site
conditions, the community dock and adjacent shorelines surveys, and the narrative description
of shoreline mitigation.
A March 2007 aquatic resource survey at and adjacent to the proposed dock found similar
bottom elevations and substrate type on surveyed transects, particularly 120-ft or more from
shore. The approximate 10-ft water depth contour line (bottom at —11 ft elevation) was 110 to
120-ft from shore. Eurasian milfoil, a non-native vascular plant, is incorrectly described as a
"macroalgae" in the report. Observed coverage and abundance of this plant are consistent
with observations I have made elsewhere in shallow -water areas of Lake Washington.
Coverage likely increases during summer months and should be accompanied by the presence
of Canada waterweed (Elodea canadensis) or similar Elodea species. Scattered debris, such as
roofing metal, was also observed along the transects. Additional bottom elevation and
substrate information was also obtained north and south of the community dock transects.
Divers observed "much trash" along several of the transects. The 10-ft water depth contour
line varied from —25 to 110 ft from shore.
Community dock effects analyses
I agree with the MSA assessment regarding the effects and impact reduction measures
incorporated into the community dock design and construction. The dock meets or exceeds
Corps and WDFW recommended guidelines for overwater structures in making extensive use of
grating, being fully pile supported and having minimal structure in the nearshore area. It will
serve 25 waterfront homeowners and remainder of the Conner Homes site community, and will
reduce or consolidate in -water usages and impacts that might otherwise occur on the
waterfront properties in the development.
There is additional guidance in the Corps Regional General Permit 3 (RGP3) titled "Construction
of New or Modification of Existing Residential Overwater Structures and Installation of
Moorage Piling in Lake Washington, Lake Sammamish, the Sammamish River and Lake Union,
Including the Lake Washington Ship Canal," and dated March 7, 2005. RGP3 contains
provisions intended to protect the environment, endangered species, essential fish habitat and
cultural resources. The community dock BE should reference RGP3 and point out that the
proposed project meets most of the of the RGP3 impact reduction specifications.
The proposed Barbee community dock is larger than permitted under RGP3 and requires Corps
authorization by a standard individual permit. This process allows mitigating measures
beyond those specified in RGP3. These measures are described in the following section.
Table 1 compares community dock siting and design conditions versus a suite of impact
reduction and mitigation measures, and relation to the RGP3 guidelines.

Another minor action, based on the 2007 diver observations (noted above) and our experience
with the Wards Cove Packing Co. redevelopment project in Lk Union, should be to remove large
metal materials and other similar debris on and adjacent to the dock alignment. Some of this
material may also be a potential hazard for boat operators and swimmers. Removal of debris is
an appropriate conservation measure for the BE.

Community dock mitigation/impact offsets
The community dock BE describes as a conservation measure and illustrates a —35-ft wide by
—80-ft long buffer of native vegetation fronting Lake Washington. Completed mitigation
construction removed non-native vegetation and installed a broad selection of native ground -
cover, shrubs and trees along the entire buffer strip. Emergent plants (such as bulrush) will
also be planted in shallow beach areas as part of a proposed larger mitigation action (see
below). This is a significant restoration action, which will, when the planted community fully
develops, enhance the value of the community dock nearshore and shoreline for juvenile
salmonids and provide improved rearing and support habitat other fish and wildlife. These
features are summarized above in Table 1.
Quantification of mitigation benefits depends on the extent, location and functional value of
the created habitat. The Corps calls for plantings as a mitigation measure In the Regional
General Permit 3 (RGP3) to offset unavoidable impacts of small docks in Lk Washington 1. For
example, restoration and planting of 360 ft of City -owned shoreline for the recently permitted
Wards Cove Packing Co., redevelopment project in Lk Union was not directly linked to offsetting
the effects of marina construction, but was viewed as a project amenity by the City of Seattle,
and served to advance the permit process and project approvals. Our experience with WDFW
and NMFS in permitting on or off -site and out -of -kind mitigation to fully offset a loss of habitat
(i.e. dredging a new boat basin) typically calls for a mitigation to affected area ratio of 2:1 (2
acres of mitigation habitat for each acre of altered habitat). This conservative approach also
assumes the mitigation habitat has reached a fully functional and stable state. For example,
plantings must achieve coverage and survival called for in mitigation success criteria.
With reference to the proposed community dock, and assuming dock shading is reduced with
the use of grating, the existing mitigation plantings exceed both the Corps RGP3 requirement to
offset the construction of a joint use dock and the more conservative 2:1 mitigation ratio noted
above. Community dock riparian and emergent mitigation plantings cover at least 2,800 sq ft,
whereas to meet the Corps joint -use requirement, 800 sq ft of plantings are required.
There is sufficient detail in the community dock (BE and lake study) planting plan and schedule
to determine the location, types and sizes of the plantings. I recommend a table be prepared
to summarize the number, type (grouped as trees or shrubs), and coverage of plantings. It
would also be helpful to indicate the species, quantity, and quality of plantings in relation to the
Corps RGP3 guidelines (note that all plants within the shoreline buffer are important PNW
native species).

Value of Conner Homes/Barbee Mill site mitigation plantings
In addition to the community dock plantings, it is proposed to construct enhanced mitigation
plantings on the other shoreline buffers within the Conner Homes/Barbee Mill site. MSA
accurately describes the purpose of these mitigation plantings and relationship to nearshore
processes. The provided mitigation descriptions and site drawings also provide an excellent
perspective on the proposed restoration actions. With the exception of the existing plantings
within the community area, the remaining mitigation enhancements within the Barbee Mill site
will consist of intensive plantings of riparian and emergent plants on a strip of shoreline 3 to 6 ft
in width and —1,000 lineal-ft in length. Again, a table could be included as described above to
summarize the key characteristics of the proposed mitigation plantings and relation to the
existing condition.
Specific to the project area, several recently reviewed documents emphasize the importance of
riparian habitat and small creek mouths in Lake Washington as juvenile rearing areas.
Historically, the mouth of May Creek had an associated wetland complex. Restoration of
riparian and emergent vegetation, which in -turn will result in increased small woody debris
(SWD) on the May Creek delta and surrounding area increase the availability of prey such as
chironomid larvae and oligochaetes and attract Chinook salmon and attract other salmonids
(from Tabor, R.A. H.A. Gearns, C.M. McCoy, and S. Camacho. 2006. NEARSHORE HABITAT USE
BY JUVENILE CHINOOK SALMON IN LENTIC SYSTEMS, 2003 AND 2004 REPORT. U.S. Fish and
Wildlife Service, Lacey, Washington). Therefore, fully developed and mature native vegetation
on the Conner Homes/Barbee Mill shoreline will offer improved habitat conditions versus the
existing condition, including increased food availability and vegetative shading, for migratory
salmonids, and resident fish and wildlife.
Project site mitigation creation and monitoring
The mitigation planting and monitoring plans described in the MSR, should be modified
somewhat and described in greater detail.
While I generally agree with the described approach for invasive plant species removal and
control, it is unclear if invasive plant removal will be extended beyond the shoreline planting
area. The removal of non-native, invasive species in a broader area will be critical to the
establishment of native vegetation in the shoreline area. Due to the extraordinarily aggressive
nature of the invasive species on site (i.e. Japanese knotweed, Himalayan blackberry, Scotch
broom, etc. ) it may be necessary to completely remove all vegetation, with the exception of
the larger and well -established tree species. For example, the following are suggested details
for control of knotweed and blackberries that could be included in the mitigation text.
• Japanese knotweed --- designated as a Class "C" noxious weed in the state of Washington.
Knotweed grows extremely fast during the spring reaching heights of up to 10-15 feet by
June. Knotweed resprouts vigorously following removal techniques such as cutting,
mowing, and digging, especially early in the growing season. The most effective control

involves individually injecting stems of knotweed with a glyphosate herbicide that when
injected is translocated into the root system at sufficient concentrations to kill the root
tissue. Treatment is most successful when applied in early July when canes are adequately
developed. Foliar application is a second method that can be used to control knotweed in
areas exhibiting new shoot growth or skinny stalks. The method involves spraying or
dabbing the top surface of every leaf on the plant and stems with herbicide.
Himalayan blackberry --- a sprawling non-native perennial that spreads via lateral root
growth forming dense thickets up to 5 meters across. Once established, blackberry is able
to out -compete native vegetation resulting in the long-term establishment of monospecific
stands. The recommended method for controlling blackberry involves a two phase process
that includes hand removal of aboveground vegetation and the removal of root crowns and
side root systems.
The Barbee mitigation enhancement project will require several phases of activity over the
course of 3-5 years thus a detailed work schedule should be developed to implement the
project elements. The following timeline is an example of the steps required to implement the
shoreline restoration project.
Year 1, Winter and Spring
• Order plants. Native plants will be ordered during the initial stage of the project to ensure
adequate supply at the time of planting. "Container" and "stake" plants are available in the
fall, whereas bare root plants are available in the winter.
• Draft and display signage. Draft and display signs notifying the public of the restoration
project and the times/dates of herbicide application. Prepare to install low fences to keep
dogs, pets and pedestrians out of areas recently treated with herbicide.
• Investigate and acquire necessary permits. Additional permits may be required, particularly
for actions involving the use of herbicides.
Year 1, Summer
• Begin knotweed eradication. Treat knotweed in June or July using the injection method.
Assess percent eradication in August and consider the use of a second treatment in late
summer or preferably during the summer of Year 2, Reestablishment of only a few shoots
can result in new and quick -to -establish stands of knotweed.
• Remove Himalayan blackberry. Complete hand removal and treat using the "cut and dab"
method for remaining plants.
• Continue removing other invasive species.

Year 1, Fall
• If required, place appropriate compost -rich topsoil in proposed planting area. Apply erosion
control treatments to protect any graded slopes between the invasive species removal and
the new plant establishment period.
• Plant native vegetation. Plant "stakes" and "container" plants in the fall. Plants are not only
available from the nursery at this time, but also experience a greater rate of survival.
• Continue removing invasive species.
Year 2, Winter
Continue planting native vegetation. Bare root plants are available from nurseries from late
November through April. Emergent species will be planted at high water edge as noted in
mitigation planting figures.
• Continue removing invasive species.
Years 2 to 5
On -going site maintenance will be required through the first year after planting on the order of
at least one site visit per month from April to September. Watering and continual hand
removal of invasive species will significantly increase the likelihood of longterm restoration
success. A maintenance plan for years 3-5 will be evaluated at the completion of year 2.
In addition, plant survival, particularly the emergents, may be compromised by wildlife. Due to
the frequent occurrence of Canada geese in the project area, some measures may needed to be
employed to protect the newly planted vegetation. Grids can be placed over the young
emergents using vertical rebar posts and lines to create an obstruction for goose entrance, both
from the sides and from above. Beaver living along the shoreline are known to remove small
trees from the uplands. Protecting recently planted upland vegetation from wildlife could also
be an important consideration.
MSR calls for three years of monitorine after mitigation development. This is appropriate for
mitigation which is not linked to a specific permit. However, a 5_y_ear monitoring_ plan may be
requested by the Corps and other permitting authorities for_proie_cts_regui_ring Corps and
Shorelines permits. The following is suggested language for this modified monitoring Ian.
"Site monitoring will be conducted by the applicant over a 5-year period commencing the
winter of the 2nd year to ensure the long-term survival and stability of the created habitat. The
applicant will allow monitoring of the terrestrial and emergent vegetation and other fish habitat
enhancement features on an annual or semi-annual basis by qualified individuals specified by
permitting agencies. Maintenance of the terrestrial and emergent plants during the 5 year
monitoring period will be performed by the applicant or the authorized agent or consultants
and shall include reasonable measures to ensure survival of 80% of the vegetation. For five
years, the applicant will provide an annual report including photographs, of the condition of the

terrestrial vegetation and emergent vegetation. The report will include percent survival of the
terrestrial vegetation and if less than 80%, measures taken to achieve greater survival.
Photographs of the terrestrial vegetation will be taken before planting, immediately after
planting, and once each succeeding year during June or July. The photos will be taken from
permanent photo station(s) selected to provide complete coverage of the reconstructed area.
The report will also include percent survival and total plant counts of emergent vegetation and,
if less than 80%, measures to achieve greater survival. Photographs of the emergent vegetation
area will be taken before planting and immediately after planting. Thereafter, photos of
emergent vegetation will be taken twice yearly, once at low lake (December or January) and
once at high lake (June or July). The report and photographs will be submitted by the end of
January of each monitoring year."
The enhanced mitigation plantings will require several phases of activity over the course of 5
years. Thus a bond should be provided to ensure waterside development work is acceptable at
the completion of construction and the agencies have the applicant's guarantee that they will
complete all required long term monitoring. This bond should be released at the conclusion of
the 5-year period.
Installation of mooring buoys
The site Autocad drawing shows total of 12 mooring buoys at lots 23 to 30, and 31 to 34. Each
is centered on the lot at the —10-ft contour line between 60 and 120-ft from shore. The buoys
and anchoring system will be sized to holds boats up to 25-ft in length. The purpose of these
buoys will be to offer safe, easy to use small craft moorage, and to reduce the impacts of vessel
anchorage.
The primary environmental benefit of mooring buoys is to reduce the effects of continued
anchorage. Without fixed buoys, property owners must anchor their vessels. Vessel anchorage
can be a major source of damage to aquatic bottomlands. When placed in vegetated areas,
the anchors can uproot and damage root systems and encourage the spread of milfoil. This
damage should be limited to the area directly affected by the anchor, unless it is dragged across
the bottom. A much larger area may be affected by the chain and line attached to the anchor.
When vessels are at anchor at the Barbee site they will be subject to swinging, which is a
circular movement around the pivot point represented by an anchor; and yawing, which occurs
as a vessel's bow is blown away from the wind. Vessels at anchor will swing in response to
wind direction, and prevailing winds may intensify or offset swinging and yawing motions. This
will tend to result in a circular pattern of sediment disturbance.
Vessels on mooring buoys will swing around the moorage points. Because these vessels tend to
be in constant motion, no shading impacts are expected from these installations, and no
mitigation should be required. These fixed moorings will designed to avoid mooring line drift
over the sediment and will minimize small vessel anchor and chain damage in bottom areas at
the Barbee site. However, anchorage impacts from larger vessels may still occur, unless they
can utilize the proposed community dock.

approved your application for an SDP. Your permit is for construction of a 1480 square
foot community dock extending 180 feet from the Ordinary High Water Mark within
shoreline jurisdiction of Lake Washington.
By law, local governments must review all SDPs for compliance with the following:

On behalf of Conner Homes, we wish to provide the following information) and response
to a comment letter about the above referenced matter from Lynda Priddy, a Remedial
Project Manager for the EPA. In her letter dated May 2, 2008, Ms. Priddy summarized
her concerns as follows:
One, users of the dock may cause a release of contamination by activities
occurring on the Quendall uplands or sediments and users may be exposed
to contamination at the Quendall Site. The second concern is whether the
treatment wall at Barbee Mill is effectively treating the arsenic plume such
that the arsenic is not contributing to the contamination at Quendall or
posing an exposure threat to arsenic at Quendall.
Ms. Priddy notes the Quendall Site is contaminated with high concentrations of
polyaromatic hydrocarbons in the sediments, groundwater and uplands of the site, and is
in the midst of an RUFS being perlonned by certain Potentially Responsible Parties,
under EPA's oversight. EPA is working with the PR -Ps to provide signage along the
waterfront of the Quendall site and along a log boom that will be placed around the area
of the lake adjoining the site, in order to inform the public that the site is contaminated
and that access is prohibited.
Notwithstanding these measures, Ms_ Priddy asserts that activities associated with the
proposed Barbee Mill dock could potentially cause disruptions of contaminated

sediments and a release of contamination within the Quendall site. She speculates that a
release may occur as a result of boating activities (such as anchoring, prop wash)
swimming and wading in the Quendall area of concern. She also mentions that
consumption of resident seafood could be of concern due to the contaminated sediments
within and adjacent to the Quendall site.
Response to the concerns about the Quendall contaminated sediments. As for the
sediments within and along the shoreline of the Barbee Mill site, we wish to point out
that those sediments have been previously investigated by Barbee Mill, and remediated
through dredging which occurred in 1999 and 2002. On February 27, 2003 the
Department of Ecology issued a No Further Action letter to Barbee Mill regarding the
contamination that had previously been discovered within those sediments.
As for the concern that users of the Community Dock would ignore the no
trespassing/warning signs along the Quendall site and the log boom, those fears are
remote and speculative. It is unreasonable to assume that users of the Community Dock
would likely ignore Quendall signs and trespass on the Quendall Site in order to swim
and wade there. And this is doubly so if the signs not only prohibited entry but also
warned of contamination. According to prior judicial decisions, such speculative fears
about trespassers are remote concerns and not worthy of consideration for purposes of
SEPA review. See, for example, Mentor v. Kitsap County, 22 Wn. App. 285, 290, 588
P.2d 1226 (1978).
Similarly, speculation that boating activities will cause or potentially cause a release of
Quendall contamination is unfounded and moreover defies common sense. The log
booms mentioned by Ms. Priddy will obviously preclude entry of any boats within the
confines of the log boom, and just as obviously there will be no boats dropping anchor
within those confines either. The dock itself will be at least 100 yards away from the
Quendall booms and site, and common sense dictates that it is highly unlikely that prop
wash associated with recreational boats from so far a distance would be able to pass
through the booms and stir up sediments. As for consuming resident seafood, it would
appear highly speculative that fish in Lake Washington have been contaminated due to
the Quendall site's contaminated sediments. But if they are in fact so contaminated, then
this problem is not peculiar or isolated to just the users of the Community Dock, as all
members of the public who already fish in the vicinity of this site will be similarly
affected. Warnings and appropriate action will be necessary for the protection all
fishermen, not just those using the Community Dock.
Response to the concerns about off -site migration from the Barbee Mill site. The
second stated concern regards the effectiveness of the "treatment wall" in intercepting

and treating the arsenic contaminated groundwater, before it migrates off of the Barbee
Mill site and onto the Quendall site. The first response we wish to note is that there is no
"nexus" between the proposed Community Dock and this particular concern of
Ms. Priddy's. Without such a nexus. there is legally nothing for the City of Renton to
mitigate or condition as it regards this Community Dock and any untreated groundwater
that may migrate to the Quendall site.
Nevertheless, we wish to point out that the mentioned "treatment wall" is actually a
subsurface passive attenuation zone (PAZ) treatment system which has been carefully
designed and installed pursuant to Ecology technical review and advice. In 2007 Barbee
Mill installed the PAZ along the shoreline and the downgradiant Conner property
boundary to intercept and treat groundwater containing arsenic prior to it leaving the site
and potentially entering the Quendall site. The PAZ is 690 feet long, ranges from ten to
25 feet wide and from 15 to 22 feet deep, and contains between 3 and 29 percent
granulated iron. The design of this plan was finalized incorporating Ecology's
comments. This system has been designed to effectively prevent the offsite migration of
arsenic contaminated groundwater onto the Quendall site.
In addition, Barbee Mill has installed eight performance monitoring wells and two
piezometers for the PAZ, and eight extraction wells and underground utilities for the
groundwater pump and treat system. The latter have been installed in order to speed the
extraction and treatment of the arsenic in the groundwater.
Barbee Mill and Ecology will in the very near future be signing an Agreed Order
pursuant to MTCA regarding the above described activities and remediation plan. As
part of that plan, the construction of the groundwater and extraction system will be
required to be operational within 120 days of the effective date of the Agreed Order. An
operation and maintenance plan will also be part of the Agreed Order, as well as a
schedule and performance criteria for the installation, operation and monitoring of the
groundwater extraction system which will be regularly reported to Ecology to determine
the effectiveness of the system. The Agreed Order will require quarterly progress reports
to Ecology and will also provide authority to Ecology to require modifications to the
system as may be necessary in the future based upon the continuing reporting and review
of the monitoring plan.
In summary, the issues concerning the Community Dock have no relationship to the
remediation of the groundwater at the Barbee Mil site. Nevertheless, the remediation
plan for arsenic contaminated groundwater has undergone appropriate review and
approval by Ecology pursuant to its authority under MTCA, and will soon be part of an
Agreed Order between Ecology and Barbee Mill.

Dear Mr. Wasser and Mr. Upper:
Mr. Wasser, this letter is a follow-up to my e-mail to you on April 28, 2008. As I
mentioned in my e-mail, EPA has completed its review of the Notice of Application and
Proposed Determination of Non -Significance -Mitigated (DNS-M) for the proposed Barbee Mill
Community Dock. EPA has serious concerns regarding the use of a dock at Barbee Mill as it
may impact contamination at Quendall.
The location of the proposed dock appears to be within approximately 300 feet of the
Quendall Terminals Superfund Site. The Quendall Site is contaminated with high concentrations
of polyaromatic hydrocarbons (PAHs) in the sediments, particularly the nearshore sediments, as
well as in the groundwater and the upland subsurface. Some of these.PAHs are especially
carcinogenic to human health and acutely toxic to aquatic organisms. Some of the Potentially
Responsible Parties (PRPs) at the Quendall Site are currently performing a Remedial
Investigation/ Feasibility Study under EPA's oversight to determine the nature and extent of
contamination at the Site and the risks posed to human health and environment from
contamination at the Site. Pending performance of the study and selection of a final cleanup
action, EPA is working with the PRPs to provide notice to the public that access to the Quendall
nearshore sediments is not permitted by placing signs along the Quendall waterfront and to also
place a boom around the area of the lake where access will be prohibited. Signs could also be
placed on the boom.
EPA is concerned that activities associated with the Barbee Mill dock could cause
disruptions of contaminated sediments and a release of contamination associated with Quendall in
spite of the signs and boom. This could be a result of boating activities (e.g., anchoring, prop
wash), swimming and wading in the Quendall area of concern. Additionally, swimming, wading

and consumption of resident seafood could be of concern due to the Quendall contaminated
sediments.
A remedial treatment wall designed to treat the arsenic plume at Barbee Mill has been
constructed along the shoreline at Barbee Mill and along the property boundary between
Quendall and Barbee. However, pumps that control the upland arsenic plume apparently are not
operational nor is there a monitoring program in place. EPA wonders if the treatment wall is
effectively treating the arsenic plume without the use of the pumps. EPA has not seen data to
indicate if the remedial system completed at Barbee Mill is successfully treating the arsenic
plume and, if not, whether the arsenic plume is compounding contamination problems at
Quendall. Under the Superfund law and regulations, a party responsible for a release of
contamination (and in this case onto a Superfund site) can be liable for that contamination.
In summary, EPA has two concerns regarding the use a dock at Barbee Mill. One, users
of the dock may cause a release of contamination by activities occurring on the Quendall uplands
or sediments and users may be exposed to contamination at the Quendall Site. The second
concern is whether the treatment wall at Barbee Mill is effectively treating the arsenic plume such
that the arsenic is not contributing to the contamination at Quendall or posing an exposure threat
to arsenic at Quendall.
EPA would like to discuss with Renton and the applicant how users of the community
dock will be informed about hazards at Quendall and the steps that will be taken to ensure that a
release of contamination at Quendall will not be caused by users of the dock.

Pursuant to Chapter 90.58 RCW, the City of Renton has granted a permit.
This action was taken on the following application:
APPLICANT: Conner Homes at Barbee Mill LLC, Attn.: Bob Dwinnell or
Gary Upper, 846 1081h Avenue NE, Bellevue, WA 98004
PROJECT: Barbee Mill Community Dock
DEVELOPMENT DESCRIPTION: The applicant is proposing to construct a community dock on
the shore of Lake Washington. The dock would have a fully
grated 6 foot x 172 foot (1,032 square foot) main walkway
and an 8 foot X 56 foot (448 square foot) " T'. Total size of
the fully grated dock would be 1,480 square feet. The dock
would be supported by four 5-inch, twelve 4-inch and eight
8-inch diameter battered steel in -water piles and two 4-inch
vertical steel piles installed upland of the Ordinary High
Water Line (OHWL). The bottom of the dock is proposed to
be 18-inches above the OHWL. Native vegetation has been
planted/installed along the riparian buffer in conjunction with
the upland development (a private Community Center for
Conner Homes at Barbee Mill LLC).
Construction is expected to take approximately 10 to 12
days to complete and would occur during the authorized fish
window (July 16 — December 31). A vibratory pile driver
would be used for 3 to 4 days to set piles for the proposed
dock.
Construction access would be by foot or by boat, and all
materials and equipment delivered to the site would arrive by
barge, that would be moored in place.
DEVELOPMENT DESCRIPTION Continued: All dock sections would be prefabricated and delivered to the
site. Glu-lam stringers are proposed to allow the longest
spans between piles. Steel piles of the smallest diameter
possible are proposed to minimize the amount of structure in
the water. Silt containment curtains would be installed
around the work.
The community dock would serve the upland development
which includes 112 lots ranging in size from 1,800 square
feet to 6,000 square feet, The community dock would be a
private day use dock for use by residents and their guests.
The lots are for the development of townhouse units - most
of which are being constructed as duplex structures along
with some 3-unit, 4-unit and 5-unit structures. Lots 23
through 48 have frontage on Lake Washington. The
community dock is proposed between lots 30 and 31. The
subject property has approximately 90 feet of lakefront with
a sloping protective berm of rock, approximately 5 feet high,
extending along the shoreline. A coir roll was installed as
part of the site remediation and extends along the toe of the
berm with a row of large lots along the shoreline just
waterward of the coir roll.
The subject site was formedy a lumber mill facility. The
former industrial land is in the process of being developed
for residential dwellings. In order to restore the former
industrial site to a site suitable for a residential waterfront
subdivision, the mill buildings were demolished, fill soils
were removed from behind the bulkhead, asphalt paving, a
pier, a wooden bulkhead and piling associated with the mill
operation were removed; and, shoreline restoration was
accomplished. The shoreline restoration was accomplished
by Barbee Mill Company upon cessation of the mill
operation_

WATER:
1. This project is not located in the Aquifer Protection Zone.
2. There are no existing watermains on this west side of the parcel.
3. If the project is going to provide'water service to the dock an appropriate. back flow device will be required.
SANITARY SEWER:
1. There are no City of Renton sanitary,sewer mains existing in the location of the proposed dock.
2. Applicant needs to verify if there is to be any plumbing out to the dock.
STORM DRAINAGE:
1. The design and installation of the closest edge of the dock shall maintain a minimum of
7 1/2' from. the center of the storm water pond outfaII point.
GENERAL:
1. All required utility, drainage and street improvements will require separate plan submittals prepared
according to City of Renton drafting standards by a licensed Civil Engineer.
2. All civil engineering plans shall be tied into a minimum of two of the City of Renton current Horizontal and
Vertical Control network.
3. Permit application must include an itemized cost estimate for these improvements. Half of the fee must be
paid upon application for building and construction permits, and the remainder when the permits are
issued. There may be additional fees for water service related expenses. See Drafting Standards

1. A dry standpipe shall be required due to the distance from the road access to the dock being significantly
greater than 150 feet to the dock.

PART ONE: PROJECT DESCRIPTION 1 BACKGROUND
The applicant is proposing to construct a community dock on the shore of Lake Washington. The dock would
have a fully grated 6 foot x 172 foot (1,032 square foot) main walkway and an 8 foot X 56 foot (448 square foot)
"T". Total size of the fully grated dock would be 1,480 square feet. The dock would be supported by four 5-
inch, twelve 4-inch and eight 8-inch diameter battered steel in -water piles and two 4-inch vertical steel piles
installed upland of the Ordinary High Water Line (OVTWL). The bottom of the dock is proposed to be 18-inches
above the OHWL. Native vegetation has been planted installed along the riparian buffer in conjunction with the
upland development (a private Community Ccntcr for Conner Homes at Barbee Mill LLC).
Construction is expected to take approximately 10 to 12 days to complete and would occur during the authorized
fish window (July 16 —December 31). A vibratory pile driver would be used for 3 to 4 days to set piles for the
proposed dock.
Construction access would be by foot or by boat, and al] materials and equipment delivered to the site would
arrive by barge, that would be moored in place. All dock sections would be prefabricated and delivered to the
site. Glu-lam stringers are proposed to allow the longest spans between piles. Steel piles of the smallest
diameter possible are proposed to minimize the amount of structure in the water. Silt containment curtains would
be installed around the work.
The community dock would serve the upland development which includes 112 lots ranging in size from 1,800
square feet to 6,000 square feet. The lots are for the development of townhouse units - most of which are being
constructed as duplex structures along with some 3-unit.. 4-unit and 5-unit structures. Lots 23 through 48 have
frontage on Lake Washington. The community dock is proposed between lots 30 and 31. The subject property
has approximately 90 feet of lakefront with a sloping protective berm of rock, approximately 5 feet high,
extending along the shoreline. A coir roll was installed as part of the site remediation and extends along the toe
of the berm with a row of large lots along the shoreline just waterward of the coir roll.
The subject site was forinerly lumber mill facility. The former industrial land is in the process of being
developed for residential dwellings. In order to restore the former industrial site to a site suitable for a residential
waterfront subdivision, the mill buildings were demolished, fill soils were removed from behind the bulkhead,
asphalt paving, a pier, a wooden bulkhead and piling associated with the mill operation were removed; and
shoreline restoration was accomplished. The shoreline restoration was accomplished by the Barbee Mill
Company upon cessation of the mill operation.
PART TWO: ENVIRONMENTAL REVIEW
In compliance with RCW 43.21C.240, the following environmental (SETA) review addresses only those project
impacts that are not adequately addressed under existing development standards and environmental regulations.
A. Environmental Threshold Recommendation
Based on analysis of probable impacts from the proposal, staff recommends that the Responsible Officials:
Issue a DNS-M with a 14-day Appeal Period.
B. Mitigation Measures

The Proposal was circulated and reviewed by various City Departments and Divisions to determine whether
the applicant has adequately identified and ad(Iressed environmental impacts anticipated to occur in
conjunction with the proposed development. Staff'reviewers have identified that the proposal is likely to
have the following probable impacts:
1. Earth
Impacts: The subject site is relatively flat with the steepest slope along the shoreline being approximately
3%. The area along the shoreline where the dock is proposed is primarily cobbles. No fill is proposed. The
majority of the project would occur over the waters of Lake Washington.
Mitigation Measures: None necessary.
Nexus: Not applicable.
2. Water (Wetland, Streams, Lakes)
Impacts: The project is proposed to occur over the waters of Lake Washington within the designated
Inner Harbor. The shoreline designation for Lake Washington at this location is "Urban
Environment" (RMC 4-3-090G). May Creek, a Shoreline of Statewide Significance is located several
hundred feet south of the project site.
The applicant submitted a document titled: "Lake Study, Barbee Mill Community Dock Project",
prepared by Marine Surveys & Assessments (dated March 20, 2008). The study identifies Lake
Washington as a Class 1 lake, as it is a perennial salmonid-bearing body of water and Shoreline of the
State.
The study conforms to the requirements for Standard Stream and Lake Studies (RMC4-48-120(D)).
Discussion of the Study is included in this section of the report and in the "Vegetation" and
"Wildlife" sections, below.
The applicant has indicated in the Construction Mitigation Description for Barbee Community Dock,
dated March 14, 2008, that, in order to minimize sediment impacts from pile driving activities a silt
curtain will be installed to contain any suspended sediment.

Washington as a Class 1 lake, as it is a perennial salmonid-bearing body of water and Shoreline of the

The study conforms to the requirements t«r Standard Stream and Lake Studies (RMC4-48-120(D)).
The study describes the Barbee Mill Leach Restoration project which has already begun. After
excavating the fill soil and removing the bulkhead during the beach restoration process, the beach was
reconstructed to mimic natural conditions with sand, gravel and rocks. No planting is proposed below
the Ordinary High Water Line (OHWL). Native riparian vegetation was planted along the restored
beach including through plantings in the coin rolls. The upland redevelopment required extensive
regarding and clearing; a mitigation planting* plan was agreed upon that includes planting along the
Lake Washington shoreline_ Planting along the shoreline, in accordance with the mitigation planting
plan, has already begun. Trees included in the mitigation planting plan are Serviceberry, Oregon Ash,
Shore Pine and Sitka Willow; shrubs include Red -osier Dogwood, Yellow Twig Dogwood, Blue Oat
Grass, Tall Oregon Grape, Low Oregon Grape. Red Flowering Currant and Snowberry; and,
groundcovers include Nodding Onion. Thrill, Kinnikinnik, Beach Strawberry and Trailing
Snowberry.
The proposed project will take place in -water and no disturbance of the restored upland vegetation is
anticipated. Vegetation will be planted in the project area in accordance with the planting and
landscape plan upon completion of the upland development site work.

Impacts: Aquatic and wildlife habitat on the site consists of a Class 1 lake as it is a salmonid-bearing body
of water and a Shoreline of the State. The project site has been heavily impacted by a long history of
industrial land use (timber processing) and resulting associated contamination of both the upland and the lake
bottom.
The applicant submitted two documents, prepared by Marine Surveys & Assessments, titled: "Lake Study,
Barbee Mill Community Dock Project" (dated March 20, 2008) and "Biological Evaluation, Barbee Mill
Dock Project" (dated March 24, 2008). These studies have identified the following bird species observed on
or near the project site: hawks, herons, eagles, quail, osprey, cormorants and songbirds. Prior to demolition
of the mill structures an osprey nest was successfully relocated not far from the original nest site. The only
eagle nests observed near the project are two nests approximately 0.65 mile from the project site on the
opposite shore on Mercer Island.
The studies indicate that salmonids observed at the site include salmon and trout. Salmonids known to be
present in Southern Lake Washington include Puget Sound Chinook salmon, coho salmon, sockeye salmon,
steelhead trout, bull trout and cutthroat trout_ Puget Sound chinook, Puget Sound steelhead and bull trout are
listed as threatened by the Endangered Species Act, Shoreline remediation was designed to be consistent
with Water Resource Inventory Area (WRIA) S Conservation Plan recommendations. As a result of the
remediation, shoreline that was previously unsuitable habitat for fish and other aquatic life due to extensive
shoreline modifications and industrial use of the site has been restored. The restore gravel substrate and
gently sloping bottom should provide favorable habitat for winter rearing of salmon fry. The new gravel
substrate should be suitable habitat for benthic invertebrates which would likely attract juvenile salmonids.
The shallower water along the recently restored shoreline should provide some level of protection from
larger predators.
No lighting has been proposed for the Barbee Mill Community Dock project.
Questions, but no formal comments have been received from the Muckleshoot Indian Tribe Fisheries
Division.
The silt curtain recommended as mitigation in Water Impacts, above, should minimize impacts to fish
species as a result of the construction activities associated with the proposed project. In addition, if at any
time, as a result of project activities, fish are observed in distress, a fish kill occurs, or water quality problems
develop (including equipment leaks or spills), operations shall cease and the WDFW at (360) 534-8233 and
Washington Department of Ecology at (425) 649-7000 shall be contacted immediately. Work shall not
resume until further approval is given by the W D1^'W,

take place in -water and should not have any short term impacts on vehicular traffic. Boat use in the area may
increase, however, significant impacts arc not anticipated.

• Applicant needs to verify if there is to be any plumbing out to the dock.
STORM DRAINAGE:
• The design and installation of the closest edge of the dock shall maintain a minimum of
7 1/2' from the center of the storm water pond outfall point.
GENERAL:
• All required utility, drainage and street improvements will require separate plan submittals prepared
according to City of Renton drafting standards by a licensed Civil Engineer.
• All civil engineering plans shall be tied into a minimum of two of the City of Renton current Horizontal and
Vertical Control network.
• Permit application must include an itemized cost estimate for these improvements. Half of the fee must be
paid upon application for building and construction permits, and the remainder when the permits are issued.
There may be additional fees for water service related expenses. See Drafting Standards

PROJECT DESCRIPTION: Conner Homes proposes to construct a community dock with a 6 foot wide by
172 fool long main walkway and an 8 foot by 56 foot "T" which would provide lake access for aquatic activities for Barbee
Mill residents and guests. A vibratory pile driver would be used for 3 to 4 days to drive piles for the proposed dock.
Construction would take approximately 10 to 12 days to complete and would occur during authorized fish window
(between July 16 — December 31).

OPTIONAL DETERMINATION OF NON -SIGNIFICANCE, MITIGATED (DNS-M): As the Lead Agency, the City of
Renton has determined that significant environmental impacts are unlikely to result from the proposed project. Therefore,
as permitted under the RCW 43.21C.110, the City of Renton is using the Optional DNS-M process to give notice that a
DNS-M is likely to be issued. Comment periods for the project and the proposed DNS -Mare integrated into a single
comment period. There will be no comment period following the issuance of the Threshold Determination of Non -
Significance -Mitigated (DNS-M). A 14-day appeal period will follow the issuance of the DNS-M.

Subj: CONSTRUCTION MITIGATION DESCRIPTION FOR BARBEE MILL COMMUNITY DOCK
The following information is provided for the proposed community dock at Barbee Mill:
Proposed Construction Dates (Begin and End Dates)
Construction will be scheduled to meet the authorized inwater work windows for Lake Washington in this
location designed to protect listed species and critical habitat. Depending on receipt of all permits from all
required local, state and federal regulatory agencies. The authorized work window for this location is July
16th to December 31st of each year. Construction is anticipated to take place sometime within those dates in
2008 and should take 10 to 12 days.
Hours and Day of Operation
Work is generally scheduled from 7:00am to 5:00pm Monday through Friday and only on Saturdays if
necessary. The project will comply with City of Renton authorized construction hours as outlined in the
building permit conditions.
Proposed Hauling/Transportation Routes
All materials, equipment and personnel will be transported to the site via construction barge from the
contractor's Kenmore or Lake Union facilities. All dock sections will be prefabricated at the contractor's
Lake Union facility and transported to the site on a construction barge.
Measures to be Implemented to Minimize Dust, Traffic, and Transportation Impacts, Erosion, Mud,
Noise and Other Noxious Characteristics
The project will not produce any dust, traffic, transportation, erosion, mud or noxious characteristics.
Minimal noise will be generated during pile driving operations which will take approximately 3 to 4 days. To
minimize noise, a vibratory pile driver will be used to drive piles. To minimize sediment impacts from pile
driving activities a silt containment curtain will be installed to contain any suspended sediment. In the
unlikely event that any construction debris enters lake waters it will be retrieved immediately and placed on
the construction barge.

Statement (EIS) must be prepared for all proposals with probable significant adverse impacts on the
quality of the environment. The purpose of this checklist is to provide information to help you and the
agency identify impacts from your proposal (and to reduce or avoid impacts from the proposal, if it can be
done) and to help the agency decide whether an EIS is required.
INSTRUCTIONS FOR APPLICANTS:
This environmental checklist asks you to describe some basic information about your proposal.
Governmental agencies use this checklist to determine whether the environmental impacts of your
proposal are significant, requiring preparation of an EIS. Answer the questions briefly, with the mosl
precise information known, or give the best description you can.
You must answer each question accurately and carefully, to the best of your knowledge. In most cases,
you should be able to answer the questions from your own observations or project plans without the need
to hire experts. If you really do not know the answer, or if a question does not apply to your proposal, write
"do not know" or "does not apply'. Complete answers to the questions now may avoid unnecessary
delays later.
Some questions ask about governmental regulations, such as zoning, shoreline, and landmark
designations. Answer these questions if you can. If you have problems, the governmental agencies can
assist you.

The proposal Is to construct a community dock to serve the Barbee Mill development. The
pier will consist of a fully grated 6' x 172' (1,032sgft) main walkway and an 8' x 56' (448sgft)
"T". Total size of the pier will be 1,480sgft. The pier surface will be fully grated to allow
light to reach the water surface below and lessen shading impacts.

ESA, are known to spawn/migrate in the Lake Washington watershed. Juvenile
salmon may use the nearshore waters of the project area. There are no spawning
streams in the immediate vicinity of the project and the site is not a documented
spawning area.
c. Is the site part of a migration route? If so, explain Juvenile salmonids migrate along
the lake shoreline. Although the site could be used by migratory waterfowl, no
particular site characteristics make the site any more attractive to waterfowl than
other Lake Washington shoreline properties.

hazardous spill management plan will be present onsite. Spill cleanup and
containment materials will also be onsite. Included in the cleanup packets will be
containment booms, materials designed to absorb petroleum produces, and plastic
bags to be used for material transport. No measures to reduce or control hazards
are assumed needed or proposed.
b. Noise
1} What types of noise exist in the area which may affect your project (for example: traffic,
equipment, operation, other)? None.
2) What types and levels of noise would be created by or associated with the project on a
short-term or a long-term basis (for example: traffic, construction, operation, other)?
Indicate what hours noise would come from the site. Noise will be generated by
construction equipment during the installation of the piles. Construction will take
place during approved City of Renton work hours and will take only a few days.
Noise created by the construction equipment will be transmitted through the barge,
increasing noise levels above ambient conditions. The range of sound magnitude
from the faintest to the loudest the human ear can hear is so large that sound
pressure is expressed on a logarithmic scale in units called decibels (dB).
Environmental noise is commonly "A -weighted" to simulate how an average
person hears sounds. A -weighted sound levels are expressed in units of A -
weighted decibels (dBA). U.S. Environmental Protection Agency (U.S. EPA)
research found that noise associated with the normal operation of construction
equipment is typically 75 to 92 dB at 46 feet (U.S. EPA 1971). These measurements
are based on sound movement through air. Decibel conversion from air to water is
approximately 26 dB higher (Waiter 1999). Underwater noise associated with the
normal operation of construction equipment will be in the 101 to 118 dB range.
Point -source noise dissipates at approximately 6 dB per distance doubled (e.g., 45,
90, 180 feet) through water.
3) Proposed measures to reduce or control noise impacts, if any: Construction will be
limited to the approved City of Renton authorized work hours.
